Some Thoughts on the Sidra
BEHAR-BECHUKOTAI
The Midrash debates why it was
that Moses was so upset that God
would not let him into the land of
Israel.
What was so special about the
land? The rabbis discuss the
special holiness of the land and
wax lyrical about its rare spiritual
and physical beauty. The land
of Israel, the air of Israel are all
reputed to bring people closer
to God. Nonetheless, the rabbis
conclude that Moses had exceeded
all normal human potential in this
regard. Surely, he could get no
closer.
The Midrash suggests that at the
heart of Moses’ upset was that he
would never see and never have
the chance to perform a series
of mitzvot, unique to the land of
Israel itself, which are known as
the “Mitzvot Hataluyot Ba-Aretz”,
the mitzvot which depend on the
land.
While the laws of Shabbat
and kashrut, fair weights and
measures,
honouring
our
parents and refraining from
vice apply wherever we are, the
Torah designates a number of
Commandments as applicable
only and exclusively within the
borders of Israel itself.
Many of these Commandments
are introduced in our parasha of
Behar. Broadly speaking, they
establish a social/welfare system
for a sovereign nation.
We are told that when the children
of Israel come into the land,
they must keep the sabbatical or

Shemitta year. Every seven years,
the land must not be tilled, planted
or harvested. It should lie fallow.
Any fruit or food which grows
naturally on the land may be taken
and consumed by whoever finds
it. But Shemitta produce may not
be traded or sold.
In the 50th year, after the
completion of seven sabbatical
cycles, a “Yovel” or Jubilee is
proclaimed and similar rules
apply. Moreover, in the 50th year,
the land is redistributed amongst
its original tribal owners so that
land which had been sold through
poverty (and you would only
ever sell your land if you were
desperate) was returned to its
traditional families. In this way,
families would not suffer for all
time in the aftermath of a bad
harvest, bad management or bad
luck. Every 50 years there would
be a balancing of the ancestral
real estate.
The parasha introduces an
obligation for society to provide
for its poor and dependants.
Individuals who incur heavy debts
are expected to work them off
according to a payment schedule
which will end at the next
Jubilee year. The Torah does not
believe that people should leave
themselves dependent on charity.
They should be made to work to
support themselves and their
dependents.
With this, the Torah admonishes
good treatment of the “Eved Ivri”,
the indentured Israelite servant.
He is not to be worked with hard

labour as a slave. He is to be
regarded as a brother and treated
a member of the household. He
must be accorded the same
good food and comparable
accommodation.
The Talmud
observes, “If you acquire for
yourself a servant, you acquire for
yourself a master”. God reminds
us that we were liberated from
Egypt to serve Him in freedom and
not to be enslaved to each other.
In reminding us of our treatment
by the Egyptians, we are also
obligated to do deal fairly with the
non-Jewish residents of Israel who
dwell in our midst.
In explaining why Israel was sent
into exile, the Talmud determines
that the Shemitta and Jubilee
years were not properly observed.
Although charity was widespread
and provision was made for the
destitute, the rich were allowed
unchecked growth and the poor
spiralled downwards without
hope of redemption. Land was
treated as a personal possession
and not as a trust from God. The
trust was breached and the land
withdrawn.
While the mitzvot of Parshat Behar
can only apply where the whole
community participates and
thus they are reserved for Jewish
sovereignty in the land of Israel;
the principles resonate throughout
Jewish teaching – a strong work
ethic, and a responsible society
which offers dignity and hope to
its workforce.
