Regular Meeting – October 14, 2014

The Meeting was called to order at 7:00 PM by Planning Commission Vice-Chairman Bob
Laraway and the pledge of allegiance was recited.
Members Present: Dunn, Grey, Hiither, Schofield, & Laraway
Members Excused: McGrath
A motion was made by Hiither, seconded by Grey, to approve the Agenda as presented. VOICE
VOTE: MOTION CARRIED 5-0-0.
A motion was made by Dunn, seconded by Hiither, to approve the minutes of the September
meeting as presented. VOICE VOTE: MOTION CARRIED 5-0-0.
Reports:
 Village Manager Wolff reported on the upcoming election, Charter’s cable build-out, and
the Village’s donation to the Isabella County Dive Team.

There was no report from the ZBA.

Wolff gave the Village Council report and discussed business of the Council since the
last Planning Commission meeting.

 Comments were offered to the Planning Commission by Mike Scherba of Isabella Vista.
Existing Business:
1. Proposed Ordinance 2014-07
The Planning Commission continued its review of the draft of Proposed Ordinance 201407. Several options were discussed with respect to how to regulate temporary vendors.
Wolff was asked to incorporate the discussion into modifying the draft and presenting it
at the next meeting of the Planning Commission.
2. Storage Pods & Shipping Containers
The Planning Commission continued its review and discussion of Storage Pods and
Shipping Containers. They discussed various options with Al Davis of Coldwater Road.
Mr. Davis owns a storage business and presently has 5 containers on his property. The
Planning Commission asked Wolff to incorporate the items from its discussion into a
modified draft to be reviewed at the next meeting.

NOVEMBER VILLAGE MANAGER’S REPORT
Lake Isabella Election Results
Attached are General Election results from on Tuesday, November 4th. Four seats to the
Village Council were elected. The top vote getters who will take office in January were:
- Dave Torgerson
- Charlie Kiel
- Paul Cueny
- Arnold Griffin
Also on the ballot were three proposed amendments to the Village Charter. All three
amendments passed. This includes an amendment which will allow members of the
Village Council to serve on the committees for the LIPOA if you so desire.
Street Reconstruction
We’ve been working on a grant with the MDEQ to cover costs involved with
reconstructing some streets in 2015. The grant is part of the market development
program that they have created with respect to recycling old tires. We have several
areas that we could target for this project and hope to narrow it down in the near future.
Trailer Storage Regulations
We’ve had one meeting between the Village and LIPOA to review and discuss possible
changes to the storage of trailers, boats, and RVs. I plan to present my report and
recommendations to the Council this month for its consideration.

pledge of allegiance was recited.

Reports:
1. Village President Torgerson reported on the current vacancies on the Planning
Commission and Board of Ethics. He reported that since the last meeting several
applications have been submitted to fill these vacancies. Based on the applications
submitted, President Torgerson made the following appointments:

Farzad Tafreshi to fill the remainder of a term on the Planning Commission.

Bernie Baldwin to the Ethics Committee.

Aaron Dore to the Ethics Committee.
 Richard Kulin to the Ethics Committee.
There were no objections from the Council to any of these appointments.
2. Village Manager Wolff provided a written report to the Village Council. In his report he
discussed a paving grant that the Village is working on to do a major paving project in
2015. He reported that with the grant the cost saving to the Village would be around
30%. He also reported on the letters send by the MDEQ to several residents regarding
Isabella Pellet. He also informed the Council of an error he made in sending the wrong
draft of a public notice to the Morning Sun for publication regarding the proposed
Charter Amendments. He reported that he had spoken to county and state about the issue

and that the state was comfortable with the Village running a correction to resolve the
issue.
3. The LIPOA report was provided by LIPOA President Russell. He discussed the
winterizing of the campground and the drawdown.

1. Public Hearing for proposed Ordinance 2014-06
A public hearing for proposed Ordinance 2014-06 was opened by Village President
Torgerson at 7:19 PM. A synopsis of the proposed Ordinance was provided by Manager
Wolff.

Questions from the Council: None
President Torgerson closed the public hearing at 7:21 PM.
A motion was made by Kiel, seconded by Griffin, to adopt proposed Ordinance 2014-06.

Torgerson NAYS: None; MOTION CARRIED UNANIMOUSLY (7-0-0).
2. Public Hearing for proposed Ordinance 2014-10
A public hearing for proposed Ordinance 2014-10 was opened by Village President
Torgerson at 7:23 PM. A synopsis of the proposed Ordinance was provided by Manager
Wolff.

Questions from the Council:
 Grey requested that once the change in inspectors is made to have a copy of the
County’s fee schedule posted here for people to see when they pull a zoning
permit.
President Torgerson closed the public hearing at 7:26 PM.

Public comments were offered to the Village Council from Paul Cueny of Clubhouse Drive.
Existing Business:
1. Resolution 2014-22; Board of Ethics Complaint Form
A motion was made by Grey, seconded by Kiel, to adopt proposed Resolution 2014-22
which creates a formal complaint form to be used by the Board of Ethics.
Pattison offered a friendly amendment to the motion on the floor. He made a motion that
the original motion be amended to also direct the Board of Ethics to review the form and
report back to the Council on any recommended changes. Without a second to the
motion, Torgerson ruled that it died for lack of support.

There was discussion on the original motion. There were no objections from the Council
to having the Board of Ethics review the form and report back with any desired changes.

2. Lake Isabella North Lot Swapping Agreement
A motion was made by Kiel, seconded by Lacca, to adopt the proposed agreement to
create a lot swapping plan in Lake Isabella North as a means to address the building and
use restrictions which limit the development of the number of well and septic systems in
the plat.

3. Lake Isabella South & Lake Isabella Golf Estates II Designation of Public Works
Successor in Building & Use Restrictions
Wolff presented a first draft of a proposal that has been discussed with Isabella County
on transferring the Public Works authority to the Village in the remaining plats with
restrictions on the number of well and septic systems.
New Business
1. MML Property & Liability Board of Directors Ballot
A motion was made by Grey, seconded by Eberhart, to authorize the Village Manager to
cast the Village’s ballot for the three candidates running for the Board of Directors of the
insurance pool. VOICE VOTE: MOTION CARRIED UNAMIMOUSLY 7-0-0.
2. November Meeting Date
The Council discussed moving the November meeting date. After discussion, the
Council agreed to change the November meeting date from November 18th to November
25th with the time and location unchanged.

Proposed Ordinances
Existing Business #1 & #2
On the agenda this month are two updated ordinance drafts from the meeting last
month. Proposed Ordinance 2014-07 has already undergone a Public Hearing and can
be recommended to the Village Council once the Planning Commission is comfortable
with the draft. Proposed Ordinance 2015-01 has not yet had a Public Hearing. Before
that ordinance can be recommended to the Village Council the Planning Commission
must first conduct a hearing per the Michigan Zoning Enabling Act. The next meeting
of the Planning Commission is scheduled for December 9th. I recommend that if that
date works for the board in terms of a quorum, holding a hearing on that evening.

ORDINANCE 2014 – 07
TEMPORARY ZONING PERMITS
The Village of Lake Isabella hereby ordains:
SECTION 1 PURPOSE
The purpose of this Ordinance is to regulate the issuance of Temporary Zoning Permits
and Temporary Vendors in the zoning code of the Village of Lake Isabella in order to
protect the public’s health, safety, and well-being.
SECTION 2 CHAPTER 1204 AMENDED
Chapter 1204 of the Zoning Code of the Village of Lake Isabella is hereby amended to
include a new definition for the term “Temporary Vendor” which shall read as follows:
Temporary Vendor: A temporary vendor is a temporary use conducted by a person or
business that engages in the selling of goods, wares, or merchandise that conducts
business from a temporary structure or vehicle such as a tent, truck, cart, trailer, or other
area outside of a permanent structure.
SECTION 3 CHAPTER 1212.33 ACCESSORY USES RENUMBERED
Chapter 1212.33 of the Zoning Code of the Village of Lake Isabella titled “Accessory
Uses” is hereby moved and renumbered to be read as currently written in the Zoning
Code as Chapter 1212.09.
SECTION 4 NEW CHAPTER 1212.33 CREATED
A new Chapter 1212.33 is hereby created in the Zoning Code of the Village of Lake
Isabella to read as follows:
1212.33
TEMPORARY VENDORS
Temporary Vendors may conduct business on any developed property with a primary use
other than a detached single-family dwelling. The following regulations shall apply to
Temporary Vendors:
1. Temporary Vendors shall only operate on developed parcels with the permission of
the owner of record of the parcel.
2. Temporary Vendors shall not conduct business via the placement tents, trailers,
trucks, or carts in a public right-of-way.

3. Temporary Vendors shall not use tents, trailers, trucks, or carts which occupy more
than 200 sqaure feet of ground coverage unless approved by the Planning
Commission.
4. Temporary Vendors shall not use tents, trailer, trucks or carts which are taller than 12
feet unless otherwise approved by the Planning Commission.
5. Parcels wishing to allow Temporary Vendors shall provide adequate off-street
parking to handle the additional traffic. At the request of the Zoning Administrator
the Village may require the owner of any such parcel to provide a parking plan to
illustrate that the parcel contains sufficient parking to accommodate all primary and
temporary uses.
6. Parcels with Temporary Vendors do not require the issuance of Temporary Zoning
Permit provided that the Temporary Vendor limits their operations to one of the
following time frames:
a. Not more than 2 days per calendar week, with a maximum of three consecutive
days, for a period not to exceed 8 consecutive calendar weeks.
b. Not more than 8 consecutive weekends.
c. Not more than 35 consecutive days.
7. Parcels that may wish to allow Temporary Vendors for a duration that exceeds the
limits established in the previous sub-section shall submit such a request to the
Planning Commission. The Planning Commission shall review and process the
application under the conditions and regulations as found in Chapter 1214 of the
zoning code applicable to Site Plans. Any such approval shall be limited to a
maximum time fame of 180 days.
8. Parcels may have upto two Temporary Vendors in operation at any single time.
9. Parcels that may wish to allow more than two Temporary Vendors at any single time
may submit such a request to the Planning Commission. The Planning Commission
shall review and process the application under the conditions and regulations as found
in Chapter 1214 of the zoning code applicable to Site Plans. Any such approval shall
be limited to a maximum time fame of 30 days.
SECTION 5 CHAPTERS 1312.17 CREATED
Section 1312.17 of the code of the Village of Lake Isabella is hereby created and is to
read as follows:

TEMPORARY ZONING PERMITS
1. Activities, uses, and structures permissible under the zoning code that are of a
temporary nature, including those items listed in §1212.29, shall only occur after a
Temporary Zoning Permit has been issued by the Zoning Administrator pursuant to
the terms and conditions applicable to the permit for the temporary use or structure
unless otherwise exempted by the zoning code.

2. Any such temporary use/structure that also requires a permit or license from the local
Health Department, State of Michigan, or Federal government shall be treated as a
temporary conditional use and may occur only upon the approval of the Planning
Commission. The application, review, and approval process for a Temporary
Conditional Use shall be the process and requirements used by the Village of Lake
Isabella to process and review Site Plans as found in Chapter 1214 of the zoning
code.
3. Houses of Worship may acquire a permit for a tent on its own property in any district.
Also, all district setback requirements must be complied with as well as
accommodating off-street parking for the additional floor area provided.
SECTION 6 SEVERABILITY
If any section, subsection, paragraph, sentence, clause, or portion of this Ordinance is
found for any reason to be invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate distinct and independent provision
and such holding shall not affect the validity of the remaining portions thereof.
SECTION 7 ORDINANCES REPEALED
All ordinances and/or parts of ordinances inconsistent with this Ordinance are hereby
repealed
SECTION 8 EFFECTIVE DATE
This Ordinance shall take effect and be in force upon the expiration of 7 days of the date
when the notice of adoption for this Ordinance is published in a newspaper of general
circulation in the Village of Lake Isabella. This Ordinance shall be codified, edited for
typos and grammatical errors, and enumerated in accordance with the codification
procedure of the Village of Lake Isabella.

TEMPORARY STRUCTURES
The Village of Lake Isabella hereby ordains:
SECTION 1 PURPOSE
The purpose of this Ordinance is to regulate Temporary Structures in the zoning code of
the Village of Lake Isabella in order to protect the public’s health, safety, and well-being.
SECTION 2 CHAPTER 1212.29 AMENDED
Chapter 1212.29 of the Zoning Code of the Village of Lake Isabella is hereby amended to
read as follows:
1212.29
TEMPORARY STRUCTURES
A. In all residential districts, No structure, whether temporary or permanent, of a fixed or
portable construction, including but not limited to, screen-tents, freestanding canopy
tents, portable carports, utility trailers, professional craftsman tool trailers, semi-truck
trailers, shipping containers, storage pods, and other such portable or seasonal
structures, shall be erected or moved onto a lot or parcel and used for or stored for
temporary purposes unless such temporary structure is expressly authorized by the
zoning code and it meets the minimum standards as defined in this chapter of the
zoning code of the Village of Lake Isabella.
1. No temporary structure may be located within any front, side, or rear required
setback area for any parcel in the village.
2. No temporary structure may be taller than 12 feet, unless otherwise approved by
the Zoning Administrator.
3. No temporary structure shall be permitted to be erected, stored, or used for a
period of more than 90 days at a time. Excecpt, craftsman tool trailers may be
utilized for a period of time greater than 90 days at a time only during
construction, remodel, repair, or renovation as part of an approved zoning or
building permit.
B. In all non-residetial districts, No structure, whether temporary or permanent, of a
fixed or portable construction, including but not limited to, screen-tents, freestanding

SECTION 3 CHAPTER 1246.05 AMENDED
Chapter 1246.05 is hereby amended. Specifically, the Special Land Uses for the East
Coldwater Business District is hereby amended to read as shown on the attached
“EXHIBIT A.”
SECTION 4 SEVERABILITY
If any section, subsection, paragraph, sentence, clause, or portion of this Ordinance is
found for any reason to be invalid or unconstitutional by any court of competent
jurisdiction, such portion shall be deemed a separate distinct and independent provision

We, the undersigned, President and Clerk of the Village of Lake Isabella, Isabella
County, State of Michigan, do hereby certify that the above and foregoing Ordinance, known as
Ordinance # 2015-01 “Temporary Structures” of the Village of Lake Isabella was adopted in the
following manner with at least seven days elapsing between the publication of the public hearing
for the Ordinance and the enactment by the Village Council at regular or special meeting of the
Lake Isabella Council, offered by councilmember __________, and seconded by councilmember
