SUBJECT: Award a construction contract for the construction of the Southbound Indio Boulevard
Overhead over Union Pacific Railroad Seismic Retrofit to Future DB International in the amount of
3, 098, 750. 74.
RECOMMENDED MOTION: Approve the design plans and specifications for the Southbound Indio
Boulevard over Union Pacific Railroad Seismic Retrofit Project, award the construction contract to
Future DB International, Inc. in the amount of $3, 098, 750.74, and approve a 10% contingency for
the project.
SUMMARY: On September 9, 2013, the State of California, Department of Transportation
Caltrans) authorized the City of Indio to bid the Southbound Indio Boulevard Overhead Seismic
Retrofit over the Union Pacific Railroad Project. The project has been bid and is now ready for
construction. Future DB International, Inc. submitted the low bid of $ 3, 098, 750.81.
After
performing due diligence of the low bidder, staff is recommending the award of the project to
Future DB International.

BACKGROUND: This project is part of the City's Seismic Safety Retrofit Program as
established by Caltrans in response to the 1989 Loma Prieta earthquake. The Southbound
Indio Boulevard Overhead over the Union Pacific Railroad is old and does not meet current
design standards and needs to be seismically retrofitted. This project to seismically retrofit this

design plans and specifications for this project were prepared by Dokken Engineering and
comply with the Caltrans approved Seismic Retrofit Strategy dated June 24, 2011. The design
is in conformance with AASHTO Load Factor Design and follows the Caltrans Bridge Design
Specifications including the 2006 Seismic Design Criteria. The City Engineer has reviewed the
design plans for the project and in his opinion the design is reasonable and meets professional
engineering standards. Therefore, the City Engineer recommends that the City Council also
approve the plans and specifications, which are on file in the Department of Public Works.
The City originally opened bids on January 9, 2014, however all bids were significantly higher
than the amount of federal funds authorized and staff recommended rejecting all bids and to
seek additional funding. City council approved this recommendation on March 5, 2014. Staff
has since received additional funding from Caltrans to cover the higher costs associated with
this project.
The City re -advertised, and on January 29, 2015, the City Clerk received and opened eight ( 8)
sealed bids. Staff performed due diligence on the apparent low bidder, and though Future DB
International, is a relatively new contractor, they have provided adequate documentation to
demonstrate responsibility and their ability to complete the project as bid. A summary of the

Staff was successful in obtaining federal funds from the Highway Bridge Program ( HBP) and
state funds from the Proposition 1B - Local Bridge Seismic Retrofit Program ( LBSRP) in the
amount to fully fund the construction cost of this project as shown above. These funds are
already appropriated in the budget. These funds are reimbursable, and therefore the City will
need to front the money until the City is reimbursed ( the City will submit monthly invoices for
the grant reimbursements).
No general fund money will be used for this project.
The professional services for this project ( such as construction management, inspection, and
engineering support) are being addressed in a separate staff report.
Council should be advised that the State funds will expire if the contract is not awarded by
March 30, 2015.
ALTERNATIVES:
1.
Reject bid from Future DB International and direct staff to determine second lowest
responsive bidder.
2.
Reject all bids and not award contract at this time.
