Privacy Policy All information collected by us (The Cottage Owner), is for internal screening purposes. By providing this information you consent to the collection, use, handling and disclosure by us of any information set out in the Cottage Rental Application relating to your stay. Terms and Conditions for the cottage at 61 Eight Mile Point Rd Oro Medonte, ON: 1. General. The cottage is offered as vacation rental accommodation for the “Client” (applicant named on “Cottage Rental Application) according to the Terms and Condition as set out in the “Cottage Rental Application” and the following “Terms and Conditions”. The owner or his representative has right to inspect the property during at rental period at any time. 2. Restrictions. The Client agrees to abide by the restrictions set forth by the Owner and shall be responsible for any and all guests, for adherence to the restrictions. 3. Payment. Booking shall be confirmed in writing by the Owner on approval of application and on receipt a Deposit. The Balance shall be due and payable 14 days prior to the first day of the rental period. Payment can be paid by certified cheque, money order, cash or online internet banking. All payments are made to the Owner. 4. Cancellation. Any cancellation made by the Client must be in writing to the Owner. The deposit is non refundable. Only if the Owner is successful in rebooking the cottage for the entire period booked, shall the Owner refund to Client all monies paid less a deposit fee. If the property is damaged, destroyed and uninhabitable or is unavailable for any other reason, then Owner may terminate this Agreement by giving written notice to Client. All payments that Client has made will be refunded and neither the Owner shall have any further liability to Client. 5. Representation. The information contained in any printed materials, photographs, online is believed to be accurate at the time of publication. The Owner reserves the right to make any changes it deems necessary to more accurately reflect the cottage property. 6. Occupancy. Clients who have guests at the property in excess of the pre-authorized number (named on the Cottage Rental Application) are subject to either immediate eviction without refund or $100 per night per guest/$300 per stay charges. Please note that we have a “NO PARTIES” policy. Sub-letting of the cottage is not permitted. Camping, tenting, trailers or other additional accommodation facilities will not be allowed unless previous writing permission has been granted by Owner. Please note that ANY person, Regardless of age is counted as a person in the occupancy of the cottage. Occupant Initials _______ 2 7. Pets. No Pets allowed, any pets found on the property will be chargeable for ($300.00) per pet. 8. Smoking. Not permitted in the cottage. Do not leave cigarette butts. 9. Noise Restrictions. Residents must maintain minimal noise to avoid disturbing neighbours; noise curfew is at 10pm daily. 10. Fire Pit. Fires must be maintained carefully and cannot be more than 3 feet in height; wood must be supplied by occupants. 11. Sauna. Users of Sauna are using at own risk. Users must also provide own firewood; firewood must be stored outside of sauna; wood stored inside Sauna can at risk of catching fire. 12. Dock Very shallow waters surround the dock, swimming at own users risk. The water is approximately 3ft deep, take caution for depths as necessary. 13. Boats & Seadoos No docking allowed at the cottage dock, waves are high which can cause damage to both boats and property. All damage done by not following this rule shall be fully chargeable to cottage occupants for any misuse. 14. Inventory/Household Rules/Cleaning The Client is expected to leave cottage in the same condition that it was in, upon their arrival, and is responsible for the cleaning of the cottage before they leave and removing own garbage and recycling. Cleaning supplies are provided. The Client agrees to read and abide by Household Rules, as stated in the Life at cottage package and/or posted at the cottage, and to use the inventory, equipment or any other part of cottage property in a safe and responsible manner. Any additional cleaning required, breakage or damage to inventory, equipment or any other part of cottage property, above and beyond normal “wear and tear” will result in additional charge to Client. Unless specified otherwise, liens and towels are not provided. 15. The Owner of the cottage will not be responsible for any personal injury, loss or expense arising out of or in connection with the use of the rental property which shall be sustained by the Client or any other persons who may be on or about the demised premises, or by the Client or any other person who uses any recreational equipment that may be on or about the property. All risks of any such injury or loss shall be the sole responsibility of the Client. Owner maximum liability for all damages, loses and causes of action, whether in contract, tort or otherwise, shall not in any case in aggregate the contract price for the rental. 16. The parties agree that this Contract shall be governed by the laws of the Province of Ontario and agree to atom solely to the jurisdiction of the courts of Ontario with respect to any and all disputes arising out of the interpretation and application of this contract and the relationship between Owner and the Client. 17. Additional Residents Not Stated On Application Form. Occupants will be charged ($300.00) per person. Occupant Initials _______ 3 You’re Obligations Repair You agree to keep the Property and all furniture, fixtures, chattels and effects in or on the Property in the same state of repair and condition as at the commencement of the rental period, save and except for ordinary wear and tear. Clean Up You agree to clean the Cottage prior to departure, remove your own garbage, dirty dishes and recycling and generally to leave the property in the same state of cleanliness and general order in which it was found. Garbage must be disposed of in black bags and recycling must be put into proper bins, which are all located in the street disposal boxes. Penalty costs for not cleaning shall be ($300.00) for stay. Keys You agree to return the key at the time of departure to the place where it was picked up. You agree to pay a fifty dollar ($50.00) charge if the key is lost or not returned at the time of departure. Telephone Calls You agree not to incur long distance or other telephone charges or ordering any pay preview, during your occupancy of the Property. In the event that any such charges are incurred, you agree to pay all such charges together with an accounting fee in an amount of fifty dollars ($50.00). You agree that if such telephone charges are incurred contrary to this Agreement, such charges and the accounting fee may be charged to your credit card. Drinking Water It is your responsibility to supply drinkable or potable water. Linens Towels, sheets, pillow cases and dish cloths are not included with the Property unless otherwise stated in the Cottage Listing. Linen and towels can be provided for a set, (1 bed & 2 towels) each are $75.00. Forgotten Items If you request the return of any items which were inadvertently left on the Property, You agree to pay an accounting/packaging fee in an amount of fifty dollars ($50.00) in addition to the cost of postage for the return of the item.
