Notice of Transfer
I, PETER CARL GUTWEIN, Treasurer, for the purposes of
section 10A of the Government Business Enterprises Act 1995,
give notice of the transfer of the assets listed in Schedule 1 of
this notice by Tasmanian Networks Pty Ltd ACN 167 357 299
to Tasmanian Railway Pty Ltd ACN 139 383 761, subject to the
terms, conditions and limitations contained in this notice.
1. Definitions
‘Asset’ has the meaning given to that term in the Government
Business Enterprises Act 1995.
‘Transfer day’ means the date referred to in clause 2 of this
notice.

‘State’ means the State of Tasmania, being the owner of
Tasmanian Networks and Tasmanian Railway.
2. Transfer day
to the abalone fishery, a person does not dive from, or enter the
water from, the fishing vessel or auxiliary vessel used from the
fishing vessel.
The assets are transferred on 15 November 2014.

(a) For the purposes of section 1(3) of schedule 1A of the
Government Business Enterprises Act 1995, the assets are
transferred by Tasmanian Networks to Tasmanian Railway
for nil consideration.
(i) in the case of Tasmanian Railway, as a contribution by
the State; and
INFORMATION
The commercial blacklip abalone fishery in State waters off
the north-west coast is being closed from 12 November 2014
until 31 December 2014 as part of arrangements to control the
total amount of abalone harvested in that area in the interest of
resource sustainability. This closed area relates to commercial
blacklip abalone fishing in fishing sub-blocks 5A, 5B and 5C
only.
(ii) in the case of Tasmanian Networks, as a distribution to
the State.

Public Notice - Dates of the Closed Season for Part of
the Commercial Abalone Fishery in State Waters off the
North-West Coast of Tasmania
I, ROBERT GOTT, A/General Manager (Water and Marine
Resources), acting under Rule 9(3) of the Fisheries (Abalone)
Rules 2009, and delegated authority under Section 20(1) of
the Living Marine Resources Management Act 1995, hereby
determine that the dates of closing of State waters of the
commercial abalone fishery in State waters off the north-west
coast of Tasmania to the activities of the take and possession of
blacklip abalone (Haliotis rubra) are as follows:
from 12 November 2014 to 31 December 2014 inclusive;
where “State waters off the north-west coast of Tasmania”
is defined to mean: those State waters within an area bounded
in the north by an imaginary line from the northernmost point
of Woolnorth Point to Brown Rocks and running due west to
the limit of State waters, bounded in the south by an imaginary
straight line running due west from the mouth of the Arthur
River to the outer limit of State waters and bounded in the east
by the line of high-water mark running approximately north
from the mouth of the Arthur River north to the northernmost
point of Woolnorth Point.
For the purpose of this public notice, “possession” does not
include blacklip abalone on a fishing vessel that is transiting
the part of State waters closed to the abalone fishery if the
blacklip abalone possessed on the vessel were taken from a part
of State waters that is open to the abalone fishery and, while
the fishing vessel is transiting the part of State waters closed
I MAKE the following order under section 270 of the Living
Marine Resources Management Act 1995:
1. Short title
This order may be cited as the Fisheries (Biosecurity) Order
2014.
2. Specification
This order is made –
(a) in respect of the harmful disease abalone viral
ganglioneuritis; and
(b) to implement treatment and testing requirements
designed to prevent the introduction of that disease into
State waters.
3. Directions issued
(1) That an abalone processor must, unless otherwise authorised,
ensure that no abalone live-holding water is discharged into
State waters from any holding premises used under the relevant
licence unless that water hasa) been treated using a system capable of achieving, on
comparing water immediately prior to entering
treatment with water immediately on leaving treatment,
a minimum 3 log 10 reduction in total marine
heterotrophic bacteria; and
b) achieved a discharge concentration value of <3 log 10 (≤
999 bacterial colony forming units per mL).
(2) That an abalone processor must, in each of the testing
periodsa) cause a water sample to be taken by an agent of an
approved service from each holding premises used
under the relevant licence; and
b) cause the water sample to be tested by an approved
laboratory for the discharge concentration value
referred to in subclause (1)(b); and
c) submit the results of that testing to the Secretary.
5. Interpretation
In this order –
"abalone" means live fish of the genus Haliotis;
“abalone processor” means the holder of a fish processing
licence that authorises the processing of abalone;
“approved laboratory” means a laboratory approved to

conduct tests relevant to ascertaining performance related
to the standards in subclauses 3(1)(a) and 3(1)(b);
“approved service” means a service approved to take
samples to be provided for testing by an approved
laboratory;“Tasmania’s biosecurity regions” means the
regions specified in Part 1 and defined in Part 2 of the
Schedule to this order;

“holding premises” means premises used to hold abalone
taken from outside the relevant biosecurity region for those
premises;
“introduction” includes re-introduction;
“relevant biosecurity region”, for premises, means, with
reference to Tasmania’s biosecurity regions, the biosecurity
region adjacent to that part of the State’s coastline where,
or closest to where, those premises are situated;
“relevant licence”, for an abalone processor, means the fish
processing licence that authorises the abalone processor to
process abalone;
"testing periods" means the following periods:
a) October of each calendar year;
b) the four week period commencing six weeks before
each Chinese New Year.
6. Fisheries (Biosecurity) Order 2013 revoked
Fisheries (Biosecurity) Order 2013 dated 13 December 2013
and published in Gazette number 21 391 on 18 December 2013
is hereby revoked.
