FOR OFC ONLY: Date: Paid: Tbl #(s): BAY RIDGE JEWISH CENTER 405 81ST STREET BROOKLYN, NY 11209 | 718-836-3103 | [email protected] SPRING FLEA MARKET APPLICATION Sunday, April 26th, 2015 | 9:00am - 4:00pm TERMS OF AGREEMENT DATED AS OF APRIL 26, 2015 BETWEEN BAY RIDGE JEWISH CENTER (BRJC) AND __________________________ (the “Vendor”) are as follows: Vendor may enter through main doors of BRJC Fourth Avenue at 81st Street, Brooklyn, New York at 7:30 A.M. in order to prepare their area for the Flea Market. 2. Doors will open at approximately 9:00 A.M. to the public and will remain open to the public to approximately 4:00 P.M. 3. Vendor must vacate the BRJC by 5:00 P.M. leaving their area in the same condition that they received it in. All areas must be left in broom clean condition. 4. Clothing racks are permitted ONLY at tables around the perimeter of the room. The perimeter tables are LIMITED and will be assigned in the order the applications are received. All clothing must be NEW. No exceptions. 5. In the event the Vendor is selling electronics, please have your customer plug in the item to make sure it works. 6. Vendors may not hang anything on the walls. Any damage caused to BRJC’s property is the sole responsibility of the Vendor. If Vendor fails to make any necessary repair to BRJC property then BRJC will repair the property and bill Vendor for the repairs. If Vendor fails to pay for the repairs and BRJC has to collect on the amount owed Vendor shall not only be responsible for the damages but for any and all costs including attorneys’ fees in the collection of the amount owed BRJC. 7. In no event is BRJC responsible to Vendor for any lost, damaged or stolen merchandise. 8. Vendor must post a sign on its table, where it can be easily seen by the public stating its return policy on all sales. 9. Any disputes arising between Vendor and its customers are strictly between the Vendor and customer. In the event that BRJC is named as a party in any claim or lawsuit by customer against Vendor, Vendor agrees to indemnify the BRJC for any damages including attorneys’ fees arising from the claim or law suit. 10. BRJC shall have at its sole discretion the right to cancel the Flea Market. If BRJC cancels the Flea Market the Vendor’s rental fee shall be refunded to the Vendor. Vendor shall have no further claims against BRJC for any damages arising from the cancellation of the Flea Market. 11. BRJC makes no representations, guarantees, warranties, expressed or implied, as to anything other than what is stated in this agreement. 12.
