“Scrap the OEC”!
That is the cry that is often
heard among overseas Filipino
workers in Hong Kong now,
after
thousands
found
themselves queuing for up to
nine hours for the $20
document that they need to be
able to exit the Philippines’
airports after a vacation, and
return to their work.
Many OFWs choose to go
home in March and/or April as
it is graduation time, or family
members are off work because
of the long Eastern holidays.
At the peak of the
applications on Mar. 15, the
queue extended all the way to
the footbridge connecting
United Centre (where the
Consulate is located) to the
next building.
On the 14th floor where the
Consulate offices are located,
every inch of public space was
packed with applicants that
getting in and out of the lifts
became
a
nightmarish
experience.
Most had to skip lunch. The
few who tried to get food
brought to them said friends
balked at the idea of having to

The previous Sunday,
Consulate volunteers said a
woman fainted. It was just
plain luck that she was the only
apparent casualty, given the
huge number of people who
kept pouring into the
Consulate for nearly the whole
month.
Though the number of
applicants has always been
huge at this time of the year,
the overcrowding has not been
as bad, mainly because the
OEC issuance was held at the
Bayanihan Centre in Kennedy
Town, which has a huge
outdoor space.

POLO claims ‘many’ refunds of illegal agency fee

There have been many cases in
which placement fees charged
by recruitment agencies were
ordered refunded by the
Philippine Overseas Labor
Office, according to Labor
Attache Nenita Garcia.
This was after The SUN
followed up a statement she
made during a recent visit by
members of the House of
Representatives that POLO
has been ordering agencies to
refund in full all placement
fees they collected from their
recruits.
Labatt Garcia said her office
has been keeping tab on the
number of such cases that
were brought to its attention.
However, her deputy, Ma.
Nena German, said the records
could not be shared imediately
as they were still packed in
boxes, waiting to be sorted
following POLO’s recent
move to its new offices at
Admiralty Centre. She also
said POLO had to protect the

Garcia said the POLO is
already wise to the various
ways by which recruitment
agencies filch job applicants.
Under Philippine laws, it is
illegal for job agencies in the
country to collect placement
fees from applicants, as the
government has shifted the
cost burden to the prospective
employers. In Hong Kong, a
foreign domestic worker is
required by law to pay a local
job agency no more than 10%
of her first monthly salary.
However, there have been
many cases of job agencies
and employers colluding to
make the workers pay for the
recruitment costs by taking out
loans from designated lending
agencies that, in turn, channel
the money to the agencies and
make the workers pay up.
In one recent case in Hong
Kong, an NGO helping
troubled maids intervened to
prevent a Filipina domestic
worker from being sent home
after she was fired by her
employer for refusing to take
out a loan as instructed by her
recruiter.
The helper was escorted by
the agency owner to the airport
when NGO staff intercepted
them. During a meeting
attended by an officer of the
Overseas Workers Welfare
Administration, the agency
agreed to refund the money
paid by the worker but still
insisted on keeping $6,000 as
payment for her services.
Garcia said the POLO is
acting on cases such as the
above, as the office is already
aware of the malpractice.
“Kapag ganoon ay alam na

iyon,” Garcia said, referring to
the illegal loan.

Maynila. Kasi that’s a form of

fee.

POLO is going after the errant
agencies, said Garcia, because
this was in accordance with the
orders of Labor Secretary
Rosalinda Baldoz.
Meanwhile, Garcia said her
office is ready to help victims
of illegal recruiters for nonexistent jobs in Canada and
Moscow. “If the recruiter is a

Nakapila si Jody sa footbridge ng Admiralty Centre upang
pumunta sa bagong opisina ng POLO para ipasok ang kanyang
bagong kontrata. Habang nasa pila, may nakahuntahan siyang
dalawang Pinay, isang nasa-25 anyos at isang mga edad 50
mahigit. Balak daw humingi ng payo ng dalawa sa POLO hinggil
sa problema ng nakababatang Pinay. Ayon dito, binigyan siya ng
apat na pahinang babala ng kanyang amo at kapag hindi niya
natupad ang mga nakasaad doon ay puputulin ang kanyang
kontrata. Ito umano ang kanyang idudulog sa POLO. Pinabasa
pa kay Jody ang sulat ng amo, na siya naman nitong ikinagulat.
Isa sa mga reklamo ay ang hayagang pagsuway ng Pinay sa mga
utos ng amo gaya ng paggising nito ng wala sa pinagkasunduan
nilang oras. Ayon sa sulat, madalas umano itong huli sa kanyang
pagtatrabaho at laging may kausap sa telepono. Kabilang din ang
hindi pagsusuot ng tamang kasuotan sa pagtatrabaho, at ang
pagsagot-sagot sa kanyang amo. Sa haba ng litanya ng apat na
pahinang sulat, naisip ni Jody na may punto ang amo sa mga
reklamo sa kanyang katulong. Sa kalaunan ng kanilang paguusap, napagtanto ni Jody na mag-ina ang kanyang kausap.
Tinanong si Jody ng nanay kung ano ang masasabi niya sa
sitwasyon ng kanyang anak. Agad na sumabad naman ang anak
na ang lagi umano niyang sagot sa amo ay, “just send me home, I
don’t care!” Ang sabi naman ng nanay nito ay sayang naman daw
ang pagpunta ng anak dito sa Hong Kong para magtrabaho kung
uuwi lang siya agad. Nang tanungin ni Jody kung gaano na siya
katagal sa among mareklamo ay sinagot siya ng dalaga ng limang
buwan pa lang umano siya dito. Madalas din umano siyang
tawagan ng amo ng kanyang anak upang magsumbong sa kanya.
Ayon sa ina, hindi daw siya naniniwalang tamad ang kanyang
anak dahil halos madurog na daw ang mga kamay nito sa allergy
bunga nga maraming trabaho. Nang tanungin naman ni Jody ang
kausap kung hindi ba siya nanghihinayang sa ginastos niya sa
pagpunta dito, agad na sagot naman nito ay hindi daw dahil ayaw
niya sa kanyang trabaho. Sa loob-loob ni Jody, matigas ang ulo
nito at mahirap bigyan ng payo ang isang taong sarado ang isip.
Ang sinabi na lang niya sa mag-inang kausap ay subukan muna
na ayusin ang trabaho ng kanyang anak at huwag magkulang sa
payo at suporta. Kung talagang hindi na matiis ay umuwi na lang
at huwag nang ipilit pa ang pagtatrabaho dito kung hindi naman
magagawa ng maayos. Sa hindi maipaliwanag na dahilan,
biglang sumakit ang ulo ni Jody sa pakikinig ng problema ng

Isang bagong tablet na matagal na niyang pangarap ang binili ni
Edna mula sa mga naipon niyang lai see galing sa amo at mga
bisita nito noong nakaraang Chinese New Year. Tuwang-tuwa si
Edna dahil dati ay sa kanyang smartphone lang siya nakikipagchat sa nobyong Amerikano. Maliit ang screen ng kanyang
smartphone kaya ika nga niya, “bitin” ang pakikipag-usap dahil
hindi niya masilayan nang maayos ang kanyang ka-chat. Dahil
dito ay pinag-ipunan niya talaga ang pambili ng tablet para mas
malaki ang screen niyang gamit. Ora mismo pagkabili ng gadget
ay agad na nag-online si Edna sa Skype para maka-chat ang
nobyo. Dahil araw ng Linggo ay maraming mga tao sa paligid
nang umpisahan ni Edna ang pakikipag-chat habang naglalakad
malapit sa Worldwide House sa Central. Hindi niya napansin na
may kasalubong siyang isang Intsik na may tulak na kariton na
puno ng gamit. Nahagip ng malaking nakausling bagahe ang
kuwerdas ng earphone ni Edna at natangay ang kanyang bagong
tablet! Humagis ito at nagulungan pa ng kariton. Napasigaw si
Edna at nang damputin niya ang gadget ay durog na ang screen
nito at hindi na mapapakinabangan. Sa halip na magpaumanhin
ang Intsik ay siya pa ang sinigawan at tila nagmura pa na hindi
umano niya tinitignan ang nilalakaran. Laking panghihinayang
at galit ang naramdaman ni Edna. Nang ikuwento niya ito sa
mga kaibigan na nasa kanilang tambayan, isa sa mga ito ang
nagsabi na dapat talagang hindi siya nakikipag-chat habang nasa
kalsada at naglalakad. Sumang-ayon naman ang iba pa niyang
kabarkarda. Kinantiyawan pa siyang, “sige, chat pa more!”

and the airport terminal fee,
and to lower the cost of
passports.
She said the leaders agreed
to hold a protest action in
May, and a dialogue with
Consulate officials in June.
In the meantime, they will
continue consulting with each
other through social media.
Pelaez said the coalition
welcomes other groups who
may want to join the
discussion.

Congress to push POEA to crack down on agencies

A congressional committee
that held a public hearing in
Hong Kong on the plight
OFWs here promised to force
the government regulator to
“crack down tightly” on
employment agencies that “run
beyond the bounds of legality”
in collecting illegal fees.
Chairman Walden Bello of
the committee on overseas
workers affairs (COWA) said
the lawmakers are aware that
Philippine
recruitment
agencies are in cahoots with
their Hong Kong counterparts.
“We’ll try our best to
address this problem in the
Philippines… Alam naman
natin na (the Philippine and
Hong Kong agencies) are
working together so, on the
Philippine end, we will try to
find a way to force the POEA
to more tightly crack down,”
Bello said.
Bello said the POEA should
not be soft on the agencies,
knowing that there are
operators with many violations
but are still in business
because they only change
names.
“We want POEA to more
effectively
address
the
problem,” he said during the
forum attended by leaders of
various concerned groups at
the Consulate on March 15.

should be pressured to clean
up its job placement industry.

Roldan probably guilty, say Congress probers

Guilty most likely. This was
the initial assessment of a
group of Philippine legislators
who visited Hong Kong
recently to look into
allegations of impropriety and
abuse of power against former
labor attaché Manuel Roldan.
The group told a forum with
about 100 Filipino community
leaders on Mar 15 that their
initial reaction to the evidence
presented to them by the
complainants and a factfinding team formed by the
Consulate was that Roldan
was guilty as charged.
But Rep. Walden Bello who
led the team from the House of
Representatives’ committee
on overseas workers affairs
said they would follow due
process, and give Roldan a
chance to air his side.
“Ipa-follow up ho natin ito
because we cannot condone
such acts,” said Bello, who
added that the case will be
pursued with concerned
government agencies like the
Department of Labor and
Employment.
The case against Roldan
centered on four main
allegations:
1. That he misused his
position and authority in
allowing the accreditation of
an employment agency
registered in the name of a
daughter of Donald Retirado,
his driver and a locally-hired
staff of the Department of
Labor and Employment;
2. That he accredited nearly
100 recruitment agencies in
violation of an existing ban,
and possibly as a way to win
favors;
3. That his mismanagement,
poor negotiations and lack of
foresight led to loss of the
Filipino Workers Resource
Center which was provided
free of charge by the Hong
Kong government; and
4. That the Philippine
Overseas Labor Office’s
(POLO) conciliation of money
claims by Filipino workers
which continued during his
term may be illegal and
inefficient
Bello said: “On all four
charges, we in the committee
say na may pagkakamali ang
ating labor attache.”
DOLE reportedly extended
word to the committee in
February that it was also

But it took DOLE several
months to start its own
investigation.
During the congressional
visit, the legislators also met
with Hong Kong labor and
immigration officials.
Bello said his group was
Roldan
investigating the case against
its former top official in Hong
Kong, who has been posted to
an adjunct office in Tacloban,
Leyte since his return to the
Philippines.
The congressional probe
was prompted by a report
released on Sept. 29 by the
Consulate’s
fact-finding
committee which suggested
Roldan may have breached
civil service laws when he
allowed his former driver,
Donald Retirado to operate an
employment agency.
The report also pointed out
that Retirado’s work contract
which was submitted to the
committee as part of its
investigation appeared to have
been tampered with, in an
apparent attempt at a coverup.
Further, that Roldan did
allow
90
additional
employment agencies in Hong
Kong to recruit Filipino
workers, despite his insistence
that the power of accreditation
rests solely with the Philippine
Overseas
Employment
Administration in Manila.
Roldan was also blamed for
the untimely return of the rentfree FWRC to the Hong Kong
government,
and
for
expanding, rather than halting,
the apparently illegal practice
of conciliating the money
claims of OFWs against their
recruiters.
The committee report was
submitted to DOLE and the
assured
by
the
host
government that it was doing
its best to protect the interests
of its migrant community,
including
the
Filipino
domestic workers.
When they mentioned the
recent case of abused
Indonesian domestic worker
Erwiana Sulistyaningsih, the
Hong
Kong
officials
reportedly said it was an
“isolated case”.
But, Bello said, “we were
skeptical”, likening the abuse
of the Indonesian maid to the
“torture” of foreign domestic
workers in Saudi Arabia.
He called on OFWs to be
courageous in exposing any
abuse or injustice they may
have suffered.
“We should always realize
that if we keep pushing for our
rights, they will be given to
us,” he said.
Bello took the chance to say
goodbye, saying it was his last
public hearing as legislator.
He stood down from his post
just days earlier, after
announcing that he had lost his
trust in President Benigno S.
Aquino III who is a political
ally of Akbayan party-list,
which he represents in
Congress.

Spike seen in number of pregnant OFWs seeking help

Eleven Filipino women with
their children were among 28
clients who sought assistance
from PathFinders, a nongovernmental organization
helping distressed migrant
mothers and children, in the
first two months of this year.
PathFinders disclosed the
numbers to The SUN saying
the 28 mom-child “families”
that approached the group
represented a 25 percent
increase over the same period
a year ago.
“Of that number, we have 16
families from Indonesia and
11 from the Philippines,” said
Luna Chan, chief operating
officer of PathFinders, citing
statistics culled from the
group’s operations last year, as
well as in January-February
this year.
The 28th family came from a
third country, she said.
Chan said since its founding
in 2007-2008, PathFinders
had helped about 3,000
families.
The group also said last
year, 92 Filipino and
Indonesian women, along with
their children, had overstayed
their visas in the wake of the
mothers’ pregnancy.
But more, or 94 clients,
were eligible to work because
they had visas, it said.
She said the encouraging
news is that “more domestic
workers are approaching us
before they lose their visas.
What normally happens is that
once their employers learn that
they (the helpers) are pregnant
… they unlawfully terminate
the workers,” Chan said.
“The workers would lose
their jobs, lose a place to stay,
don’t know what to do about
visas and they are pregnant
and apply (for jobs), and how
are they going top deal with
these issues within two weeks.
They only have two weeks to
leave (Hong Kong). If they
don’t know that they can make
a claim, or somebody could
tell the immigration about
their situation, and if they are
not able to extend their visa
then, they would overstay and
lose their ability to come back
and work,” she said.
Chan said in 2014, the NGO
had 621 clients with 28
percent of Filipino nationality
and 68 percent Indonesian.
The rest came from Thailand,
India, Bangladesh and other

“If we look at the overall

these years, it looks like
Indonesians made up 74
percent and Filipinos around
22 percent,” she said.
“If we look at per family and
each family has one at least

“The number of cases
actually grew by 25 percent,
like the number of families we
assisted in 2015. But there are
people who just called and
then we could only provide
information,” Chan said.

counseling increased by 25%,
she
said.
“The
very
encouraging development is
that we had more valid visa
holders approaching us in
2014 than before,” Chan said.
The migrant mothers who
had sought help from
PathFinders over the years
claimed they got pregnant by
their boyfriends or spouses in
the Philippines, employers,
rapists, boyfriends in Hong
Kong, and spontaneous
relationships that led to onenight stands.
Chan said it relied only on
information supplied by the
women, and that usually it
took months to build enough
trust between them and the
clients for them to know the
real story.
“Roughly speaking, most of
the women’s partners are
South Asian like Pakistani,
Bangladeshi, India,” said
Chan, adding that the others
are Africans, Caucasian,
French, and Chinese.
The
Philippine
government’s support for the
Filipina worker is more
sophisticated
and
comprehensive
than
in
Indonesia so, in comparison
with their Indonesia sisters, the
Filipinas “tend to be more
okay”.
Many of the children helped
by PathFinders who were born
in Hong Kong 10 to 15 years
ago were undocumented, so
the group helped them to
report to Immigration so they
could be cognizance paper, a
recognition that they formally
exists.
Jailed mom airs message for OFWs before flying home with baby

Regina (not her real name) and
her Hong Kong-born baby boy
are a few steps closer to flying
home to the Philippines and
ending a traumatic saga in their
lives.
Regina told The SUN she
would leave on Mar 28 if she
could obtain a travel
certificate for her baby from
the Philippine Consulate
before then.
A week earlier, she
managed to secure her baby’s
birth certificate from the
Immigration Department with
help from PathFinders, a nongovernmental organization
that focuses on helping foreign
domestic workers who are
either pregnant, or give birth in
Hong Kong.
“I just got his birth
certificate. The next step is to
apply for his travel document
at the Philippine Consulate,”
Regina said.
A one-way travel document
is issued by the Consulate to
Filipino citizens in lieu of a
passport
in
cases
of
emergency. In Regina’s case,
she needed the travel
document so she could bring
her baby with her when she
returns to the Philippines.
Regina’s real-life drama
unreeled in November last
year when she told her
employer that she was four
months pregnant.
At the time, the 27-year-old
Filipina had been working for
her Chinese employer in Hung
Hom for about nine months. It
was her second job as her first
employer, an Australian,
released her 10 months into
their two-year contract
because the family had to
leave Hong Kong.
Four months into her new
job, Regina returned to her
hometown in Camarines Sur
for a rendezvous with her
Dubai-based common-law
husband. That was when she
got pregnant.
“Initially my Chinese
employer wanted me to
terminate
my
work
contract…because she said it
was illegal to terminate a
pregnant employee in Hong
Kong,” Regina said.
“I asked her if she’d allow
me to work just four more
months because I was
repaying my Php100,000
recruitment fee and she
replied, ‘OK, I will retain you
until the end of January’,” the
maid added.
But that turned out to be a
big lie. On the evening of Nov.
9, the employer took Regina to
the employment agency and
allegedly forced her to sign a
letter
terminating
their
contract after the required onemonth notice. The letter was
said to have been drafted by
the agent.
Two days afterwards, her
employers reportedly told
Regina to stay at home as they
would be the ones to pick up
their three-year-old child from
school.
But at 11am that same day,
the employer’s husband
reportedly returned home and
told Regina that his wife’s
necklace and and ring were
missing. Regina replied she
wasn’t aware of the jewelry,
but the man insisted she search
her room. She brought out her
suitcase and searched through
her clothes but found nothing.
“Then why don’t you check
your handbag?” the man
replied. Regina said she did as
she was told because she was
confident she did not take the
jewelry. However, she was
surprised to find the missing
jewelry from a small pocket in
her bag.
The
male
employer
immediately took her to the
Wanchai police station where
his wife was already waiting.
Regina said she told the
cops that she did not steal the
jewelry, but they did not listen
to her. She also was not
allowed to make calls, so her
family back home was not
aware that she was in trouble.
“They asked me to post a
$500 bail but saw I had only
$200 in my pocket, so they

kept me in custody overnight.
In the morning, they took me
to Kowloon court where
lawyers interviewed me. After
that, I was taken to the Tai
Lam correctional,” she said.
She returned to court on
Dec. 20 where she was asked
to make a plea. Regina
admitted the offence, saying
the Filipinas she met in Tai
Lam had advised her it would
be better to plead guilty if she
wanted to go home and give
birth in the Philippines.
Her duty lawyer also gave
his approval to her plea, even
if he was supposedly aware
that Regina did not really want
to admit guilt.
She was sentenced to two
months in jail and was
immediately returned to jail.
Ten days later, she started
bleeding, and was taken to
Queen Elizabeth Hospital in
Jordan. She delivered her son
the next morning via a
Caesarian section.
On Jan. 2, while still in
hospital, Regina was informed
that she was being released
from custody. She was
discharged from the hospital
three days later.
“I was crying at the time
because I did not know where
to go and I had no money at all
to buy baby clothes. My baby
had no clothes and it was very
cold then,” she recalled,
sobbing.
Holding her infant close to
her because of the cold,
Regina stepped out of the
hospital not knowing where to
go. Luckily, she met some
Filipinas who advised her to
go to the Bethune House
Migrant Women’s Refuge on
Jordan Road just a few blocks
away.
“One of our clients informed
me there was a Filipina mother
sitting on the pavement crying
while breastfeeding her
newborn, so we went out to
fetch the mother and child,”
said Esther C. Bangcawayan
of the Mission for Migrant
Workers who runs the Jordan
Road shelter.
It was only when she felt the
warm
embrace
of
Bangcawayan that Regina was
relieved. She knew then that
she and her baby were in safe
hands.
Asked whether she would
press civil action against the
employer, Regina told The
SUN that all she wanted was to
go back home as soon as
possible. “I just want to return
home with my baby and share
my story so that other OFWs
would learn from my
experience,” she said.

Blood Donation Action in
which treats await blood
donors starting April 12.
Those who give blood will
receive a foldable magazine
holder with a blood donation
message printed on it. Easterthemed photo props are also
available at all donation
venues for blood donors to
take pictures with.
The BTS said fewer people
may turn up at donor centres
because of the five-day Easter
holiday period.
Meanwhile, hospitals will
increase their blood reserves
before the long holidays to get
prepared for regular blood
utilization and any sudden
situations with a high blood
demand. The daily blood
collection needs to increase
before the Easter holidays to
ensure a normal blood supply.
The blood inventories have
remained relatively low
recently.
The BTS urges more
members of the public to
respond promptly to its
appeal. A minimum of 1,100
people on average will need to
come forward every day in
meeting the demand through
the coming two weeks. Blood
donors who intend to travel
overseas are asked to donate
before their trips.

The embassy reminded

jobseekers not to deal with
agents or individuals in China

tourist visas in exchange for a

to unscrupulous actions, the

Filipino groups have again
taken part in the annual Hong
Kong Flower Show at Victoria
Park, which ran from Mar. 2029.
As in past years, the
Rizalista group occupied one
of the booths, where Filipino
cultural
dances
were
performed,
and
native
costumes displayed.
Going by the theme “When
Blossoms Dance,” the festival
again showcased hundreds of
varieties of flowers, as well as
floral
and
garden
arrangements that attracted
horticulture enthusiasts from
here and around the world.
The display is so huge and
the area so vast that visitors
need at least three to four
hours to fully see everything
that is on offer.
Apart from the flowers that
were in full bloom, there were
also food and plants on sale.
Plant lovers had the time of
their lives buying up potted
flowers like orchids which
went for $20 a pot, but there
were also expensive ones like
rare cacti that cost hundreds,
even thousands of dollars.

Doctors say early detection
vital to treating breast cancer

About 300 Filipino domestic
workers attended a talk on
breast cancer awareness by
four medical experts held on
Mar 15 at the University of
Hong Kong.
The seminar is part of the
series of talks on health and
nutrition spearheaded by Dr.
Michael M. Manio and
organized by the Centre of
Development and Resources
for Students (CEDARS) in
partnership with the Philippine
Consulate General.
The speakers included Dr.
Melanie B. Cruz from the
Asian Hospital and Medical
Center, Dr. Alexandra Nina
dela Cruz Odi from the
Medical City University of the
Philippines, Dr. Elke Marie A.
Sauz from The Medical City,
and Dr. Clement Chen of
Queen Mary Hospital.
Dr Cruz told the participants
that when one is diagnosed
with breast cancer it doesn’t
mean that that person will die
at once. The ailment can be
cured if detected earlier.
According to a report of
GloboCan 2008 which was
cited during the seminar, the
Philippines ranks 3rd among
Asian countries with the
highest rate of breast cancer
among women. Filipino
women should know that
gender, age and genetics are
factors in developing cancer
cells. The ailment cannot be
prevented but one can reduce
the risk of suffering from the
disease by monitoring one’s
weight, having a balanced diet,
and a healthy lifestyle.
The early symptoms include
abnormalities in appearance of
the breast, discharge of
colored fluids and stiffness of

Hong Kong leads region in OVR for January

The
overseas
voting
registration (OVR) in Hong
Kong has reached a new high
in January, when it posted the
highest number of new voters
for the Asia Pacific region.
This was according to Vice
Consul Fatima Quintin, who is
in charge of the OVR for the
2016 presidential elections.
Quintin said the figure is 5%
more than the number of
voters who registered in
December last year.
“We are No. 1 in the AsiaPacific for that month, and we
are happy that our momentum
is continuing,” she said,
adding that for March, the
daily registration at the
Consulate alone was 70-80
people. “With the momentum,
we expect to reach the target
of 20,000” by the Oct. 31
deadline. “It’s possible,”

softball league Group A,
jumped to an early lead in its
match against Sieger on March
29, but lost its scoring touch on
several errors to bow to last
year’s champions, 3-11.
The Filipinas’ sister team in
Group B, however, made the
day for team manager Law
Wai-ho when it hammered
local rivals Bruins, 9-0.
The Pinays entered the
diamond at Tin Kwong Field
as the underdogs, since this
was their first time to play
against the young and
powerful ladies’ softball squad
in Hong Kong.
“Stay cool. Don’t get
excited at the bat,” coach
Bernie Cabasal advised the
Filipinas as they played the
home team.
The first inning had hardly
started when the Filipinas
rattled the champions with a
blast to the outfield by Fate

Filipino groups have booked
seats in these establishments at

these places will be fun,
because we will be cheering
with friends. Also those who
would want to bet can do so
with people in the crowd,”
said a regular viewer in these

A small number would be
watching the fight on TV sets
connected to a cable company
that uses satellites to broadcast

Polling agency Pulse Asia
released its latest survey,
conducted on March 1 to 7
with 1, 200 respondents,
showing
that
Aquino’s
approval rating fell by 21
percentage points, from 59
percent in November 2014 to
only 38 percent three months
later.
Aquino’s trust rating
dropped by 20 percentage
points, from 56 percent in
November to 36 percent in the
March survey.
Senate President Franklin
Drilon took the top position in
the list, having garnered the
highest trust rating of 44
percent among the top 5
government officials. Vice
President Jejomar Binay came
a close second, with 42
percent trust rating.
Aquino suffered the biggest
drop in approval ratings
among the Philippines’ top
five officials. “Amidst the
various challenges being faced
by his administration at the
present time, appreciation for

Scrap the OEC
It was one of the scariest
experiences ever. Imagine
being squeezed into a lift, and
then realizing when you get to
your desired floor that every
square inch of the space you
were supposed to step out on
was crammed-full of people?
That was exactly what
happened when a number of
us braved the queues that
snaked
around
United
Centre’s ground floor lift
lobby on Mar. 15 to make it in
time for our appointment at
the Consulate on the 14th floor.
At 8:15 am, the tail-end of
the queue could no longer be
seen from the lift doors. But
we thanked our lucky stars
when we were allowed to get
to the front of the line so we
could be in time for our
meeting.
Being squeezed tight in an
elevator
was
nothing
compared to the more
horrifying experience of
seeing, as the lift doors
opened, that a wall of people
was blocking your way.
“Get back in!” some of the
people shouted, but the ones
behind you would not be
denied the right to finally take
their place in that sea of
humanity, and so pushed you
forward while the ones in front
tried to move you all back into
the lift.
Not even when we were
walking among the throngs of
people at the height of the
Occupy protest did we feel
such a sense of panic. In a
flash, one realized that all it
took was for someone to shout
a wrong word, or collapse
from exhaustion or sheer panic
like ours, and a stampede
could ensue.
Luckily, the worst-case
scenario did not happen. But
one shudders to think how
close we all were to being hurt,
or even crushed to death at that
time.
But the ones in the queue
were the real unlucky ones.
Tired and hungry, they had no
choice but to stay put even
during their only rest day in the
week just so they could get the
piece of paper that would
ensure their hassle-free return
to Hong Kong.
Many went without lunch,
but with the fortitude that often
comes with taking on
backbreaking work, hardly
anyone complained.
All this for what? So our
workers could secure a $20worth of document that our
government has been insisting
they must have so they could

There is this feeling where you
want to do something, in which
you keep saying you will do it
BUT never actually find the
time to do it. I have – HAD –
this feeling and finally it’s off
my list.
Here’s the deal: I’ve been
living in Hong Kong for 11
years and in this course of
time, despite the advancement
of technology i.e. having the
Internet as basically the new
form of encyclopedia, I did not
really try to learn more about
Philippine history even if I
wanted to/needed to because
of feeling ashamed of not
knowing more.
Anyway, an event transpired
today
where
history
enthusiasts – specifically those
who have an extreme
fascination with the national
hero of the Philippines who is
D. Jose P. Rizal – conducted a
walking tour that went through
places that had some historic
connection to Rizal’s brief
stay in Hong Kong. The tour
ignited my interest in knowing
about our history again.
What I experienced today
were so new that I felt like a
small kid learning about the
world once again. The only
difference is that I got into this
out of interest, and now feel so
enriched that I keep wanting to
have more.
To say that the tour was
amazing is an understatement.
Sadly, there were not a lot of
participants despite the
insistent attempt to reach out
to Filipino youths, which was
the main target of Section Juan
– the organizer of the event.
I wish that the Filipinos in
Hong Kong, especially the
youngsters, can find it in them
the thirst to know more about
our country and its past, to
know more about our culture
and not just what’s on the
surface.
It’ll be a great shame if we
could not pass on what we
know of our history to future
generations. We have the
resources and the chance to
visit actual places where
history happened, but many
are taking these for granted.

OEC is needed when the
worker already has her
employment visa stamped on
her passport, and could also
produce a work contract and a
HKID should they be deemed
necessary.
What special qualification
do the harried staff at the
Consulate possess that airport
personnel do not have, in
determining whether an OFW
is entitled to the all-important
certificate?
It could only be the money.
With tens of thousands of
OFWs returning home each
day, the OEC, even at a mere
$25 or Php100 each, is making
oodles of money for the
government.
To add salt to injury, we
now see the source of this gold
mine – the OFW – being made
to go through a wringer just to
get this superfluous piece of
paper.
As we Filipinos would say,
“Pinagkakakitaan na nga,
pinapahirapan pa.”
For this, we partly blame
newbie labor officials at the
Consulate who in a fit of
recklessness, moved the
Saturday processing of the
OEC from the relatively
pleasant surroundings of the
Bayanihan Centre to the
suffocating confines of United
Centre.
We also blame our labor
officials in Manila for failing
to make a promised OEC
online application system
work so our OFWs could have
been spared the indignity and
agony of standing in line for
hours just so they could be
squeezed for more money.
But mostly, we blame our
government for not giving our
OFWs the importance that
they deserve.
It is because of our workers’
suffering that many children
are better fed and kept in
school where they get a crack
at having a better life. It is
mainly through our OFWs’
sacrifices that our economy
has remained afloat. They
should be taken care of, not
squeezed.
So, enough, we say. Scrap
the OEC now.

I want to share what Mr. LJ
wrote:
I own and manage a
manpower company. It is a
small company and all the
loans of the company are all
under my name. I don’t have a
fixed salary, so I just get
whatever I need for my family
and myself from the company
which also includes my home
loan, car loan, insurances etc.
The company has experienced
financial difficulties since last
year when we got suspended
from our major client. More
than 50% of my manpower is
deployed in that major client.
I lost 75% of the contractual
employees with that client. In
short, I currently have more
liabilities (loans and payables)
than my income and assets.
So far, I’m able to manage
my cash flow and pay my
loans by using other loans.
But thinking ahead of the
worst case scenario, I decided
to get myself back to the
corporate world as an
employee so that I do not have
to get a salary from my
company. Fortunately, a
company offered me a job.
The package offer is not
enough to cover my monthly
expenses; meaning I still have
to get something from my
company/business. I also
started a tour business as a
backup plan business to at
least help the company from
its financial burden. But of
course, it does not bring that
much income for now. I’m
just hopeful we can be
reinstated back by our major
client or get a new client. In
the event that my company
gets back on track and begin
redeploying more employees,
I’ll need extra cash to shoulder
the first payroll of these new
employees. That’s how a
manpower agency works; we
pay our employees before we
can bill our client(s).
I’m thinking of another long
term
(personal/business)
investment - pre-selling A 2bedroom condo unit worth
P1.9M
with
a
10%
downpayment (P8k+/month)
payable in 21months until its
turnover; 90% balance shall be
under bank loan of 7.5% per
annum (P17k/month for
15years). After 21 months
time, I can use the condo to
live there, have it rented out
for more than the monthly
ammortization or sell it at a
higher price. I might use this
as my second home, a place
where I can live.
My question is, do you think
I should invest in this or not? I
don’t know if it is the right
thing to do because of my
current financial situation. Is
it a right move to invest and
take advantage of the promo/
sale since I may be needing in
the future a place where I can
live; or have it rented out so
that the rental could take care
of the monthly ammortization;
or sell it at a higher price in the
future?
Lastly, what is your advise
on our business? Manpower
industry is saturated and we
are all aware that DOLE has so
many rules. Also, agency fees
in manpower industry are not
that high. Payment terms could
also be unfavourable to us and
that is usually our major
concern. We have to pay our
employees on time but our
clients have the luxury of time
as to when they want to pay us.

While we try to answer all
emails, we try to advise when
we have the know-how.
However, we are sure you
understand
that
more
complicated cases like yours
would really require a more in
depth study of your personal
situation and perhaps even a
separate financial consultation
arrangement. What is clear
now is that your business has
put you in debt and you have
had to take on a job which
doesnt even pay enough to
cover your expenses. You are
relying on loans plus a new
tour-related one to provide
you the additional income to
cover your cash deficits.
Have you made your SAL
and PIES, your projections
and your Personal Financial
Plan? It is only from this that
any advice can be given.
Perhaps, you are even able to
answer your own questions
when you analyze these.
It seems you are still hoping
you can regain your lost
manpower contract to solve
your financial problems. Yet,
even without this happening,
you already want to speculate
in real estate. The purchase of
real estate without any real
purpose is really a “gamble.”
If you need it as your
permanent resident, you need
to analyze if you can truly
afford it. Renting it out is just
a goal. It is not a certainty and
thus cannot be relied on.
Besides, in buying at preselling stage, you are really
taking on a performance risk
by the developer. He may or
may not complete the unit in
time and with the quality he is
promising. The value of the
condo could increase but it
could also decrease. The
basic consideration here is
whether you can or cannot
afford to speculate given that
your present cash flow is not
even sufficient for your
present needs.
One of the major principles
that you have not been
following is to separate your
business from your personal
financials. You should have
been paying yourself a fixed
salary to precisely establish
what your company is really
worth. Of course, you can
keep your loans and other
expenses in the name of your
company for “tax purposes” if
the items are really used in
your business. Then you
should have been effectively
“Paying Yourself First.” from
the fixed salary you should
have regularly received.

Two new government policies
could see thousands of
Filipino workers in Canada
heading back home starting
Apr. 1.
The first, and more
sweeping one, is the overhaul
of the Temporary Foreign
Worker Program (TFWP).
Following this change, nearly
4,000 Filipinos who entered
Canada in 2011 under the
program will have to leave
over the next 12 months when
their contracts are expired
under the new government
policy.
More face deportation in the
next two years, as their
contracts reach the new fouryear limit of stay.
The
second
is
the
amendment of the Live-In
Caregiver Program, which
removes the requirement that
the workers live with the
employer, but restricts their
entry and applications for
permanent residency to two
“new pathways”.
Under the amended TFWP,
all temporary workers who
have been working in Canada
for four years or more will
have to leave. That means they
will not be granted another

work permit for an additional
four years, no matter how hard
or well they have worked, or
how anxious their employers
are to retain them.
The Canadian government
said the reform was in
response to reports of abuse of

Online OEC filing available, but only few users

Unknown to most overseas
Filpino workers in Hong
Kong, there is —or there
should be— an easier way to
apply for the overseas
employment certificate or
OEC, the document that cause
frustratingly long queues
during peak seasons.
The OEC online service has
been available for at least two
months, but for some reason,
even today’s relatively technosavvy Filipino migrants
workers seem reluctant to
avail of it.
“Matagal na po tayong
mayroong BMOnline pero
nagsisiksikan pa rin sila sa
consulate,” Labor Attache
Nenita Garcia told The SUN,
when asked during an
interview whether the online
application service was
available.
She said the online
application for OEC is
available on the website of the
Philippine
Overseas
Employment Administration.
All that an applicant needs to
do is visit that site and click on
the BMOnline icon and input
personal details.
Payment can be done
through remittance company
iRemit, which has several
outlets in Hong Kong.
Garcia said the central
database for the personal
details of all registered OFWs
is with the POEA, which
launched the BMOnline
service on Jan. 27 this year.
“Once na nakapag-register
sila, nandoon na ang kanilang
data kaya next time na magapply sila, nandoon na,”
Garcia said.
Despite the apparent ease of
using the online service, the
labor attaché said migrant
workers are hesitant to avail of
it, either because they are still
uncomfortable using the
internet, or still prefer to make
the application personally at
the Consulate.
To help the workers, she
said the Philippine Overseas
Labor Office has gone the
extra mile training the OFWs
on how to use the online
system with help from Filipino

Thus, the chaos, which was
witnessed by no less than a
group of Philippine legislators
who conducted a public
hearing at the Consulate on
Mar. 15.
At an earlier interview with
The SUN, Consul General
Bernardita Catalla admitted
that even she was taken aback
when she saw the huge crowd
at the start of the month. She
said she immediately asked
POLO staff who had already
moved to their new offices at
nearby Admiralty Centre, to
open more windows for OEC
processing to decongest the
service area.
And what is this allimportant document that the
OFWs were so desperate to
get? It is what they are
required to produce at
Philippine airports to prove
that they are OFWs entitled to
exemption from travel tax, and
for a refund of the terminal fee
they were forced to pay along
with their air ticket.
But many OFWs have long
balked at the idea of having to
secure the OEC when they
already have their work visas
and contracts to prove their
status. Many say that it is just
another reason to extract
money from them.
The SUN posted pictures of
the long queues for the OEC

Most said no, and gave
varied reasons. Here are some
of them (some are edited

She admitted that any
technology is hard to learn in
the beginning, but added that
POEA’s website has a tutorial
service
for
first-time
applicants.
Surprisingly, though, POLO
has yet to announce publicly
that the online application
service is available, not even
when faced with the deluge of
applicants during the pregraduation and Holy Week
season.
The answer could well be
because the system does not
work—at least not yet.
Intrigued by the question of
why no one seems to be
promoting – or using - the
easier and stress-free service,
The SUN asked two OFWs
who have been working in
Hong Kong for not less than
10 years and who have been
applying for the OEC at least
twice a year, to try the much
bruited-about service.
After filling in basic
personal details, the first OFW
was forced to discontinue
when asked for the number of
the last OEC issued to him.
“No way will I remember
that,” he said. “We always
throw away the document as
soon as we get back to Hong
Kong. Besides, why are we not
told to keep it so we could
apply online the next time we
need an OEC?”
The second OFW thought
she was luckier because she
managed to keep her last OEC,
as she had just gone home, and
had asked her daughter to keep
it for a refund.
She happily put in the
number as requested, but was
stumped by what she saw next.
“No data found” was the
message that came up on the
screen.
Obviously, not even the
most sophisticated online
service could churn out data if
none was fed to it in the first
place.
Unless POLO built a data
base of all OFWs in HK and
shared it with POEA, this
supposed service will remain
but an illusion.

New DCG looks forward to
working with Filcom
“Seven years in the making.” That’s how the
country’s new second top official at the
Consulate calls his assignment to Hong Kong,
as he recalls with amusement how he was
supposed to have been posted here as early as
2007.
Deputy Consul General Christian L. de Jesus
says he was already on his way to Hong Kong
for his first overseas assignment, when
Ambassador Domingo Siazon got him to go to
Japan instead.
A lawyer and a fluent Japanese speaker,
DCG De Jesus did not have any trouble settling
down in his first overseas post. The bonus, he
says, was he became under the tutelage not only
of Ambassador Siazon, but also of his
successor, Ambassador Manolo Lopez, who is
another highly regarded diplomat and
businessman.
He spent all of the allowed six years of
overseas stay in Tokyo, before returning to the
Department of Foreign Affairs’ home office
where he worked at the internal audit service
division.
But the lure of Hong Kong remained, and
when the no. 2 post here opened with DCG
Rosanna Villamor’s departure for Washington
D.C., de Jesus did not think twice about coming
over.
The prospect of serving in a post where
diplomacy takes a back seat to promoting the
welfare of overseas Filipino workers does not
seem to faze him. Four days after his arrival on
Mar. 25, he attended his first Filipino
community meeting, and was evidently keen to
meet and mingle with community leaders.
“I hope to get to know all of you someday,”
he told the gathering after being introduced by
Consul General Bernardita Catalla.

“I would like to think it (law
practice) has helped me a lot in

seem like de Jesus has his
work cut out for him. But with
his experience and willingness
to serve, he has no reason to

enthusiasm and community spirit shown by the
leaders, and would like to know more about the

Tackling more demanding jobs is nothing
new to this diplomat. Armed with the law
degree he obtained from Ateneo de Manila
University in 1999, de Jesus first went to work
with SGV, now known as the largest
professional services firm in the Philippines.

The chef’s coat fits

Catering for a family that
owns a string of well-known
restaurants in Hong Kong is
not an easy task, but Nerissa
D. Roxas has achieved the
challenging job with flying
colors. Neri, as she is
fondly called by her friends,
especially those who are
members of the Filipino
Basketball Association or
FBA which she leads, has
been working for her
Australian employers in
Pokfulam since 1992.
Although her employers
are famous restaurateurs,
they still prefer to come
home to Neri’s home
cooked meals. Even her two
wards profess to love her
cooking more than anything
bought outside, including the
fancy dishes served at their
parent’s restaurants.
The family has so much trust
in Neri’s cooking that
whenever they host a dinner
party, they ask their all-around
helper to don her customized
chef’s coat, and take charge of
the kitchen.
Neri never shrinks from
such task, as she always
manages to come up with the
perfect menu according to her
employer’s
preference,
whether it be for a western or
continental themed party, a
Hawaiian luau, or a French
fondue.
She has also perfected the
art of Southeast Asian and
Australian cuisine, which she
gets to serve in various parts of
the world, as her employers
often take her traveling with
them. From the appetizers,
main course and desserts, Neri
prepares them to perfection.
With no formal culinary
education, Neri’s cooking
skills
have
come
naturally. Still, she wants to
learn the formal way: “Kung
may culinary school dito sa
Hong Kong na pwede kong
pasukan, gusto ko ring magaral.” (If there is a culinary
school in Hong Kong which I
can attend, I would be very
interested).
As proof of her trust in
Neri’s cooking, her employer
Nerissa D. Roxas: Employers prefer her cooking to that
served in their restaurants.
Fresh Fruit Pavlova
For meringue:
10-12 egg whites
450 grams caster sugar
1 teaspoon corn flour
1 teaspoon cream of tartar
1 teaspoon white vinegar
For serving:
250 ml. cream, whipped
Fresh fruit, such as passion
fruit, strawberries, mango,
banana, kiwi
Vanilla or passion fruit ice
cream (optional)
Method:
1. Prepare a 30 cm.
diameter or square metal
baking tray, lined with
greaseproof paper or foil.
Use a pencil to trace a
circle on the paper 28-30
cm. diameter.
2. Set oven to 200
degrees Celsius
3. In an electric mixer,
beat egg whites until firm
but not dry. Add about half
of the sugar, and all of the
corn flour, cream of tartar,
and vinegar, and continue
to beat on full power until
the sugar has dissolved and
the mix is quite firm and
creamy. Gently fold in the
rest of the sugar.
4. Place the mixture on the
tray inside the circle, ensuring
that the sides are as high as the
center.
5. Place the tray in the oven
and immediately reduce the
temperature to 100 degrees
Celsius. Check after two
hours. When the pavlova is
slightly puffed, a little colored
(but not brown) and crisp,
leave for another 30 minutes.
6. Remove and allow to cool
thoroughly. Just before
serving, cover the top with
whipped cream. Decorate with
sliced fruits, and drizzle with
passion fruit. Serve at once.
Note: Keep meringue
in an air-tight container if
it’s not to be eaten right
away to maintain
freshness.

keeps her own compilation of
these recipes, which she
simply named: “Neri’s
Menu”.
Like most passionate cooks,
Neri prefers to use all natural
ingredients and shuns using
additives. One of her quick
fixes is to make broth from
fresh organic chickens, which
she then stores in the freezer in
several portions. She uses the
broth for a lot of dishes,
including Thai chicken
noodles in soup using fresh
ingredients, or a flavorful
minestrone soup.
But Neri does not only
specialize in savoury dishes,
she is also a very good
baker. One of her specialties
is pavlova, which many
people swear is “to die for”,
with its perfectly crunchy light
meringue, topped with fresh
cream and fruits. She shares
the recipe on this page.
Neri is also known for her
one-of-a-kind Spanish bread,
which is one of bestsellers in
her own bakery back in her
hometown of Malolos,
Bulacan. But Gloria’s Bakery
is most famous for its
specialty cake called “inipit”.
These are small, rectangular
sponge cakes sprinkled with
sugar sandwiched in a sweet
hint of citrus aroma flavored
with “dayap” or lime rind
filling.
Neri quips, “Yung filling ng
inipit ay secret recipe namin
yan dahil kami lang ang may
ganyang lasa.” (The filling
for the inipit is from our secret
recipe, that’s why only we can
come up with that taste).
She says her sister, who is
managing the bakery, has
been urging her return to the
Philippines because their
products are selling so well
they can no longer cope with
the demand. According to
Neri, their bakery is already
getting more than 20 orders of
boxed inipit each day.
But Neri has to be
persuaded some more, as she
is still enjoying her stay in
Hong Kong, especially the
basketball games her FBA
group organizes on a regular
basis. Still, it makes her happy
and confident that if and when
she decides to go home for
good, she can still wear her
chef’s coat and do what she
truly loves.

OFWs in Canada face uncertain future over twin policy changes

amendments, employers were
allowed to hire caregivers
under two categories starting
Dec. 1 last year: those who
look after children, and those
who care for the elderly or
with high medical needs.
The caregivers can apply for
permanent residency under the
category for which they were
hired. However, a cap of 2,750
applicants per year has been
imposed for each category,
which means not everyone will
be able to acquire the soughtafter status.
This contrasts sharply with
the decades-old former
program, where caregivers
had a guaranteed pathway to
permanent residency after two
years of work.
Beboso sees this as the
government’s way to restrict
the entry of caregivers into the
country. “What we are seeing
more and more now is a move
to temporariness,” she said.
She also rues the lack of
consultation and the haste with
which Canada imposed the
sweeping changes.
In reaction, Migrante
Canada has launched an
information drive about the
twin policy changes, and is
now supporting an online
campaign to stop the mass
deportation of the temporary
workers.
“If these workers are good
enough to work, then they are
good enough to stay”, she said.
Media reports in Canada
show many business owners
are also opposed to the TFWP
reforms, calling them a “kneejerk reaction” to isolated cases

consulate and the Hong Kong

More than 100 people who
packed the conference hall
listened intently as Cynthia
Tellez, general manager of the
Mission for Migrant Workers,
spoke about the two-week rule
that gave domestic helpers just
14 days to stay in Hong Kong
after their contract ended, and
the live-out option for helpers.
She said the removal of the
live-out option since 2003 was
against the ILO Convention as
it exposes the women workers
to risks of abuse in their
employers’ home. She also hit
the discriminatory “W” and
“FW” codes on migrant
workers’ ID cards that identify
them as domestic workers.
Among the issues with the
Philippine government that
Tellez brought up were
overcharging and illegal
placement
fees,
illegal
lending, and conciliation
meetings that are being held at
the POLO offices despite the
practice being illegal.

chairperson of UNIFILMigrante, hit the Philippine
government for failing to
punish recruitment agencies
that continue to charge illegal
recruitment fees.

victimized

illegal
recruiters. They are lured by
promises of bigger salaries

of Filipinas who fell victims to
recruiters.
She pointed out the apparent
collusion between Manila-
based recruiters and their
Hong Kong counterparts in
overcharging applicants and
setting them up for bogus
loans to pay the agencies.

Roldan, who accredited nearly
100 new agencies to recruit
Filipino workers despite an

defendant, Jennet A. Barcia,
hit him and caused his bruises.
Barcia was arrested on Oct.
29 and has subsequently
pleaded not guilty to the
charge.
At the start of the trial,
Magistrate Jason Wan Siuming put the prosecution
under pressure when he
rejected a medical report that
was signed by the doctor who
examined the child but did not
have a sworn declaration as
required by the court.
“I don’t criticize anybody,
but this is the second time that
somebody is charged with
assault and that kind of
medical report is rejected,” he
said.
Wan then advised the child
by video about the interview
session with the defense
lawyer. The prosecutor had
earlier interviewed the boy in a
court backroom.
The interview by the
defense counsel, barrister
Vandana Rajwani, took more
than two hours as she skillfully
persuaded the boy to answer
all her questions without
boring him.
It was learned that the boy
slept in a room with a threedeck bed. His sister used the
top deck, he occupied the
middle part and the helper, the
lowest.
The boy admitted that
Barcia would play with him
and read him stories before he
went to sleep. “When you get
hurt, does she carry you and
clean you and tell you that she
loves you very much?”
Rajwani asked the boy.
“Yes,” he replied.
“Did kongyan Che-che hit
you?”
“No.”
Surprised by the boy’s
answer, the prosecutor sought
permission to query the boy
again. “This morning you said
kongyan Che-che hit. Now,
when the defense lawyer asked
you if kongyan Che-he didn’t
hurt you, you said ‘Yes’,” she
said.
“Did kongyan Che-che hit
you once?” the prosecutor
asked again.
“Yes,” the boy answered.

policewoman who arrested
Barcia on the evening of Oct.
29, was asked by the
magistrate why she did not
state in the admitted facts that
she did not caution the
defendant immediately after
the arrest.
The officer, who took the
witness stand for the
prosecution, said she just
wrote down what Barcia said
and did not remember to
caution her immediately”.
The defense lawyer asked
the officer about a statement in
the penultimate line of the
report copy in which the
victim was quoted as saying
“when sister hit the window
sill, accidentally hit the…”
The officer said she
believed something was
missing and that the phrase
should be “accidentally hit the
bottom of the window sill”.
She also confirmed that it
was the boy who said “When
sister hit me, it happened
accidentally hit the window
near my bed”.
At this point the defense
lawyer said she asked for
clarification of the missing
lines on Feb. 18 but did not
receive it from the police.
Magistrate Wan adjourned
the trial to Apr 17 so all parties
could look at the original entry
in the notebook.
‘Live-out’ DH on bail, employer faces arrest

A Filipina domestic worker
who had been arrested for
staying outside her contractual
address was allowed by a
Shatin court to post bail on
Mar. 16 while prosecutors said
they expected her employer to
be arrested soon.
Diana S. Segui, who was in
the custody of the Hong Kong
Immigration Department since
her arrest on June 5 last year,
appeared in court for her bail
application. Segui returned to
court a month after she
pleaded not guilty to a charge
of making false representation
to an immigration officer by
stating in her contract that she
would be living in the house of
her employer.
The prosecution lawyer
applied for an adjournment of
the case until April 13, saying
that the defendant had made a
non-prejudicial statement to
the immigration authorities
implicating her employer.
The
prosecutor
told
Magistrate Cheung Kit-yee
that the employer was now
“pending interception”.
“Should the employer be
charged as soon as possible,
the date would be brought up,”
the prosecutor said.
The defense lawyer said
Segui was willing to put up
$1,000 as bail. She also
pledged to report to the Mong
Kok police station everyday.
Segui’s lawyer added that
the
defendant’s
travel
document was being held by
the immigration department.
Magistrate
Cheung
adjourned the hearing until
April 15 and granted the
defendant’s application for a
$1,000 bail and to reside at the
Yau Ma Tei address Tei that
she had given in her
application.
When the case was first
heard in the court for mention
on Feb. 17, the defendant
pleaded not guilty to the
charge.

DH gets suspended sentence, boss jailed 8 weeks over illegal inn
A Filipina domestic worker
who admitted to managing an
unlicensed guesthouse walked
out free from Eastern Court on
Mar 19 after getting a twoweek suspended jail sentence
and a fine of $2,000.
But Susan L. Plantig’s
employer who operated the
guesthouse at Causeway Bay
Mansion, was jailed for eight
weeks and ordered to pay a
fine of $10,000.
The employer, Manila-born
Johnson H. Kung was said to
have committed more serious
offences by operating the
illegal inn and aiding and
abetting the maid’s violation
of immigration rules.
Magistrate Lee Siu-ho also
said that Plantig “did not have
much choice on the matter” as
she felt compelled to obey
Kung.
Lee added that since the 38year-old single mother’s
capability to work in Hong
Kong had been affected by her
conviction, the consequences
were severe enough.
The court was told that
Plantig was her family’s
breadwinner,
and
was
supportingthe medical needs
of her 15-year-old son who has
a heart problem
As for Kung, the magistrate
said: “Due to the fact that you
instructed your domestic
helper to commit the offense
and that she had no choice to
refuse your order … I think the
appropriate course to take is to
impose
an
immediate
custodial sentence.”
Kung and Plantig were
arrested on June 30 last year
by immigration agents who
posed as tourists and booked a
room for two nights at the

This prompted Cheang to
send the case to another court
which reset the hearing to May
5 so Juan will have enough
time to get help under the duty
lawyer scheme.

theft for allegedly stealing the
Octopus card of her
employer’s daughter. The
alleged victim, a secondary
school student, is said to be
preparing to take the HKDSE
next month so could not testify
at an earlier date.

of cosmetics items from a
Watsons store in Central.
Rachel E. Avarecio, 29, is
accused of stealing a box of
bandage strips, a jar of scar
remover, a jar of mentholatum
gel, and two boxes of hair dye
at a Watsons store in Central.
Magistrate Wan adjourned
the hearing of the case to Apr
17 at the request of the
prosecution and extended

to four charges of stealing
$65,000 in various currencies
and a luxury watch from her
employer’s household in Tsing
Yi.
The defense counsel said in
mitigation that the maid
committed the offenses
because a Filipina friend from
whom
she
borrowed
Php150,000 for her job
placement fee had been
badgering her about the loan.

by a Tagalog interpreter at a
Tsuen Wan court.
According to the admitted
facts, the 44-year-old mother
of two began stealing from her

stealing 8,500 yuan in

US$100 and 4,900 yuan.
Then sometime in January,
Buen took a Rolex watch
worth $27,000 that the
employer used to put on the
television top.
On Feb. 6, the employer
noticed that the US$2,000 was
gone from the bedroom
drawer where she had been
keeping it.\.
That
prompted
the
household members to check
their valuables. The employer
noticed that her watch had
gone missing while the
employer’s mother said she
lost 4,900 yuan and a US$100
bill that she had been keeping
in her wallet. The grandmother
also said she lost 8,500 yuan
that was in her bag.
Police officers were called
and they searched the
belongings of Bueno for the
missing items. They did not
recover any of the cash but
found a pawnshop receipt
issued on Jan. 4 for the stolen
Rolex watch, which Buen had
pawned for just $1,000.
“Defendant,
you
are
convicted of the four charges
on your own admission,”
Magistrate Debbie Ng Chungyee said.
In mitigation, the defense

cancer.
Buen first came to Hong
Kong in 2008, and served two
families until 2011. She
returned in June last year to
work for her employer at Villa
Esplanade in Tsing Yi.
To pay for her agency fee,
she borrowed money from a
friend
who
lent
her
Php150,000 to be paid in 18
monthly installments of
$2,000 including a 25%
interest.
When her friend’s Japanese
husband learned about the
loan, he reportedly got furious
and attacked his wife. That
prompted Buen’s friend to
double the monthy repayment
to settle the loan sooner.
Magistrate Ng gave due
consideration to Buen’s plight
but said the maid had
committed a serious offense.
“Theft against your employer
is a serious breach of trust,
more so because you did it
four times,” she said.
Ng also noted that the stolen
money estimated at $64,518
was not recovered by the
victims and they still have to
pay the pawnshop $1,000 to
regain the watch.
The magistrate meted Buen
concurrent sentences of 12
months in jail for the first
charge, 8 months for the
second, 6 months for the third
and 9 for the fourth but all to
be discounted by one-third for
her guilty plea.
Ng also gave Buen a further
discount of one month in
consideration of her situation,
thus shortening her jail term to
7 months.
