Governance Committee Events, Activities and Information

Membertou is one of many First Nations in Canada to sign onto the First Nations Land Management Framework
Agreement. The Agreement transfers authority and management of reserve lands from the Federal government to our own
control, and removes us from roughly 25% of the Indian Act.
But what does this really mean? To provide a better understanding of the Act, we have a compiled of some of the most
common questions our members might have. Over the next several issues of the Membertou Aknutmaqn newsletter, the
Governance Committee will feature new FAQs on Land Code.
Land Code Frequently Asked Questions (Part 3)
Q: Are off-reserve Members involved?
A: Yes, ALL Members 18 years or older, both on and off reserve have the right to vote on the Land Code and Individual
Agreement.
Q: What lands are involved?
A: Potentially, all 3 of Membertou reserve lands. The reserve lands of Malagawatch are not included because they are
jointly held with other communities.
Q: Will the land governance powers extend to traditional Membertou territories?
A: No. The land governance powers only relate to existing reserves held by Membertou. (Excluding Malagawatch)
Q: Will First Nation land be considered fee simple land?
A: No change to title is affected by our land code. Lands will continue to be reserve lands held in trust by Canada but
jurisdiction over the land and decision making in relation to the land will be in the hands of Membertou.
Q: Can Membertou make laws?
A: Yes. Membertou will have the power to make laws in respect of the development, conservation, protection, management,
use and possession.
Q: How will Membertou laws be enforced?
A: Membertou will have full power to enforce its land & environmental laws. Laws can also be tried in federal or provincial
courts.
Q: What powers will Membertou have?
A: All the powers of an owner in relation to its land, except control over title or the power to sell. Membertou will be able to
lease or develop their land & resources, subject to Membertou law.
Q: What happens to existing 3rd party interests?
A: Nothing. They will continue in effect according to their terms & conditions.

New After-Hours Phone Service For Housing Repair Emergencies
Beginning on Monday, December 15th, the Membertou Housing Department will be introducing an after-hours
telephone service for Membertou residents experiencing housing repair emergencies. The telephone service
will operate between 4:30 pm to 8:00 am on weekdays and 24 hours during weekends and holidays. Membertou
residents are asked to call the Housing Department’s main telephone line at (902) 564-2111 and the call will be
directed to a call answering service.
The following situations are considered as housing repair emergencies: (1) no heat, no oil or a power outage; (2)
broken or leaking water lines; (3) furnace oil leaks; (4) sewer back-up; (5) failed sump pump during a storm; (6)
broken window or door from storm damage or vandalism; (7) leaking hot water or (8) any other situation that
may be considered as a housing repair emergency.
If the call meets any of the above situations, the call answering service will contact the Director of the Housing
Department immediately who will arrange for a qualified contractor or Housing Department employee to address
the situation.
All non-emergency calls will be forwarded to the Housing Department on the following regular business day.
If there are any questions about this new service, please do not hesitate to contact any member of Council or
Randy Carroll, Director of Housing and Community Facilities.

Classes are now finished for the Christmas Break and will
resume on January 14, 2015. Religion Education classes for
Grades 2, First Holy Communion, and Grade 4 ,Reconciliation, will be held on Wednesday evenings from 6:30 to 7:30
p.m. Classes will be held at the Seniors Centre.
Grade 9 Religion Classes for the Sacrament of Confirmation will start in the new year. The first class is on Sunday,
January 18, 2015, starting at 7:00 p.m. at the Seniors Centre.

Membertou Heritage Park
The Honour Song by George Paul
I travelled out west to Alberta in 1983 to visit an elder named Buffalo Child, commonly known as Albert Lightning. He had
been conducting ceremonies for our people in the east coast for a few years so this time some of us were going to travel out
there. Our first ceremony was a Sundance conducted by Harold Cardinal and his family at the Alexander Reserve, which is
north of Edmonton in a wooded area. This was my first experience in a ceremony of that type, but it was at this ceremony
where I saw a vision. Above the Sundance lodge, hanging from a roughly constructed structure were many different coloured cotton clothes hanging from the ceiling. In this vision I saw a green hill and dancing up the hill were thousands of
Native people from all different tribes. As they came closer in my vision I could see it was the Mi’kmaq people leading the
dance.
Shortly after, we went to Kootney Plains, where Albert was conducting ceremonies with many people from all over the
world attending. I met up with people from back home who had also been receiving teachings from Albert, that night
around the fire we talked about reviving our culture. I had a feeling in my heart that I would have to fast for understanding, to learn why my people had lost so much and consider the question: What did we do so wrong to lose our dances, our
songs and our ceremonies? During my fast this feeling hit me and weighed heavy on my heart. I couldn’t help but cry. I
cried until my crying turned into a chant and it was this chant that gave the message. Unity. My people, let us work together
toward unity. Be proud of who you are. Believe in yourself. Tahoe!

Important Notice: Needles And Sharps Containers
Sharps containers are available at the Membertou Wellness Home free of
charge. These containers are disposed of in the proper manner so not to
infect anyone. If you need a sharps container, please come to the Wellness
Home and pick one up. Please do not throw needles and lancets in your
garbage. This is very dangerous to childen who may be playing in your area
as well as our garbage collectors.
Smoking Cessation Program
For Membertou Band and Community Members. If interested in joining
the Smoking Cessation program there will be a sign-up sheet at the Membertou Wellness Home. Learn about nicotine replacement, quitting and
coping strategies. There is no charge for participating in the program.
The one hour information session will be held weekly during lunch hour
(lunch provided) for six weeks from January 21, 2015 until February 25,
2015.

Membertou Public Works and Housing Now Separate Departments
The Membertou Public Works Department is now separated from the Membertou Housing Department. Both
departments are part of Membertou’s governing operations but now employ separate directors, structures and
responsibilities.
The departments began the process of separating in 2012 and they now both occupy different locations in Membertou.
The primary responsibilities of the Public Works Department is construction and maintenance of major infrastructure such as water and sewer, roads and the clearing and preparation of lands for construction. The Public
Works Department also completes snow removal for all commercial properties in the community and the Elementary School. The department does not clear snow from Churchill Drive or from elder’s driveways.
One of the largest departments in Membertou, Public Works employs approximately forty people during the
construction season and a reduced crew over the winter snow removal months. Safety is a primary concern for
the department’s employees who routinely work at potentially dangerous construction sites. The department
employs a full time Safety Officer who remains on site throughout all construction phases and activities.
This past year, the Membertou Public Works department planned, executed and completed nineteen projects
during the construction season. One of the largest projects undertaken this year is the Tupsi Drive Sewer Connection. This project will connect the sanitary sewer main located at the end of Tupsi Drive near the intersection
of Tupsi and Wally Bernard. Workers needed to excavate a 26 foot deep trench in order to install the pipes and
manholes and they affectionately refer to the work site as “The Big Dig”.
New driveways and gravel were installed for some residents this past season and sod was installed at the new
school and other residential locations. New ditches and culverts were installed on Pi’kun Drive and storm systems and lot infilling was completed on Veteran’s Avenue. A house that suffered fire damage in the community
was torn down and lots along Wally Bernard were cleared and readied for future construction. A water connection on Bradley Street was completed along with some foundational work and preparation on Tupsi Drive. Road
patching is an ongoing project for the department as well.
As the season draws to an end, the department will complete all repairs to all heavy equipment and vehicles and
keep snow removal gear in good working order over the winter months and a complete department inventory
will be undertaken as well.
Last winter saw 24 snow events, beginning December 8, 2013. The department is prepared to combat any weather events this year.
