March 17, 2015 Thailand - MOI Provides Exemptions for GHS and Transport Registration for Certain Chemicals The Thai Ministry of Industry (MOI) published in the Government Gazette on 19 February 2015 a Notification on the Exemption of Rules Regarding the Act on Hazardous Substances 1992 List 5.6 under Supervision of the Ministry of Industry B.E. 2558 (Exemption Notification). The Exemption Notification exempts importers, exporters and manufacturers of substances on List 5.6 from: 1) the GHS classification and labeling (as required by Notification of MOI on Hazard Classification and Communication System of Hazardous Substances B.E. 2555 (2012)); 2) registration of vehicles transporting chemical substances (as required by Notification of MOI on Land Transportation of Hazardous Substance B.E. 2547 (2004)); 3) designation of a person responsible for safe storage of chemicals (as required by Notification of MOI on Designation of a Specialized Person Responsible for Safety of Hazardous Substance Storage under Authorization of Department of Industrial Works at the Hazardous Substance Business Facility B.E. 2551 (2008)). Substances on List 5.6 are Type 1 chemicals with the following properties: explosive, flammable, oxidizing agent or peroxide, toxic, mutagen, corrosive, irritant, carcinogen, toxic to reproductive organ, or environmentally hazardous. The MOI Notification regarding the List of Hazardous Substances B.E. 2556, as amended by the MOI Notification regarding the List of Hazardous Substances (No. 2) B.E. 2558, includes lists of chemicals that have been classified into Types 1-4. Chemicals under each Type are subject to different requirements as specified by the various authorities, including the MOI. The Exemption Notification took effect on 20 February 2015, the day following the publication date in the Government Gazette.
