SUMMARY: The Bureau of
Land Management (BLM), Las
Cruces District Office, proposes to lease two parcels of public land totaling 4.12 acres in
Sierra County, New Mexico, for
agricultural purposes (pecan
orchard). The subject parcels
were inadvertently developed
by the adjacent landowner into
a pecan orchard without authorization. The area has a
long history of agricultural use
and the proposed lease would
provide the BLM with a reasonable option to resolve the
continued unauthorized use of
the affected public lands. The
BLM proposes to lease the
lands for not less than the fair
market value to Winder Farm.
The BLM White Sands Resource Management Plan, dated October 1986, does not exclude the subject parcel from
the authorized officer’s discretion to consider lease proposals in the subject area.

would represent unfair competitive and economic disadvantage to the originator of the
unique land use concept.”
Based on past use of the subject parcels for the establishment of pecan trees owned by
Winder Farm, it is the authorized officer’s decision to offer
the proposed agricultural lease
to Winder Farm on a non-competitive basis because competitive bidding would represent an unfair competitive and
economic disadvantage to
Winder Farm. As noted above,
Winder Farms’ use of the parcels constituted an inadvertent
trespass that they discovered
and subsequently reported to
the BLM. Winder Farms has
since worked with the BLM to
resolve the trespass. Subsequent to the BLM’s receipt of
an application for leasing by
Winder Farm that complies
with all applicable requirements set forth at 43 CFR
2920.5, processing of the proposed lease will take place in
accordance with 43 CFR
2920.6, and other applicable
regulations. Information and
documentation regarding processing of the lease application
is available as described in ADDRESSES, above, and reference should be made to National Environmental Policy Act
(NEPA) analysis, to be conducted under DOI-BLM-NML000-2014-0168-EA. No final
decision on the lease will be
made until all required analyses are completed. If authorized, the lease would be subject to provisions of FLPMA
and all applicable regulations
of the Secretary of the Interior,
including, but not limited to, 43
CFR part 2920, and to valid existing rights.
Public comments regarding the
proposed lease may be submitted in writing--see ADDRESSES above--on or before
January 22, 2015. Comments

stormy issue in recent years,
had his say.
“First of all, I would like
to go ahead and commend
Bruce, staff and (County
Attorney) Dave (Pato) for
a job well done in regards
to obtaining the property on
South Broadway.
Armijo was referring to
the Whitehead Chevrolet
property, where the Sheriff’s
Office and Road Department
are to be relocated. All three
commissioners
endorsed
the $716,000 deal, and
Swingle announced it was
officially given the state
Department of Finance &
Administration’s stamp of
approval after thorough
review.
“Second of all, I would
like to congratulate our new
elected officials,” Armijo
added. “I think we’ve got a
pretty good (commission)
coming aboard, I think the
voters made a wise decision
– I’m going to go ahead
and…”
“How do you mean that,
kicking us out?” Allen
jokingly interjected.
Disregarding Allen, Armijo
continued, saying there are
“a couple of issues I would
like to address, and I hope
the news media prints this.”
In fact, the news media has
reported extensively on socalled “floodgate,” which
revolves around Truth or
Consequences businessman
Randy Ashbaugh’s longstanding assertion that flood
mitigation/repair funds are
unaccounted for and the
county’s stance that the
money is still tied up under
the control of the state-level
FEMA office.
“The funds are in Santa
Fe,” Armijo said. “The
only thing is, they’re
buried under two pounds of
paperwork that the state has
not yet done.”
Armijo said he, along
with
county
Finance
Director Teresa Ragsdale,
former flood director Barry
Ragsdale and others are
further vindicated by a
recent award from the State
Auditor recognizing Sierra
County as the recipient of
the Small County Audit
Achievement Award for
Fiscal year 2013.
“Which basically tells
you that staff has done an
outstanding job,” he said. “I
want to thank you, Teresa,
and I hope this right here
will clarify a bunch of riffs
and other things.”
Like
his
fellow
commissioners,
Armijo
thanked
staff
and
constituents alike, and
also touched on the county
manager and his fellow
commissioners.
“Mr. Swingle, I want
to thank you for coming
down,” he said. “I’ve known
Mr. Swingle for quite a few
years.

had our differences of
opinion – but we have for
the last 50 years, and that’s
not gonna change.

It was Ashbaugh who
spoke up first during public
comment.
Picking up on one of
Luna’s
remarks
about
“‘what a fabulous job
Walter Armijo has done,’”
Ashbaugh alighted on the
chairman.
“Well, let’s look at that:
no landfill, no sheriff’s
office, no road building,
no jail, no leadership – we
have too many lawsuits
to count, a hospital that’s
been devastated, people still
working that are responsible
for gross mishandling of our
taxpayers’ flood money…”
Ashbaugh continued to
press Barry Ragsdale, who
was present, to account
“for the $291,000 and the
$77,000 he said was coming
in on the e-mail,” and he also
continued to criticize recent
acquisitions of real estate in
which the county has been
the primary “agent.”
“Some of the members
of the commission know
that the investigations and
different things are going to
continue,” Ashbaugh said.
“And personally, after the
first of the year, I am going
to call for a grand jury.
“It takes 2,000 and
something
signatures
– I think I can get that – and
some of the members on this
commission, I think, should
be worried.
“I want to wish everybody
a Merry Christmas, but more
importantly I want to thank
Commissioner Allen for his
community service… he’s
done a lot of things in the
city and the county here.
And, Bobby, I ask you to
please protect your health.”
Said Armijo, “Thank you,
Mr. Ashbaugh, please stick
around because I’m sure
we’ve got some other things
we need to talk about.”
“No, I have to take care of
my brother, he’s critically
ill,” Ashbaugh replied.
“Well, you’ll read about it
in the newspaper.”

Also
during
public
comment, Commissionerelect Lyon, a former county
commissioner
returning
to office in January,
commended Armijo and
Allen for their service.
“…I do know that the
vast majority of people in
Sierra County want to thank
both of you two for the job
you’ve done, for the hours
you have put in,” he said.
“As most of you know, I’ve
served on the commission
before, and I know there’s a
lot that goes on that people
don’t really know until
they’ve sat in that position.
So, thank you again, I know
Sierra County’s interests
were always what was in
both of you two’s heart…
“The last thing I want to
say is, just go easy on the
new commission.”

This temporary policy
utilizes the newly adopted
the State of New Mexico’s
policy, with the specified
inclusion of blood analysis
in the biological specimens
to be randomly collected.
Mayor Eunice Kent and
several members of the
council voiced their concern
over including this form
of testing specifically in
the motion. Currently, this
form of testing is considered
the most accurate when
attempting to detect illicit
drugs.
The council and staff
cautioned specific language
in regards to defining or
limiting the understanding
of
“employee”
and
“volunteer.”
Council member Sarah
Stagner expressed specific
concern that the policy may
become tangled when using
or defining “volunteer,” as
the city relies heavily on
residents of the community
during special events and
holiday celebrations.
As such, the city focused
on
developing
future
language that would focus
on those who are operating
city
equipment
and/or
vehicles.
Additionally,
staff
cautioned the council from
developing limited language
regarding the use of medical
marijuana.
Briley expressed that
government policy, state
and federal laws, are in a
status of constant change.
Because of this, his
recommended, with the
support of city legal council,
the avoidance of specifying
any drugs for which to be
tested. Instead, the city
will delegate the targeted
screening to the medical
personnel
who
would
be conducting the actual
testing. This will, hopefully,
allow for the policy to not
have undergoing future
changes, in response to any
potential shifts in state and
federal laws.
This temporary policy
for Elephant Butte will be
revisited mid-spring 2015,
after Briley has time to
develop language to the
specific needs of the city.
Council and staff conducted
lengthy
discussion
on
the possibility of the city
undertaking management of
the Dam Site location and
surrounding land. While
some points of concern were
voiced, the council aimed to
merely discuss drafting a
letter of intent to further
investigate this matter. As
such, none of the council
or Mayor Kent had any
objections to such.
The council elected to
table further discussion
regarding their reservations
regarding both management
and finances of the property/
land, as the city staff had
no way of answering the
concerns without further
investigations. Neither staff
nor council voiced when
the next open discussion
would occur, however,
Mayor Kent voiced the
positive experience thus far
with discussions that have
transpired with both BOR
and NMSP.

pistol with live ammunition
on Buckendahl as well as a
black cylinder with a halfounce of marijuana inside
the container.
The
authorities
later
located the man’s vehicle
stuck off the shoulder of
State Highway 179, and
Buckendahl
positively
identified the silver Chrysler
as belonging to him.
Buckendahl stated that
prior to the officers’ arrival,
he had fallen and struck
his head, but later refused
medical treatment when
EMS arrived on scene.
Deputy Diaz asked the
man if –in the three hours he
had been walking around,
attempting to flag someone
down– he had consumed
any alcohol. Buckendahl
stated that he had not,
adding that the last time he
had drank alcohol was at
about midnight or 1 a.m.
Buckendahl
agreed
to submit to a series of
Standard Field Sobriety
tests, but stumbled upon
trying to exit the patrol car.
Buckendahl
reportedly
failed all of the tests, and
then later refused to submit
to a breath or blood tests.
He was then transported to
the Sierra County Detention
Center for booking.
