Terms of Bids: (By signing and submitting a Sealed Bid form, SIGNER agrees to all terms listed.)
1) “Sealed Bids” must be physically/actually received at the Juab County Clerk/Auditors Office, 160 North Main Street,
Nephi, UT 84648, no later than 3:00 P.M. on May 28, 2015.
2) “Sealed Bids” will be opened in the Juab County Commission Chambers, 160 North Main Street – Room 101, Nephi,
UT 84648 at 3:05 pm on May 28, 2015 in a public meeting.
3) A Rocky Ridge Fire Station Construction “SEALED BID FORM” (pages 1 - 3) and “THE MUNICIPAL
BUILDING AUTHORITY OF JUAB COUNTY - CONSTRUCTION CONTRACT” shall be reviewed, completed
(i.e. fill in the blanks), initialed, signed and returned with your “Sealed Bid” in a sealed envelope as shown on page 3.
Sealed-Bid and Contract Forms are available on the Juab County Website at: juabcounty.com (under “Permits and
Licenses”, then go to “Bid Forms”), or at the Juab County Clerk Auditor’s Office.
4) The Municipal Building Authority of Juab County reserves the right to reject any and all Bids, including token Bids,
and to waive any informality of the Bids. The Municipal Building Authority of Juab County also reserves the right to
not accept the lowest Bid for purchases, nor accept the highest Bid for property sales, when, in the opinion of the
Authority, a different Bid may be in the best interest of The Municipal Building Authority of Juab County.
5) Bids shall include a Statement of Contractor Qualifications, references and specify a flat fee for construction of the
Rocky Ridge Fire Station in Rocky Ridge City, Utah complete.
6) The “Total Bid Amount” shall include any and all labor, materials, equipment, equipment mobilization, bonding and
any and all costs, directly or indirectly related to the construction of the Rocky Ridge Fire Station in Rocky Ridge
City, Utah complete in accordance with Architects bid documents, construction contract, specifications and terms
herein identified.

8) Bidders shall specify a firm “start date” and firm “completion date”. Start date and completion date will be
considered in the bid award.
9) All bids remain subject to acceptance for 60 days after the day of the bid submission. The Municipal Building
Authority of Juab County may, in its sole discretion, release any Proposal and return the Bid security prior to that
date.
10) Bids shall be submitted in a sealed envelope addressed as shown on page 3.
11) Successful Bidder shall be required to perform work under contract with The Municipal Building Authority of Juab
County. A properly completed (i.e. bidders shall fill in the blanks); signed contract shall be submitted with the Rocky
Ridge Fire Station Sealed Bid. Forms available as referred to in item #3 above.
12) Performance and Subcontractor Payment Bonding required as described in Section 4 of the Construction Contract.
Official Bonds shall be provided by successful bidder within 3 business days of Bid award and prior to
commencement of any work.
13) List of proposed Subcontractors and Materials Providers shall be provided with Sealed Bid Form.
14)
Certificate of Liability coverage, including Contractual Liability and Worker’s Compensation insurance
coverage shall be provided to The Municipal Building Authority of Juab County prior to commencement of
work.
Insurance: The Municipal Building Authority of Juab County requires the following Insurance Requirements for Building Authority of
Juab County Projects be in place before construction begins. Contractor shall procure and maintain the following types of insurance
and minimum coverage limits for the duration of this Agreement. Any sub-contractor hired by the Contractor to perform work on the
Project shall also meet these insurance requirements

Commercial General Liability and Automobile: $2,000,000.00 combined single limit per occurrence for bodily injury,
personal injury and property damage. If the policy contains a general aggregate limit, the general aggregate limit
must apply separately to this Agreement or the general aggregate limit shall be $4,000,000.00.
2.
Worker’s Compensation and Employer’s Liability: Workers’ Compensation as required by the State of Utah and
$1,000,000.00 per accident for Employer’s Liability.
3.
Deductibles: any deductibles or self-insured retentions must be declared to and approved by The Municipal Building
Authority of Juab County. At The Municipal Building Authority of Juab County’s option, The Municipal Building
Authority of Juab County may require that the insurer reduce or eliminate the deductibles or self-insured retentions as
respects The Municipal Building Authority of Juab County, its officers, officials, employees and volunteers; or The
Contractor procure a bond or letter of credit guaranteeing payment of any deductibles or self-insured retentions.
4.
Certificates of Insurance: The Contractor shall provide The Municipal Building Authority of Juab County with
certificates of Insurance and with original endorsements effecting coverage required by this Agreement. The
certificates and endorsements for each insurance policy shall be signed by a person authorized by that insurer to bind
coverage on its behalf. All certificates and endorsements shall be received and approved by The Municipal Building
Authority of Juab County before work commences. The Municipal Building Authority of Juab County reserves the
right to require complete, certified copies of all required insurance policies, at any time.
5.
Subcontractors: The Contractor shall include any subcontractors as insureds under its policies or shall furnish
separate certificates and endorsements for each sub-contractor. All coverages for sub-contractors shall be subject to
all of the requirements stated herein.
6.
Indemnification: The Contractor shall indemnify and hold The Municipal Building Authority of Juab County and its
officers, officials, employees, agents and volunteers harmless from and against all claims, damages, losses and
expenses (including attorney’s fees), and costs relating to environmental clean-up or non-compliance, arising out of
or resulting from the Contractor’s acts or failures to act in performing this Agreement and completing the Project. The
Contractor shall not be liable for The Municipal Building Authority of Juab County’s own negligent acts.
15) Contractor and all subcontractors must provide certification with the “Sealed Bid Form” that he/she is registered and
participating in the Status Verification System required under Utah Statute 63G-11-103.
16) No work shall be performed until a properly executed Construction Contract is in place (i.e. signed by both parties)
with all licenses, bonds, insurance certifications, etc. (as referred to above) having been received by The Municipal
Building Authority of Juab County.
