Terms & Conditions - Prize Competition Participation in the "Feedback Partnershop" competition and its implementation is subject to the following provisions. 1. Subject of this agreement These terms and conditions govern participation in the "Feedback Partnershop" competition of sprd.net AG, Gießerstraße 27, 04229 Leipzig (hereinafter referred to as "Spreadshirt"). 2. Eligibility and operation of the prize competition 2.1 The competition starts on 06.05.2015 and ends on 06.06.2015 at about 12.00 clock. 2.2. Participation is open to individuals who are older than 18 years. Participants in the "Feedback Partnershop" competition must be registered with Spreadshirt as a shop operator. 2.3 A participant takes part in the competition by providing feedback on the new Spreadshirt partner shop under one of the links in the "Spreadshop Feedback Forum" (DE: sprdshirt.uservoice.com/forums/290692; EN_Europe: sprdshirt.uservoice.com/ forums / 290698; FR: sprdshirt.uservoice.com/forums/290707). To access the "Spreadshop Feedback Forum" participants must enter their e-mail address and name. Entry of the name is optional. Instead of the name a pseudonym can also be entered. 2.4 All participants in the "Feedback Partnershop" competition have the chance to win an IPad Air 2 (64 GB) valued at approx. € 589.00. 2.5. Participation in the competition and presentation of the prize are free of charge for participants. 3. Procedure 3.1 The winner will be promptly notified after the end of the competition by an e-mail to the indicated email address requesting confirmation of the acceptance of the prize as well as details of the relevant postal address. After the winner has confirmed acceptance of the prize and provided his or her postal address the prize will be shipped. 3.2 If the winner does not confirm acceptance of the prize within a period of 14 days the prize will be forfeited. If the indicated contact data is not correct (e.g. invalid email address) Spreadshirt will be under no obligation to identify the correct address. The disadvantages resulting from provision of incorrect contact information will be borne by the participants. 3.3 Payment of the value of the prize in cash is not possible. 3.4 The participant may waive acceptance of the prize. Warranty disclaimer Spreadshirt expressly points out that the availability and functionality of the competition cannot be guaranteed. Due to external circumstances or constraints the competition may be wholly or partially terminated or modified in its implementation, even without meeting specific deadlines. This will not lead to any claims against Spreadshirt on the part of participants. Such termination may be for technical reasons (e.g. a computer virus, tampering or defective software or hardware) which interfere with the proper operation of the competition. 5. Liability 5.1 The liability of Spreadshirt will be governed by the applicable statutory provisions, unless otherwise specified in this agreement. Spreadshirt will be liable for damages, regardless of the legal reason, in the event of malicious intent and gross negligence. In the case of simple negligence Spreadshirt will be liable only for damages resulting from injury to life, limb or health, and for breach of a material contractual obligation (an obligation which allows for the proper conduct of the competition in the first place and on which the contractual partner can as a rule rely); in the latter case the liability of Spreadshirt will be limited to compensation for the foreseeable damage which typically occurs in such cases. 5.2 To the extent that the liability of Spreadshirt is excluded or limited in this agreement, this also applies to the personal liability of employees, workers, representatives and agents of Spreadshirt. 6. Your email address and optionally your name will be recorded for the purpose of the design and implementation of the prize competition. Entry of your name is optional. Instead of the name a pseudonym can also be entered. Your data will not be disclosed to third parties. You can at any time, in writing or text form, request Spreadshirt to provide you free of charge with information about the personal data stored by you at Spreadshirt. In addition you can, if there are statutory provisions for this, request the correction, blocking or deletion of your data.
