Why Scotland? Why Now?
In the era of what occurred in Ferguson, Missouri and New York City, the nation’s attention has
been focused on the use of excessive force by police and law enforcement officers. This is nothing
new, and has been around for as long as there have been law enforcement officers. But now, the
world’s focus is on this issue. There is a need for a comprehensive CLE on the topic of excessive
force. What is it? Why does it exist? What do we do about it? These are questions that will be
answered at this seminar, which qualifies for 16 hours of CLE credits including 1 hour of ethics
and professionalism.

One of the most important questions in addressing and litigating excessive force is why does
this occur. And why are we going to Scotland to find out?

You will learn from Scottish Barristers and Solicitors, Judges and the head of the country’s
police force.
You will learn that THEY, the SCOTS, have developed a better way.
You will be instructed from the recently retried Queen’s Royal Prosecutor who will
enlighten us on the path Scotland has taken which results in no excessive force in their
entire COUNTRY.
Yes, it is true, excessive force is a foreign concept in Scotland, it simply does not exist.

The area now known as 'Merchant City' was developed from the 1750s onwards. Residences
and warehouses of the wealthy merchant "tobacco lords" (who prospered in shipping and,
amongst other things, tobacco, sugar and tea) were built in the area. The district, west of the
High Street, is the historic backbone of the city and is characterized by wide, straight streets,
vistas, and squares.
Ross Priory

The group will take a field trip to an ancient Priory situated in an unrivalled position on the
banks of Loch Lomond with stunning views of mount Ben Lomond and the surrounding hills, yet
only 40 minutes from Glasgow. The Trossachs National Park surrounds Loch Lomond and
includes several ranges of hills, the Trossachs being the most famous.
The house, acquired by the University of Strathclyde in 1971, is one of the finest examples of
gothic architecture in Scotland. This fascinating, historic building dates back to around 1693 and
was for many years the property of the Buchanan family.
The Priory is a secluded and unusual venue enhanced by extensive grounds and gardens and a
nine hole golf course. The gardens contain a remarkable collection of rhododendrons and
azaleas.
Stirling Castle

Located in Stirling, the Castle is one of the largest and most important castles, both historically
and architecturally, in Scotland. It is an important fortification from the earliest times. Most of
the principal buildings of the castle date from the fifteenth and sixteenth centuries. A few
structures of the fourteenth century remain, while the outer defences fronting the town date
from the early eighteenth century. Several Scottish Kings and Queens have been crowned at
Stirling, including Mary, Queen of Scots, in 1542. There have been at least eight sieges of
Stirling Castle, including several during the Wars of Scottish Independence, with the last being
in 1746, when Bonnie Prince Charlie unsuccessfully tried to take the castle.
West Highland Railway

The West Highland Railway was one of the last main lines to be built in Scotland. It is one of the
most scenic railway lines in Britain, linking Fort William on the west coast to Glasgow. It is
universally regarded as the most awesome and beautiful railway journey which includes the
Glenfinnan Viaduct made famous in the Harry Potter films.
Edinburgh Festival and Tattoo

We will visit the Edinburgh Festival which is an arts and cultural festival that takes place each
summer, in August, in Edinburgh, Scotland and forms the largest annual cultural festival in the
world.
We have reserved a limited number of tickets to The Royal Edinburgh Military Tattoo, an
annual series of Military tattoos performed by British Armed Forces, Commonwealth and
International military bands and display teams on the esplanade of Edinburgh Castle in the
Scottish capital, Edinburgh. The event takes place annually throughout August.
Program Co-Directors
Prof. Rafe Foreman joined UMKC as the Douglas Stripp Dean’s Distinguished Professor and
Director of Advocacy in 2011 after a distinguished career as a trial lawyer, most recently as a
partner at Foreman, Lewis & Hutchison P.C. in Grapevine, Texas. He served as a litigation
specialist, including criminal defense, plaintiff’s personal injury, civil rights, employment,
discrimination, wrongful death, excessive force and 1983 actions.
After receiving his bachelor’s degree from Texas A&M University in agricultural education,
Professor Foreman received his J.D. degree from Texas Tech University School of Law, where he
was on the Moot Court championship team, regional co-chair of the Client Counseling
Competition and a member of the Board of Barristers. He has advanced education in
psychology at Fielding University and at the National Psychodrama Training Center. Professor
Foreman is a graduate of the Trial Lawyers College and served as a board member from 20052014.
Professor Foreman is Board Certified in Criminal Law by the Texas Board of Legal Specialization.
He teaches Trial Advocacy and Evidence and coaches the Trial Advocacy teams.
