are many techniques that can be used to find someone who simply doesn’t want
to be found and they are all legal. What are some new practices that you may not
know about? Though there are people who seem to disappear, everyone has to be
somewhere. This breakout session will give you tips on how to legally find the people
that you are looking for. This session will also include information regarding this topic
that is located in the Fair Debt Collections Practices Act. If you’re looking for new ideas,
or simply trying to find out what’s legal and what’s not, please attend this session. I

Effective Team Building – No “Trust Falls” Needed

Do you wish your staff was more willing to jump in and help when issues arise? Do you
have folks in your offices that have an “it’s not my job” attitude? It takes time, effort,
and leading by example, but you can put together a top notch team willing to jump in
and help anytime the need arises. In this session, we will talk about what it takes to
create a good team as well as some fun exercises you can do to encourage teamwork.
Come prepared to share what works well in your office, too—we are all open to new
ideas!
TCPA (Telephone Consumer Protection Act) Compliance
Jay Winston, Credit & Collection Education Forum
The TCPA governs do-not-call requests, use of auto-dialers, consent to call, wrong
parties called, and related issues. While the FDCPA remains the largest source of
lawsuits by student loan debtors, the number of lawsuits filed under the TCPA is
rapidly increasing. Recent court decisions have created new exposure and liability for
schools using dialers or pre-recorded messages. Previously “safe” consent forms may
now invite lawsuits and need to be changed. Updates on a growing bodyt of law
establishing vicarious liability for your outside vendors under the TCPA will also be
discussed.

As manager of the Student Business Office Bob oversees multiple facets
of student financial services at Western, including university cashiering,
the Perkins Loan department, student and general receivables, and
university collections. Through collaboration with vendors and the
strong support of third party collection agencies, Western continuously
strives for improvement in efficiencies and effectiveness in the billing
and collection process. Bob finds attendance and participation in higher
education conferences to be invaluable in gaining the knowledge and
insight needed to meet or exceed the expectations of today’s students.

Brian Smith began his career in the Department of Education in 1987,
working on the TRIO, Title III, and other higher education grant programs.
In 1995 he began working on the Federal student financial assistance
programs. Brian works with the Direct Loan Program, the Federal
Family Education Loan Program, and the Perkins Loan Program, with an
emphasis on the Perkins Program. Since 2000, Brian has been involved
in the development of Perkins Loan Program forms, regulations, and Dear
Colleague Letters.
