Dear Members and Friends:
Legislature Returns Monday for Full Start of Session – They’re Baaaaack!!!
Monday was the first day when most policy committees in both houses start (in earnest)
to hear the 2,500 bills that have been introduced this year.
Of course from this amount, many have or will be “gutted” from spot bill form into
something completely different. Others will be set for hearing, but then never actually
be heard, because authors know their bills have no chance of passage (particularly if
they are Republican-authored). Then there are the ‘simple’ bills that are intent on addressing one
narrow issue, but ultimately become equivalent to “War and Peace” in terms of size by the time they
make it through the legislative process.
So, over the next month all bills will have to pass through their policy committee(s), or be ‘parked’
meaning that they become a two-year bill that cannot be acted upon without a rule waiver until next
January, or die. The only exceptions to this rule are committee-sponsored bills that have no deadlines,
meaning that they can be introduced throughout the session
Monday will also ‘ramp-up’ the fundraiser machine. That shaking sound you hear emanating from
Sacramento is from legislators calling all of their ‘friends’ to ‘entice them’ to attend their forthcoming
fundraiser. The wine and cheese will be quite plentiful over the next several months around town!

SFPUC Contractors Open House – Over $1,000,000,000 in
maintenance and repair work. If your company does less that
$14,000,000 / year you need to become part of this. San Mateo
County residents are elligible for the LBE bid discount giving you
a small business advantage. The qualifying process is easy. Be sure

San Carlos Police report that there have been a large number of construction site tool
thefts. If you leave power or other valuable tools on the job site make sure they are
securely locked up! Better yet, don’t leave them on site and be sure your truck tool box
is secure when parked overnight.

The Office of Administrative Law (OAL) has officially approved the revised Heat
Illness Prevention Standards. This now clears away the final hurdle, meaning the
revisions will take effect May 1, 2015.
I encourage everyone to bookmark the Heat Illness Prevention webpage which also
contains a copy of the guidelines, a Q & A session as well as everything else an

Safety and Workshops at the Exchange!
Hearing Protection – Custom Fitted Ear Plugs – These are the Rolls Royce
of hearing protection, better than any muffs or plugs or anything else. You can
have a pair made for your ears in just a few minutes at the Exchange on
Wednesday, 4/15/2015. The hearing technician will be in our plan room at 735
Industrial Road from 7AM until 2PM – Just stop by and have a pair made.

First Aid and CPR Together in one session Get your first aid and CPR
certification on the same morning. You should have one person (at least) with
certification on each job site and also one certified person in the office. This
certification meets all Cal-OSHA requirements and you get a certification card
about a week after passing the class. 4/29 from 7:30 AM until about 1:30 Members
$75 and non-members are $150. Be sure to sign up early – this CPR + First Aid
training session usually fills up fast.
Fun Things for Members
Fishing in Baja leave July 9th and return July 13th – Big game
fishing in La Paz, Mexico Includes just about everything – but
don’t delay – we could only get 20 spots this year. Use the flyer
in this issue.
Wild Boar Hunting at Carnaza in Santa Margarita –
11,000 acres of land with wild boar. Start Friday 6/19 and
leave Sunday 6/21. Stay in the trailers and bring your rifles,
pistols and shotguns for fun at the ranch.
We have two hunts this year, the first one sold out
immediately, but we still have a few spots on the second

Conference Room Use – Members are welcome to use the conference room at
735 Industrial free of charge during business hours. Sign up is on a first come,
first served basis and you can reserve the room by calling us at 650-591-4486. It
holds about 20.
Construction Forms – Stuff like lien forms, pre-liens, contracts, notices of
completion, etc. We have them at the exchange for a nominal fee. Stop by and get
the ones you need!
Litigation Search. One of the best ways for contractors to assess your owner
client, or for subs to assess general contractors is to look at their past. Have they
been involved in a lot of litigation? People tend to continue the same pattern in
life and those who have had a great many disputes in the past will probably also have them in the
future. Your exchange will provide member companies with a San Mateo County, and adjacent
counties, court history of prospective customers.
Mediation – The Exchange will informally mediate construction related disputes. This
is true “no fault” mediation where parties are assisted in reaching a settlement. There
is no “verdict” or “judgment” and attorneys are not allowed. If you need help in
resolving a problem please give Tom a call at 650-591-4486. There is no charge for mediation.
Workers Comp Discount – Many Exchange members who have workers comp
insurance through State Fund get a 6% discount (in addition to other discounts)
because they can join our State Fund group 826. You need to know that when you
renew you need to ask to be put in 826 otherwise they will not put you in a group and
you will have to pay more. If you discover it later on, they will not “reverse it”. Be sure you ask
for group 826 at the time of renewal!

Reduce Health Insurance Costs? Don’t expect a miracle but there are a
few things you should do! The legislated inclusion of many people who
could not get “normal” health insurance has really increased the price
that everyone pays. Insurance is one of the biggest employee expenses
you have – and one that has come under increased attention in the last
two years. There are a couple of things you should do to try and keep
costs under control:
Form a small group: In California a group can be two people or more. Even with only
two people in the “group” you get about 5% off the single person premium. If you can
put together a larger group of more than five insured you can save up to 10%.
Look for the “sweet spot”. The sweet spot is the best cost versus benefit policy. Carriers
play the numbers to make their policies appealing. If you look at you likely usage versus
the premium, deductible and out of pocket max, you will find that there is usually a
policy that will actually cost you less overall considering all costs, and it is usually not
the least expensive nor is it the most expensive choice. You should check this annually
because the rates and plan features change rapidly in these troubled times for health
insurance.
Compare carriers annually. The carriers have to make a profit to stay in business, but
the age mix of their customers can help change the cost. A carrier with a lot of young
customers can have lower rates for the older ones (under Obamacare the young “support”
the old) so check your rates against other carriers every renewal period to see if things
have changed.
You need help doing this. You need a broker with the patience and desire to really help you
rather than just make more money by increasing your premium. We recommend Todd Taylor at

Sacramento Report – They are coming back from spring break on April 6th and
here is a list of the things important to us that are coming up:
AB 742 (Gallagher) - Heavy-duty diesel-fueled vehicles: safety review:
filters.
Would prohibit the State Air Resources Board from enforcing a certain
regulation that restricts emissions from in-use, diesel-fueled vehicles until the state board
completes a review of the safety of any particulate-matter filters required to be installed on
affected vehicles.
AB 750 (Low) Business and professions: licenses.
Would authorize any of the boards, bureaus, commissions, or programs within the Department of
Consumer Affairs, except as specified, to establish by regulation a system for a retired category
of license for persons who are not actively engaged in the practice of their profession or
vocation, and would prohibit the holder of a retired license from engaging in any activity for
which a license is required.
AB 756 (Chang) - Small businesses: state agencies: civil fines and penalties.
Would declare the intent of the Legislature to enact legislation that would authorize certain state
agencies to waive penalties for small businesses within their first 120 days of operation if certain
requirements are met.
AB 777 (Harper) - California Global Warming Solutions Act of 2006: repeal.
The California Global Warming Solutions Act of 2006 designates the State Air Resources Board
as the state agency charged with monitoring and regulating sources of emissions of greenhouse
gases. The state board is required to adopt a statewide greenhouse gas emissions limit equivalent
to the statewide greenhouse gas emissions level in 1990 to be achieved by 2020 and to adopt
rules and regulations in an open public process to achieve the maximum, technologically
feasible, and cost-effective greenhouse gas emissions reductions. This bill would repeal the act.
AB 785 (Brown) - State government: small business certification.
Current law authorizes a city, county, or city and county to license any kind of business not
prohibited by law transacted and carried out within the city, county, or city and county, as
specified. This bill would express the intent of the Legislature to enact legislation that would
create a statewide small business certification system.
AB 795 (Low) - Employment: day's work.
Current employment regulation law, with certain exceptions, establishes an 8-hour workday and
a 40-hour workweek, and requires payment of prescribed overtime compensation for additional
hours worked.
AB 823 (Bigelow) - Counties: ordinances.
Would modify the requirements for a county board of supervisors to publish a summary of a
proposed ordinance or proposed amendment to an existing ordinance to meet the publication
requirement for an ordinance to take effect, including, among other new requirements, allowing
posting on the county's Internet Web site.
AB 842 (Patterson) - Contractors: trust or custodial benefits plans: essential health
benefits.
Would provide that a contractor that bids on or has been awarded work covered by a project
labor agreement that provides health care coverage to workers on the project that is the subject of
the agreement, that includes essential health benefits, as described in the PPACA, and that
provides evidence of that coverage to the entity awarding the contract, is exempt from a
requirement to pay into a trust or custodial benefit plan for health and welfare or similar benefits
for those workers an amount equal to the amount that the contractor would have been required to
pay into that trust or custodial benefit plan for health care costs for those workers.
AB 846 (Gallagher) - Mechanic's lien: discretionary dismissal.
Current law authorizes a court to dismiss an action to enforce a mechanic's lien for want of
prosecution if it is not brought to trial within 2 years after commencement of the action. This bill
would authorize a court to dismiss an action to enforce a mechanic's lien for want of prosecution
if service is not made within 6 months after commencement of the action
AB 852 (Burke) - Public works: prevailing wages.
Would expand the definition of "public works," for the purposes of provisions relating to the
prevailing rate of per diem wages, to also include any construction, alteration, demolition,
installation, or repair work done under private contract on a hospital or health care facility
project when the project is paid for, in whole or in part, with the proceeds of conduit revenue
bonds, as defined, that were issued on or after January 1, 2016. This bill contains other related
provisions and other existing laws.
