ON LOT 1388 & 915, MUKIM OF RASAH, DISTRICT OF SEREMBAN, STATE OF
NEGERI SEMBILAN DARUL KHUSUS (“THE PROPERTIES”) ON THE VERIFICATION
OF OWNERSHIP EXERCISE TO FACILITATE THE TRANSFER OF INDIVIDUAL TITLES
TO PURCHASERS VERIFIED AS OWNERS
IN THE HIGH COURT OF MALAYA AT KUALA LUMPUR

1) TAKE NOTE that this is the FINAL NOTICE from us as Liquidator of Kemayan
Resources Sdn Bhd (In Liquidation) (“KRSB”) to all purchasers and financial institutions
of the fifty nine (59) lots at Rasah Kemayan Golf and Country Township (“the
Properties”) all located on Lot 1388 & 915, Mukim of Rasah, District of Seremban,
State of Negeri Sembilan Darul Khusus (“the Project’) whom have yet to revert to the
Liquidator on the Verification of Ownership Exercise (“the Verification Exercise”) to
facilitate the transfer of individual titles to purchasers verified as owners.
2) Prior to the transfer of Individual Titles of the Properties to the Purchasers, the
Liquidator will be carrying out a Verification Exercise to verify the Purchasers ownership
of the Properties. The Individual Titles of the Properties will ONLY be transferred to the
Purchasers once the Liquidator has verified the Purchasers ownership of the
Properties.
3) Please find below the details of the fifty nine (59) lots in which the Verification
Exercise is to be carried out to determine the ownership (purchasers) / beneficial
interest (financial institution) of the same and to facilitate the transfer of the Individual

4) To facilitate the Verification Exercise and subsequent transfer of Individual Titles of the
Lots to Purchasers, Purchasers are requested to prove their beneficial ownership of the
Lots for the abovementioned purpose at their own costs, unless the Court orders
otherwise, by submitting the documents in full set and certified as true copies by a
solicitor (unless advised otherwise) with the required payments to the Liquidator,
listed below:
a) Latest correspondence address and contact number of the purchasers;
b) Two (2) Certified true copy by a solicitor of the Identity card (for individual);
c) Two (2) Certified true copy by a solicitor of the Director’s identification Card (for
companies);
d) Two (2) Certified true copy by a company secretary of the Form 9, Form 13
(where applicable), latest Form 24, latest Form 49, Company’s Resolution and
Memorandum & Articles of Association (for companies);
e) Two (2) Certified true copy by a solicitor of the Principal Sale and Purchase
Agreement;
f) Two (2) Certified true copy by a solicitor of the Sub-Sale and Purchase
Agreement (where applicable);
g) One (1) Certified true copy by a solicitor of Loan Agreement (where applicable);
h) One (1) Certified true copy by a solicitor of the Deed of Assignments (where
applicable);
i) One (1) Certified true copy by a solicitor of the Deed of Receipt and
Reassignment (where applicable);
j) One (1) Certified true copy by a solicitor of Deed of Mutual Covenants (where
applicable);
k) One (1) Certified true copy by a solicitor of Proof of Payments (Official receipt of
BHSB, Financier’s loan disbursement advice or other form of payments);
l) One (1) Certified true copy by a solicitor of other supporting documents which is
relevant;
m) One (1) certified true copy of the latest quit rent receipt; and
n) One (1) certified true copy of the latest assessment receipt.
5) All required documents and payments must be received by the Liquidator on or before
10th November 2014 (“the Deadline”) at the following address:

All financial institutions which have provided any form of financing assistance to the
purchasers of the Properties and/or have beneficial interests in the Properties will also
be requested by the liquidator in writing to furnish the abovementioned documents.

PLEASE NOTE that the Liquidator has no knowledge if the Properties have been sold
by the Developer of KRSB previously as he does not have in his custody any
purchasers listing and records pertaining to the sale transactions of the Properties. In
this regards, the Liquidator is solely relying on the documents provided by you (if any)
to establish the beneficial ownership / beneficial interest of the Properties for the
transfer of individual titles.

Kindly note that if the Liquidator does not receive on or before the Deadline, the
required documents and payments to facilitate the Verification Exercise and the
transfer of Individual Titles of the Properties to Purchasers verified as owners or the
required documents from financial institution to confirm their beneficial interests in the
Properties, the Liquidator shall deem that the Properties (the title is still in the name
of KRSB) is unclaimed / unsold and shall proceed to dispose of the same without
further notice to you. The Liquidator will not be held liable for any disposal of the
Properties should Purchasers / Financial Institution reverts with claims after the
disposal of the Properties.
