Chris Hoglan v Breckenridge Hills ! Incident Report Discrepancies 1) In the Incident Report “Type of Premise (For Vehicles State Where Parked)” box, it was put as Road/Highway. I was on a sidewalk. I’m not sure if that is classified under road/highway. ! 2) In the Incident Report Narrative, Officer Tyler attempts to place the pocket knife discovery on Baltimore Ave by stating “It should be noted that there was a black folding pocket knife located in the right front pants pocket of the subject.” This was conveniently placed almost immediately after he states “I placed one handcuff on the subjects left wrist at which the subject started to pull his right wrist away from me and attempted to retrieve something out of his right pants pocket.” I believe Tyler intentionally tries to place the knife discovery on me on Baltimore, although not stated that way. It was not seen or known about in anyway until they told me to empty my pockets in the jail cell. If Tyler was concerned about the knife, why was it not listed in the Incident Report “Suspects Armed With” box. I believe this is because he did not find the knife for quite some time and left it unchecked because it hadn’t happened yet. Despite what his narrative says, further showing his false narrative. ! 3) Hair Color is Brown, not black ! 4) In the Incident Report Property section, it shows they seized evidence. The evidence is stated as “John Doe Fingerprints”. My fingerprints were definitely unlawfully seized from me. At no point did I give them permission to finger print me. I stated verbally “I do not consent to you finger printing me”. Is it normal to submit fingerprints as evidence? ! Incident Report Narrative Breakdown ! 1) Tyler states “at 00:10 hours, I was radio dispatched to respond to 9910 Benson Ave for a report of flourishing that just occurred.” Can we check to see if this time matches with dispatch logs? ! 2) Tyler states “I asked the male what his name was to which he replied “I don’t have to tell you shit.” This is absolutely false. I maintained the upmost respect and was calm and referred to Officer Tyler as sir. Never did I use a swear word at him or have a negative or forceful tone. I believe the video shows this. The truth is he shouted “What’s your name” with a forceful tone from his patrol car. I replied “I don’t need to answer that” ! 3) Tyler states “I exited my patrol vehicle and again requested the name and again I was refused the name” The video will show Tyler actually says “stop now or you’ll go to jail” Chris replies “Is there a reason I’m being stopped sir?” Tyler yells “Yes”. Chris replied “what’s that” and Tyler states “I need to know who you are.” ! 4) Tyler specifically says “It should be noted that the subject was advised at least four times that he could either give me his name or face criminal charges for interfering with police.” The video will show that is false. Officer Tyler did ask me my name or who I was 13 times in the first two minutes of conversing with him. He told me I was going to go to jail or threatened with jail three times. I was not told what I was being charged with until after they forcefully seized my fingerprints from me later in the jail. I asked Tyler why I was being stopped/what reason did he have for detention/am I being detained 11 times on the video. ! 5) Tyler states “The subject again refused and was advised that he was under arrest.” I was never advised of arrest. As previously stated, I was threatened with jail three times in the video, but was never advised I was being placed under arrest. I was never read my Miranda warning, or told what I was being charged with. Tyler went straight for my arm and grabbed me with no warning as the video shows. ! 6) Tyler states “I placed one handcuff on the subjects left wrist at which the subject started to pull his right wrist away from me and attempted to retrieve something out of his right pants pocket” The video will show this is false. Tyler grabbed my left forearm and pulled it behind my back. I was still holding my iPhone and recording the altercation with my right hand. I told Tyler “I don’t consent to this sir.” Tyler sharply responded “You don’t have to consent to it” I then said “I don’t consent to this, I do have to consent to this” He clicked the handcuff on my left wrist and at the same time, I was attempting to put my phone in my right pants pocket. You can hear me say in the video two times that I was trying to put my phone in my pocket. I was worried the police would unlawfully seize my phone from me with my video evidence. ! 7) Tyler states “Officer Allemann, DSN 247 of this command attempted to secure the subjects right hand. Officer Allemann and I then directed the subject to the ground and were able to secure the subjects right wrist in handcuffs properly.” This is an accurate statement; however it fails to mention Officer Allemann seizing my iPhone from me. Officer Allemann was grabbing at my phone with one hand while holding my arm with his other hand. I was trying to put my phone in my right jean pocket. I had about 1” in the pocket, but knew if I dropped it, it would fall on the ground or Officer Allemann was going to take it from me. It would not land in my pocket. I had no freedom of movement and the police had me totally stuck where I couldn’t move. Allemann stated “You’re gonna go to the ground” when I replied “I’m just trying to put my phone in my pocket.” At this point, my arms are frozen and I can’t move. Allemann has his leg bent and his knee between my legs. Both officers forced me forward and they came crashing down on top of me. The handcuff closed as tight as possible on my left wrist with the weight of two men falling on it. Once I was handcuffed they got up and told me to stand up. I got to my feet and nothing was said by me or the officers. Tyler took me to his patrol car and told me to get in the back. ! 8) Tyler states “It should be noted that there was a black folding pocket knife located in the right front pants pocket of the subject.” This is false. I had the pocket knife in my left pants pocket. I regularly place my iPhone in my right pocket as I am right handed. I don’t like things to scratch my screen and place my keys and knife in my left pocket. This is also a strange place to put this statement as mentioned earlier. The knife was not recovered on Baltimore. It was recovered when Tyler told me to empty my pockets in the jail cell and I placed the closed knife and keys on the bench I was sitting on. Alleman then stated “great, he has a knife in there with him”. ! 9) Tyler stated “At Police Headquarters the subject still refused to identify himself.” This is accurate but fails to mention that I verbally told Tyler immediately upon more questions from Tyler at the jail, that “I was invoking my 5th Amendment right to not answer any questions.” Tyler continued to press me as to whom I was. I told him I wanted to be charged with a crime or sent home. Allemann laughed and said “we just want to know who you are, we are not trying to incriminate you with innocent questions” I was then questioned many more times. ! 10) Tyler states “I fingerprinted the subject as John Doe in attempts to identify the subject through A.F.I.S.” This is an accurate statement, however I told Tyler I did not give them permission to finger print me. I stated verbally “I do not consent to you finger printing me”. At this time, I still had not been charged with a crime. ! 11) Tyler states that A.F.I.S. division at the highway patrol identified me as Christopher Hoglan. He goes onto state “It should also be noted that Hoglan was now ruled out as being the brother of Oswald.” The problem with this statement is its timing yet again. They positively cleared me as being Oswald’s brother within approximately 1 to 1 ½ hours after getting to jail. Allemann left the room for approximately 30min to 1 hour. He returned and told Tyler under his breath quietly “I know you don’t want to hear this, but this probably isn’t your guy. I spoke with the brother and he said his brother was not balding and had returned and taken his car somewhere.” Officer Tyler said “Well I am going to charge him with interfering. If he doesn’t wasn’t to talk, I’ll just flop him down at St. Ann until he does”. Tyler then went back to messing with the finger printing machine. He could not figure out how to enter me into the system. They knew I was not Oswald’s brother long before they positively identified me. The Chief and Captain of Breckenridge were called on their personal cell phones about the finger printing machine issue. Those phone calls took place at approximately 2:30-3am. Those two ranking officers should confirm that Tyler knew I was not Oswald’s brother before they had the finger printing machine working. ! ! ! 12) Tyler finishes his narrative by stating that I was charged with Interfering with Police and transported to the City of St Ann Jail for housing until my $500 could be posted. This is true but fails to mention he left me with no way to post my bond. I asked him when I was going to be able to call someone to tell them where I was and Tyler stated “you’re not getting a call to anyone” When we arrived at St. Ann, Tyler told the receiving officer “do not under any circumstances give him a phone call or a cell with phone access” He also said “good luck getting any information out of this guy, he hasn’t told us anything all night” ! ! ! There are a large amount of details and information left out by Officer Tyler. Please see my entire story attached. This was written to the best of my recollection 1 day after the event. I did not include any details, or make up any facts that were not 100% true.
