CONTEST TERMS & CONDITIONS
Information on how to participate and Contest Rules form the Contest Terms & Conditions. By
registering or taking part in this contest, all persons participating herein (the “participants”) agree to be
bound by these Contest Terms and Conditions.
Contest Rules
1. The Contest Terms and Conditions apply to all “WIN a Yacht trip” contest as referred to in paragraph
3 (collectively, the “Contest”). The Contest is open to all individual Singapore residents who are (i) aged
18 and above as at the start of the Contest Period, (ii) not prohibited in any manner by any person,
entity, authority or law anywhere in the world from participating in this Contest or any similar contest,
and (iii) not employees and immediate family members of Nestlé Singapore and its agencies which are
directly involved in this Contest. By participating in the Contest, each participant represents and
warrants that he or she has met the eligibility criteria set out under these Contest Terms and Conditions.
2. The contest period commences at 0000 hours on 21 Feb 2014 and ends at 2359 hours on 10 April
2014, both dates inclusive (the “Contest Period”).
3. Participants are required to purchase $8 worth of qualifying KIT KAT or WONKA products at
participating Cold Storage outlets in Singapore, and submit original tax invoice with a completed Lucky
Draw Participation Form available at the relevant Contest counter to stand a chance to win a Yacht trip.
Three winners will be selected via a lucky draw after the Contest Period. Applicable phone, internet,
postal or any other charges may apply, and the participants shall be responsible for such costs and
expenses. Submission of entries should reach us by post before 13 April 2014. Proof of submission is
not proof of receipt, and Nestlé Singapore shall not be responsible or liable for any delay or non-receipt
of submissions.
4. Only entries that are complete and correct as deemed by Nestlé Singapore (Pte) Ltd and its authorized
employees and officers (“Nestlé Singapore”) will be deemed as eligible. Participants shall participate in
the Contest on his or her own account, and shall not submit forms or participate on behalf of other
persons. Each participant represents and warrants that he or she has obtained all necessary consents,
licences and approvals required in connection with the Contest and his/her participation, and all
materials, documents and forms submitted or created by him or her in connection with the Contest are
original and do not infringe on the rights of any party, including but not limited to any intellectual
property rights, patent, trademark or brand name registered or enforceable anywhere in the world.
5. The draw for the winner will be conducted on the following date and venue or such other date or time
as Nestlé Singapore may determine at its sole and absolute discretion:

Three (3) winners will be drawn on the Date of Draw indicated above.
Winners will be notified via [post] based on the submitted contact details. Winners shall ensure that they
remain contactable at all times. If Nestlé Singapore fails to contact any winner for any reason
whatsoever, it shall at its discretion elect to determine another winner in accordance with the Contest
mechanism.
Travel period for the Yacht trip has to be completed between 1 June 2014 and 30 Sept 2014. Participants
are bound by the terms and conditions of the travel package.
Booking may be made one week prior to charter with [insert travel agency’s name] and subject to the
availability of the yacht. Alternative arrangement will be made if yacht Taylan, or the Manako is not
available. This yacht is available for 10 paxs (four (4) hours on Weekday only) and the trip is done
within the vicinity of Singapore. Food & Beverages (F&B) catering for up to 10 paxs is included in the
charter. Nestlé Singapore reserves the rights in the selection of the F&B caterer.
6. Nestlé Singapore has the right at any time to substitute any Prize with prizes of similar value as
determined by Nestlé Singapore, without notice to you. Prizes won are given out on an ‘as it is’ basis,
and are not transferable, or exchangeable or redeemable for cash. All warranties and representations in
connection with the prizes are expressly excluded to the extent not prohibited by law. Winners are
responsible for collecting in person any prizes won, and agree to comply with and be bound by all terms
and conditions which the Prizes may be subject to. The date(s), time(s) and venue(s) of the collection of
prizes will be notified to the winners.
7. Winners will be required to submit personally the following verification documents to be eligible to
collect any prize: NRIC or passport. The award of prizes shall be subject to verification to the full
satisfaction of Nestlé Singapore. Participants who do not comply with the official Contest Rules shall be
disqualified.
8. Nestlé Singapore has the right to disregard or disqualify any vote, nomination, participant or winner,
in such manner as Nestlé Singapore deems fit, without giving notice or reason, and without any liability
to any person. In particular, no participant shall, or procure another person to, (i) tamper with the
registration process or the operation of the contest or the relevant website, (ii) participate in the contest
in any manner which may create any prejudice to or anomaly in the scoring system or operation of the
contest, and/or (iii) breach these Terms and Conditions, the Computer Misuse Act or any other
applicable law or regulation.
9. Nestlé Singapore may, at its sole discretion, modify these terms and conditions, make prize
substitutions or cancel this Contest, without prior notice to any person. Nestlé Singapore’s decision on
all matters relating to this contest will be final, binding and conclusive on all persons participating in this
Contest, and no correspondence will be entertained
10. Where prizes contain a specified validity period during which it should be utilized, no requests
for extensions or replacements whatsoever will be entertained. Prizes which remain unclaimed by
any participant for 60 days] after the announcement of the winners shall be conclusively forfeited by
such participant, and such forfeited prize shall be dealt with at Nestlé Singapore’s discretion in
accordance with applicable laws.
11. To extent permitted by law, each participant and any person acting on his/her behalf agree that all
relevant organisers (including Nestlé Singapore) of the Contest shall not be responsible or liable for any
loss, injury, death, claim or damage suffered by any person arising out of or in connection with the
Contest and prize(s), and shall release completely and indemnify each the relevant organisers (including
Nestlé Singapore) from any claims losses, damages, costs or expenses incurred in connection therewith.
12. Personal Data
12.1 Each participant's participation in this Contest is conditional upon the participant consenting to
[Nestlé Singapore] and its affiliated companies and business units using the participant's personal data
for the following purposes:




to notify the participant if he/she has won the Contest;
to conduct, manage, and administer the Contest including verifying the identity of participants
for participation or prize collection
for consumer research, promotional, advertising and marketing purposes;
for Nestlé Singapore and its affiliates to obtain feedback on its products and services.
Nestlé Singapore and its affiliated companies and business units may share a participant's personal data
between themselves for administrative purposes, and with third parties supporting their administrative
and business functions. In some cases, this may involve the storage, use, disclosure or other processing,
or transfer of your personal data out of Singapore. Nestlé Singapore and its affiliated companies and
business units may also share a participant's personal data with third parties to carry out crosspromotion. By participating in this Contest, the participant consents to the use of his or her personal
data for the purposes listed above.
12.2 Any information, personal data and material about or obtained from the participant may be
accessed, stored or otherwise processed in any medium or format determined by Nestlé Singapore.
12.3 To find out more about how Nestlé Singapore collects, uses or discloses your personal data, or if
you would like to contact our Data Protection Officer with queries relating to personal data, please visit
our privacy policy at http://www.nestle.com.sg/info/privacypolicy. If a participant wishes to make an
access request or any amendment or correction to his or her personal data, he or she may contact Nestlé
Singapore's Data Protection Officer for information. Administrative charges may apply. If a participant
wishes to withdraw consent to any specific use of his or her personal data, the participant may do so by
completing the withdrawal form available online at www.nestle.com.sg under the “Unsubscribe” tab.
13. Each participant also agrees that all worldwide intellectual property rights in any statement,
materials or content submitted, made or created by a participant in connection with the Contest and any
derivative works arising therefrom will be perpetually and unconditionally vested in, assigned to, and
owned by, Nestlé Singapore. Nestlé Singapore has the right to use and modify such materials/works in
any way it deems fit without compensation to any participant, and each participant waives all rights
(including moral rights) he/she may have in such materials/works.
14. This Contest is governed by Singapore law, and each participant agrees to submit to exclusive
jurisdiction of the Singapore courts.
15. Any trademarks, graphic symbols, logos or intellectual property contained in any materials used in
connection with this Contest, in particular that relating to the Contest prizes, are the property of their
respective owners. This Contest and Nestlé Singapore are not affiliated with, or endorsed or sponsored
by, the relevant owners, where such owners are not part of the Nestlé group of companies.
