Rules of Competition
Discovery Science Competition (“Competition”) – 1.10.2013 – 25.10.2014
1. This Competition is organised by Discovery Communications Europe
Limited (Company No. 05039068) located at Discovery House, Chiswick
Park Building 2, 566 Chiswick High Road, London, W4 5YB, United Kingdom,
(the "Promoter"). All participants taking part in this Competition
(”Participant(s)”) will be deemed to have read and understood these rules
(“Rules” which term includes any amendments thereto) and to have agreed to
be bound by them. The Promoter will publish any amendments to the Rules
on the website http://www.yourdiscoveryscience.com/ (“Website”) and
participants agree that the amendments shall form part of the Rules, and shall
apply to this Competition from the date of publication on the Website. All entry
instructions form part of the Rules.
2. The Competition is open to residents of Netherlands, Belgium, Switzerland,
Denmark, Finland, Iceland, Norway, Sweden, Russia, Ukraine, Belarus,
Lithuania, Estonia, Latvia, Georgia, Romania, Bulgaria, Albania, Serbia,
Croatia, Slovenia, Macedonia, Bosnia, Malta, Montenegro, Moldova,
Slovakia, Hungary, Czech Republic, Greece, Cyprus, Egypt, Turkey, Israel,
Kazakstan, Kyrgyzstan, Armenia, Afghanistan, Bahrain, Iran, Iraq, Jordan,
Kuwait, Lebanon, Oman, West Bank, Gaza Strip, Palestine, Qatar, Saudi
Arabia, Syria, United Arab Emirates, Yemen excluding employees of
Promoter and their families, the Promoter's agents or anyone professionally
associated with the Competition. Only one entry per person is permitted.
3. Entrants under 18 years old must gain the permission of their parents or
guardians to enter the promotion. If parental or guardian consent is found not
to have been given, the prize may not be awarded to that winner. Proof of
identification may be required at the request of the Promoter.
4. Participants expressly declare and represent that (i) they submit to the laws
and jurisdiction of England in participating in this Competition and (ii) they are
individuals and not a company or any professional and/or commercial entity.
5. The Competition will run from 1 October 2014 to 25 October 2014. The
closing time and date for receipt of entries is 23:59 hr. (GMT) on 25 October
2014.
6. Method of Entry
No purchase is necessary to enter the Competition.
The Competition must be entered by sending an email to
[email protected] attaching a video of your answer to the
question ‘Why can’t you live without science?’
a. Duration of videos should not be longer than thirty (30) seconds and
may be submitted in English language or one of the recognized
languages of the regions included in this Competition.
b. All entry information, including the images and videos uploaded, once
submitted becomes the property of the Promoter. The Promoter
reserves the right to use this information worldwide across its
websites, social media sites and for promotional use where it sees fit.
c. Participants pledge that any content submitted within their entry has
been created by themselves and is not the property of any other
individual, group, organisation, company or government.
d. Each entry is subject to approval by Promoter.
e. Any entry that is deemed as offensive, inappropriate, obscene,
unlawful or otherwise objectionable content or information will not be
granted approval and will therefore be excluded from the Competition.
f.
Entries must not contain or refer to any third party brand and must not
contain or reference any third party names, logos and/or trademarks.
g. Entries must not use images which are under copyright nor images of
third parties other than the Participant. The Participant hereby
irrevocably consents to the use of Participant’s personal image in the
videos (if any) by the Promoter, in any media or platform whatsoever
and worldwide.
h. All entries will be moderated to ensure they meet the criteria set, any
not meeting the minimum criteria will be disqualified.
7. By entering, the winner gives their consent to the Promoter to use their
names and country of residence in any publicity relating to the competition.
8. Participants and specifically the winner of the Prize irrevocably agree that the
ownership of all intellectual property rights in their video, including but not
limited to copyrights, shall belong exclusively to Promoter and are hereby
assigned to Promoter worldwide and in perpetuity. As one of the conditions
for confirmation of a winner of a Prize, or and entry to the competition, such
Participant shall, if required by the Promoter, execute any such document as
may be necessary or proper to evidence or secure to the Promoter the rights
granted under this paragraph.
9. Prizes
There is one prize (“Prize”) which shall consist of:

a star will be named after the Prize winner.
This will be a real star that’s clearly visible from Europe will be named
after the winner and the star naming process will be recorded in the
globally recognised Star-naming Registry - a registry in which star
names are recorded, administered and audited. The winner will be
required to provide us with the relevant data and once the process is
completed he/she will receive a certificate and star chart. The naming
of the star will be valid for a lifetime.


The combined value of the Prize is valued at approximately £405.
The winner of the Prize will be required to comply with the laws, regulations
and customs the winner’s country of residence, host countries, and conditions
stipulated by prize sponsors.
The Prize winner shall be solely responsible for any other expense incurred
by the Prize winner and/or guest, which has not been expressly undertaken
by the Promoter in these Rules.
There shall be no replacement or substitute prize or any other form of
compensation, and the Promoter may in its sole discretion determine whether
to select another Prize winner if the original winner’s entry is invalid in any
way.
The Prize winner accepts the Prize at their own risk. The Prize winner
understands that the Prize is being made available to the Prize winner on
condition that the Prize winner will hold safe the Promoters from any claims or
liability arising from any loss or damage, injuries, illness, loss or expenses
arising from any part of the Prize.
10. Any applicable taxes on any element of the Prize will be paid by the winners,
to the fullest extent permitted by the law of each applicable jurisdiction. It is
the responsibility of winners to report their Prize to the relevant authorities
and to pay any applicable tax or duties including without limitation custom
duty and related taxes, if and when applicable.
11. The Prize is non-exchangeable, non-transferable and non-refundable and
there is no cash alternative in whole or in part. The Prize is subject to
availability and in the event of circumstances outside of its control the
Promoter reserves the right to substitute a similar or alternative prize of equal
or greater value. The Prize must be taken up only by the winner.
12. The Prize shall be awarded to the Participant who submits the best answer
(as determined by the Promoter in its sole discretion) to the question as
decided by the Promoter.
13. The decision of the Promoter will be final and no correspondence will be
entered into.
14. The winner will be selected and notified by email by 27 October 2014 using
the details submitted by the winner with their contest entry. The name and
country of the winner will also be published on the Website. The winner must
claim his/her prize no later than by 29 October 2014, 18:00 hr (GMT). In the
event that, for any reason whatsoever, any winner does not or is not able to
claim his/her Prize by the stipulated time, whether due to a failure to comply
with these Rules, or if the winner cannot be contacted from the details
supplied, then the Prize will be deemed forfeited, and Promoter may at its
sole discretion determine whether to select another winner from all of the
remaining entries. The Promoter reserves the right to disqualify any
Participant and/or winner in the event of non-compliance with these Rules,
and in its sole discretion determine whether to select an alternate winner.
15. The Promoter reserves the right to vary details of any of the prizes, or
substitute any prize with a prize of equivalent value. The Promoter may at its
sole discretion extend the closing time and date, suspend, terminate or
modify the Competition and/or the Rules prior to the closing date by notice
published on the Website.
16. By participating in this Competition, Participants hereby irrevocably transfer
and assign of all of their rights to any intellectual property in the Participant’s
entry to Promoter. Participant hereby irrevocably transfers and assigns to
Promoter any and all rights in and to the Entry including without limitation all
copyrights and financial rights thereto, worldwide, in perpetuity and in any
media whatsoever including without limitation the rights to reproduction,
broadcasting, rebroadcasting, public performance, public communication,
translation, adaptation, rental, lending or making the work available to the
public in any manner, including through computers, internet, information
networks, communication networks and other means, as well as translation,
adaptation, license, transfer and any kind of disposal of such rights. All
submitted entries will not be returned to the Participant, and shall be the
exclusive property of the Promoter, and the Promoter shall have the exclusive
right to use or deal with the entries and content therein, including for example,
to modify and publish the entries or any part thereof, and to license,
sublicense and assign rights thereto to third parties.
17. To the fullest extent permitted by applicable law, the Participant agrees that
Discovery Communications Europe Limited’s privacy policy set forth in
http://www.discoveryuk.com/privacy-policy/ shall apply to the treatment of
each Participant’s personal data, and consents to the processing of their
personal data by Discovery Communications Europe Limited as Data
Controller (as defined in the United Kingdom’s Data Protection Act 1998) for
the purposes of the administration of this Competition and any other purposes
to which the Participant has expressly consented. Where required by
applicable law, Promoter will comply with applicable local law on protection of
personal data and warrants that all personal data received in connection with
the Competition will be treated in accordance with the standards set out in the
Data Protection Act 1998.
18. The Promoter cannot accept any responsibility for any damage, loss, injury or
disappointment suffered by any Participant entering the Competition or as a
result of accepting any prize. The Promoter is not responsible for any
problems or technical malfunction of any computer on-line systems, servers,
or providers, computer equipment or software, failure of any email or entry to
be received on account of technical problems or traffic congestion on the
internet, or at any website, including any injury to or resulting from
participation or downloading any materials in the Competition. Nothing in
these Rules shall exclude the Promoter’s liability for death as a result of its
negligence.
