A RESOLUTION PROVIDING FOR NOTICE OF A PUBLIC HEARING TO CONSIDER ADOPTION OF REDEVELOPMENT PROJECT PLAN 3B FOR THE CITY CENTER TIF DISTRICT (“Midas Hotel Project”).
WHEREAS, on September 11, 2001, pursuant to K.S.A. 12-1770 et seq., as amended (the “Act”) and
Ordinance No. 4427 of the City of Lenexa, Kansas (“City”), and in order to promote, stimulate and develop the
general and economic welfare of the City, the Governing Body established a redevelopment district consisting of
approximately 190 acres referred to as the City Center TIF District (“Original District”); and
WHEREAS, on December 20, 2005, the Governing Body adopted Ordinance No. 4824 amending the
City Center Redevelopment District to encompass a total of approximately 424 acres (“District”); and
WHEREAS, the Governing Body desires to consider adopting Redevelopment (TIF) Project Plan 3B
(“Project Plan 3B”) in accordance with the Act. The purpose of Project Plan 3B is to construct an approximately
124 room hotel under the Marriott Springhill Suites flag consisting of approximately 80,900 sq. ft., three (3) units
of retail space consisting of approximately 5,200 sq. ft., a two story parking garage structure with approximately
184 spaces and on-street parking surrounding the lot of approximately 31 spaces, and the infrastructure, site
improvements and amenities associated therewith; and
WHEREAS, a comprehensive feasibility study has been completed which indicates the benefits
derived from Project Plan 3B are significant. Revenues from the redevelopment (TIF) project area included in
Project Plan 3B and other available revenues are expected to be sufficient to pay for the eligible TIF reimbursable
project costs; and
WHEREAS, on February 2, 2015, the Planning Commission of the City reviewed Project Plan 3B and
passed Resolution No. 2015-02 finding that Project Plan 3B is consistent with the comprehensive general plan
for the development of the City.

NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF LENEXA,

SECTION 5: The City Clerk shall mail a copy of this Resolution, Exhibits A and B, and a courtesy copy
of Project Plan 3B by certified mail, return receipt requested, to the Board of County Commissioners of Johnson
County, Kansas, and the Board of Education of Unified School District No. 512, Johnson County, Kansas. The
City Clerk shall also mail copies of the above by certified mail to each owner and occupant of land within the
proposed redevelopment project area not more than 10 days following the date of adoption of this Resolution.

two sculpture sites would be compatible with each other and the surrounding development.
Proposals will reviewed by the Public Art Master Plan Committee, hereafter referred to as the selection committee,
a body of volunteers comprised of artist experts, residents and stakeholders to determine a recommendation for
the City Governing Body. Ultimately, the City of Overland Park Governing Body has final authority of all decisions
of art acquisitions.
Roundabout #1 is 100’ in diameter. Roundabout #2 is 76’ in diameter. The City expects that both installations
will not have the same scale, neither will the sites have the same budget, nor is it required that one artist manage both installations. Artists may apply for both locations in which case the sites must be compatible with each
other. However, if two separate proposals are selected, it is incumbent on the selection committee to demonstrate
compatibility between the two proposals.

At the public hearing, the Governing Body of the City will consider findings

DESCRIPTION OF DISTRICT PLAN
K.S.A. 12-1770 et seq., as amended, authorizes cities to establish redevelopment districts to
promote the general and economic welfare of the city. The general boundaries of the proposed
redevelopment district (the “District”) are West 91st Street to the south, the western boundary of
Overland Park Racquet Club and Glenwood Street to the east, West 89th Street to the north, and

WITHIN THE CITY PURSUANT TO K.S.A. 12-1770 ET SEQ., AS
AMENDED (NORTHEAST AND SOUTHEAST CORNERS OF 95TH
STREET AND METCALF AVENUE – CENTRAL SQUARE
REDEVELOPMENT TIF PROJECT).
WHEREAS, pursuant to K.S.A. 12-1770 et seq., as amended (the “Act”), the City of
Overland Park, Kansas (the “City”), is authorized to assist in the development and
redevelopment of eligible areas within the City in order to promote, stimulate and develop the
general and economic welfare of the State of Kansas and its communities; and
WHEREAS, the City hereby finds and determines it desirable to encourage the
development and redevelopment of certain real property within the City generally located at 95th
Street and Metcalf Avenue in the City and to consider the establishment of a redevelopment
district at such location (the “Redevelopment District”); and

WHEREAS, pursuant to the Act, the City must adopt a resolution stating that the City is
considering the establishment of the Redevelopment District and include in such resolution
notice that a public hearing will be held to consider the establishment of said Redevelopment
District.
NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE
CITY OF OVERLAND PARK, KANSAS, AS FOLLOWS:
1.
Notice is hereby given that a public hearing to consider the establishment by the
City of the Redevelopment District shall be held at the Overland Park City Hall, 8500 Santa Fe
Drive, Overland Park, Kansas, on March 16, 2015, at 7:30 p.m. (or as soon thereafter as is
practical).

The proposed boundaries of the Redevelopment District are set forth in Exhibit A
attached hereto and incorporated herein by reference.

A description of the proposed district plan for the Redevelopment District which
identifies all of the project areas and the general manner of all buildings, facilities and
improvements in each project area that are proposed to be constructed or improved in each
project area are attached hereto as Exhibit B and incorporated herein by reference.
4.
A description and map of the proposed Redevelopment District are available for
public inspection during regular office hours in the Office of the City Clerk, at Overland Park
City Hall, 8500 Santa Fe Drive, Overland Park, Kansas.
5.
At the public hearing, the Governing Body of the City will consider findings
necessary for the establishment of the proposed Redevelopment District.
6.
A copy of this Resolution shall be sent by certified mail, return receipt requested,
to the Board of Commissioners of Johnson County, Kansas, and the Board of Education of
Unified School District No. 512, Johnson County, Kansas. Copies of this Resolution also shall
be mailed by certified mail, return receipt requested, to each owner and occupant of land within
the District not more than 10 days following the date of adoption of this Resolution. This
Resolution and Exhibits A and B attached to this Resolution and a map delineating the area to be
included in the Redevelopment District attached hereto as Exhibit C shall be published once in
the official City newspaper not less than one week or more than two weeks preceding the date
fixed for the public hearing.

minimum front yard, but restricts the area to 60 square feet for the stoop and 80 square feet for the roof. The
