Answer: STEINBERG & ASSOCIATES COMPANY PROFILE After retiring from the U.S. Army Corps of Engineers in April 1992 with over 35 years of Government service, 12 of which as a Senior Executive at Corps Headquarters, Dr. Bory Steinberg and his wife Naomi Kogon-Steinberg, a former corporate lawyer and MBA, established Steinberg & Associates, a consulting firm specializing in water resources issues, environmental restoration, infrastructure and intergovernmental relations. The focus of the firm’s work is in assisting non-Federal sponsors of Corps of Engineers Civil Works projects and studies in achieving their objectives. In February 2009, Mr. Richard Worthington joined the firm upon his retirement from the Corps of Engineers. This has significantly enhanced Steinberg & Associates’ capabilities in the areas of Corps of Engineers planning and policy. At the present time, Steinberg & Associates represent a number of non-Federal water resources project sponsors in the processing and approval of feasibility reports, General Reevaluation Reports, authorization of projects in Water Resources Development Acts (WRDAs), funding of Studies and Projects in Annual Appropriations Acts, Preconstruction Engineering and Design (PED) Cost Sharing Agreements, Project Cost Sharing Agreements (PCA's), Credit/Reimbursement Agreements and more. In addition, working on behalf of our clients, we have assisted them in getting favorable resolution of policy issues, report approvals, the signing of numerous Project Cooperation Agreements (PCAs), Project Partnership Agreements (PPAs) and changes in legislation to achieve their objectives. 2 Key Personnel for Broward County Matters: Dr. Bory Steinberg – Principal DR. BORY STEINBERG is the confounder of Steinberg & Associates, a consulting firm assisting local sponsors of water resources projects such as ports, flood control agencies, and other water resources organizations, on harbor improvements, dredging issues, confined disposal facilities, beach restoration and nourishment, flood control issues and environmental restoration projects. The firm was established in April 1992, after his retirement from 35 years service in the U.S. Army Corps of Engineers. While in the Corps, Dr. Steinberg served at Corps Headquarters as Chief of the Project Management Division from 1989 to 1992, Chief of the Policy, Review, and Initiatives Division from 1985 to 1989 and Chief of Programs Division from 1980 to 1985. One of Dr. Steinberg’s career highlights was his assignment in Israel in 1979-1980 as part of the Camp David Peace Accord when the U.S. Army Corps of Engineers was assigned the task of constructing two airbases for Israel in lieu of the bases that Israel had to vacate in the Sinai Desert. As Chief, Planning and Coordination Office, Tel-Aviv, Dr. Steinberg played a critical role in the construction of these air bases which were completed by the Corps in two and a half years when experts in the engineering community said it would take six years. He developed and managed the implementation of a state-of-the-art management information system, integrating design, procurement and construction, crucial to the successful completion of this fast-track air base construction project. Steinberg & Associates has been advising clients and assisting them in resolving issues on partnership projects with the Corps and matters related to legislation, policies and their interpretation. Services provided include assistance with Project Cooperation Agreements (PCAs), Project Partnership Agreements (PPAs), the preparation of a number of key reports, draft legislation and correspondence with the Corps, the Assistant Secretary of the Army for Civil Works (ASA(CW)), other Federal agencies, and Congress. The objective of the firm has been to come up with solutions that the Federal Government can accept and, at the same time, meet the client's needs. Steinberg & Associates has developed unique capability in successfully implementing projects by non-Federal sponsors pursuant to legislation in Water Resources Development Acts (WRDAs) including some that are rarely used. Dr. Steinberg received a B.S. in Civil Engineering from Rutgers University, an M.S. in Public Financial Management and a Doctorate in Public Administration from The George Washington University. He is an active member of the American Association of Port 3 Authorities, the International Association of Ports and Harbors and the Army Engineer Association. Dr. Steinberg was recently awarded the American Association of Port Authorities (AAPA)'s Distinguished Service Award. Naomi Kogon-Steinberg – Principal Ms. Naomi Kogon-Steinberg is the confounder of Steinberg & Associates, a consulting firm assisting local sponsors of water resources projects such as flood control agencies, ports and other water resources agencies, on flood control issues, environmental restoration projects, harbor improvements, dredging issues, confined disposal facilities and beach restoration and nourishment. Prior to coming to the U.S., Ms. Kogon-Steinberg was, among other things, legal counsel to Koor Industries, the largest industrial conglomerate in Israel. One of her career highlights was her involvement in 1979-1980 in the $1.04 Billion Negev Airbase Project which was part of the Camp David Peace Accord. She was assigned by the Israeli Ministry of Defense to the position of Internal Controller where she had to ensure that the project was proceeding within the budget. This position lead her to be involved with the various contractors and the U.S. Army Corps of Engineers which was in charge of the construction of the two air bases. Ms. Kogon-Steinberg has an LL.B in Law from the Hebrew University in Jerusalem, Israel and an MBA from INSEAD, the European Institute of Business Administration in Fontainebleau, France. She is an active member of various professional associations such as the American Association of Port Authorities (AAPA) and the International Association of Ports and Harbors (IAPH) where she co-chairs the Long Range Planning & Review Committee, is the Founding Chair of the IAPH Women’s Forum and the initiator and founder of the newly established Cruise Committee. 4 Rich Worthington –Associate Mr. Rich Worthington has forty-five years of successful experience in planning and implementing water resources and port projects in partnership with the U.S. Army Corps of Engineers and local governments, state governments, and port authorities. He has experience in all levels of the Federal project development process from individual project planning to development and implementation of National policies. Mr. Worthington spent 38-years in the U.S. Army Corps of Engineers Water Resources program primarily in project planning and policy development and execution. He held planning and policy positions in the Pittsburgh District (1970-1978), Seattle District ((19781980), the Board of Engineers for Rivers and Harbors (1980-1988), and the Corps Headquarters (2001-2009). While at the Corps Headquarters, Mr. Worthington spent a year as a fellow on the staff of Senator George Voinovich of Ohio working on the Water Resources Development Act of 2000. Mr. Worthington ended his Corps of Engineers career in the Corps Headquarters as senior policy advisor for navigation. In 2009 Mr. Worthington joined Steinberg & Associates. Steinberg & Associates provides services to Port Authorities and other non-Federal government agencies that are partnering with the Corps of Engineers on navigation, flood risk reduction, environmental restoration, beach restoration, and other water resources studies and projects. The work involves providing assistance in the processing and approval of feasibility studies and other decision documents, resolution of policy issues, securing legislative modifications to projects, authorization and funding of projects, negotiation and approval of cost sharing and crediting agreements, and other services. Mr. Worthington earned a Bachelor of Science degree in Forest Management from Pennsylvania State University in 1968. He is an associate member of the American Association of Port Authorities and is active in the Harbors and Navigation Committee. 5 2. Answer: Contract 1. a) Client Name: Port Freeport, Texas b) Description of work performed: The principle Corps of Engineer activities during the period that Steinberg & Associates have been under contract with Port Freeport are: (1) a feasibility study to examine channel improvements alternatives at Port Freeport and recommend a plan of improvement for Congressional authorization; (2) a request to the Assistant Secretary of the Army (Civil Works) to assume Federal maintenance under authority of Section 204 (f) of the Water Resources Development Act of 1986 for a channel widening to be constructed by non-Federal interests; (3) preconstruction engineering and design activities that are currently ongoing to complete a General Re-evaluation Report to seek approval of modifications to the authorized channel improvement project and initiate design of the first increment of the project; and (4) annual Federal operation and maintenance activities. The work performed includes the following: * Facilitating the coordination and collaboration with the Corps of Engineers at the District, Division, and Headquarters level to assure communications are maintained and issues of funding, schedules, application of policies, agreements, and other matters are resolved in a timely manner. * Participating in study milestone and issue resolution meetings and assisting Port Freeport in identifying issues to be resolved at these meeting and preparing materials to assist in issue resolutions. * Assisting Port Freeport in identifying Corps of Engineers legislative authorities and Corps of Engineers policies that provide opportunities for study and project acceleration including but not limited to advanced funding, work-in-kind for credit, and contributed funds. * Assisting Port Freeport in the review of reports, schedules, agreements and other Corps of Engineers study and project documents. * Preparing letters, information papers, options papers, agreements, and other documents related to the Corps of Engineers studies and project. 6 * Assisting Port Freeport in advocating for Federal funding with the Corps of Engineers, Assistant Secretary of the Army (Civil Works), and Office of Management and Budget. The most significant results of the services performed are as follows: * Corps of Engineers completion of a feasibility study recommending channel improvements for Port Freeport and resulting in a Report of the Chief of Engineers dated January 7, 2013, recommending Congressional authorization of the channel improvement project. * Congressional authorization of the Freeport Harbor Channel Improvement Project in the Water Resources Reform and Development Act of 2014. * Federal funding for preconstruction engineering and design for the channel improvement project in Fiscal Year 2014 and 2015. * Assistant Secretary of the Army (Civil Works) approval of Federal maintenance of channel widening to be constructed by non-Federal interests with execution of a Memorandum of Agreement for Federal maintenance between the Corps of Engineers and Port Freeport on , * Adequate operation and maintenance funding for Freeport Harbor during the duration of the contract. Contract 2 a) Client name - Maryland Port Administration, MPA (Port of Baltimore), but the actual contract is with the Maryland Environmental Services (MES). 7 b) Description of work performed. During the period of the contract with the Maryland Port Administration (MPA) the principle Corps of Engineers activities have been related to the provision of dredged material placement for operation and maintenance dredging of the Baltimore Harbor and Channels Project and the Delaware River to Chesapeake Bay project and approach channels including environmentally beneficial dredged material placement, Corps of Engineers activities during the contract period included: (1) three feasibility studies seeking Congressional authorization of projects for island restoration in Chesapeake Bay using operation and maintenance dredged material; (2) two decision document and user fee memorandum of agreements for placement of dredged material in confined disposal facilities constructed by MPA and made available for placement of Federal dredged material under the terms of a user fee agreements; (3) a Limited Re-evaluation Report seeking Congressional authorization of a revised cost estimate for the Poplar Island project and project expansion; (4) a General Re-evaluation Report to examine the economic justification and environmental acceptability of authorized but unconstructed widening features of the Baltimore Harbor and Channels Project; and (5) annual Federal construction and operation and maintenance activities. The work performed included the same activities listed for Port Freeport. MPA activities also included working with MPA’s Congressional advocates to obtain legislation addressing issues of critical importance to MPA. c) Approximate per month average contract value - $6,000 d) Dates covering the terms of the contract. The initial contract was executed in 1994. The current contract was executed in 2011 and extends until June 2015. The most significant results of the services performed are : * Congressional authorization of the Poplar Island, Maryland project in the Water Resources Development Act of 1996. The project consists of restoration of an island in the Chesapeake Bay using material dredged from Federal navigation projects. * Execution of a Project Cooperation Agreement (PCA) between the Corps of Engineers and the State of Maryland for construction of the Poplar island project in April 1997. 8 * Congressional authorization in the Water Resources Development Act of 2000 that the non-Federal share of the Poplar Island project may be provided in in-kind services and materials. The PCA for the project was modified to include this provision. * Congressional authorization of the expanded Poplar Island Project in the Water Resources Development Act of 2007. * Execution of a User Fee Memorandum of Agreement for placement of Federal dredged material in the Cox Creek Placement Area constructed by the MPA and payment of a Federal user fee. * Congressional authorization of the Mid–Chesapeake Bay Island project in the Water Resources Reform and Development Act of 2014 (WRDDA 14). The project consists of restoring of two islands in the Chesapeake Bay using dredged material. * Clarification in WRRDA 14 that the non-Federal share of the Poplar Island expansion is 25 percent. * Congressional authorization in WRRDA of a higher cost estimate for the Poplar Island project based on a Limited Re-evaluation Report prepared by the Corps of Engineers and sent to Congress. * Provision in WRRDA 2014 that will allow the Assistant Secretary of the Army (Civil Works) to approve Federal assumption of maintenance for channel improvements constructed by MPA. * Federal funding in FY 2014 and FY 2015 for the General Re-Evaluation Report for the remaining authorized (but not constructed), widening of the Baltimore Harbor and Channels 50 ft. Project, previously constructed following WRDA 1986. * Adequate construction funding for Poplar Island project and adequate operation and maintenance funding for Baltimore Harbor and Channels and Chesapeake and Delaware Canal and approach channels during the duration of the contract. 3. Describe the firm’s understanding of, and experience with, major port dredging and beach nourishment projects and what unique quality the firm can provide which makes the firm different than other potential proposers. Answer: Major Port Dredging: The information provided in (2) above details our experience in major port dredging and dredged material placement for Port Freeport, Texas and the Port of Baltimore, Maryland. In addition, we are currently assisting the Port of Cleveland in working with the Corps of Engineers in dredged material management planning. The Port of Cleveland is pursuing plans to provide dredged material placement capacity to the Corps under the terms of a user fee agreement. We have recently worked with the Port of Pascagoula on an assumption of Federal maintenance proposal for a proposed non-Federally constructed channel widening and dredged material placement matters. We have worked in the past with Port Everglades, Port Canaveral (for 17 years), Port of Los Angeles and the Port of Corpus Christi through HDR, Inc. on major port dredging issues and the Corps of Engineers program. Beach Nourishment: We have extensive experience in working with Ports and local government agencies on beach nourishment as follows. * Broward County Beaches - We worked with Broward County on the implementation and funding of the Phase III Broward County Beach Federal project and the negotiation and execution of a reimbursement agreement with the Corps of Engineers for the project. We also assisted Broward County in obtaining Congressional authorization for credit for certain mitigation feature not included in the reimbursement agreement. * Placement of Port Everglades Maintenance Material on Broward County Beaches We worked with the Corps of Engineers , Port Everglades and Broward County to negotiate a contributed funds agreement for placement of beach quality sand from the Federal maintenance of Port Everglades on Broward County Beaches. 10 * Sand Bypassing at Port Canaveral - There was a major issue of beach erosion on Brevard County Beaches resulting from the lack of sand bypassing around the jettied entrance to Port Canaveral. Steinberg and associates worked with Port Canaveral and the Corps of Engineers to obtain authorization and funding to implement sand bypassing. Then unique qualities that Steinberg & Associates bring to each of these projects and issues is the extensive and detailed knowledge of the Corps of Engineers, programs, processes, and policies and the relationships with Corps of Engineers personnel including the Corps leadership established over years of working together both within the Corps and as consultants. 5.
