ELECTRONIC DISCOVERY IN FEDERAL & STATE COURT, RELATED ETHICAL ISSUES (1.0 HOUR)
This CLE will address the basics of electronic discovery, related caselaw, assessment of the evolving landscape, electronic discovery in the realm of social media, and the burgeoning matter of service of process via social media. The program will also address some ethical rules and implications that can arise from the use of social media, both in the discovery context and in researching witnesses pre-trial or juror backgrounds during voir dire.
Speaker: Michael L. Fox, Esq.
HUMAN TRAFFICKING: MODERN DAY SLAVERY & COMPLIANCE CHALLENGES (1.0 HOUR)
Human trafficking is slavery, the trade in human beings. An estimated 20 million men, women and children around the world are
victims of human trafficking at any given time, and it is estimated to be worth $150.2 billion annually – second only to the international drug trade. In this presentation, we will examine both types of human trafficking: labor trafficking and sex trafficking. We will
focus on the US government’s current response to labor trafficking and discuss how corporate entities can prevent and detect trafficked labor by implementing risk-based compliance controls (much like those in the anti-money laundering and anti-corruption
spaces). The presentation will also look at sex trafficking, including the politics of defining and measuring the problem, how current
discourse around combating sex trafficking can obscure more than it clarifies, and the components of a rights-centered approach
to addressing it.
Speakers: Hillary Rosenberg, Esq., Jennifer Rosenberg
IMPACT ON BOARD MEMBERS FROM CHANGES TO NOT-FOR-PROFIT CORP. LAW (1.0 HOUR)
The program will address the current status of the fiduciary duty of Board members of not-for-profit corporations. It will also address what Board members and not-for-profit corporations should know about the positive and more challenging changes to corporate governance under the new Nonprofit Revitalization Act. If you currently serve on a Board or represent a not-for-profit corporation, you are impacted by the new law.
Speaker: Maureen Crush, Esq.
SEXY DEPOSITIONS: HOW TO DEVELOP A PROVOCATIVE APPROACH (1.5 HOURS)
How to get what you want from your man (or woman, as the case may be). Learn techniques for getting all you need from the witness by making love and not war and for using deposition testimony to your best advantage. Topics for this program will include:
make out your case; determine to get what you need; check out the witness; who’s smarter – the witness or you?; mix up the pace
and order of your questions; take advantage of the CPLR; and win your case at the deposition.
Speakers: Helene E. Blank, Esq., Lenore Kramer, Esq.

SATURDAY, MAY 16, 2015
HACKING - IT COULD HAPPEN TO YOU: CYBER LAW & ETHICS (2.0 HOURS)
Sony. Target. Anthem Health. The White House. You’ve read the headlines. You’ve heard the news reports. Think it can’t happen to you? Think again! This CLE will present an overview of the current state of “cyber law” and the additional obligations imposed upon attorneys in New York by the Rules of Professional Responsibility. A hypothetical will be used to illustrate issues relating to the protection of confidential information by attorneys and their clients as well as planning for, mandatory and recommended
actions after, and potential liability and consequences following a data breach.
Speakers: Hon. Betty Weinberg Ellerin, Donna E. Frosco, Esq., Stephen D. Hoffman, Esq., Lenore Kramer, Esq.
Edwina Frances Martin, Esq., Deborah A. Scalise, Esq.
CONNECTING WITH CLIENTS: OPENING THE DOOR TO ADR FOR FAMILY MATTERS (1.0 HOUR)
When addressing family issues, more and more clients are seeking out a personalized, private and efficient process such as Collaborative Law or Mediation. This workshop, through case analysis, will focus on the initial relationship between attorney and client through a better understanding of the various ADR processes, an enhanced ability to help clients select the best process, and
improved skills in client consultation.
Speakers: Bridget M. O’Connell, Esq., Abby Rosmarin, Esq.
LOOK WHO’S NOT TALKING: WOMEN, LAWYERS AND COMMUNICATION (1.0 HOUR)
The practice of law requires attorneys to practice the art of communication. Yet, no matter how adept women may be at this skill,
our voices often fall on deaf ears. Several studies show that when women speak in a professional setting they are either not heard
or are heard as shrill or overly aggressive. This panel will explore the data behind these observations and provide insights about
how female lawyers may overcome these negative perceptions. Using our own professional experiences (as a judge, a professor,
a government lawyer and a private practitioner), as well as substantive findings from psychologists and other experts, the panel
will enhance the skills of lawyers who must regularly speak in courtrooms and boardrooms, in negotiations and mediations and in
communications with colleagues and other professionals.
Speaker: Hon. Christine M. Clark, Suzanne M. Dugan, Esq., Christine C. Kopec, Esq.
OUR PARENTS, OURSELVES: THE DIFFICULT DECISIONS TO MAKE AS WE AGE (1.5 HOURS)
This program will focus on the women of the “sandwich” generation, caregivers for their children and their parents, and the difficult
decisions that need to be made both for themselves and their aging parents. This presentation will cover health care decisionmaking, power of attorney, senior living choices (both licensed and unlicensed), home care options, and the future of the health
care industry. The presentation will cover substantive legal topics involving elder care and health law in a manner that makes the
information accessible and useful for each attendee’s personal situation, as well as in her practice.
Speaker: Nancy Sciochetti, Esq.

Clean the World is a non-profit organization that collects discarded soaps, shampoos, conditioners and other
hygiene products from more than 1,200 participating hotels and hospitality partners. Since its inception in
2009, Clean the World has been steadily increasing its services and operations to accommodate rapidly expanding community needs, awareness and donations by providing something as basic as soap for hand
washing.
As part of its ONE Project, participants will assemble hygiene kits that will benefit the local community. Each
kit includes a bar of recycled soap, shampoo and conditioner, lotion, a toothbrush, toothpaste, a razor, a
washcloth and an inspirational note from you to someone in need. Our chosen recipient for the completed
kits is Wellspring, formerly known as the Domestic Violence Rape Crisis Services of Saratoga County
(DVRC), in Saratoga Springs, NY. Wellspring has been providing services to victims of domestic violence
and sexual assault in Saratoga County for 30 years. They offer a full range of emergency, shelter and community services, and work with the survivors of relationship abuse to escape the abuse and restart their life.
