29 May - 04 Jun 2014 How to Register your Company and Products under a Preferential Trade Agreement Preferential Bilateral Trade is that exchange of goods and services, which takes place between two parties. Currently, Zimbabwe has such trading arrangements with Botswana, Malawi, Namibia and Mozambique in the region. At the international level, Zimbabwe is signatory to Eastern and Southern Africa (ESA)-European Union (EU) interim Economic Partnership Agreement (iEPA). Zimbabwe is also a member of Regional Trade Agreements namely, the Southern African Development Community (SADC) Trade Protocol and the Common Market for Eastern and Southern Africa (COMESA) Free Trade Area. Qualifying products for these Agreements enter the territory of signatory Member States without payment of customs duty. The interim Economic Partnership Agreement (iEPA) confers quota and duty free access to Zimbabwean products exported into the 28 Member States of the European Union (EU). Qualification Criteria An overarching requirement for qualification to trade under the Preferential Bilateral Agreements is that products to be exported should originate from countries that are signatory to the Agreement. For export products to qualify under these Bilateral Agreements, it is necessary for the exporter to be registered with the Zimbabwe Revenue Authority (ZIMRA). The exporter submits an application to ZIMRA to register both the company and the specific export products. For qualification under the Regional Bilateral Agreements, ZIMRA conducts an on-site inspection of the production process, including an analysis of the costs of production as a key verification criterion of origin of product concerned. To enable the ZIMRA Officials to verify the eligibility of the products, the exporter is required to submit the following documents (listed in Box1 below) in duplicate: BOX 1: DOCUMENTS TO ACCOMPANY APPLICATION FOR PREFERENTIAL TREATMENT OF EXPORTS UNDER A SPECIFIC TRADING AGREEMENT •A formal Application Letter (on a company Letterhead/logo) to be registered under the Agreement. •A certified copy of the Certificate of Incorporation. •A valid Tax Clearance Certificate. •List of contact persons together with their cell numbers and physical addresses. •A list of products intended for export (tariff headings optional). •List of raw materials used and where they are sourced from (tariff headings optional). •A detailed step-by-step description of the manufacturing process for each product. •A Sketch Plan of the factory showing machinery layout. •A certified copy of Title Deeds or Lease Agreements for the premises together with any copies of utility bills incurred in the last 3 months. •A factual production cost analysis of the products intended for export (The production cost analysis must be based on the actual production costs for a period of not less than 3 months). Once successfully registered, an Exporter is then expected to present the Certificate of Origin to ZIMRA to facilitate the export of products covered by a specific Trade Agreement.
