• Local authorities have a right to provide waste services
• Issues raised included the need for looking at our policies, legislation, bylaws, and necessary planning tools to align them with recent
developments.
• The support we need to get on waste management from other support
units in the Departments and municipalities
• Training, awareness raising and capacity building
• Sharing of visions, responsibilities, monitoring and evaluating tools,
systems and legislation for amendments where necessary.

1. Potential areas of conflict and overlap on the legal mandates of
the different national Departments, provinces and Local
authorities on waste management
o Oversight role of DM’s vs LM’s not actualised as envisaged
through the Constitution and applicable legislation
o DM’s and LM’s don’t share common vision/ not seeing eye to
eye wrt WM issues. This leads to beneficiaries suffering in the
delivery of waste management services e.g. waste pickers
o Municipalities not endorsing the projects that are being
proposed for them

2. Challenges with the provision of waste management services
2.1 Resources
o Financial: Inadequate funding for waste management and budget for
WM not ring-fenced
o Human: Lack of skills and technical know-how/ expertise to deal with
contractual matters between LG and third parties
2.2 Institutional barriers
o Waste service delivery slow in LG with the absence of appointed /
designated WMO’s
o Non-competitive wages / salaries to recruit and retain highly skilled
professionals in LG
o Questionable land ownership to undertake waste management projects

2.3 Awareness Raising/ Training/ Capacity Building
o Non-accredited training in LG - not regarded as valuable for skills
development
o LG officials not well conversant with requirements (revision of by-laws,
IWMP dev and tariff setting) to implement NWMS and related policies
o Closing the gaps between political and administrative appointees
responsible for WM in LG
2.4 Policy and Legislation
o The need to look at our constitution, policies and legislation
o The need to look at by-laws, and necessary planning tools to align them
with recent developments.
o The need to look at the implementation of the NWMS
RECOMMENDED ACTIONS
 SALGA: Resolve challenges wrt project management issues
between LM and DM (short-term)
 SALGA/DEA/DCOG: Amendment of the Constitution to deal away
with differentiated mandates with respect to services (waste
management) - (long term)
 DEA: Consider provision of accredited training not non-accredited
training. Training to close current lack of technical knowledge on
contractual matters; NWMS implementation (medium to long term)
 SALGA/DEA/DCOG/etc: To conduct awareness raising on waste
management and clean up campaigns (short to medium term).

RECOMMENDED ACTIONS
 LG: Land ownership should be cleared/ obtained with owners
(traditional leadership/ private owners) prior to commencement of
the project (Short term)
 DCOG/ NT: Review current allocations for WM services; Ring-fence
budget allocations for WM (Medium term)
 Industry, Gov. and Communities: Consider PPP projects in waste
 DEA: Clear policy direction regarding WTE projects and waste
technologies (Zero waste to landfill opportunities) (Short and
Medium term)
 DEA/COGTA/Municipalities: Review the NWMS 2011, By-laws, and
related regulatory tools.
