DESIGN A DRESS COMPETITION TERMS AND CONDITIONS (effective 07 April 2014) Prize Details We are offering one (1) person the opportunity to have their princess dress design made for them and their doll. Please read the full terms and conditions below How to enter: Entries will be accepted via the competition webpage at http://www.disney.co.za (the “Website”) or in store at Toys R Us stores across South Africa. For online entry: Visit the competition page at http://www.disney.co.za (and log in or register with the site) and upload your dress design to the website in accordance with the instructions provided. For in store entry: Visit any Toys R Us story in South Africa and locate the designated Disney zone to pick up an entry sheet, have your child draw their design on the entry sheet, fill in your details and submit the drawing in the competition box in accordance with the instructions provided Only sketches and drawing will be accepted. Except where indicated on the entry sheet, please ensure your entry does not include any people or personal details on the front of the submission. Disney will moderate all entries and reserves the right not to accept entries which are technically unacceptable, contain inappropriate or offensive material, people, personal information on the front of the entry, where parental consent was not received or which breach any of these Terms and Conditions. Start Date: 07 April 2014, 09.00am (“Start Date & Time”) Close Date: 03 May 2014, 4.00pm (“Close Date & Time”) Winners Notified by: 09 May 2014 Acceptance Date: Residents: 12 May 2014 (” Acceptance Date”) Open to residents of South Africa only (“Resident(s)”) Age Group: You must be a parent/legal guardian aged eighteen (18) or entering or older, entering on behalf of the child aged between three(3) and ten (10) years old (the “Child”) Prize Details: For the avoidance of doubt, parent/legal guardians may assist the Child with their entry, but the drawing must be the original work of the Child. There is one (1) prize, consisting of: One (1) dress inspired by the winner’s drawing for the winner, plus a matching dress for their doll. One (1) Disney Princess Doll from Mattel (the “Prize”) Restrictions - The prize is a dress inspired by the winner’s drawing and the winner’s design may be modified in order to make it suitable for production. Prize may not be an exact replica of the winner’s drawing. - The winning dress will be made to the winner’s selected dress size (child’s sizes only) and once the winner’s parent/guardian confirms the size this cannot be changed. - Winner will be required to sign a release. - Winner will be required to take part in any publicity accompanying or resulting from this promotion, including without limitation a photo shoot of the winner wearing their design. Princess Design a Dress Competition – Terms and Conditions - April 2014 - Prize is not suitable for children under the age of five (5) years of age. Winner Selection: Following the close of the competition, all valid entries will be reviewed by a panel of judges and one (1) winner will be selected. The winning entry will be the dress which is the most inspiring that is also suitable for production. The judge’s decision is final. Prize Fulfilment: 31 May 2014. The winner will be required to participate in a prize acceptance and promotional st photo shoot, to take place at their local Toys R Us Store on or around the 31 May st 2014. In the event the winner is unavailable on the 31 May, Promoter will work with the winner to arrange a suitable time/date for the prize acceptance. Winners parent/legal guardian will be required to sign a release in respect to any photographs taken at the prize acceptance consenting to publication of the photographs and assigning all rights in the photographs to Disney. Eligibility. a. If you are entering online, you must be a registered Disney member and have an active account to enter. b. Open to Residents in the Age Group only. Not open to employees (or their immediate families) of Disney, its agencies or anyone else professionally associated with this promotion. c. Maximum one (1) entry per person unless otherwise stated. Entries via agents or third parties or use of multiple identities and email addresses are not permitted. Use of automated entries or programs is prohibited and all such entries will be disqualified. d. Only online entries via the promotion website or submitted in store will be accepted. Entries via post will not be accepted. Disney does not accept responsibility for entries which could not be submitted via handheld devices. Entries must be completed online or submitted in store by the Close Date. e. Winning entry will be subject to a verification process (“Verification Process”). This will include but not be limited to: i. Confirmation that you (a) entered the competition (b) meet the Entry Restrictions and (c) accept the prize; ii. Parent/legal guardian confirming they are the Parent of the Child who submitted the drawing; iii. Parent/legal guardian confirming their Child is the correct age and is eligible for the prize. Successful completion of the Verification Process is a condition of entry. 2. Personal Information. If you enter online, we will ask you to either submit your existing Disney username and password or to register your personal details with us. If you enter in store, you will be asked to provide your name, address and contact details. Your personal information will be used in accordance with Disney’s current published Privacy Policy and may be passed to our agents to administer the promotion, send out prizes and to enable Disney to promote the competition in any media including without limitation Disney TV, online and publishing channels. Personal information will only be used for marketing purposes if you have consented to receive future marketing from Disney (you may have already done this if you have registered your details with Disney previously or if you opt in to receive such marketing messages on the in store entry). 3. Competition Entries & Selection. a. Competition is open on the Start Date &Time closes on the Close Date &Time. b. Disney will moderate all entries and reserves the right not to accept entries which are technically unacceptable, contain inappropriate material or breach any of these terms and conditions. c. Following moderation, and where applicable, receipt of Parental consent, Disney will upload entries received online to the Disney Gallery. Publication of any entry on the Disney Gallery does not mean that Princess Design a Dress Competition – Terms and Conditions - April 2014 d. e. you have won. For the avoidance of doubt, entries received in store will not be uploaded to the Disney Gallery. Following the close of the competition, all valid entries received online and in store will be viewed by a panel of judges and a winner will be selected according to the judging criteria set out in the competition entry page. The judges shall have the sole and absolute discretion to decide on the award of each prize. By entering any competition you (and your parent or guardian if you are under 18) confirm (i) that you and they are the owner of the entry submitted, (ii) the entry does not knowingly copy or infringe the rights of any other person and (iii) Disney is permitted to reproduce and use the entry submitted by you on any media (including without limitation Disney TV, online and publishing channels) anywhere in the world and without a time limit in order to carry out the competition and select winners (which may include publishing your personal information and your entry for a public vote to select finalists or the winner and any runners-up) and for any and all related promotional purposes to promote the competition and to promote Disney 4. Production Schedules. All dates and locations relating to the Event / Prize are subject to changes. 5. Prize Confirmation & Acceptance. The winner or their parent/legal guardian will receive a confirmation message via telephone by the Notification Date and, if applicable, a subsequent follow up email (please see Internet Safety). The Promoter must receive a positive response from the Parents no later than the Acceptance Date. If a positive response is not received within such period or Promoter is unable to contact Parent(s), or a bounce back message is received, the Promoter reserves the right to select alternative Entrants in their absolute discretion and the Promoter shall have no liability in respect of the entry initially selected. If the Entrants drawn declines to/ cannot take part, a further draw will take place until the properly completed entries required are drawn and a positive response is received from the Parent. 6. Filming/Photography. The winners may be asked to consent to filming a television appearance or participating in a photo shoot in relation to the prize (“Contribution”) and in such event the winner shall consent to the recording, broadcasting and/or publication of the Contribution and the winner’s Parent or legal guardian on behalf of the winner shall assign to Disney all rights of whatsoever nature including all copyright in respect of the Contribution and grant all further consents or licences necessary to enable the fullest use of the Contribution throughout the universe in perpetuity by any and all means in any and all media, whether now known or hereafter developed, without liability or acknowledgement. 7. Prize Fulfilment. No cash or other alternative prizes are available, except that in the event of circumstances outside of its control Disney reserves the right to substitute a similar prize of equal or greater value. Prizes cannot be transferred or sold by winners unless a Parent or grandparent is entering the promotion on behalf of a child or family member. Unless otherwise stated in the prize description, winners are solely responsible for all additional costs and expenses associated with claiming the prize. Disney reserves the right to ask winners to sign a written release before awarding any prize. Disney reserves the right to request proof of identity or to verify eligibility conditions and to award any prize to the winner in person. 8. Disney’s Liability. a. For online entries: Disney cannot guarantee continuous, uninterrupted or secure access to the website and is not responsible for any disruption to the promotion or the website due to technical problems or otherwise due to events outside of its reasonable control. Entrants should access the website via a desktop device. Disney accepts no responsibility whatsoever for problems accessing the website via a handheld device. b. Disney has arranged this promotion in good faith but, to the fullest extent allowed by law, accepts no responsibility for loss or damages as a result of anyone participating in the promotion or any aspect of any prize awarded. Your legal rights as a consumer are not affected. 9. Cancellation or Disqualification. a. Disney reserves the right to disqualify late, misdirected, incomplete, corrupted, lost, illegible or invalid entries. b. Disney reserves the right to modify, suspend, cancel or terminate the promotion or extend or resume the entry period or disqualify any participant at any time without giving advance notice and will do so if it cannot be guaranteed that the promotion can be carried out fairly or correctly for technical, legal or other reasons or if Disney suspects that any person has been manipulating entries or the results, or has provided false information or has acted unethically in any other way. In the event that The Walt Disney Company Africa wishes to contact you in connection with a competition entry (including without limitation contacting the winner(s)), it will do so via an email address ending 'disney.com' or by phone (with a follow-up confirmatory message from a 'disney.com' email address). Any communication purporting to be from Disney Channel but using a different email prefix (for example, hotmail.com, yahoo.com) should be treated with suspicion and forwarded to Disney Channel customer services: [email protected]. We advise that you do not act upon or reply to any such third party correspondence unless and until you receive feedback from Disney Channel. If you have any queries or concerns regarding any correspondence purporting to be from Disney Channel please contact [email protected] 11. Publicity. Winners may be required to participate in reasonable related publicity without further payment or permission. You agree that Disney may publish first name, surname initial, age, town/city and/or likeness. 12. Winners' details. Winners' details will be published on the Disney website within 2 (two) weeks after the prize(s) are awarded. For information regarding the names of the winners (and, if applicable, their winning entries) go to the Disney Website or send a stamped and addressed envelope to the Customer Services address on the promotion entry page quoting “Winners List” and the name of the prize draw or competition. Unfortunately we are unable to return any entries sent to us by post. No purchase necessary. Disney's decision is final and we reserve the right not to correspond on any matter.
