Who has Spring Fever?
This is an exciting time of the year. Daylight savings begins on March 8th
at 2:00 AM (don’t forget to spring your clocks forward and change your
smoke detector and CO detector batteries) and spring, the spring (vernal)
equinox, begins on March 20th at 4:45 MST. In the real estate world, this
traditionally means our busiest time of the year has begun. This is the
time that reminds me of the movie “Being There” starring Peter Sellers.
In this movie there is a discussion with the President of the United States
and powers to be at the White House asked Chance the Gardener what
his thoughts are on the outlook of the economy. It goes like this:
President "Bobby": Mr. Gardener, do you agree with Ben, or do you think that we can stimulate
growth through temporary incentives?
Chance the Gardener: As long as the roots are not severed, all is well. And all will be well in the
garden.
President "Bobby": In the garden.
Chance the Gardener: Yes. In the garden, growth has it seasons. First comes spring and summer, but then we have fall and winter. And then we get spring and summer again.
President "Bobby": Spring and summer.
Chance the Gardener: Yes.
President "Bobby": Then fall and winter.

We all have been sowing our fields all fall and winter and we are beginning to see that this year is on
track to be a bumper crop and all of us will be extremely busy. I welcome this as I hope all you do too.
With this said, I can’t stress how imperative it is for Realtors® to remain extremely professional and to
keep our Code of Ethics in tact along with keeping our clients’ best interest in the forefront and treating
other Realtors® with respect. This is also the time of year when we see new Realtors® joining our
association and I encourage everyone to reach out and welcome them into our association and
encourage them to get involved.

“HAVE YOU SIGNED AN AGENCY AGREEMENT?”
Isn’t this the question we should ask all buyers before we start to work with them? No it is not. There are two reasons
why this is not the correct question.
First the Code of Ethics does not discuss “agency”. Article 16 is concerned with “exclusive representation or exclusive brokerage relationships” In Colorado there are two ways a buyer can be subject to an exclusive representation or exclusive brokerage relationship. One is by signing an Exclusive Right to Buy (Buyer Agency Contract).
The other is by signing an Exclusive Right to Buy (Transaction Broker Contract). Since the buyer we are talking
with may have signed either of these “exclusive brokerage relationship agreements” the proper question is, “Have
you entered into an exclusive agreement with any other broker?” We are not so much concerned with “agency” as
we are concerned with “exclusive relationships.”
The second reason why the above question may not be the proper question is a more REALTOR to REALTOR
issue. There are some areas in Colorado where the following question is asked, “Are you working with another
REALTOR?” Do you see the difference between these two questions? The first question could indicate that if the
buyer hasn’t signed a contract, you consider them “fair game.” “Since you haven’t signed anything (even though
you may be actively working with another REALTOR) I’m going after you.” If the buyer has not signed an Exclusive Right to Buy contract there is nothing unethical if you “go after them”. However, does this type of an attitude
foster REALTOR to REALTOR cooperation? If a buyer has established a relationship with another REALTOR is it
in any brokers best interest to insert themselves into that existing relationship?
Are we not, as an organization, attempting to promote good relationships between ourselves? Is one potential
commission worth alienating another broker? Instead of asking “Have you signed an agency agreement” you
might want to consider asking , “Are you working with another REALTOR?”

working as a very “poor” paralegal by day/telemarketer by

Your Listings on Zillow
Niki Moran, Projects Manager
There are many mixed feelings about Zillow. Some agents love it, some despise it, and some take it with a grain of salt.
But consumers are using Zillow and you need to understand how your listings get there. In addition, a behind-thescenes business relationship changed which will alter how that is accomplished, so we want to bring you up to speed.
A bit of back story first. Back in 2007 IRES partnered with ListHub to give Managing Brokers/Owners the ability to
syndicate their office listings to third party websites, if they so desired. For the last
seven years Brokers chose where to syndicate their listings through the ListHub
Dashboard. That included Zillow, Trulia, Yahoo, AOL, etc.
However, the agreement between Zillow and ListHub ends effective April 7 th. After
April 7th, the ListHub Dashboard will still give Brokers the ability to send listings to many
other sites, but not to Zillow. (Renewal negotiations with Zillow broke off with Listhub
over “terms that reflect the best interest of the brokerage industry”.)
The existing listing agreement with Zillow ends April 7 th.
So, now what? For starters, if you choose to send your listings directly to Zillow via an
office or franchise feed, outside of the MLS, be sure that your listing data is sufficiently
protected. That means negotiating a license agreement that protects your sellers, yourself, and controls how the data
can be used.
As of this writing (early February), IRES is considering how we might assist brokers in sending listings to Zillow. The
exact process is not yet decided, but we will get the word out as soon as a solution is in place. As needed, check with
us before you sign an agreement with Zillow.
Please understand two things: IRES does not and will not sell listing data to Zillow or any third party syndicator for
profit. There are administrative and technical costs that must be covered but that is the extent of it. Also, IRES will
always put the broker in the driver seat in deciding where their listings are displayed and marketed. They are your
listings. Period.
After April 7th, Brokers will still be able to syndicate listings to other third parties through the ListHub dashboard.
Before then, we highly recommend you view your Listhub dashboard to 1) Ensure your listings are going where you
want and 2) Make sure your marketing efforts are paying off. Consider your ROI by viewing the leads generated and
the number of views from each site. Below are the 2014 numbers comparing the top four sites that generate leads.
