George to Cascade Shores Transmission Main - Initial Study/Mitigated Negative Declaration ENGINEERING RECOMMENDATION: Conduct Public Hearing; after hearing testimony, consider adopting Resolution No. 2015-11 (adopting a mitigated negative declaration and approve the project and mitigation monitoring and reporting program for the project). BACKGROUND: Currently, the Cascade Shores system is dependent on the South Yuba Canal raw water delivery system as a source of raw water. This system has experienced numerous failures requiring the Cascade Shores system to use water stored in the Cascade Pipeline until repairs are complete. The intent of this project is to provide treated water from the E. George system to the Cascade Shores system. This project is critical to providing a more reliable water delivery system to the Cascade Shores system and removes its reliance on the South Yuba Canal. Service would be from the modernized and expanded E. George Water Treatment Plant (WTP). In addition, to providing a more reliable water source this new pipeline would: 1. 2. 3. 4. Abandon the small and outdated Cascade Shores WTP Remove Sargent Jacobs Pump Station Provide availability to treated water for properties within District boundaries Provide the potential for treated water to properties currently outside of the District 5. Provide fire hydrants along the project inside and outside of the District 6. Provide stub out for future extensions of pipeline to serve treated water to the Banner Quaker Hill area. The project was conceptualized over five years ago; however the importance was not understood until the recent chronic raw water delivery issues with South Yuba Canal. The project was discussed in the March 19, 2014 Engineering Committee. On July 29, 2014, a public informational meeting was held to discuss the potential pipeline route and to gather input from the property owners. On March 8, 2015, a CEQA Informational meeting was held to discuss the project. Prior to the meeting, a notification was mailed to 105 property owners along the pipeline path and posted on the District website. On March 30, 2015, a notice extending public comment period and rescheduling the public hearing to April 22, 2015 was sent to 105 property owners and posted on the District website. The project was noticed in The Union Newspaper on April 1, 2015. It is the recommendation of the Engineering Department to approve this CEQA document. BUDGET IMPACTS: The Project is estimated at $2.5 million for construction of the transmission main and ancillary items. The project is budgeted in 2015 for $800,000 with additional $2,000,000 in 2016. This project will be constructed with Cascade Shores Phase 3-B which is a replacement pipeline project. It will be in an adjacent trench but share in the pavement restoration. The Cascade Shores Phase 3-B project is under a categorical exemption and budgeted under the pipeline replacement program for $750,000. GEORGE TO CASCADE SHORES TRANSMISSION MAIN PROJECT WHEREAS, Nevada Irrigation District (“District”) has undertaken the review of a project to install approximately 16,200 linear feet of 12-inch diameter treated water transmission main from the E. George Water Treatment System to the Cascade Shores Water Treatment Plant (the “Project”); and WHEREAS, the California Environmental Quality Act of 1970 (“CEQA”) requires state, local, and other agencies to evaluate or reduce, when feasible, the significant environmental impacts of their respective projects; and WHEREAS, the District’s engineering staff has prepared a Preliminary Review and Initial Study (“Initial Study”) for the proposed Project (including biological studies conducted by Stantec), in accordance with the requirements of CEQA; and WHEREAS, on April 1, 2015, a Notice of Intent to Adopt a Mitigated Negative Declaration for the Project was published in The Union newspaper, advising of the time and place of a public hearing on the Project; and WHEREAS, on April 22, 2015, following a public hearing on the Mitigated Negative Declaration for the Project, the Board of Directors of the Nevada Irrigation District approved the adoption of the proposed Mitigated Negative Declaration for the Project as presented; and NOW THEREFORE, BE IT RESOLVED by the Board of Directors of the Nevada Irrigation District that it does find as follows: 1. The above recitals are true and correct. 2. Based on its review of the whole record before it, including the Initial Study, presentations of Staff and the public comments, both written and oral, received in response to its Notice of Intent, the Board finds that there is no substantial evidence of record that the Project will have a significant effect on the environment and that the Mitigated Negative Declaration represents the independent judgment and analysis of the District. Mitigation measures are made a condition for approval of the Project and the Board hereby adopts the mitigation measures which it has either required in the Project or made a condition of approval to mitigate or avoid significant environmental impacts. 4. The documents which constitute the record of proceedings upon which the decision of the Board is based are located at the offices of Nevada Irrigation District, 1036 West Main Street, Grass Valley, California, and the Secretary to the Board is the custodian thereof. 5. The Board of Directors hereby approves the Project. 6. The Board Secretary is hereby authorized to file a Notice of Determination, a copy of which is attached as Exhibit ‘A’, with the Office of the County Clerk, Nevada County and State Clearinghouse.
