The Council met at 14:01.
2.
The Deputy Chairperson took the Chair and requested members to observe a moment
of silence for prayers or meditation.
3.
[14:02] Notices of motion.
4.
[14:07] Mr G Michalakis moved without notice: That the Council (1)
notes the sad passing away of Judge Hannes Fagan, retired Western Cape
Deputy Judge President;
(2)
acknowledges that this former University of Cape Town and Oxford graduate,
began practicing as an advocate in 1952 and was appointed to the bench in
1977;
(3)
also notes that Judge Fagan will be remembered as a principled and devoted
jurist who specifically made a great impact on our correctional services through
his role as inspecting judge of prisons; and
(4)
further recommends that the Council conveys its sincerest condolences to his
wife, Sheila, and the family during this sad time.
Motion agreed to in accordance with section 65 of the Constitution.

[14:12] Ms L L Zwane moved without notice: That the Council -

(1)
notes that Ntokozo Hadebe was found guilty on three charges of murder by
Judge Nico Coetzee of the North Gauteng High Court, following six charges of
rape and three charges of kidnapping and murder of kids between the ages of
two and five years in Diepsloot, in 2013;
(2)
welcomes the conviction of nine life sentences for the three murder charges and
six rape counts, and fifteen years for the three kidnapping charges and hopes
that it will serve as a deterrent to those who are involved in these terrible act of
abusing and violently raping defenseless women and children;
(3)
further notes the positive role played by the community in assisting the Police in
identifying and finally arresting the culprit and ensuring that he is removed from
the society; and
(4)
takes this opportunity to commend the police for job well done by ensuring that
women and children will be safer in our streets after the removal of this culprit
and hope that they will continue to arrest those who perpetrate violence against
women and children.

[14:15] Mr H B Groenewald moved without notice: That the Council (1)
notes with great shock and deep sorrow that South Africa has lost Mbulaeni
Mulaudzi, a great athlete and Senzo Meyiwa, one of our best young footballers
and captain of Bafana Bafana and Orlando Pirates, whose lives have been taken
away at the prime of their careers;
(2)
also notes that together with the Democratic Alliance takes this opportunity to
reach out to their families and friends during their time of bereavement; and
(3)
expresses wishes that their souls may rest in peace.
Motion agreed to in accordance with section 65 of the Constitution.

[14:16] Mr B Nthebe moved without notice: That the Council (1)
notes the shooting of an African National Congress, MP Hon. Jackson Mthembu
while drawing money at an ATM on Mandela Street in Witbank, Mpumalanga, on
Sunday, 19 October 2014 ;
(2)
further notes that four suspects have since been arrested and that Hon Mthembu
was discharged from hospital yesterday, Wednesday, 29 October 2014; and
(3)
takes this opportunity to condemn in the harshest possible terms this senseless
crime and wishes Hon. Mthembu a speedy recovery.

[14:21] The Chief Whip of the Council, moved: That the Council amend the motion
regarding the designation of members to the Magistrates Commission adopted by the
House on 24 June 2014, by replacing Mr Moses Titus Mhlanga with Mr Simphiwe
George Mthimunye as permanent member and designate Mr Litho Suka as alternate
member in accordance with section 3 (2) of the Magistrates Act, 1993 (Act No 90 of
1993).
Question put: That the motion be agreed to.
IN FAVOUR: Eastern Cape, Free State, Gauteng, KwaZulu-Natal, Limpopo,
Mpumalanga, Northern Cape, North West, Western Cape.
Motion accordingly agreed to in terms of section 3(1)(a)(xi) of the Magistrates Act, 1993

[14:24] Statement in terms of Rule 251 by the Deputy Minister of Basic Education:
Eradicating excess teachers and filling teacher vacancies on time: “Strategies to
address teacher vacancies and excess teachers in our schools.”
