FACILITY RENTAL AGREEMENT
THIS AGREEMENT (“Agreement”) is made and entered into on the ___________ day of
______________________, 20_____ , by and between Christ the King Lutheran Church
(“CTK”) and (
) (“User”).
NOW THEREFORE, in consideration of the information contained herein, including the
attached executed Rental Application Form, the parties agree as follows:

TERMS OF AGREEMENT: This agreement is for the
event to be
held on the date of

utilizing
CTK’s Christian Ministry Center (“CMC”). All cost and use specifications are as
stated on the attached Rental Application Form which constitutes part of this Agreement.
The User is required to make payment of Security/Cleaning and Damage Deposit
(“Deposit”) as set forth on the rental application. The entire deposit will be refunded if
the event occurs as scheduled and no damage has occurred to any part of the Christ the
King Campus or any contents therein and the CMC has been cleaned and set up to the
conditions given to the User. If the event is cancelled by the User 50% of the deposit will
be refunded.
RENTAL FEES: Rental Fees include the time needed for the User to remove and set up
necessary equipment prior to the event and cleaning and restoration of the set up after the
event. Event set up and clean up are performed by the User. Rental fees are due thirty
(30) days prior to event date. Rental fees are 50% refundable if event cancelled by User
no less than fifteen (15) days prior to the event date. No refund if event cancelled by
User fifteen (15) days or less from event date. All additional fees and specifications are
as stated on the attached Rental Application Form or additional forms as needed and
indicated. Members are defined as persons who have been present at worship, given an
offering and received communion within the last year at CTK.
ACCESS: CTK will provide a representative with a key to meet with User, or their
authorized representative, and open the facility.
CTK will further provide a
representative with a key to meet with User, or their authorized representative, and close
the facility. Any alternative arrangements must be specified in the attached Rental
Application Form.
SERVICES: The services provided include the general lighting from the permanent
fixtures, outlets, heat or air conditioning, water for normal usage, and any other
additional services specified on the attached Rental Application Form. Failure to provide
these services due to circumstances beyond the control of CTK, however, shall not
constitute a breach of this agreement. CTK will not provide any linens, decorations,
service dishes, plates, flatware, glassware, etc. These are the responsibility of the User or
their authorized representative.
USE RESTRICTIONS: User agrees to:
(a) Occupy the facility in a safe and careful manner and comply with all laws,
regulations, and ordinances for Pinellas County and the neighboring
communities, including, but not limited to Pinellas County Noise Ordinance No.
74-11 Article III, Section 18-71 which regulates sound levels.
(b) Limit sound producing equipment such as stereo music, disc jockeys, live
bands, etc. to 11:00 P.M.
(c) Use the facility solely for the purposes indicated on the Rental Agreement.
(d) Prohibit any part of the premises from being used for any unlawful or immoral
purpose or in any manner as to injure persons or property.
(e) Prohibit the moving or re-positioning of walls except by the authorized
representative of CTK.
(f) Prohibit the possession and/or use of weapons and/or illegal drugs anywhere on
CTK property.
(g) Prohibit the use of any and all tobacco products within the facility. A
designated smoking area will be available during all events, except during the
hours of Pre-School operation (6:30 A.M. to 6:00 P.M. Monday through
Friday), and any other special Pre-School activities. During these specified
times, smoking is only permitted off CTK property in accordance with the
Pinellas County Licensing Board.
(h) Allow the monitoring of all activities by the authorized representative of CTK.
(i) Prohibit loitering outside or around the buildings.
(j) Ensure that proper clothes and shoes are worn while on the premises.
(k) Prohibit all pets with the exception of trained “special needs” animals.
(l) Prohibit discrimination against anyone in the use of the premises.

(m) Conclude the event by 11:00 P.M. (excluding clean-up) unless otherwise
specified in the Facility Rental Agreement.
(n) Authorize CTK to eject or cause to be ejected from the facility any
objectionable person or persons. Neither CTK nor any of it officers, agents,
employees, volunteers or representatives shall be liable to the User for any
damages sustained by the User through the exercise by CTK of such right.
6. ALCOHOLIC BEVERAGES: By State Law, no one under the age of twenty-one (21)
may be served or consume alcoholic beverages. Should the User serve or permit
alcoholic beverages defined as beer, wine and champagne only to legal adults on the
premises, User assumes any and all liability arising there from and agrees not hold CTK
responsible for any damages or claims. If the User permits the sale of alcoholic
beverages defined as beer, wine and champagne only during the event, the User must
provide a professional, licensed service (bartending staff), provide a copy of the server’s
valid license, and provide evidence of current insurance by producing a Certificate of
Insurance naming Christ the King Lutheran Church as Additional Named Insured on the
required policies. The name of the licensed service, the copy of the license and the
Certificate of Insurance must be received by CTK thirty (30) days prior to the event.
There will be no allowance of alcoholic beverages to be consumed or taken outside the
CMC. Specifications for the use of alcohol at this event are stated on the attached Rental
Application Form.
7. EQUIPMENT: Use of equipment such as tables and chairs shall be limited to that
agreed upon by the User and CTK for event purposes and shall not be removed from the
building. Damaged equipment will be subject to use of deposit conditions.
8. PROFESSIONAL ENTERTAINMENT: All professional entertainment (bands, DJ,
etc.) must be pre-approved by CTK. These entities must provide evidence of current
insurance by producing a Certificate of Insurance naming Christ the King Lutheran
Church as Additional Named Insured on the required policies. The name of the
entertainer and the Certificate of Insurance must be received by CTK thirty (30) days
prior to the event.
9. AUDIO VISUAL/PRODUCTION EQUIPMENT & STAGE USE: The use of any
audio visual, production lighting or production equipment, or use of the stage or stage
area as defined by the physical raised stage and all equipment and areas not on the main
floor of the CMC facility, including the use or operation of the partition doors on the
main floor, will be subject to the terms and conditions as agreed upon under separate
agreement for use.
10. KITCHEN FACILITIES: Kitchen facility usage is limited to refrigeration and/or reheating of food items. No food preparation is allowed. All left over food is to be
removed by the User. Any food not removed by the User will be thrown away.
11. DECORATIONS: Permitted decorations are paper streamers, balloons, and biodegradable products. Table decorations and self standing decorations (such as potted
plants) are also permitted; table floral decorations must have a provision to prevent water
damage to table tops. Prohibited decorations are the affixing of anything to the walls,
floors, or ceilings with nails, tacks, staples or two sided tape; the removal of any pictures,
mirrors, plants or decorations already “in place” within the facility is not permitted. NO
confetti, sequins, glitter, bird seed, potpourri or other loosely scattered objects are
allowed in the building or anywhere on CTK property. All decorations are to be removed
by the User or their authorized representative no later than two hours immediately
following the event unless otherwise specified on the attached Rental Application Form.
12. MERCHANDISE SALES: The sale of any commercial merchandise must be preapproved by CTK. The approval for sale and cost of the merchandise must be specified
on the attached Rental Application Form. Christ the King Lutheran Church reserves the
right to deny the sale of any merchandise it feels is inappropriate or contrary to the
Christian Mission Statement.
13. PARKING: Parking spaces are available in designated areas as indicated below. The
User is required to monitor the parking areas around the facility. The User is prohibited
from charging for the use of the parking spaces. Any damages to vehicles, persons, or
property in the parking areas are the User’s responsibility and will be covered under the
User’s liability insurance coverage. The Use must provide a Certificate of Insurance
naming Christ the King Lutheran Church as an Additional Named Insured on the required
policies.
14. CONDITION OF PROPERTY: The User is responsible to leave the building, grounds
and equipment in the same condition as handed over at the beginning of the event. All
trash must be collected and placed in the dumpster. The landscaped areas and parking
spaces must also be cleared of trash, bottles, and any other objects. Failure to leave
property in same condition will result in the use of the damage deposit to the extent that it
covers any required action on the part of CTK.

15. INDEMNIFICATION:
User shall “hold harmless and indemnify” Christ the King
Lutheran Church and any of its officers, employees, volunteers or representatives from
and against all claims, damages, losses and expenses arising from any act, omission,
neglect or wrongdoing by the User. User assumes all risk of damage and loss by theft as
CTK is not responsible for any lost, stolen or damaged articles within the facility or
property.
16. UNAVOIDABLE EVENT: In the event of a hurricane, fire, act of God or any other
event beyond the control of CTK, this Agreement automatically terminates with no
breach of contract. User acknowledges that in the event of a hurricane or other natural
disaster, the Christian Ministry Center is designated as an Emergency Shelter by Pinellas
County Emergency Management Operations. That primary use supersedes any rental
agreement. In this event, CTK will refund all deposits paid by the User.
17. DEFAULT: If default occurs on the part of the User in the fulfillment of any of the
terms contained herein, or if the User causes or permits any damage to be done to the
premises, then CTK may, at its option, terminate this Agreement. In such case, the rent
hereunder, shall constitute an element of CTK’s damage resulting from User’s default.
Any remedy granted in this Agreement to CTK shall be inclusive of all other legal
remedies available.
IN WITNESS WHEREOF, the parties have caused this Agreement to be executed by their duly
authorized representatives on the day and date first written above.
