Dykstra - On March 19, 2015 Village staff contacted Embassy Construction to inform them the Building Permit was ready to be picked up, and would be issued once all fees were paid. These fees included the following impact fees: Sewer Impact Fee in the amount of $2, 520. 00 Water Impact Fee in the amount of $2, 706. 00 Park Impact Fee in the amount of $2, 136. 00 Fire Impact Fee in the amount of $ 1, 547. 00 On March 20, 2015 the Dykstra' s contacted Village Staff and questioned the imposition of the Sewer and Water Impact Fees. Village Staff informed the Dykstra' s, that per the municipal code, the building permit could not be issued until all impact fees were paid. On March 22, 2015 the Dykstra' s sent an email to Trustees Raymonds and Helm requesting the consider waiving the sewer and water fees. In this request, the Dykstra' s stated they paid over $ 23, 000 for a mound system and well, and " were under the assumption that we would not Village have to pay these two fees as they are not applicable for our situation". On March 24, 2015 Embassy Construction submitted a check from Troy and Nicole Dykstra for all applicable fees, and picked up the building permit for the home. ORDINANCE Section 42- 156 of the municipal code states " Any developer or property owner upon whom an impact fee has been imposed may contest the amount, collection or use of the impact fee by filing a notice of appeal to the village board." According to subsection ( c) of this same section, the appropriate department head shall submit a written report and recommendation to the village manager. The village manager " shall review this report and make a written recommendation to the village board", and within 45 days of the village managers recommendation, the village board shall " adopt a resolution denying, approving or approving in part the appeal" ANALYSIS Although the proposed home would be approximately 1 mile from the nearest sewer and water mains, the subject home is located in the Fox River Basin, and these utilities are located in the Lake Michigan Basin. The extension of these utilities into the Fox River Basin would require approval of all the State and Provinces abutting the Great Lakes. The nearest water main within the Fox River Basin is approximately 3. 25 miles away, and the nearest sewer main in the Fox River Basin is approximately 1 mile away in the Village of Lannon. It is unlikely municipal sewer or water utilities will be able to serve this property within 10 years. RECOMMENDATION Per our meeting with Mark Fitzgerald on March 27, 2015, it was determined this item would be placed on the April 6, 2015 Utilities and Public Works Committee agenda for discussion. I recommend, at the discretion of Mark Fitzgerald, one of us draft the required " written report and recommendation to the village manager" taking into account the discussion with the Utilities Public Works Committee. This report can be submitted to the Village Manager shortly after the April 6t" Committee meeting, allowing time for the Village Manager to prepare a recommendation for the Utilities and Public Works Committee and Village Board of Trustees to consider at their meeting on April 20, 2015. The Reconstruction will consist of the removal and replacement of all the existing asphalt pavement, concrete curb, gutter and concrete driveway approaches from approximately Appleton Avenue to Grand Avenue. The condition of Pershing Avenue has reached a level in which routine maintenance was no longer an option in providing a structurally sound roadway. A copy of the bid tabulation is attached to this memo. FISCAL NOTE The Engineering Department has reviewed the submitted bids and the low bid was submitted by Stark Asphalt, Inc. for the Total Base Bid in the amount of $219,434. 35. The Engineers Estimate for this project was $ 225, 000 for the Total Base Bid. Funding for this project was included in the 2015 Capital Budget Approved on March 16, 2015. Since the borrowing for the 2015 Capital Budget has not taken place, it is the Village' s intent to reimburse itself from funds to be secured as part of a future borrowing to fund this Project. This budget amount includes the actual cost of construction of the project, as well as estimated project administration, inspection and contingency costs. RECOMMENDATION The Engineering Department recommends that the Village award the project to Stark Asphalt, Inc. in the amount of $219, 434. 35 with funds to come from the 2015 Capital Budget that was approved by the Village Board with a Declaration of Intent to Reimburse on file. Additionally, the project will also be removing certain sections of asphalt pavement around the Village Hall Campus area too. The second part is the placing of a Black Boiler Slag Aggregate on existing Village streets to seal the existing roadway. Black Boiler Slag is applied by using a thin layer of heated oil sprayed over the entire roadway followed up with small boiler slag aggregate that is rolled into the oil. This is a very economical surface treatment that prolongs the life of our streets by reducing the pavement deterioration caused by weathering. Timely and preventative maintenance like this prevents costly street reconstruction projects in the future. A copy of the bid tabulation is attached to this memo. FISCAL NOTE The Engineering Department has reviewed the submitted bids and the low bid was submitted by Stark Asphalt, Inc. for the Total Base Bid in the amount of $461, 206. 70. The Engineers Estimate for this project was $ 450, 000 for the Total Base Bid. There is $ 600, 000 allocated in the 2015 DPW Operating Budget for this project and for the 2015 Asphalt Paving program. The $ 461, 206. 70 will be paid for from the $ 600, 000 in the 2015 DPW Operating Budget with the remaining $ 138, 793. 30 being allocated to the 2015 Asphalt Paving Program. RECOMMENDATION The Engineering Department recommends that the Village award the project to Stark Asphalt, Inc. in the amount of $461, 206.70 with funds to come from the Street Maintenance portion of the 2015 Department of Public Works Operating Budget that was approved by the Village Board.
