Circular 2014/22, issued on 5 September 2014, provided information on the awarding of the final Burke GCSE Prize 2014. 2. In addition, the Department advised that the prize fund will be wound up following the award of the final prize. One of the requirements for winding up the scheme is that the appropriate statutory notice must be given. The first stage of the process required the First Statutory Notice to be displayed in schools for a period of 28 days from the date of Circular 2014/22. 3. Annex A CHARITIES ACT (NORTHERN IRELAND) 1964 The Department for Social Development has made a cy-près scheme in respect of The Burke Memorial Prize Fund, in pursuance of sections 13 and 22(1)(e)(iii) and 3 of the Charities Act (Northern Ireland) 1964, as those sections continue to apply by virtue of Article 3 of the Charities Act 2008 (Consequential Provision and Savings) Order (Northern Ireland) 2013. The details of the scheme are below. The Burke Memorial Prize Fund was established in 1883 in memory of Thomas Henry Burke (1829-1882), Under-Secretary to the Lord Lieutenant of Ireland. 2. The assets of the Burke Memorial Prize Fund apportioned to Northern Ireland (“the Fund”) were vested in the Ministry (now the Department) of Education by section 1(4) of the Administrative Provisions Act (Northern Ireland) 1925. 3. The Burke Memorial Prize (“the Prize”) was awarded up to 1994, lapsed for the period 1995 to 2004, was re-launched in 2005 and was last awarded in 2007. 4. The Prize was initially awarded annually under rules set by the Commissioners of Intermediate Education and later awarded to the candidate who the Department of Education considered was “the best answerer” in General Certificate of Secondary Education (“GCSE”) examinations taken in Northern Ireland. 5. The Fund consists of 200 shares in the Central Investment Fund for Charities, with a capital value of £2,234.80 as at 31 April 2014 and also accrued income of £2,068.99 as at 31 December 2013. 6. Pursuant to an application to the Department on 3 May 2012, the Department of Education proposes that, due to the small income from the Fund, prizes have ceased to provide a suitable and effective application of the Fund and that the Fund be wound up and a number of final prizes in certain subjects be awarded in respect of a single academic year and on its behalf by the Council for the Curriculum, Examinations and Assessment (“CCEA”). NOW THEREFORE The Department for Social Development, after due inquiry under sections 13 and 22(1)(e)(iii) and (3) of the Charities Act (Northern Ireland) 1964 HEREBY MAKES THE FOLLOWING SCHEME The Fund shall be wound up and the capital and any accrued income shall be applied to provide final prizes, under the Burke General Certificate of Secondary Education Prize 2014, to be awarded by the CCEA as follows: i. the Prize will be based on the best scores contributing to the Summer 2014 award of grade in CCEA GCSE English Language, Mathematics and Gaeilge examination results; ii. the Prize will be divided equally between: the candidates achieving 1st to 3rd place rankings in GCSE English Language, the candidates achieving 1st to 3rd place rankings in GCSE Mathematics, and the candidates achieving 1st and 2nd place rankings in GCSE Gaeilge; iii. to ensure that the value of each prize does not exceed £350, the CCEA may extend the Prize to the next ranking or next two rankings in each subject.
