What an extraordinary year 2009
was for the U.S.-Denmark relationship. President Obama visited
Copenhagen twice. We also welcomed the First Lady, Secretary
of State Hillary Clinton, Speaker
of the House Nancy Pelosi, five
other cabinet members, Senators
Kerry, Bond, and Inhofe, twenty
members of Congress, governors,
mayors, Chicagoans – and Oprah.
The visits of these and many
other Americans in government,
business, sports, and culture
have provided great opportunities to celebrate and deepen the
friendship among Danes and Americans. The alliance between the
United States and Denmark has
never been stronger. My thanks
to AmCham for your continued
support to the Embassy since my
arrival on July 29, 2009, especially
for co-sponsoring the USA Booth
at Bright Green during COP-15. I
look forward to many more joint
efforts to promote American business opportunities in Denmark.
Despite the economic difficulties many companies have faced
over the past year, there is a sense
of continued optimism among
AmCham members. I share your
positive view that 2010 will be a
better year than last year and that
we can now see the international
tides changing. We at the U.S.
Embassy will continue to press
forward on many fronts, but in
particular in helping to build even
more robust commercial ties
between the United States and
Denmark. This will include major
as well as smaller events to bring
together innovative American and
Danish firms to find ways they can
partner in building better, smarter,
more sustainable products that
will benefit consumers in both
countries and beyond, particularly
in the clean energy sector.
We also look forward to acting
on President Obama’s program to
help put Americans back to work
and our nation back on a path to
sustainable economic growth. A
key element in supporting this
effort will be the implementation
of the National Export Initiative
(NEI), launched in his recent State
of the Union address to Congress.

exports over the next five years
and support two million jobs in
the U.S. This will be a ”whole of
government” approach to promoting U.S. exports, including the
creation of an Export Promotion
Cabinet reporting to the President
consisting of top leaders from the
Agriculture, Commerce, State, and
Treasury and Departments, the
Export-Import Bank, the office of
the United States Trade Representative, and the Small Business
Administration. It will also provide
substantially more resources for
the Commerce Department to
help U.S. firms increase exports.
As Secretary of Commerce Gary
Locke announced, the initiative
will include three areas of focus:
– A more robust effort by the
U.S. Government to expand its
trade advocacy in all its forms,
including educating U.S. companies about opportunities overseas,
direct-ly connecting them with
new customers, and advocating
more forcefully for their interests;
– Improving access to credit
in the wake of the financial
crisis, especially for small- and
medium-sized businesses that
want to export;
– Continuing the rigorous
enforcement of international
trade laws to help remove barriers
that prevent U.S. companies from
getting open and fair access to
foreign markets.
These areas are consistent
with AmCham’s priorities, and
I look forward to working with
all of you to promote President
Obama’s agenda. As Secretary
Locke said when announcing the
NEI, ”From the advent of the
phone, to the automobile, to new
drug therapies and the Internet,
America’s strength has always
been its peoples’ ability to create
and sell products and services
that help others around the world
lead healthier, wealthier and more
productive lives.” This describes
the best of American business. I
thank and congratulate each of
you for playing your part in living
up to this aspiration.
Laurie S. Fulton
Before being appointed U.S. Ambassador
to Denmark, Ms. Fulton was a Partner at
Williams & Connolly LLP, where she had a
national practice in complex civil litigation,
internal investigations and white collar
criminal defense. In 2004, she was named
one of “Washington’s Top Lawyers” by the
Washingtonian magazine.
Ms. Fulton has co-chaired the Criminal Litigation Committee of the Section of Litigation
of the American Bar Association. She was appointed and confirmed by the U.S. Senate to
serve on the Board of Directors of the United
States Institute of Peace from 2004 to 2008,
and serves as Co-Chair of USIP’s International
Advisory Council. She has been active in nonprofits and community organizations such as
Bright Beginnings, Inc., Girl Scouts Women’s
Advisory Board, Alumni Admissions Interview
Program at Georgetown Law School and the
South Dakota Farmers Union Foundation.
Prior to entering the field of law, Ms. Fulton worked on Capitol Hill and as Executive
Director of Peace Links and Access, A Security
Information Exchange.
Ms. Fulton holds a B.A. from the University
of Nebraska at Omaha and a J.D., magna cum
laude from Georgetown University.

and some of our key achievements. Our efforts this past
year took many forms, including
policy-driven meetings with key
ministers and political decisionmakers, as well as business
leaders; stimulating, high-level
networking events; and top notch
promotion and profiling opportunities for our members.
2009 was also a year for AmCham to review and improve the
way in which we communicate
with our members. The migration to the html based Business
Brief was one step in this process
that has allowed AmCham to
communicate important news
and upcoming activities quickly,
easily, effectively and timely to
the members.
More importantly, AmCham
invested in its most important
communications tool in 2009 –
the new www.amcham.dk, which
was officially launched on January
25, 2010.

Throughout the year, AmCham Denmark worked to provide members access to key business and political leaders through a series of meetings and events. Whether speaking out on behalf of its members,
facilitating personal face-to-face contact, or just drawing attention to the important contributions
international companies make to Denmark, its economy and its ability to compete, AmCham excelled
in 2009.
CONNECTIONS
2009 presented outstanding opportunities for AmCham members to connect with other high level
executives, diplomats and politicians in a variety of settings. From AmCham’s 10th anniversary
celebration to the IOC and COP 15 in Copenhagen to technical knowledge exchange conferences like
the Analytical Instruments Committee’s ESAC and critical information sharing OSAC events, the
strength of AmCham’s network was clear.
SERVICE
AmCham makes it a priority to provide top-notch service to its member companies. Whether assisting
with high level executive visits, providing high quality opportunities for company promotion, or helping
companies get their key messages out to AmCham’s extensive membership network, AmCham members benefitted in 2009.

AmCham Denmark’s policy efforts gained momentum in 2009
starting with the January Board
of Directors’ round table with
then Prime Minister Anders Fogh
Rasmussen. AmCham’s efforts
and access to key decision makers
continued throughout the year,
communicating members’ issues
at several key opportunities and
paving a solid path for a stronger
voice for international business in
2010.
Some important policy highlights of 2009 include round
table meetings with Margrethe
Vestager, Social Liberal Party
Leader in February; Minister for
Business and Economic Affairs,
Lene Espersen, in May; Minister
for Education, Bertel Haarder,
in September; and Minister for
Justice, Brian Mikkelsen, in November. Each of these meetings
focused on communicating the
issues that face internationally
operating companies in Denmark,
Danish and non-Danish, as they
pursue solutions to Denmark’s
shortage of highly qualified labor.
These meetings have spurred
action in several areas including
non-EU driver’s license exchange
and international school capacity.
Additionally, AmCham’s Healthcare Committee dedicated 2009
to pushing for solutions to issues
in the Danish healthcare system,
specifically those issues that
prevent the timely integration of
innovative treatments and the
practices involved in performing
clinical trials that prolong and
complicate the process. In a round
table meeting with Minister for
Health and Prevention Jakob Axel
Nielsen in April the committee
outlined the challenges and the
real threat of diminishing investments in Denmark if these issues
are not addressed. To further
emphasize their importance, AmCham dedicated the 2009 Foreign
Investors Summit to these issues.
“Diagnosing the Danish Healthcare
System” was held in September
in the historic Landstingsal in
Christiansborg and featured
focused discussions with both politicians and the General Director
for the Danish National Board of
Health, Jesper Fisker.
To round out the year, AmCham presented its 2009 Foreign
Company of the Year award to Iron
Mountain A/S at the traditional
Ambassador’s reception at Rydhave in October. A true testament
to the contributions that international business makes to Denmark, Iron Mountain’s Managing
Director Søren Eltorp, eloquently
accepted the award on behalf of
the company’s employees, partners, and loyal customers.

AmCham’s Trans-Atlantic Access Strengthened in 2009

Ample opportunities presented
themselves in 2009 for AmCham
to take part in discussions on
issues of trans-Atlantic importance. Its access to the right
officials throughout the year gave
AmCham Denmark a clear line for
communicating both the issues,
and some proposed solutions to
barriers affecting trade across the
pond.
Hosting the United Nation’s
COP 15 conference, Copenhagen
was a year-round hot spot for
climate and energy policy. Already
in February AmCham Denmark
had its first meeting with U.S.
climate policy experts – Stephen
Eule from the U.S. Chamber’s
Institute for 21st Century Energy
and Norine Kennedy from the U.S.
Council for International Business – to discuss the challenges
to reaching an agreement at
COP 15. Rounding out the spring,
AmCham and partner Climate
Consortium delivered an executive
breakfast briefing on the ”Energy
and Climate Change Challenge”
featuring experts Mark Spelman,
Accenture, and Katherine Richardson, Copenhagen University.
AmCham kicked into high gear
in the fall with several events
focusing on climate change. From
a business perspective, climate
change legislation can have far
reaching implications. In a joint
event with General Electric, CEO
Jeffrey Immelt and COP 15 Host,
Danish Climate Minister Connie
Hedegaard, discussed just what
steps GE has taken to be a leader
in implementing climate change
initiatives throughout the corporation.
Finally, AmCham pulled out all the
stops, closely cooperating with
the U.S. Embassy to produce the
USA Pavilion at Bright Green, DI’s
Climate Conference held during
COP 15. This cooperation allowed
AmCham to continue to build
upon its trans-Atlantic ties in
meetings with, among others,

– no matter what else happens,
business goes on. That’s what
AmCham members experienced
in a number of informative and
insightful, high-quality events.
In February, AmCham held the
first Outlook 2009 at ISS with a
look at successfully navigating a
company through the economic
downturn. Experts addressed the
challenges and pitfalls of developing business strategies within a
time of economic uncertainty and
some good advice for minimizing
bad decisions. The second Outlook 2009 held at EDS took this
a step further, looking at how,
when, and what to communicate
internally and externally during
an economic downturn. Both
events were well attended by the
who’s who in AmCham’s member
network.

AmCham hit a key milestone in 2009 – 10 years of
representing international business in Denmark.
We felt this was a milestone worth celebrating, so
that is exactly what we did. We celebrated both at
the Annual General Meeting held at A.P. MøllerMærsk in March and at the Anniversary Celebration
and reception held at Tivoli Castle in May, reminiscing AmCham’s past and looking forward to its
next decade. We also celebrated the companies

On behalf of its members, AmCham uses its persuasive voice to ensure an optimal business and investment
climate in Denmark. AmCham’s work is divided into three coordinated areas:

AmCham’s work is based on member driven policy initiatives determined through annual surveys and
round table meetings. This special section contains AmCham Denmark’s policy positions in several key areas.

Policy, Advocacy and AmCham
AmCham Denmark’s policy and advocacy is driven by the
concerns and needs of AmCham member companies.
Through annual surveys, executive meetings and committee work, AmCham develops policy positions on issues impacting its member companies. Effective resolution will support building an optimal, sustainable foreign
investment environment in Denmark and minimizing
barriers to international commerce. Our policy positions
are grounded in the best available evidence, transparent
and free from conflict of interest.
One of the principle activities of AmCham Denmark is
to represent the internationally oriented business community as well as to facilitate the entrance of potential
new investors into Denmark. The member companies
of AmCham represent many of the largest companies
in Denmark with a majority of foreign direct investment
and trans-Atlantic trade.
Exchange of non-EU
Driver’s License
Foreign workers from EU-countries, Nordic Countries, Lichtenstein, Japan, South
Korea, Russia or Switzerland may simply exchange their domestic driving license for
a Danish driving license. On the other hand, other foreign talents from, for example,
the USA, Australia, Canada, India and China, need to pass a driving test to obtain a
Danish driving license.
AmCham Denmark believes the process that must be undertaken in Denmark to
drive a car legally is extreme. Several suggestions to simplify the process have
been communicated to the Ministry of Justice. These are:
a. Extend the timeframe for exchange from the current 14 days
to minimum 6 months from the time the residency permit is granted.
b. Offer the theoretical test in English.
c. Offer an abbreviated theoretical test and remove the requirement
for a practical test.
d. Allow driving tests to be taken in private vehicles.
e. Ensure the availability of the study guide in English.
f. Establish a “Fast Track” procedure for expatriate professionals
over the age of 24.
When one considers that the average foreign manager and his/her spouse entering
Denmark have been licensed drivers in a country other than Denmark for several, if
not many years, it seems overly burdensome to have to retake a driving test. Especially when put into the perspective that a tourist can legally drive in Denmark for
up to six months (the entire legal length of stay on an extended tourist visa).
While this issue seems minor, it has such a substantial impact on the on-boarding
of expat families, that its importance cannot be overstressed.

HEALTHCARE
AmCham Denmark is convinced that Denmark has the means to build on areas necessary to create a world class healthcare system. But there is a long way to go. The most
striking evidence is that Denmark has one of
the lowest life expectancies among the OECD
countries – 23rd position with 78.4 years,
well behind neighboring Sweden, Finland,
Norway and Germany. Though boasting one
of the highest life expectancies in 1960, Denmark has fallen short of reaping the benefits
that innovation has contributed to increasing
life expectancy in other EU countries.
AmCham brings together international experience and perspective from both domestic
and foreign healthcare companies and is
strongly committed to making the Danish
healthcare system a world class provider of
treatments that ensure quality of care. What
is needed is a reason for them to invest and
grow jobs.
AmCham believes that improving the quality of healthcare and making Denmark an attractive environment for healthcare companies to invest in are fundamentally linked.

school capacity. This negatively impacts the company’s ability to compete in the global marketplace.”

INTERNATIONAL SCHOOL
CAPACITY IS INSUFFICIENT
For foreign workers with school age children, a major challenge is securing a place at an international
school. It has previously been estimated that there is a shortage of 2,400 international school places
in the greater Copenhagen area. The study “Staying in Denmark – Denmark Is a Nice Place to Work”
showed furthermore that 37% of the foreign workers who already live in Denmark were considering
moving due to the lack of school places. AmCham Denmark believes that there is a big demand for
capacity in international schools and that it is a serious problem in relation to attracting and retaining
foreign talent.
AmCham has communicated this issue to the Minister of Education along with several suggestions
which will help to increase capacity through enabling the expansion of existing schools and the establishment of new international schools. They are:
a. Modify the applicable law (Friskoleloven) to allow international schools to establish branches
of existing schools
b. Introduce the International Baccalaureate (IB) degree option into more public schools
c. Allow for the pro-rating of subsidies to help with operations costs (capital flow)
d. Provide advantageous long-term leasing on state-owned properties for expansions or new schools
ATTRACTING AND
RETAINING TALENT
Denmark continues to be challenged to produce sufficient quantities of the highly qualified labor to meet growing
demand. Furthermore, this trend is expected to continue as the aging workforce retires and the number of advanced
degree graduates remains stagnant. Figures from the Confederation of Danish Industries (DI) show that Denmark lost
orders equivalent to 32 billion DKK in the period 2005-2007, mainly due to the shortage of highly qualified labor in the
workforce.
AmCham Denmark believes that in the short term, highly qualified foreign workers are the answer. But in order for
Denmark to be successful in attracting and retaining highly qualified foreign workers, it is essential that they are met
with a system and structure that make it attractive to work and live in the country. Specifically, the highly qualified
workers that companies are employing and recruiting need to see economic and social gains of residing and working in
Denmark and at the same time, barriers and bureaucracy in connection to moving to Denmark need to be minimized.
In the long term, however, Denmark must not underestimate the importance of developing a long term talent strategy that includes increasing the size and quality of a “home grown” supply of talent as well as being a highly attractive destination for foreign labor. AmCham encourages political cooperation in developing a comprehensive strategy
that will place Denmark firmly in a leading position to grow, attract and retain highly qualified talent in the years to
come.

DANISH TAX POLICY

Globalization is forcing nations to play a greater role in enhancing their global attractiveness. Incentive policies designed to attract foreign investment, skilled labor and research experts, as well as rewarding higher education degree
completion, are crucial to strengthening competitive advantage.
In this regard, Denmark’s high tax rate has contributed to the reduction in the supply of highly skilled and educated
human capital. In a Confederation of Danish Industries’ publication – “Global Benchmark Report 2009” – from April
2009, Denmark ranked 24th when compared against 29 OECD countries as an attractive destination for foreign highly
skilled labor.
At a time when companies are having difficulties filling essential positions and the war for talent has gone global,
Denmark does not offer a competitive environment. Looking inward, Denmark’s tax policy hinders the incentive to
work, acquire skills and complete a higher education.
AmCham Denmark believes that to ensure the supply of needed human capital in the long term, Denmark must set
down a plan with clear steps to reduce the marginal tax rate, value added tax and other taxes on goods and services.

TRANS-ATLANTIC TRADE
The relationship between the European Union and the United States has frequently
been compared to that of an old married couple; deeply united, occasionally quarrelsome,
but steadfastly committed because we are constantly reminded of how much we have
in common. This 60-year “marriage”, like any successful marriage, has figured out each
other’s idiosyncrasies, upon more than one occasion accommodated the wishes of their
partner, and figured out how to pick their battles when it comes time to squabble. And
because of this experience the relationship has grown stronger over the years. Today, EU
and U.S. economies are so intertwined that combined they make up 60% of global GDP,
and constitute a $4 trillion trans-Atlantic economy that provides approximately 14 million
jobs.
So far, political leaders have pledged to strengthen transatlantic economic ties. The
Transatlantic Economic Council (TEC) has been created and empowered to resolve regulatory differences on a wide range of issues. Currently, through the TEC, both sides have
identified a work plan to resolve a number of key regulatory barriers, which over the years
have driven up consumer costs and made companies less competitive. AmCham Denmark believes it is critically important to continue the momentum,
champion the progress, and redouble trans-Atlantic efforts. U.S. and Danish companies
alike should pay attention, be supportive, and push both governments to deliver on the
promise that regulatory cooperation holds to our combined economic future.
