JISETI NA POSTBANK PROMOTION - TERMS AND CONDITIONS The following terms and conditions apply to the JISETI NA POSTBANK PROMOTION. Kenya Post Office Savings Bank (hereinafter referred to as Postbank), as the organizer of the promotion reserves its right to change these terms and conditions and the structure and format of the prizes at any time during the duration of the promotion upon publication on the Postbank website www.postbank.co.ke 1. Objective 1.1. The objective of participating in the JISETI NA POSTBANK PROMOTION is to open a new account or deposit & grow your savings into your existing account for a chance to win the daily and bi-monthly prizes. There will also be a chance to win the grand Prize. 2. Promotion period and eligibility 2.1. The promotion will run from Monday 16th May to Wednesday 27thJuly 2011. 2.2. Entry 2.2.1. There are 2 ways to enter the promotion: o Open a participating Postbank account with a deposit of at least Kshs 500. o Make a deposit of Kshs. 500 (on the same day) or more into an existing participating Postbank account. 2.2.2. The more you deposit and grow your savings, the more chances you have of winning. 2.2.3. Deposits on the passbook are exempted. 2.2.4. The new account or deposit must be made at a Postbank branch or at a Postbank Agent location. 2.2.5. New account holders must meet the minimum account opening requirements for the participating account to qualify. 2.2.6. The accounts eligible for participation are: All Postbank savings accounts including the following: Pamoja Savings Account, Pensions Account, STEP account, Save As You Earn (SAYE) Account and Fixed Deposit Account. 2.2.7. Check off deductions into SAYE accounts and transfers from other Postbank accounts are NOT eligible. 2.2.8. Participation will be by sending an SMS in the manner prescribed and advertised. A computerized system will notify participants of receipt of SMS entry. 2.2.9. Each participant (Account holder) will qualify for one daily entry that will be eligible for the daily, bimonthly and grand draws. The more entries you have the more times you have to participate in the draws. 2.3. Staff of Postbank and its sub-agents, Information Convergence Technologies Ltd and The Advertising Company, their spouses and children are not eligible to participate in the JISETI NA POSTBANK promotion.Each prize winner will be required to declare or affirm in the Form of Discharge that they do not belong to any of the restricted group of persons. 3. Operation 3.1. To enter, you are required to send the following details to the short code number, “5334”, via a short message service ("SMS"). 3.1.1.For all participating accounts except SAYE and Fixed Deposits the following details from the deposit slip: Teller ID (TLR ID), Authorization No (AUTH NO) and Account name as displayed in the Postbank deposit slip in the following format:TLR ID#AUTH NO#Account Name. For example: 6020#0120650#Andrew N Other 3.1.2.For SAYE : The receipt number (as shown in the deposit receipt) and your name as displayed in the bank deposit slip in the following format: Receipt No# Name. For example: 2345678989#Andrew N Other 3.1.3.For Fixed Deposits The customer’s name and Branch. Customer name#Branch 3.1.4.PatacashM-PESA Deposits: The word Patacash followed by the Account Name For example: Patacash#Andrew N Other 3.1.5.For instructions on how to participate, send an SMS message with the word “how” to the short code number 5334. 3.2. To qualify as a valid entry, the SMS message must be sent by on the same date as the date of the deposit. 3.3. By sending this SMS the customer shall be deemed to have expressed his desire and consent for participating in the promotion and to be bound by the terms and conditions of the promotion. 3.4. Postbank shall not be held liable for any failed SMS, including SMS's not received, for whatever reason. 3.5. Each SMS shall be charged at Ksh. 6, which shall be charged against your cellular communication account with the relevant network service provider, and/or deducted from the available credit if you make use of a Pay-As-You-Go pre-paid service. 4. It shall be the sole responsibility of the participant to accurately activate an entry, by texting their details in the prescribed and advertised manner. 4.1. The outgoing SMSs sent by the organizer in reply are FREE of charge and shall not be charged to the customer/client. 5. Prizes 5.1. By sending an SMS to the short code number “5334”, you will become eligible for entry to the following prizes: 5.2. Grand Prizes Grand Winner - A brand new Nissan Pick Up NP 200 estimated at Kshs 1,537,000. 1st runners up – A cash prize of Kshs 500,000. 2nd Runners up – A cash prize of Kshs 300,000. There will be 3 different grand draw winners. Of the above 3 grand draw prizes, a participant can win only a single prize. 5.3. Daily Prizes The total entries for each day of the week will be entered into a draw in which participants stand a chance to win the following prizes over the promotion period: 500 Umbrellas, 500 T Shirts, 500 Cash Deposits of Kshs 1000 each, 300 Gym bags, 100 Caps and 250 air time vouchers of Kshs 1000 each. There are a total 2,150 prizes over the promotion period. A participant can win only one prize per day. 5.4. Bi-Monthly (Every 2 weeks) Prizes The totals entries over weekly periods will be entered into a draw in which participants stand a chance to win the following prizes over the promotion period: 20 Mobile phones, 20 Gas Cooker,1 Home theatre system, 2 Laptops, 1 Fridge and 1 Motor bike. There are a total of 45 prizes over the promotion period. A participant can win only one prize per draw. 5.5. All prizes are non-transferable and no cash or other alternative shall be offered for the prizes 6. Draws and Notifications of Winners 6.1. Actual draw dates will be communicated to the Betting Control and Licensing Board two days prior to each draw. 6.2. For the daily prizes, a separate draw will be held for the entries received on each day/date. Winners will be picked for each of the days/dates. Entries for deposits or new accounts opened on Saturdays will be counted as being for the following Monday. 6.3. Bi-Monthly draws means that winners will be drawn from all the entries received over the 2 weekly period (except for the last draw which may have a longer period) up to the closing date for that period. Entries for deposits or new accounts opened on Saturdays will be counted as being for the following Monday. 6.4. Winners will be randomly chosen using a computerised selection application and the outcome, as may be communicated by Postbank from time-to-time, shall be final. Postbank and Betting Controland Licensing Board reserves the right to conduct a re-run of the random selection process, in the event that it suspects, in its sole discretion, any malfunction, or nefarious conduct during the selection process. The decision on the selected winners is final and no correspondence will be entered into. 6.5. The entries in a particular draw (i.e. daily or bi-monthly) will not be eligible to participate in the subsequent draws of the same category. 6.6. All entries received during the promotion period will be entered into the grand draw. 6.7. The names of the grand draw winners will be published in the press. The names of the other daily and bi-monthly winners will be published in the Postbank website www.postbank.co.ke 6.8. Postbank and Betting Control and Licensing Board reserves the right to disqualify any entrant or withdraw any prize awarded to entrants for interference with the entry process including but not limited to: canvassing, or for submitting an entry which is not in accordance with these terms and conditions 6.9. Postbank reserves the right to withdraw any prizes to be awarded to any person suspected or implicated of fraudulent activities or attempts thereof. 7. Redemption of prizes 7.1. Winners of the daily and bi-monthly draw prizes will be contacted on the cellular number from which their SMS originated or was initiated. Upon notification for the winning of the prize, the winner shall also be notified how to receive it. All customers must keep their mobile phones switched on during the duration of the Promotion in order to be able to receive the winner announcement and not lose their right to a prize. 7.2. Winners will be contacted through telephone number 0702111611. 7.3. All winners must present authentic identification in form of original national identification card or original passport (Or such other valid identification such as a military ID card) plus their Postbank ATM/Debit card, SAYE card or other relevant and acceptable account holding proof or documentation. 7.4. Winners will be required to travel, at their own cost, to the nearest Postbank branch or to the Postbank Head Office in Nairobi to collect their prize. 7.5. By participating in the promotion, you acknowledge and agree that your cellular phone number shall be used as part of the verification method. Postbank shall not be responsible to verify the identity of the mobile device holder, from which the SMS was initiated, or to confirm that it is indeed the holder who initiated the SMS. It is your sole responsibility to ensure safekeeping of your mobile device and you indemnify Postbank against any claim whatsoever as a result of award of any prize to an incorrect person by virtue of third parties having gained access to your mobile device. 7.6. Cash prizes will be awarded by crediting the money into the Postbank accounts of the respective winners. 7.7. You will be required to furnish Postbank with your name, address, proof of bank account details, and a copy of your identification document and agree to provide Postbank with such other information as may be required from time-to-time, in Postbank's sole discretion, before redemption of any prize. 7.8. In addition to any other requirements specified herein, winners will be required to provide the original valid deposit receipt which must not be mutilated, altered, illegible, and incomplete or tampered with in any manner.The information recorded on the receipt must correspond with the computer or other records of Postbank. Any person who forges, alters, attempts to alter, or presents a forged or altered receipt with a view to obtaining a prize is liable to criminal prosecution. 7.9. Postbank reserves the right, at its sole discretion, not to redeem a prize in the event that a person is unable to provide valid proof that they are the winners. 7.10. Winners must claim their prizes within 3 months after the end of the promotion or forfeit their prizes. 8. Publicity and Commercial Communication 8.1. By agreeing to participate in the promotion, all winners of the various prizes agree that Postbank may print, publish, broadcast and use, worldwide, in any media at any time, their names, picture, voice, likeness, and/or biographical/personal or business information for promotional or related purposes without additional compensation. 8.2. By participating in the promotion, the user allows Postbank the right to communicate with themselves by various means including but not restricted to SMS, telephonic and platform communications. 8.3. By participating in the promotion, the participant agrees to opt-in to Postbank’sfuture commercial communication messages and promotions. Participants will be able to opt-out of any commercial messaging by notifying Postbank. At such time, the said participant will be removed from the database without any questions. 9. Amendments to terms and conditions 9.1. Postbank may amend the terms and conditions from time-to-time. By participating in the promotion you are bound to the prevailing version of the terms and conditions. 9.2. If any portion of the terms and conditions is deemed void or unenforceable, then such provision shall only be deemed severable from the remainder of the terms and conditions and shall not affect the enforceability or validity thereof. 10. Indemnity and Other Terms and Conditions 10.1. Although POSTBANK has taken care to ensure that the promotion is accurate and that you suffer no loss or damage as a result of your participation in the promotion, your participation is entirely at your own risk and you assume full responsibility for the risk of loss resulting from your participation 10.2. Postbank is entitled to determine the rules of the promotion at its own discretion, it reserves the right at any time to change or amend them. At any time Postbank reserves the right to stop, discontinue or resume the promotion at its own discretion as well as the participation of anyone when improprieties have been established or suspected. 10.3. Postbank will not be liable to a participant for any monetary loss or damage. Without limitation Postbank is not liable to a participant for any direct or indirect loss, damage or expense regardless of whether the same arose from negligence, breach of contract or otherwise, and regardless of whether Postbank has any control over circumstances giving rise to the claim or not. 10.4. Postbank is not responsible for the inability to secure participation in the promotion due to circumstances out of its control or that of its third party providers – i.e. Force Majeure or problems in the delivery of the SMS services by the respective Mobile operator, which is outside of Postbank’s control. 10.5. By participating in the promotion, you indemnify POSTBANK, its employees, suppliers and representatives against any loss (including consequential loss), damage, cost, claims, or expense incurred by you or any third party as a consequence of you participating in the promotion 11. Jurisdiction 11.1. Participation is limited to subscribers of SAFARICOM and AIRTEL networks /telecommunication companies. 11.2. The promotion is subject to KENYAN legislation and changes thereto. 11.3. Postbank and the Betting Control and Licensing Board reserves the right to, at any point in time, to suspend or terminate the promotion or amend these terms and conditions at any time for any valid technical or commercial reason. 12. Assignment 12.1. Postbank is entitled to cede and assign any of its rights and obligations in respect of these terms and conditions or in respect of any of the services related thereto. 12.2. You are not entitled to cede and/or assign any of your rights acquired in relation to Postbank without first obtaining Postbank’s express written consent. 13. Nefarious conduct 13.1. You agree not to attempt to exploit any error, virus, bug, defect, or inconsistency ("Bug") in the promotion operations and/or any aspect of the promotion to your advantage, or to the disadvantage of any other participants, at any time. Furthermore, you agree to report any such bug to Postbank, immediately upon discovery thereof. 13.2. You will not make any attempts to circumvent the random selection system used in the promotion in electing a daily and bi-monthly winner, or manipulate the outcome of any draw or activity.
