TERMS AND CONDITIONS
By entering the Herald Sun Win a VIP Crown Oaks Experience Promotion, you are agreeing to the following
terms and conditions:
1.
STANDARD TERMS
1.1
Information on how to enter forms part of the terms of entry. Entry into the promotion is deemed
acceptance of these conditions of entry.
2.
WHO CAN ENTER?
2.1
Subject to clause 2.2, entry is only open to residents of Victoria aged 18 years or older.
2.2
Employees and their immediate families of The Herald and Weekly Times Pty Ltd and Victoria Racing
Club (VRC) and their associated agencies and companies are not eligible to enter. Immediate family
means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether by
natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece,
nephew, brother, sister, step-brother, step-sister or first cousin.
3.
HOW TO ENTER
3.1
The competition commences on Thursday October 4, 2012 at 00.01am (AEST) and concludes on
Monday October 8, 2012 at 23.59 pm (AEDT) (“the Competition Period”).
3.2
In order to enter the competition entrants must SMS their full name, age, address and phone
number to 1991 9909 during the competition period.
3.3
Entrants in the competition may enter as many times as they like, however only one (1) prize per
phone number will be awarded. SMS entries via the internet or computer generation are invalid and
will not be accepted.
3.4
The time of entry will in each case be the time the SMS message is received by Salmat Interactive.
3.5
The SMS entry mechanic is only open to readers with an SMS compatible mobile phone connected to
a service provider which permits text messaging to the promotional SMS number. It is recommended
that entrants check with their individual service provider in this regard. For SMS help call 1300 131

3.6
Each SMS entry will be charged at a premium rate, namely $0.55 (including GST), which covers the
cost of the entry and reply message.
3.7
The time of entry will, in each case, be the time that the SMS is received by Salmat Interactive.
3.8
The Promoters, their agents, affiliates or representatives will not be liable for any late, lost or
misdirected entries.
4.
HOW TO WIN
4.1
Each entrant who has entered the competition over the Competition Period and registered all
details in accordance with clause 3 will be entered into the prize draw. The draw will be a random
selection and will take place at Salmat IDR, Level 2, 116 Miller Street, North Sydney NSW 2060 on
Tuesday October 9, 2012 at 10.00am (AEDT).
4.2
The first valid entry drawn will be the major winner. The next twenty valid entries drawn will be
the runners up.
4.3
The major prize winner will be notified by phone within 3 working days of the draw, a letter advising
the winner of their prize will also be mailed out and their name will be published in the Herald Sun
public notices on Thursday October 25. The twenty (20) runners up will be notified in writing.
4.4
The Promoter’s decision is final and the Promoter will not enter into correspondence regarding the
result.
4.5
It is a condition of accepting the prize that the winners may be required to sign a legal release in a
form determined by the promoters in its absolute discretion.

4.6
Entries not completed in accordance with these terms and conditions will not be considered valid
and will not be included in the draw. Indecipherable or incomplete entries will be deemed invalid.
4.7
The Promoters reserve the right to verify the validity of entries and to disqualify any entry which, in
the opinion of the Promoters, includes objectionable content, profanity, potentially insulting,
inflammatory or defamatory statements, disqualify any entrant who tampers with the entry
process, who submits an entry that is not in accordance with these terms and conditions of entry,
or who has, in the opinion of the Promoters, engaged in conduct in entering the promotion which
is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the
promotion and/or Promoters. The Promoters reserve the right to disqualify a winner if the
Promoters become aware that the winner and/or the winner’s entry is of a type described in this
clause.
5.
PRIZES
5.1
There will be one (1) major winner. The major prize winner will receive the following prize package
as set out below:
Two (2) tickets to the VRC Oaks Club Luncheon held at Crown Melbourne on Wednesday
November 7, 2012. Valued at $490.
A luxury overnight stay at Crown Metropol for two (2) people for the night of Wednesday
November 7, 2012. Valued at $295.
Return transfer to Flemington Racecourse by Melbourne Cup helicopters on Thursday
November 8. Valued at $800
Dining for two (2) in The Champions Lounge Crown Oaks Day, Thursday November 8, 2012.
Raceday hospitality including cocktail menu all day, beverages, race books, ticketing and
access to Lawn Stand Seats. Valued at $1080.
Total value of the major prize is $2,665.
There will be twenty (20) runners up. Each runner up will win a double pass to Crown Oaks Day on
Thursday November 8, 2012, with reserved covered lawn seating access. Each prize is valued at
$110. The total value of the runner up prizes is: $2200
Total Prize pool valued at $4,865.
5.2
The major winner and their guest must both be aged 18 years or older as of November 7, 2012.
The major winner and guest will be asked to provide proof of age.
5.3
Prizes are forfeited and not redeemable for cash if unable to attend the events on the dates and
locations stipulated. If for any reason the winner does not take the prize or any element of the
prize at the time stipulated by the Promoter, then the prizes or any element of the prize will not be
redeemable for cash or transferable.
5.4
Spending money, meals, insurance, transport and transfers unless specified, items of a personal
nature, in-room charges and all other ancillary costs are not included.
5.5
The prizes are not transferable, exchangeable or redeemable for cash. In the event of that any
prize item is unavailable; the promoter reserves the right to substitute a prize item of equal or
greater value.
5.6
In participating in the prizes, the winners agree to participate and co-operate as required in all
editorial activities relating to the promotion, including but not limited to being interviewed and
photographed. The winners grant the Promoter a perpetual and non-exclusive licence to use such
footage and photographs in all media worldwide and the winners will not be entitled to any fee for
such use.
6.
NO LIABILITY
6.1
In the case of the intervention of any outside act, agent or event which prevents or significantly
hinders the Promoter’s ability to proceed with the competition on the dates and in the manner
described in these terms and conditions, including but not limited to vandalism, power failures,
tempests, natural disasters, acts of God, civil unrest, strike, war, act of terrorism, the Promoter may

in its absolute discretion cancel the competition and recommence it from the start on the same
conditions, subject to State Legislation.
6.2
The Herald and Weekly Times Ltd and VRC and their associated agencies and companies will take
no responsibility for prizes damaged or lost in transit, or late, lost or misdirected mail.
6.3
The Herald and Weekly Times Ltd and VRC and their associated agencies and companies will not be
liable for any misadventure, accident, injury, loss (including but not limited to consequential loss) or
claim that may occur:
a) during the draw;
b) whilst undertaking any travel won on or connected with their entry into the draw; or
c) in the participation in any prize;
d) as a consequence of late, lost or misdirected mail;
e) due to the broadcast of any program relating to the competition or the publication of any
material, including any statements made by any compere, staff member, journalist, other
entrants or any other person;
f)
in relation to failure of an SMS entry message to be received by the promoter on account of
technical problems or traffic congestion;
g) arising from or related to any problem or technical malfunction of any telephone network or
lines or mobile communications network related to or resulting from participation in this
promotion;
h) due to circumstances outside the Promoter’s reasonable control.
6.4
The Herald and Weekly Times Ltd and VRC and its affiliates assume no responsibility for any error,
omission, interruption, deletion, defect, delay in operation or transmission, communications line
failure, theft or destruction or unauthorised access to, or alteration of, entries, and reserves the
right to take any action that may be available.
6.5
If, for any reason, this competition is not capable of being conducted as planned, including, but not
limited, due to tampering, unauthorised intervention, fraud, technical failures or any other causes
beyond the control of the Promoter which corrupt or affect the administration security, fairness,
integrity or proper conduct of this competition, the Promoter reserves the right, in its sole discretion,
to disqualify any individual who tampers with the entry process, take any action that may be
available, and to cancel, terminate, modify or suspend the competition, subject to State Legislation.
7.
PROMOTER’S DETAILS
7.1
The Promoter is the Herald and Weekly Times Pty Ltd ABN 49 004 113 937 of HWT Tower, 40 City
Road, Southbank VIC 3006.
7.2
The Sponsor is the Victorian Racing Club (VRC).
7.3
Entry details remain the property of the Promoter and its related entities. The promoter is collecting
the entrant's personal information for the purpose of conducting and promoting this competition
(including but not limited to determining and notifying winners). The entrant's personal information
may be disclosed to VRC for this purpose. The entrant may request access to his or her personal
