BIDDING OF UNSERVICEABLE EMPTY SACKS
Sealed bid for the following items shall be received by the Bidding Committee at the
Office of the National Food Authority, Surigao del Sur Provincial Office, Mabua, Tandag
City, not later than May 11, 2015 at 10:00 A.M., at which time and place, your bids
shall be opened in the presence of all the participating bidders or their authorized
representatives:

The offer shall be for the whole lot on “AS-IS-WHERE-IS” and in “NO SELECTION
BASIS”.
A Bidder’s Bond equivalent to ten percent (10%) of the total amount of the offer in the
form of CASH, CASHIER’s or MANAGER’s CHECK, in favor of NFA shall accompany the
Sealed Offer. Otherwise, the offer shall be automatically rejected.
Prospective bidders can inspect the above-mentioned items at GID-Duplex Warehouse,
Mabua, Tandag City.
The Bidding Committee reserves the right to reject any or all bids or to waive any
formalities or defects found therein and accept only such offers which, in its judgement,
is most reasonable and advantageous to the National Food Authority (NFA).

TERMS AND CONDITIONS OF THE SALE
BIDDING OF UNSERVICEABLE EMPTY SACKS
1. The offer shall be for the whole lot offered, on “AS IS WHERE IS” and “NO SELECTION”
basis.
2. A Bidder’s Bond equivalent to ten percent (10%) of the total amount of the offer in the form of
cash, cashier’s or manager’s check, in favor of NFA, shall accompany the Sealed Offer otherwise the
offer shall be automatically rejected.
3. The sealed offers will be publicly opened at the same time and place aforementioned in the
presence of all offerors who desire to be present.
4. Upon award of sale, the Bidder’s Bond of the winning bidder shall automatically be converted
to Performance Bond.
5. Whole payment in CASH for the whole lot as bidded shall be made within 48 hours upon
receipt of the Notice of Award. In the event the awardee fails to remit the amount within the period, the
Bidder’s Bond shall be deemed automatically forfeited in favor of the NFA without the necessity of a
court action for forfeiture.
6. Withdrawal of bidded stocks shall be made within 5 working days from the date of payment,
otherwise storage fee charged by the NFA to whatever balance thereof not withdrawn within the period
shall be borne by the winning bidder.
7. Release of Performance Bond shall not be made unless a certification from the Provincial
Office is presented that winning bidder has no outstanding obligation with NFA with respect to the use of
transportation equipment, labor etc.
8. Furthermore, failure to withdraw the stocks within the withdrawal period as well as to pay
whatever excess for circumstances attributable to awardee, the latter shall be liable to a penalty sum
equivalent to the excess in accordance with the bid price plus automatic forfeiture of the Performance
Bond in favor of the NFA without necessity of a court action. This is without prejudice to other legal
sanctions that the NFA may take as warranted in the premises like sanctions for damages or
disqualification from further participation in subsequent bidding.
9. Stock Movements/Transfers
a. In-warehouse movements-the two (2) handling movements (pile to scale and scale to truck)
will be shouldered by NFA. However, in case of delay in withdrawal, said handling
movements including all expenses incurred due to delay, will be charged to the awardee.
b. All incidental expenses incurred like handling, hauling and other expenses related thereto
of the awarded items shall be borne by awardee.
