HOW TO SUBMIT A VALID TENDER
A tender, the deposit and the envelope in which the tender is submitted must be prepared and submitted pursuant to the Municipal
Act, 2001 and the Municipal Tax Sales Rules.
Only One Parcel of Land
A tender must relate to only one parcel of land, therefore if you want to submit tenders on more than one property, you will need to
submit completely separate tenders for each property.
Preparing a Form 7 – Tender to Purchase

A tender must be in Form 7.
It must be typewritten or legibly handwritten in ink.
It must be equal to or greater than the minimum tender amount advertised.
It must be accompanied by a deposit of at least 20 per cent of the amount tendered
It must be made by way of money order, bank draft or cheque certified by a bank or trust corporation.
It must not include any terms or condition not provided for in the Municipal Tax Sales Rules (Ontario Regulation 181/03).
It must be submitted in a sealed envelope which indicates on it that it is a tax sale and provides a short description or municipal
address of the land sufficient to permit the treasurer to identify the parcel of land to which the tender relates.
8. It must be addressed to the person who holds the position of Treasurer, even if their title is different.
9. It must relate to only one parcel of land, therefore if you want to submit tenders on two properties, you will need to submit two
completely separate “Form 7 – Tender to Purchase” forms or your tender will be rejected.
10. Under “Re: Sale of: (description of land)”, enter the description of the land of which you are submitting your tender. (e.g. the
description of the land as shown on the Form 6 – Sale of Land by Public Tender Advertisement.)

Your tender must be accompanied by a deposit of at least 20% of the amount you tender, so you must calculate it to 3 decimal
points. (For instance, if your tender is $10,000.01, 20% would be $2,000.002, so your deposit would need to be no less than
$2,000.01 or your tender will be rejected.
Your deposit must be made by way of money order or by way of bank draft or cheque certified by a bank or trust corporation. (If
your deposit is made by way of cash, or by way of a cheque certified by a credit union, your tender will be rejected.)

It must indicate on it that it is a tax sale.
It must provide a short description or municipal address of the land sufficient to permit the treasurer to identify the parcel of land

Submitting your Tender

Your tender can be submitted in person, by courier or by mail.
Your tender must be received by the treasurer on or before the time and date indicated in the advertisement for tax sale. If your
tender is received late, it will be rejected.
Withdrawing your Tender

The tenderer must send a written request to the treasurer to have the tender withdrawn.

The written request to withdraw a tender must be received by the treasurer before 3 p.m. local time on the date of the tax sale.
(The envelope containing a tender that has been withdrawn will be opened at the time all other tenders envelopes are opened.
Cancellation of a Tax Sale
The treasurer can cancel a tax sale at any time before a tax deed or notice of vesting is registered on title.

Deputy Treasurer under Section 286(2) of the Municipal Act, 2001, even if their Title is different.
