Ds’ Chapter 13 plan was confirmed on May 28, 2014 and provided for surrender of
rental real estate located at 7118 Reeds Road, Overland Park, Johnson County, KS
66204 to secured creditor Wells Fargo. Foreclosure proceedings have not been
initiated by Wells Fargo to date.
After confirmation, Ds entered into a contract with a realtor to list and sell the
rental real estate. Realtor was successful in finding a buyer who has agreed to pay
$90,000.00 cash for the property.
It is anticipated that there will be excess proceeds of approximately $7,630.00 at
sale closing. Ds have incurred attorney fees and expenses of $600.00 for postpetition legal services required to obtain this Court’s approval of the employment
of realtor and the proposed terms of the sale of the rental property on an expedited
basis and this motion to retain. Counsel requests that these fees be paid directly to
counsel by the title company from the excess settlement proceeds.
TTE's objection: **Non-exempt rental property liquidated** The Trustee objects
to the Motion to Retain Net Proceeds from Sale of Rental Real Estate as these
funds represent non-exempt equity. The proceeds (approximately $7630) should be
paid over to the Trustee and paid to the priority creditors.

I’ll give you a little more
information on what’s going on. Debtors had been paying their own insurance on the home. There was
a lapse from Jan-March 2014 so Nationstar paid the whole year of insurance and added escrow to the
mortgage payments. Meanwhile Debtors continued to pay their own insurance. So they paid double
insurance for all of 2014, except Jan-March. We’re trying to get Nationstar to cancel the escrow for
2015 so this doesn’t happen again, and also sort out who owes who money now…
