How much does it cost? 1. It does not cover music in recreation and leisure centres or music in fitness facilities available in hotels, motels and other accommodation which are covered under other licence agreements.. Music is an essential part of your fitness centre and fitness and wellbeing business. This licence allows you to use music from any legal source, to keep your clients working out, feeling better and looking great. An APRA AMCOS licence meets your Copyright Act obligations and ensures the songwriters and composers who create the music are paid fairly for their work. 2. Music in fitness classes includes pre-choreographed group fitness classes, including but not limited to the fitness class index* At the start of the year depending on your class size mix, choose Tariff A or B (whichever calculation gives you the lower fee). This tariff will apply for the full year. Tariff A: $2.61 per class Tariff B: $1.57 per class for classes with 10 or fewer people AND $3.66 per class for each class with more than 10 people Background music used in your centre or in your business location on any device including music systems, radio, TVs, tablets, CDs, hard drives and cardio machines. $0.825 per year, per member of your fitness centre or business with a minimum annual fee of $192.50 Virtual fitness classes directed by a fitness instructor in a video presentation and performed using a pre-recorded medium. It does not include tuition from a live, in-class instructor and it must be made available by the fitness centre to individual users on demand. $0.11 per year, per member with a minimum fee of $55.00 Member: someone who has an agreement with you to use your facilities. 3. 4. For your first Licence Year, that is the first licence granted to you by APRA AMCOS, your provisional and actual fee will be based on your Centre or business’s average membership. This is calculated by adding the number of members at your commencement date to the number of members at your first anniversary and dividing that number by two. A smartphone or tablet is used for background music that is also heard in the weights area and changing rooms. The gym has 800 members. We care about ensuring the licence fees you pay are distributed in the most economical and accurate way possible. We deduct our expenses from the revenue we receive and then distribute your fees to the songwriters, composers and music publishers whose works we have licensed to you. This means for every dollar we collect, about 87 cents is returned to music creators. At around 13 per cent, our costs compare very favourably to organisations providing the same service overseas. For example, in the UK the figure is about 16 per cent and about 18.5 per cent in Germany. • Fees from background music, music on hold and copying go into royalty pools and are distributed according to data on music use from radio stations, ARIA chart placings and music video channels. • If you use a background music supplier, we have arrangements with many to pay your fees directly to the music they report to us. • Fees from fitness classes are paid 50 per cent to the makers of aerobic and fitness CDs based on survey advice from ACNielsen, and 50 per cent to our radio royalty pools. There are several different ways to get permission to play music in your fitness centre or business. APRA AMCOS Licence. Our licence is a onestop shop for the world’s repertoire of music and we believe it provides the easiest and most cost-effective way to access public performance rights to music. Background Music Supplier. If you use an authorised background music supplier to provide the music at your premises, it may be that they can also provide you with all the necessary music licences you need. Feel free to contact us to see if you are already covered. Direct Licensing. Our members may license their music directly to music users and you are free to discuss this with them. You can find more details on our website under Dealing directly with copyright owners. Re-recorded or “PPCA-Free” Music. Some music suppliers re-record popular tracks using session musicians and singers. Although the product is not the original recording, you still need our licence because the lyrics and melodies are not changed and remain represented by us. Royalty-Free Music. Some music suppliers offer recordings of music which they say is outside our repertoire and so does not need our licence. If you wish to use a “Royalty-Free” music product, please contact us and we will check whether any extra licences are needed. We’ve done the hard work for you so our licence allows you to use any commercially released music from around the world, including the music used in the fitness class types listed over the page. When do I pay? You pay when you first take out the licence, then just once a year. If your APRA AMCOS licence fee is more than $500, we will put you on quarterly payments (with no interest) or you can choose to pay once a year. Extended payment terms are available.
