Governance Committee Events, Activities and Information

Membertou is one of many First Nations in Canada to sign onto the First Nations Land Management Framework
Agreement. The Agreement transfers authority and management of reserve lands from the Federal government to our own
control, and removes us from roughly 25% of the Indian Act.
But what does this really mean? To provide a better understanding of the Act, we have a compiled of some of the most
common questions our members might have. Over the next several issues of the Membertou Aknutmaqn newsletter, the
Governance Committee will feature new FAQs on Land Code.
Land Code Frequently Asked Questions (Part 1)
Q: What is the Framework Agreement?
A: An opportunity to take back land governance jurisdiction from Canada over our lands and resources
Q: What is a Land Code?
A: The basic land law of the First Nation. It will replace 38 land related sections of the Indian Act.
Q: What is Land Governance?
A: Land Governance is the ability to make, administer and enforce laws as well as the day-to-day management and
administration of Membertou lands & resources.
Q: Is this part of aboriginal self government?
A: Yes, this is one component of self government and deals only with Membertou lands and resources.
Q: Will the fiduciary relationship between the Crown & Membertou continue?
A: Yes, the federal Crown’s “special relationship” with Membertou will continue. The Minister’s responsibility is less than it
would have been under the Indian Act because Membertou will be making its own laws and day-to-day decisions.
Q: Is this Bill an amendment to the Indian Act?
A: No, Membertou is choosing to opt out of the land management sections of the Indian Act.
Q: Is there any continuing federal responsibility for Membertou lands?
A: Yes Membertou lands will continue to be reserve lands as defined by the constitution
of but will have no management authority over the land.

•Discussion about Council portfolios and avoiding conflicts of interest.
•The By-Law requiring fences around pools of a certain depth/height was allowed by AANDC but Council will amend the by-law to
incorporate changes suggested by AANDC.
•Presentation from Gillian Allen of KMK regarding the King’s Road Reserve and the importance of the historical record after the
William (Tsilhqot’in Decision).
•Dan Christmas presented on our obligations under Workers’ Compensation Board legislation as they relate to contractors working
in Membertou
•Jennifer Martin and Mike McIntyre presented the Tangible Capital Assets Policy and a plan to gather the information needed under
this policy.
Updates from October 28, 2014, Chief and Council meeting:
•Council reviewed new business that arose over past two (2) weeks.
•Council reviewed and approved of two (2) new employee recommendations from HR Director Darlene Collins
•Council reviewed and approved a presentation on the Home and Community Care Policy, presented by Jennifer Martin, Policy
Coordinator
•Richard Paul presented on the clean-up of the gaming buildings. Plans are in place to have buildings cleaned up over next few
months.
•Council reviewed and approved three (3) salary review recommendations from HR Director Darlene Collins
•Council reviewed and awarded various contracts for construction and renovation work to homes in the community.
•Council reviewed and discussed of various letters submitted to Chief and Council.
Membertou Youth Chief and Council Elections
Elections for the 2014-15 Membertou Youth Chief and Council will take place on MONDAY, NOVEMBER 24, 2014, during lunch
hour at Sydney Academy. Lunch will be provided.
Nominees, if they choose, will have a few moments to present to fellow students on why they should be members of the YCC.

Applications Available for 2015 Store Tobacco Quotas
All interested store owners are reminded that applications are now available for the 2015 store tobacco quota. Applications
can be picked up at the Tobacco Shop or at the Band Office during regular business hours.
To be eligible for a tobacco quota, the following criteria must be met:
• Store-owners must be registered Band Members of Membertou;
• Store-owners must own and operate a full time business;
• Store-owners must conduct their business from either their place of residence or from a separate building for that
purpose;
• Store-owners must have their business name registered with the NS Registry of Joint Stocks;
• Store-owners must have a Tobacco Retail Vendor Permit from the Provincial Tax Commission.
All applications must be submitted to the Reception Desk at the Band Office by Friday, December 5, 2014.

Youth Advisory Council Opportunity
I am looking for Mi’kmaw youth who are interested in submitting an application for appointment to the Youth Advisory Council. The
Youth Advisory Council advises the Minister of Education and Early Childhood Development on matters dealing with the needs and
concerns of youth, the effectiveness of existing programs and the creation of new programs policies and services. The Government
wants to hear from youth on a range of issues including bullying, the future of Nova Scotia, and government services to youth. Appointment to the Youth Advisory Council looks great on your resume and is a fun and rewarding opportunity to meet other youth in the
province.
The Council is made up of 12-15 youth between the ages of 15 and 24. Members are selected on the basis of their personal ability to
contribute to the work of the Council; their ability to represent a major ethnic, cultural or other segment of the population; their ability
to represent a major youth serving organization; or a combination of the above. Most importantly, members must be interested in youth
issues and needs.
Members are not paid for serving on the Council, but their travel to meetings and Council events is covered. There are approximately
4-6 meetings or events each year. Chaperones will accompany youth as required. Appointments are for a two year term.
The Youth Advisory Council gives young Nova Scotians the opportunity to advise government on the views of youth on issues affecting
them today and in the future. Interested youth may send a resume, along with a one-page letter describing their interest and why they
would be an asset, to:

Membertou Heritage Park - Aboriginal Protocols
From time to time, traditional Aboriginal ceremonies will be taking place at the Heritage Park and Membertou Facilities. The information below describes these activities, their significance and the protocols surrounding them. When participating in these ceremonies
park visitors are asked to follow these protocols out of respect for Aboriginal traditions and values. If you have questions about any of
these activities please call the Membertou Heritage Park office and/or speak with our Elder during your visit. The following teachings
have been shared with me by local Elders and it’s an honour to share teachings to one and all. The following teachings may differ from
place to place or family to family. Also I would like to share a teaching that an Elder who once told me “If Respect and Sincerity are followed or demonstrated, that is very important.”
The Elder
The Elder is given the title and recognition as Elder by other Elders of her/his respective community or nation. They are selected
based on their experience as mediators, their spiritual and traditional knowledge and their capacity to pass on these experiences
to others. One does not have to be a senior citizen to be an Elder.
The gifted individual is given the position of Elder by spiritual and
human acceptance, and must commit to fulfill his/her responsibilities to ensure that traditional values, principles and
other teachings are passed along, and to provide instruction to
help individuals live in the right way. In the performance of these
activities, the Elder may be assisted by an Elder’s Helper.
During ceremonies, Elders may choose to smudge prior to the
others in a group or they may often be offered a place of respect at
the head of a line. When food is served, Elders are served before
others in attendance.

Membertou Community Member Wins Big in
San Francisco!
A very special congratulations goes to Glen Gould, who was
named Best Actor at the 2014 American Indian Motion Picture Awards Show on November 9, 2014, in San Francisco,
California. The awards were part of the 29th Annual American Indian Film Festival.
Glen won the best actor award for his portrayal of ‘Joseph’
in the 2013 film Rhymes for Young Ghouls,which was also
nominated for Best Film.

community of Membertou for their love and support during the recent passing of my nephew Malcolm MacKenzieHiscock on October 30, 2014.
To all of you who sent sympathy cards, offered condolences,
attended the wake and funeral – your words of prayer and
comfort were very much appreciated by both the Hiscock &
MacKenzie families.
A very special THANK YOU to all the young people in
Membertou who were friends of Malcolm, and the athletes
who played hockey and football with him. I know his
passing was hard on all of you and I cannot express how
comforting your presence was to our families. Thanks for
sharing your stories and memories of Malcolm with us all.
You are an amazing group of young adults. Stay strong!

Potlotek Adult Education Program
Work Activities:
• Responsible for teaching Adult Basic Education, Pre-GED and GED courses using instructional methods geared toward the
adult learner in a classroom setting. Plan lessons and curriculum based on the learning needs of culturally diver e and multi-skill
level students which prepare students to pass the GED tests and/or enhance basic education skills.
• Responsible for teaching the GED test areas (literature, writing, social studies, science and math) or adult basic education skills
areas (writing, math, language)
• Plan and prepares relevant and practical class lessons and monitors students’ performance.
• Implement a variety of instructional delivery methods, that include group or individualized instruction as well as computer
programs that help students make learning gains. Relies on experience and judgment to plan and accomplish goals. Performs a
variety of tasks.
• May lead and direct the work of others.
• Responsible for effective classroom management that enhances student learning

Surplus Sale
The public works department has declared some equipment surplus to their needs; therefore,
Membertou will be accepting bids on the following pieces of equipment:

Item #1 -1994 GMC 66-passenger school bus (most seats have been removed)

Item #2 -1999 Ford F350 Super Duty-Gas Engine
To view the vehicles, please contact Darrell Bernard, Director of Public Works, at (902) 5788830 between the hours of 8:00 a.m. to 4:30 p.m., Monday to Friday only.
As per our policy, only Membertou residents will be permitted to submit bids on this equipment.

All vehicles are sold “as is, where is” with the awarded bidder responsible for all removal
costs.
All sold vehicles must be removed within one week after the bidder is notified of the award.
Bids must be dropped-off at the upstairs reception area in the band office in a sealed enveloped that is clearly marked with the tender number “MT2014.22” and identified “Surplus
Vehicles” no later than 2:00 p.m. on Friday, November 28, 2014.
Late bids will NOT be accepted.
