Proposals.

7. In case of dispute arising upon or in relation to or in connection with the contract between
the Client and the consultant, who has not been settled amicably, any party can refer the
dispute for Arbitration. Such disputes shall be referred to the sole Arbitrator who shall be
mutually appointed by the parties. Such arbitration shall be held at Gandhinagar as per
Arbitration and Conciliation Act 1996 rules. The decision of the arbitrator shall be final and
binding upon the parties. The expenses of the arbitration shall be shared equally by the
Client and the consultant. The Laws of India shall govern this Agreement for all purposes.
8. GMPB will not be responsible for procurement and attestation using the digital signature,

Instructions to Agencies
1. Definitions

“Client” means the ‘Gujarat Medicinal Plants Board’ and with which the selected Agency
signs the Contract for the Services.
“Agency” means any entity including Government/Non- Government
Organization/Private firm or a Joint Venture/Consortium that is willing to provide the
Services to the Client under the Contract and submits proposal in response to this Tender
Document.
“Contract” means the Contract signed by the Agency and Client and all the attached
documents and Appendices.
“Data Sheet” means such part of the Instructions to Agencies used to reflect specific
location and assignment conditions.
“Day” means calendar day.
"Government” means the Government of Gujarat.
"Instructions to Agencies” (Section 1 of the Tender Document) means the document
which provides interested Agencies with all information needed to prepare their Proposals
“Joint Venture” means Agencies which comprises two or more Partners each of whom
will be jointly and severally liable to the Client for all the Agencies obligations under the
Contract.
Partner” means any of the entities which make up the Joint Venture, provided that each
of them substantially performs the Services and/or has experience contributing to the
enhancement of the expertise of the Joint Venture; and “Partners” means all those
entities.
“Personnel” means qualified persons provided by the Agency and assigned to perform the
Services or any part thereof.
“Proposal” means a technical proposal or a financial proposal, or both.
“TCCC” means Technical Capability Cum Cost-Based selection.
“TD” means this Tender Document.
“Services” means the work to be performed pursuant to the Contract.
“Standard Electronic Means” includes facsimile and email t r a n s m i s s i o n .

INTRODUCTION:-
•
The Applicants are invited to submit a Technical Proposal and a Financial Proposal, for
the services required for the assignment named in the Data Sheet. The Proposal will be
the basis for contract negotiations and ultimately for allotment of a Contract with the
selected Agency.
•
Agencies should familiarize themselves with local conditions relevant to the Services
and take them into account in preparing their Proposals. To obtain first-hand
information on the assignment and local conditions, Agencies are encouraged to visit the
Client before submitting a proposal and to attend a pre-proposal conference as specified
in the Data Sheet. Attending the pre-bid conference is optional. Agencies should
contact the Client’s representative named in the Data Sheet to arrange for their visit or to
obtain additional information on the pre-bid conference. Agencies should ensure that
these officials are advised of the visit in adequate time to allow them to make appropriate
arrangements.
•
Agencies shall bear all costs associated with the preparation and submission of their
proposals and contract negotiation. The Client is not bound to accept any proposal, and
reserves the right to annul the selection process at any time prior to Contract award,
without thereby incurring any liability to the agency.
Fraud & Corruption
•
The client requires that Agencies observe the highest standard of ethics during the
procurement and execution of such contracts. In pursuance of this policy, the client;
will reject the result of evaluation of proposals if it determines that the Agency being
evaluated has engaged in corrupt or fraudulent practices in competing for the contract in
the client: Will recognize an Agency as ineligible, for period determined by the
Government of Gujarat.
•
The Client will be entitled to forfeit and appropriate the bid security without prejudice
to Client‘s any other right or remedy under the above condition.

Eligibility Criteria
The applicants may apply to create Herbal Garden in Schools and Ayurvedic
dispensaries/ hospitals of Gujarat. Schools and Ayurvedic dispensaries/ hospitals should
have minimum 500 to 1000 square meters area. Applicants where they are applying there
should not developed herbal or dispensary garden before.
The applicants may apply to create Schools and Ayurvedic dispensaries/ hospitals in the
categories as shown below as table:1

Project Details
Scope of Work
Title of the project:
Establishment of Herbal Gardens in Schools and Ayurved dispensaries / hospitals of Gujarat.
Status of board:
Conservation and Development of rare, endangered and highly utilized medicinal plants is
very much needed due to the over-exploitation of natural resources. For the development of
this sector, Govt. of India vide its Notification No. Z. 18020/19/97- MP Cell dated 24.11.2000
established National Medicinal Plants Board (NMPB) with the Department of Ayurveda,
Yoga & Naturopathy, Unani, Sidhha and Homoeopathy (AYUSH). As per the guidelines of
NMPB, Govt. of Gujarat has also established Gujarat Medicinal Plants Board (GMPB) vide
its Notification No. F.No. 18020/9/2001 MP Board dated 27.11.2001.
The office of Gujarat Medicinal Plants Board has been made independent and being headed
by Chief Executive Officer an officer of Chief Conservator of Forest cadre. He is being
assisted by two technical officer in preparation of new projects as well as implementation and
monitoring of ongoing projects.
Brief Introduction of Concept and Justification of the Project
As Ayurveda mainly dependent upon plant based products, the dravyaguna or materiamedica plays
an important role in the Ayurveda practice. There are many fresh preparations which can be given
to patients to get maximum benefit.
The authentic concept of swaras, kalk, kwath, etc. is very rare in recent Ayurveda practices. As
these procedures require less efforts an preparations, even these medications are harmless to use
also, moreover these preparations can be explained to patients and they can use it without many
contra-indications. If we start using the traditional form of treatment– fresh preparations of Swaras,
kalk etc. this will give immediate results as well as will be economically rational in comparison to
resent medications.
The medicinal plants required for fresh medications are easily available in the villages but in urban
and suburban areas the availability of medicinal plants becomes difficult. If herbal gardens are
created in ayurvedic dispensaries / hospitals owned by the State Government, the availability of
medicinal plants will be eased out. Further efficacious use of these plants for treatment of common
illness and that too as per the guidance of professional doctors will be ensured. Patient may collect
the plant for their usage from dispensary itself.
The destruction and loss of medicinal plants resource have resulted due denudation and
deforestation.
Natural regeneration of medicinal plants has been hampered due to unregulated grazing and forest
fire.
The majority of traders resort to collection of wild medicinal plants through untrained and
unskilled laborers. Sometime these laborers employ improper/ destructive harvesting methods such

as extraction of entire plants, roots, rhizome, tubers and bulbs of the species and hampering
regeneration.
Overexploitation of these species, as well as trampling at particular places during collection have
destroyed many fragile habitats and caused irreparable damage to many species.
Therefore it has been proposed for creating awareness and capacity building of local people
involving school going children, for raising medicinal plants and thereby reducing pressure on
natural resource.
Objectives of the project.
• To create medicinal plant resource in dispensaries so that it can be available to the patients.
• To create awareness about traditional uses of medicinal plants in the masses.
• To create medicinal plant resource in schools so that it can be replicated in the nearby areas
and also become available to the needy persons.
• To create awareness about traditional uses of medicinal plants for better health of school going
children and teachers
