NOTICE OF PUBLIC HEARING
The Governing Body of Leawood, Kansas (the “City”), will meet for the purpose of holding a public hearing for the purpose of considering the advisability of amending and reaffirming a transportation development district
making certain hereinafter described transportation project improvements.
A.
Time and Place of Hearing
November 17, 2014, at 7:30 p.m, or as soon thereafter as the matter can be heard, at 4800
Town Center Drive, Leawood, Kansas 66211.
B.
Boundaries of Transportation District
The boundaries of the transportation development district (the “District”) are generally described as follows:
The District is bounded by Nall Avenue on the West, 117th Street on the South and Southeast,
and Town Center Drive on the North. The legal description of the property contained in the District is set
forth in Exhibit A attached hereto and incorporated by reference herein. A map generally outlining the
boundaries of the District is attached as Exhibit B hereto, and incorporated by reference herein.
C.
Transportation District Projects
The general nature of the transportation district projects (the “Projects”) consist of: two approximately seven-story parking garages, containing approximately 700 parking spaces, the
Hotel Floor of Garage A and the Hotel Garage as both are further defined in the Development
Agreement for Use of Transient Guest Tax for Construction of Hotel Garage Improvements in
the Park Place Development District, originally entered into on October 15, 2007 and amended
on August 15, 2011 and amended on October 6, 2014, and that Development Agreement
pertaining to creation of a Transportation Development District entered into on October 17,
2005 and amended on October 15, 2007, August 15, 2011 and October 20, 2014.
D.
Costs
The maximum total costs of the Projects are $28,727,472 to include up to $3,327,472 of
improvements to the Hotel Floor of Garage A and the Hotel Garage, of which no more than
$18,327,472 will be financed through the Transportation Development District and no more
than $15,000,000 may be financed by the City’s issuance of special obligation bonds.
E.
Method of Financing
The costs of the Projects and associated reserves and costs of issuance may be financed by
the issuance of revenue bonds of the City in an estimated principal amount of $15,000,000.
Any such bonds will be secured by the pledge of money received from the imposition of
a transportation district sales tax in an amount determined by the Governing Body not to
exceed 1% on the selling of tangible personal property at retail or rendering or furnishing
services within the District, or as otherwise provided by the Kansas Retailers Sales Tax Act,
and also by assessments levied against the property in amounts to be determined by the
Governing Body.
F.
Special Assessments
The Governing Body, pursuant to K.S.A. 12-17,143 and the City’s home rule authority to
determine its local affairs and government as authorized by Article 12, Section 5 of the
Kansas Constitution may levy special assessments against the property in the District, as
necessary in the judgment of the Governing Body to secure any TDD bonds at a rate and on
such properties to be determined by the Governing Body. No assessments may be levied
against the City at large and no full faith and credit notes or bonds will be issued by the City
to finance the Project.
The public hearing may be adjourned from time to time. At the conclusion of the public hearing, the Governing Body may, by passage of an ordinance, amend and reaffirm the District, authorize the Projects,
approve the estimated costs of such Projects and approve the method of financing the same. Such
ordinance shall become effective upon publication once in the official City newspaper.

HEARD AT THE PUBLIC HEARING.

are further defined as the Hotel Garage and the Hotel Floor of Garage A, respectively,
in the Development Agreement for Use of Transient Guest Tax for Construction of Hotel
Garage Improvements in the Park Place Development District, originally entered into
on October 15, 2007 and amended on August 15, 2011 and amended on October 6,
2014, and that Development Agreement pertaining to creation of a Transportation
Development District entered into on October 17, 2005 and amended on October 15,
2007, August 15, 2011 and October 20, 2014 (collectively, the “Development Agreements”), and such other related appurtenances thereto as are required by final plans
approved by the City.

Costs
The maximum total costs of the Projects are $12,227,472.
Method of Financing
The costs of the Projects and associated reserves and costs of issuance may be financed
by the issuance of revenue bonds of the City in an estimated principal amount which
shall not exceed $4,300,000, payable from transient guest tax revenues, and $3,327,472
of which petitioners propose be financed by periodic payment or reimbursement (on a
so called “pay as you go” basis) to Park Place Investors, LLC (“PPI”) by the City from
transient guest tax revenues as may be annually appropriated by the City’s Governing
Body and sales tax revenues as further set forth in the Development Agreements.

Sales Tax and Special Assessments
No additional Transportation District sales tax or assessment pursuant to the TDD Act is
authorized as a result of this Petition.
The public hearing may be adjourned from time to time. At the conclusion of the public hearing, the

in the form of addenda issued by the consultant.
All bidders shall verify that they have considered all written addenda. Neither the City nor the consultant shall
be responsible for oral instructions.
Any written addenda issued during the time of bidding shall be covered and included in the bid. There will be no
clarifications or exceptions allowed on the bid. Bids are for a total bid package, total contract price.
Bids shall be made upon the form provided in ink or typewritten. Numbers shall be stated both in writing and in
figures; the signature shall be long hand; and the complete form shall be without alteration or erasure. On alternate
items for which a bid is not submitted, a written indication of “no bid” on the bid form is required.
No oral, telegraphic, facsimile or telephonic bids or alterations will be considered.
The following items must be included in the sealed envelope with the bid:

when satisfactory bonds in an amount equal to 100% of the contract amount, required insurance certificates and
other required documents shall have been furnished and the contract documents have been executed.
In the event the successful bidder is unable to execute the contract, for whatever reason, City may exercise its
legal prerogatives, including, but not limited to, enforcement of its rights as to the bid security.
The City reserves the right to accept or reject any and all bids and to waive any technicalities or irregularities therein.
Bids may be modified or withdrawn by written request of the bidder received in the office of the City Clerk, prior
to the time and date for bid opening; provided, however, that no bidder may withdraw its bid for a period of thirty
(30) days from the date set for the opening thereof. ALL BIDDERS AGREE THAT REJECTION SHALL CREATE NO

The City of Leawood Planning Commission will hold a public hearing on Tuesday, November 25, 2014 at 6:00
p.m. at the Leawood City Hall, Council Chambers, 4800 Town Center Drive, Leawood, Kansas, to consider an
amendment to the Leawood Development Ordinance, Section 16-2-6.4, MXD (Mixed Use Development District),
pertaining to uses.
