The Minnesota Nurses Association legislative scorecard provides a summary of each legislator’s vote on important nursing, health care and workforce issues, and a tool to hold them accountable. Ryan Winkler How to use this scorecard: The votes scored in this scorecard were chosen based on MNA’s legislative priorities (available at www.mnnurses.org), which are set each year by MNA’s House of Delegates. To find out who your state legislators are, visit www.mnnurses.org/grassrootsaction. Legislators’ scores were calculated based on these criteria: 1. One point was awarded each time a legislator voted in support of MNA’s core legislative priorities. A point was deducted each time a legislator voted against our priorities. 2. A bonus point was awarded each time a legislator chief-authored a bill that addressed one of MNA’s priorities. A point was deducted for chief- authoring legislation counter to our priorities. 3. If a legislator did not vote on a bill, he or she received zero points. 4. Legislators who supported nurses during 2012 contract or organizing campaigns were awarded an extra point. The 2012 Legislative Landscape This legislative session was dominated by complaints of hyper-partisanship and negotiations on a Vikings Stadium. Behind those headlines, attacks on nursing practice and workers’ rights intensified and triggered an unprecedented show of grassroots activism by nurses and our allies. One illustration of the partisan gridlock at the Capitol is the fact that this session the Legislature passed the second fewest bills in Minnesota history. This lack of measurable accomplishments makes it harder to score the work legislators did, and it makes the behind-the-scenes work even more important. It’s difficult to quantify the work that our allies did behind the scenes to stop harmful bills and to advance important priorities for nurses, so this work isn’t necessarily reflected in a legislator’s score. MNA worked with our allies behind the scenes to address many issues that are very important to the nursing practice and health care access. These issues did not come up for a specific vote, but our work this session brought them to the attention of legislators, the media and the public. • • Safe Staffing: After years of broken promises from hospitals to work directly with nurses to address patient safety issues that resulted from inadequate staffing, MNA nurses introduced legislation with the bipartisan support of authors Rep. Larry Howes (R) and Sen. Jeff Hayden (DFL). The 2012 Staffing for Patient Safety Act includes setting a maximum patient assignment for Registered Nurses based on factors including nursing intensity and patient acuity, and would require hospital administrators to work directly with nurses to ensure that adequate resources are provided to keep patients safe. We will continue to pursue safe staffing at the Capitol, as well as at the bargaining table and at the bedside. HMO Transparency: While no bills made it through the legislative process, MNA and our allies continued asking hard questions about the nearly $4 billion a year that HMOs receive to administer public health care programs. As a result, the federal government started an investigation and held hearings in Washington, DC to determine if our state Medicaid program is overpaying these insurance companies. MNA will continue to push for transparency, including third party audits, so taxpayers can finally learn how much of this money goes to provide actual health care, and what goes to insurance company profits. • Willmar State Mental Health Facility: As part of last session’s budget cuts, the Willmar state mental health facility was slated for closure this spring. Due to the work of MNA nurses as well as our labor allies and Willmar legislators, the legislature included funding in the Health and Human Services bill to keep this much-needed facility open for another year, giving lawmakers and the Department of Human Services more time to find a permanent solution. • Nursing Scope of Practice: While no legislation was introduced this session, the Board of Nursing is proposing changes to the Nurse Practice Act that we expect to see in the next legislative session. Their proposal includes expanding the LPN scope of practice to include assessment and delegation. Public “listening sessions” were held all over the state this spring and summer to seek opinions on this proposal. It’s critical that nurses voice their concerns about this proposal. • Budget Amendments: Proposed constitutional amendments that would have made it nearly impossible for future legislatures to raise revenue and would have created even more budgetary gimmicks and gridlock, never made it through the legislative process. Early in the session, MNA nurses lobbied legislators against these proposals at our Day on the Hill. It is the legislators’ job to create a budget, and we believe they need to do the job they were elected to do. Bipartisan Alliances Despite the increasingly partisan nature of the Capitol, MNA was able to work with legislators of both parties to achieve real accomplishments this session. Nurses’ values and priorities are non-partisan. That was truer this session than ever before. MNA members built and strengthened relationships with legislators on both sides of the aisle, especially related to the issues of Right to Work, making neglect of a vulnerable adult a felony, and HMO accountability. MNA also reintroduced our Safe Staffing bill, with bipartisan authors Senator Jeff Hayden (DFL-Minneapolis) and Representative Larry Howes (R-Walker), demonstrating that patient safety isn’t a partisan issue. This session also saw the passage of the most bipartisan Health and Human Services budget bill in recent memory, authored by Representative Jim Abeler (RAnoka) that contained many good items for nurses and patients, including language keeping the Willmar Community Transitional Services facility open. MNA members connected with legislators of both parties, which made us more effective and respected at the Capitol. This led to several legislative victories for nurses, patients and the community. Right to Work One of the most important ways our bipartisan alliances paid off this year was on the issue of Right to Work. While this bill to weaken unions was authored by Republicans and backed by major corporations, there were many Republican legislators (joining with all of the Democratic legislators) who knew Right to Work was wrong for Minnesota. Mostly behind the scenes, these legislators worked to keep the bill from moving forward. Good jobs and the right to a voice in the workplace should not be partisan issue, and we are grateful to all of the Legislators who stood with us to oppose this unfair, unnecessary and unsafe bill. Grassroots Nurse Power Nurses showed even more power at the Capitol this year than ever, with our Day on the Hill early in the session, and tremendous turnout at hearings on Right to Work and the National Nurse Licensure Compact. In addition, nurses made an unprecedented number of contacts with their legislators about these bills. As we continue to defend the nursing practice and the rights of workers, while advancing the causes of patient safety, access to health care and a fair state budget, nurses need to keep up that grassroots action. One way we’re doing that is through the new Regional Action Councils across the state. Six groups have formed (Northwest Minnesota, Northeast Minnesota, West Metro, East Metro, Southwest Minnesota and Southeast Minnesota) to get the word out to nurses about policy issues, as well as to do the electoral and outreach work to increase support of nurses’ values in our communities. Would have made Minnesota a part of the Interstate Nurse Licensure Compact, which allows nurses with a license in one Compact state to practice in any Compact state. Would lower Minnesota’s nursing standards, make patients less safe by allowing unsafe nurses to easily move from state to state, and make it easier for employers to move large numbers of strikebreakers across state lines. “Due to overwhelming advocacy from nurses and other labor allies, Governor Dayton indicated to MNA that he would veto the bill, but it never came to his desk. The House and Senate adjourned before taking a final vote on the Compact. A “no” vote is a good vote for nurses. DEFEATED” Opposed Part of a national effort to dramatically weaken unions and the rights of union members, funded by large corporations. Workers in Right to Work states earn considerably less than those in states with full union membership, making this bill very risky just as our economy is picking up again. The tremendous outpouring of opposition from nurses and fellow union members influenced enough DFL and Republican legislators to stop the Right to Work amendment from completing the legislative process. Despite multiple attempts by proponents from the beginning of session to the very end to pass this amendment, union members and our allies stood together and spoke with one voice about this unfair, unsafe and unnecessary legislation that would tip the scales in favor of big corporations and against working people. A “no” vote is a good vote for nurses. DEFEATED. Opposed Minnesota was one of the few states in the nation that did not treat neglect of a vulnerable adult as a felony. In response to recent news stories about terrible neglect cases, county attorneys and the bill authors crafted the bill to stiffen the penalties for neglect. MNA worked with the authors of this bill to add first-in-the-nation language that protects both vulnerable adults and health care workers. Unlike every other state that punishes neglect of a vulnerable adult as a felony, the new Minnesota law includes language protecting nurses and other health care workers from punishment for neglect that was due to circumstances outside their control, such as unsafe staffing levels. Minnesota is the first state ever to use unsafe staffing levels as an affirmative defense. A “yes” vote is a good vote for nurses. Passed both bodies of the legislature unanimously and SIGNED INTO LAW by the Governor. SUPPORTED Unified Trust Accounts Bill - HF8. Authors: Sen. David Hann (R) and Rep. Steve Gottwalt (R) This bill would have put millions of health care dollars in the hands of the insurance industry with no oversight or protections for Minnesotans. It would have turned our health insurance exchange (the marketplace mandated by the Affordable Care Act to make purchasing health care more efficient and affordable) over to a complicated, costly system of insurance industry brokers who would manage our health care funds, while also getting paid by insurance companies themselves. . This bill passed both bodies of the Legislature but was vetoed by Governor Dayton. A “no” vote is a good vote for nurses. Opposed First Omnibus Tax Bill – HF2337/SF1972. Authors: Sen. Julianne Ortman (R) and Rep. Greg Davids (R) This bill did nothing to address the inequality in our tax system – for example, the richest paying a smaller percentage of their income in taxes than the middle class and working class. While the authors intended the bill to stimulate the economy and create jobs, it probably would have done neither, while giving tax cuts to businesses for things they already do. The bill would have also added to the state’s structural deficit in future years, because the tax cuts it contained were not paid for. This would put our public services, like already strapped schools and health care programs, at risk. DEFEATED. This bill passed both bodies of the Legislature but was vetoed by Governor Dayton.
