 Licensing Act 2003 ‐ Applications completed in 2014 Please find below a list of Licensing Act 2003 applications completed since 1 January 2014 by the Licensing Authority, Worthing Borough Council, for new Premises Licences, Variations to existing Premises Licences and Review applications. The terms of the Licensing Act 2003 dictate that all 'new' application and 'variation' applications are publicised and consulted on. If no representations are received from 'Responsible Authorities' or any other persons such applications must be granted as applied for. If relevant representations are received and mediation between the parties is unsuccessful then the application has to be deliberated by a sub‐committee of the Licensing & Control Committee B following a hearing. 'Minor variations' are also consulted on but only by 'public notice' on the premises, details posted on this website and any responsible authorities the licensing authority selects as relevant. If relevant representations are received and considered by officers to have implications under the licensing objectives then the application is simply rejected and a full variation has to be applied for. ‘Review’ applications cannot be withdrawn unless a licence is surrendered and must be heard by the full Licensing Committee B whatever agreement mediation may produce. Co‐Op ‐ Tarring Road An application for a new premises licence to allow licensable activity at a proposed new supermarket/convenience store. The shop to be situated at 49‐56 Tarring Road, Worthing. The application is seeking authorisation for the sale of alcohol, for consumption off the premises.  Sale of Alcohol: 07.00hrs to 23.00hrs Monday ‐ Sunday incl.  Opening to the public 07.00hrs to 23.00hrs Monday ‐ Sunday incl. Licence holder and applicant: Co‐Operative Group Food Ltd. Consultation closed: Thursday 18 December 2014 Committee Hearing: Cancelled No representations were received from the public. The application attracted one representation from a responsible authority (Sussex Police). The Licensing Act encourages mediation and this was conducted successfully. The police concerns regarding the application were addressed by the applicant volunteering a number of conditions that will become enforceable conditions of licence. As a result they withdrew their representation and, consequently, an amended licence was granted as per the terms of the Licensing Act 2003. __________________________________________________________________________________ 1 Updated: 23 December 2014 Beach House Bar‐Cafe An application for a 'minor variation' to the premises licence at the 'Beach House Bar‐Cafe'. The cafe bar is situated at 23 Marine Parade, Worthing, BN11 3PS. The application sought to vary the existing Premises Licence to authorise:  Amendment to a condition of Licence. Condition20 of Annex 2, which currently states: No drinks will be allowed on terrace after 22.00hrs. No customers are to be permitted to use the external drinking area after 22.00hrs on any night for any licensable activity or the consumption of alcohol. The use of the area for patrons to smoke beyond 22.00hrs may be permitted but this activity must be monitored by a member of staff to ensure that noise and disturbance is prevented.  To read: No drinks will be allowed on terrace after 23.00hrs Sunday to Thursday or 00.00hrs (midnight) Friday, Saturday & Bank Holiday Sundays. No customers are to be permitted to use the external drinking area after these times for any licensable activity or the consumption of alcohol. Consultation closed: Wednesday 17 December 2014 Committee Hearing: Not required for a minor variation For a minor variation application, in addition to the statutory public consultation, the Licensing Authority has the discretion to consult any responsible authorities it considers necessary and relevant to the type of application. In this case, as it involved changes to the timings regarding the use of the outside patio that could potentially have implications to the licensing objectives Sussex Police and the Environmental Protection Team were consulted. The authorities consulted made no representation and no formal representations were received from members of the public. After due consideration it was decided the changes made would have no adverse effect on the licensing objectives. Consequently, the minor variation was granted as per the terms of the Licensing Act 2003. ___________________________________________________________________________ All in Onez An application for a new premises licence for the convenience store known as 'All in Onez'. The shop is situated at 137 Clifton Road, Worthing, BN11 4DP. The application sought authorisation for the sale of alcohol, for consumption off the premises.  Sale of Alcohol: 08.00hrs to 23.00hrs Monday ‐ Saturday 10.00hrs to 22.00hrs Sunday.  Opening to the public: 08.00hrs to 23.00hrs Monday – Saturday 10.00hrs to 22.00hrs Sunday. Licence holder and applicant: Mr Arudchelvan Chelliah Consultation closed: Thursday 4 December 2014 2 Updated: 23 December 2014 Committee Hearing: Held on Wednesday 17 December 2014 The application attracted four individual letters of representation. One from a responsible authority (Sussex Police) one from a Ward Councillor and two letters from local residents. The Licensing Act encourages mediation and this was partially successful with the applicant volunteering conditions that addressed the Police's concerns. They formally withdrew their objection. Further mediated was unsuccessful and a hearing was required. Members of the Licensing & Control Sub‐Committee considered the matter and the application was granted with the mediated conditions and with three further conditions, recommended by the Ward Councillor, imposed. The sub‐
committee was satisfied that with conditions the granting of a licence would not to undermine the licensing objectives. Members stated in their reasons that there is a recognised problem of street drinkers using the area and therefore these conditions are appropriate to ensure that the licensing objective of the prevention of crime and disorder is not undermined. The Wheatsheaf An application for a variation to the premises licence at the 'Wheatsheaf'. The public house is situated at 22‐24 Richmond Road, Worthing, BN11 1PP. The application sought to vary the existing Premises Licence to: Delete the following conditions of licence contained in annexe 3 (Conditions attached by the Licensing Authority at a Review Hearing) :  A refusal register and an incident register will be kept on the premises to record all refusals and incidents of crime or disorder. These records will be made available to the officers of the licensing authority and police upon request.  At least 2 SIA trained & licensed door supervisors will be deployed on the premise from 21.00hrs until 30 minutes after closing on Friday & Saturday evenings and on any evenings when a live act or DJ is playing, unless otherwise agreed in advance by Sussex Police. Those performing the role of door supervisor will not perform any other role when engaged for the purpose of door supervision duties.  SIA door supervisors will also be deployed from 21.00hrs until 30 minutes after closing time on Christmas Eve, Christmas Day, Boxing Day, New Year’s Eve, New Year’s Day, Good Friday, Easter Saturday, Easter Sunday, Easter Monday and all other bank holidays, plus the day preceding a bank holiday. On all other days when door supervisors are not employed, a documented, suitable and sufficient risk assessment must be completed, identifying the activities undertaken at the premises and the controls necessary to minimise the risk of crime and disorder occurring in accordance with the licensing objectives.  All door supervisors must be fully briefed prior to starting work, with clear written instructions regarding their specific duties. Door staff must be made aware, by the management, of individuals banned by Worthing Pubwatch. A record of these briefings must be kept and made available to officers of the licensing authority and/or the police upon request. And replace with:  SIA trained & licensed door supervisors to be employed when a requirement is identified by the Designated Premises Supervisor’s risk assessment or requested by Sussex Police (a minimum of 48 hours advanced written notice required from the Police Licensing Team)  A reduction in the licensed hours for alcohol sales, the provision of recorded music and late night refreshment by 1 hour to a 01.00hrs terminal time on Thursday, Friday & Saturday nights.  A reduction in the corresponding opening hours. The supermarket/convenience store is situated at 23‐25 South Street Tarring, Worthing, BN14 7LG. The application sought to vary the existing Premises Licence to authorise:  Changes to the layout of the premise. No changes to the hours for licensable activity or types of regulated activity provided were proposed by this application and all conditions of licence to remain unchanged. Applicant: Rabbi Moshe Dadoun Consultation closed: Saturday 25 October 2014 Committee Hearing: Held on Thursday 20 November 2014 The application attracted four individual letters of representation. Two representations from Tarring Ward councillors, a representation from Sussex Police and a letter from a local business. The Licensing Act encourages mediation and this was partially successful with the applicant volunteering conditions that addressed the Police's and councillors' concerns. They formally withdrew their objections. Further mediated was unsuccessful and a hearing was required. Members of the Licensing & Control Sub‐Committee considered the matter and the application was granted with the mediated conditions. The bars & cafe are situated at 21 Marine Parade, Worthing, BN11 3PT. The application sought to vary the existing Premises Licence to:  Extend opening hours of the 1st floor terrace from 22.00hrs until 00.00hrs (midnight) for the consumption of alcohol.  Allow vertical drinking in the 2nd & 3rd floor function rooms at all events.  Allow vertical drinking in ground floor vintage tea rooms and in outside seating area until 22.30hrs.  Extend the hours for licensable activity on a Sunday to match those of other days of the week  Amend condition 12 & 15 of annexe 2 to allow windows & doors to remain open until 23.30hrs. The application sought to vary the existing Premises Licence to:  Remove a number of licence conditions as outdated, irrelevant or unenforceable: I.
Condition 3 of annexe 2 which details the maximum capacity of persons to be allowed on the premises. Which is now considered outdated as covered by the Regulatory Reform (Fire Safety) Order 2005. II.
Condition 13 of annexe 2 which states: 'The family orientated nature of the business to be reflected in the customer base' which is considered unenforceable. III.
Condition 24 of annexe 2 which states: 'Children to be allowed in the dining area only unless otherwise passing from one place to another' which is considered outdated.  Attach the following conditions to the licence: I.
The Decking area to be cordoned off at 23.00hrs each night. II.
Controls to be in place to ensure that the fire exit is not used as a smoking area. III.

Applicant: East Sussex Drinks Ltd. Consultation closed: Monday 15 September 2014 Committee Hearing: Held on Wednesday 8 October 2014 The application attracted four individual letters of representation, a petition from 16 local residents, a representation from the ward Councillor and a representation from Sussex Police. The Licensing Act encourages mediation and this was partially successful with the applicant volunteering a condition that addressed the Police's concerns. They formally withdrew their objections. However, the other representations could not be mediated and a hearing was required. Members of the Licensing & Control Sub‐Committee considered the matter and the application was granted with a number of new conditions imposed. Consultation closed: Saturday 20 September 2014 Committee Hearing: Cancelled Two relevant representations were received regarding this application from Sussex Police and the Environmental Protection Team. The Licensing Act encourages mediation and this was conducted successfully. Both authorities' concerns regarding the application were addressed by the applicant volunteering a number of conditions that will become enforceable conditions of licence and amending opening hours. 8 Updated: 23 December 2014 As a result both withdrew their representations and, consequently, an amended licence was granted as per the terms of the Licensing Act 2003. Hare & Hounds An application for a 'minor variation' to the premises licence at the 'Hare & Hounds'. The public house is situated at 79‐81 Portland Road, Worthing, BN13 3DW. The application sought to vary the existing Premises Licence to remove or amend a number of licence conditions:  Remove as outdated, irrelevant or unenforceable: i. The embedded restrictions carried over from the old Justices' Liquor Licence with the exception of the New Year timings. ii. The standard & specific conditions carried over from the old Public Entertainment Licence with the exception of the requirement that departing customers must not be permitted to take glasses or opened bottles outside the premises.  Amend condition 3 of annexe 2 of the licence to state: The use of the rear garden for the consumption of alcohol to cease at 23.20hrs. No customers are to be permitted to use this external drinking area after 23.20hrs on any night for any licensable activity or the consumption of alcohol. The use of the area for patrons to smoke beyond 23.20hrs may be permitted but this activity must be regularly monitored by a member of staff to ensure that noise and disturbance is prevented. To stop the current practice of customers congregating on the narrow pavement on the street outside the pub to smoke when the rear garden is closed.  Amend condition 9 of annexe 2 of the licence to state: After 21:00 hours on a Friday, Saturday or Sunday, no children under 18 are allowed on the premises. (formerly known as Wrights Cafe) The cafe is situated at 9 Warwick Street, Worthing, BN11 3DF. 9 Updated: 23 December 2014 The application sought to vary the existing Premises Licence to:  Extend opening hours by 30 minutes in the evening to 23.00hrs.  Extend the hours for the sale of alcohol by 30 minutes to a terminal time of 22.30hrs.  Extend the hours for the provision of recorded music by 30 minutes to a terminal time of 22.30hrs.  Amend condition 5 of annexe 2to allow the sale of spirits and liquors. No further changes were proposed by this application and all other conditions of the licence to remain unchanged. At which individuals present were arrested for offences associated with handling stolen goods. Further investigations were also being conducted regarding counterfeit goods and an arrest for the offence of assault involving ‘Grievous Bodily Harm’. As part of the process Sussex Police issued a certificate under section 53A of the Licensing Act 2003 on 27 May and this was considered by the Licensing Authority on 28 May. As a result, as an interim step, the licensing authority imposed a suspension of the licence, due to their concerns regarding the seriousness of the criminal activity relating to the premise. The suspension ran from 29 May until the matter was heard. The Licensing Authority agreed that the crimes detailed in the Police application amounted to serious crime as set out in the Home Office Guidance. A hearing was held on 19 June but adjourned for 1 month at the request of the applicant & licence holder and the full hearing was held on Wednesday 16 July. At the hearing representations were heard from all the parties and after due consideration the Committee resolved that the premises licence should be revoked. The licence holder has 21 days in which to appeal this decision but the interim measure of a suspension, taken at the expedited Committee hearing on 28 May 2014 and extended at the Committee on 19 June 2014 when this matter was adjourned, will continue in place until the 21 day appeal period expires or if an appeal is lodged until the matter has been disposed of by the Magistrates Court. The reasons given by members for the decision were that the Committee considered the historical and repeated breaches of the licence, and in particular that the licence on the same premises has been previously suspended on two occasions. The Committee believed that the only reasonable and proportionate action to take was to revoke the licence.
