Working for QUALITY in HOME CARE
Legislative and regulatory changes now in force
A variety of changes to how the care system will operate and be regulated are now in
place, with the Care Act now in force. Homecare providers in England will now be
required by legislation to follow new regulations called the 'fundamental standards',
which have taken over from the 'Essential standards of quality and safety'. In addition
the regulations include a new requirement for providers to display the rating they receive
from CQC, bring training into line with the Care Certificate and respond to requirements
around the Duty of Candour and the Fit and Proper Person Regulations.
CQC publishes position on Care Certificate
CQC has published its position on the Care Certificate and set out what it expects from
health and social care providers when the Care Certificate commences from 1 April 2015
in England. The position statement also explains what CQC will be checking when it
carries out inspections, to ensure the provider has the correct approach to staff
induction, support and training using CQC's new key lines of enquiry. CQC's Position on

UKHCA need your evidence
Have you ever been in a situation where rising local authority eligibility rates have meant
that someone's access to your service was discontinued? If so, what was the impact on
that individual, your organisation and the carers providing support?
UKHCA, along with the Care and Support Alliance are collecting case studies on what the
genuine human impact of rising eligibility rates and unmet need actually means on the
front line of social care.
Please share any anecodtal evidence or case studies you may be aware of by
contacting the helpline on the usual number or by emailing [email protected].
Any case studies can be kept anonymous though we may contact you to discuss any
issues further.

BIS have updated their guidance on the calculation of the National Minimum Wage
(NMW) to take into account developments in the case law relating to sleep-ins. Anthony

TUPE Guide now available for UKHCA members
TUPE is one of the most complicated areas of employment law that affects homecare
providers. It can apply in many different types of situations and continues to evolve, as
businesses change hands, service providers change, and councils outsource their
homecare services. Assessing the effect of TUPE on a transfer is a key aspect of gauging
the viability of a contract, both for the transferring and the transferee employer. This
guide by Anthony Collins Solicitors LLP is intended to be a simple introduction to help
UKHCA members understand TUPE and how it can affect their businesses.
Celebrating Good Care, Championing Outstanding Care
CQC has published a new national report "Celebrating Good Care,
Championing Outstanding Care" which contains examples of good and outstanding care
found in CQC inspections, since the new regulatory regime was introduced in autumn
2014. The Commission says it intends to produce this report quarterly.
New guide published on what to expect when someone is dying
The National Council for Palliative Care have published a new guide exploring what
carers, family and friends might expect when someone they know is dying. The guide,
which can be read at

the kind of care and support that might be available to support people at such a difficult

The Pensions Regulator introduces new online step-by-step guide for small
employers
Many business owners will be required to meet their Automatic Enrolment duties at some
point in 2015.To support small and micro employers to meet their duties, The Pensions
Regulator has recently updated their website specifically for small and micro employers.
There is a new step-by-step online guide to automatic enrolment divided into 11 steps,
enabling employers to work through one task at a time. Each step in the new guide tells
employers when they should complete the task and how long they should expect it to
take, as well as letting them know what’s next. The step-by-step guide to automatic

Helen Sanderson Associates, known for their work on person-centred care, have written
a short blog on 'Doing daily records differently' which UKHCA members might find
interesting. It considers if records can be both compliant and useful, in a practical sense.
