Bids will be received by the Ms. Leanne Dawkins, City Clerk, City of Cordova at the Cordova City Hall, 3885 North Massachusetts Avenue, Cordova AL, 35550 by Friday, March 27, 2015 at 12:00 noon. Bids will be opened in the council room of the City of Cordova on Tuesday, March 31, 2015 at 12:00 noon. Time is of the essence in submitting bids and only sealed bids received in the City office by the time listed above shall be opened and considered. Bidders and any other interested individuals are invited to attend the bid opening. Prospective bidders are instructed to read the General Terms and Conditions, Special Terms and Conditions, and Bid Specifications very carefully. Bid addendums will be provided to all bidders, if necessary. Bids must be made in compliance with the guidelines in the sections referred to herein and each page initialed by the bidder representative to denote understanding of such compliance. Please place the Summary Bid Proposal Form and the individual Bid Proposal Forms in front of and separated from all other documents included in the bid packet. Bids submitted in pencil and bids not submitted on the Bid Proposal Form will not be considered. All corrections and erasures shall be initialed and dated by the bidder representative. Bids that are submitted without being signed will automatically be rejected. Bid envelopes must be sealed and must indicate clearly the appropriate bid number, bid Item and bid opening date, as indicated on the cover sheet of this bid packet. Envelopes containing a “no bid” shall also include the words, “NO BID” on the outside of the envelope. Facsimiles and emails will not be accepted. Bids submitted by “Express/Overnight” services must be in a separate inner envelope or package sealed and identified as stated above, and must be delivered prior to the bid opening time. The City will not be responsible in the event the U.S. Postal Service or any other courier system fails to deliver the proposal to the City office by the deadline stated in the bid request. Bonds - Pursuant to the Code of Alabama 1975, Section 39-2-4, all bidders shall file with his or her bid either a cashier’s check drawn on an Alabama bank or a bid bond executed by a surety company payable to City of Cordova for an amount not less than five percent of the proposed bid amount, but in no event more than ten thousand dollars ($10,000). The bid bond or security shall be retained by the City until a contract is executed, a purchase order is issued, or in some cases, until materials and/or equipment is received. Pursuant to the Code of Alabama 1975, Section 39-1-1, a performance bond from a successful bidder must be executed for 100% of the contract price before commencing the work. In addition, another bond, payable to City of Cordova shall be executed in an amount not less than 50% of the contract price, with the obligation that the contractor or contractors shall promptly make payments to all persons supplying labor, materials, or supplies for or in the prosecution of the work provided in the contract. Successful bidder must also furnish proof of liability and worker’s compensation insurance. Failure to submit any bond as required will result in rejection of the bid. Waiver of Subrogation against the City. Comprehensive General Liability Insurance, with limits of liability for bodily injury of not less than $1,000,000, any one occurrence; and for property damage of not less than $1,000,000 any one occurrence; with $1,000,000 aggregate. Such insurance shall include the following: Contractor’s Protective Liability, covering liability for work sublet. A. Contractual Liability, insuring the indemnity agreements contained in this contract. Coverage for damage due to collapse of or structure injury to any building or structure due to excavation, tunneling, pile driving, cofferdam or caisson work or dredging; to moving shoring; underpinning, raising or demolition of any building or structure or removal or rebuilding of any structural support thereof; to blasting or explosions; or to wires, conduits pipes, mains, sewers, tanks, tunnels or any other property below the surface of the ground. A Waiver of Subrogation against the City B. Comprehensive Automobile Insurance, with limits of liability for bodily injury of not less than $250,000, any one person; and $500,000, any one occurrence; and for property damage of not less than $100,000, any one occurrence. Such coverage shall include owned, hired, and non-owned vehicles. CONTRACTOR shall provide proof of all required insurance upon delivery of the executed contract with the City. Certificate of Compliance Beason-Hammons and E-Verify. All bidders shall file with their response to any RFP or other form of procurement shall complete the Certificate of Compliance with the Beason-Hammon Alabama Taxpayer And Citizen Protection Act As Amended as a condition for the award of any contract, grant, or incentive by the State of Alabama, any political subdivision thereof, or any statefunded entity to a business entity or employer that employs one or more employees within the State of Alabama. The form is included with the bid documents. Advertisement of Project Completion – The contractor shall immediately after the completion of the contract, give notice of the completion by advertisement in a newspaper of general circulation published within the county in which the work has been done for a period of four successive weeks. 5% of the contract amount shall be Page | 2 Bidder’s Initials ______________ City of Cordova Building Plans Bid Number 2015-001 (PLEASE READ AND INITIAL EACH PAGE) retained by the City of Cordova and paid to the contractor 30 days after final advertisement. Other Compliance/Legal Assurances - The City provides equal opportunities for all businesses and does not discriminate against any vendor regardless of race, sex, creed, age, disability, national origin or religion in consideration for an award. Bidders must abide by the provision of the Americans with Disabilities Act of 1990 and assure that in connection with the performance of work under this agreement that they are an equal opportunity employer and do not discriminate on the basis of race, sex, creed, age, disability, national origin or religion. All bidders must comply with applicable sections of the Alabama Competitive Bid Law, Code of Alabama 1975. The City assumes no legal liability to purchase items or services under any contract unless funds are appropriated for that particular fiscal year. The successful bidder agrees, by entering into this contract, to defend, indemnify and hold harmless the City of Cordova, its officers and employees from any and all causes of actions or claims of damages arising out of or related to bidder’s performance of this contract. Bid Prices – All bid amounts shall be submitted on the attached Bid Proposal Form. Prices quoted shall be delivered prices, exclusive of state sales taxes. The City will assume no transportation or handling charges other than specified in this bid. If there are discrepancies between unit prices quoted and extensions, the unit price will prevail. Prices quoted shall remain firm for a minimum of 60 days from the date of opening of the bid, unless so stated differently in the bid. Bid Exceptions/Deviations/Substitutions – The attached specifications are being provided to potential bidders as guidelines, which describe the type and quality of equipment, supply, and/or service that the City is seeking to purchase. The bidder must indicate compliance or list detailed exceptions to each specification item for consideration. The bidder must provide satisfactory proof that the alternative product is, in fact, equal to the product described in the specifications. Failure to comply with any part of this provision could be cause for rejection of the bid. Bid Award/Rejection – All bids will be awarded to the lowest responsive and responsible bidder on the base bid and add alternates that the City chooses to pursue. This determination may involve all or some of the following factors: price, conformity to specifications, financial ability to meet the contract, previous performance, facilities and equipment, availability of repair parts, experience, delivery promise, terms of payments, compatibility as required, other costs, and other objective and accountable factors which are reasonable. Unless Special Terms and Conditions of the bid specify otherwise, the City reserves the right to make an award in whole or part to one or more bidders whenever deemed necessary and in the best interest of the City. The City reserves the right to accept or reject any or all items covered in the request, or any portion(s) thereof, waive formalities, readvertise and/or take such other steps deemed necessary and in the best interest of the City. Bidders may be disqualified and bid proposals may be rejected for any of (but not limited to) the following causes: Failure to use the bid forms furnished by the City Lack of signature by an authorized representative on the Bid Proposal Form. Failure to properly complete the bid form. Evidence of collusion among bidders. Unauthorized alteration of the bid form. Failure to furnish bonds or security, as required. Termination for Convenience -Upon three days written notice to the CONTRACTOR, the City may, without cause and without prejudice to any other right or remedy of the City, terminate the Contract. In such case, CONTRACTOR shall be paid for (without duplication of any items); completed and acceptable work executed in accordance with the Contract Documents prior to the effective date of termination. Contractor shall not be paid on account of loss of anticipated profits or revenue or other economic loss arising out of or resulting from such termination. Rubbish and Demolition Materials – The contractor shall provide cleanup and removal of all construction debris. Page | 4 Bidder’s Initials ______________ City of Cordova Building Plans Bid Number 2015-001 (PLEASE READ AND INITIAL EACH PAGE) Scope of Project: The City of Cordova acquired the approximately 2,175 Square Foot ranch style home to serve as the business office for the Cordova Fire and Rescue Firehouse. This is the Base Bid, is an extension to be added to the rear elevation of the building that will serve as the bays for four pieces of existing fire equipment. This is represented on Sheets A1.0, A2.3, A2.4, and A4.1. This extension is designed to tie back to the roof structure of the existing building. Add Alternate 1 is represented on Sheets A3.1. It is the remodel of the front elevation that ties in the roof structure with a new entrance and a new set of steps and doorways on the front elevation. Add Alternate 2 is represented on Sheets A2.1, A2.2 and A2.3. It is the demolition and rebuilding of the interior space of the existing structure. Add Alternate 3 is represented on Sheets A3.2, and A3.3. It is the modifications to the right and left elevations that provide additional access to the interior space of the existing structure. Submittals Bidders should pay attention to all project notes on the plans. Bidders will submit one Summary Bid Proposal Form and a separate Bid Proposal Form for each Add Alternate. The project will be awarded to the bidder that submits the lowest responsive and responsible bid for the base bid and any add alternates the City chooses to construct. Any questions will be answered in writing and provided to all bidders requesting a package. Documentation Contractor must be licensed by the State of Alabama and provide a copy of such license. Contractor will be required to secure all necessary permits prior to beginning work. Within 30 days of bid award, contractor must furnish proof of liability and worker’s compensation insurance. Upon receipt of this and any other required documentation, a purchase order will be issued and work may begin.
