• Regular Meeting of the Zoning Board of Appeals held in the Municipal Building on October 13, 1982. Present: Acting Chairman Ryan, Messrs. Rosenberg and Dolan, Mrs. Cassella, Village Attorney Murray, Building Inspector Hendrix and Deputy Clerk Graham. Minutes of the September 8th meeting approved as corrected. The Board reopened a public hearing for Mrs. Theresa Sansevera for an area variance to allow an addition to the rear of her home at 28 Rochambeau Avenue, Sheet 7, Block 435, Lot 8. Chairman Ryan stated that at the last meeting the Board adjourned the hearing in order to revisit the site. The Board acknowledged receipt of a letter from Mrs. Sansevera, dated September 15, 1982, including a copy of her deed and stating the reasons why she is requesting this variance. Mrs. Sansevera presented the Board with two letters from neighbors who feel the application should be approved, namely Mrs. Anna E. King, 26 Rochambeau Avenue and Mr. & Mrs. Schezzini, 21 Rochambeau Avenue. She also presented for the record 15 pictures of her property. Mrs. Sansevera stated, at this time, she has nothing further to add. • Mr. Pirrotti, attorney for Mr. & Mrs. Andreacchi of 30 Rochambeau Avenue, stated that his clients object to the granting of this application, and he explained that, in their opinion, the addition. will be too close to their property and the proposed porch is too large, 'causing a devaluation of their property. He also presented a picture of his client's property. The Board asked if the proposed porch were reduced in size would it be acceptable. The ap____ plicant, Mr~ Pirrotti and his clients, at the Board's requ~t~et in private to discuss the proposal. After a brief discussion, ~C'95~!!.AJ_ Mr. Pirrotti stated that no agreement could be reached that was ~ acceptable to all parties involved. ~ ... , j,r Motion was made by Mr. Dolan, seconded by Mr. Rosenberg, to close this public hearing. Motion carried, all members voting "aye". Motion was made by Mr. Dolan, seconded by Mrs. Cassella, that this application, as filed and amended, be approved. Motion carried, all voting "aye". Findings of Fact and Decision to be appended to the minutes of tonight's meeting. The Board opened the second public hearing scheduled for this evening on an application filed by Mr. Anthony DiGiorgio. The clerk read the following notice; • NOTICE IS HEREBY GIVEN that an application has been filed by Anthony DiGiorgio for an area variance to allow an addition to the east side of his home at 40 Sandrock Avenue, Dobbs Ferry, New York, Sheet 20, Block 460, Lots 18 & 19. NOTICE IS FURTHER GIVEN that the Board of Zoning Appeals will hold a public hearing on Wednesday evening, October 13, 1982, at eight-thirty o'clock • Zoning Board of Appeals Meeting October 13, 1982 Page 2 p.m., or as soon thereafter as possible, in the Municipal Building, 112 Main Street, Dobbs Ferry, New York, to consider the granting of such a variance. The Clerk noted that the applicant had completed noticing of persons within 200' in accordance with the rules and regulations of the Board. Further, there was no communicati.ons received on this application. Acting Chairman Ryan noted receipt of the following: • 1) Letter from Building Inspector Hildinger denying Mr. DeGiorgio a building permit. 2) Mr. DeGiorgio's application for variance and copy of his deed. Dated 9/23/82. 3) Plan drawn by John P. Egner, architect, dated September 8, 1982, received October 4, 1982 showing proposed additions. Chairman Ryan opened the hearing to the floor. briefly on his application. Mr. DeGiorgio spoke Mr. Frank Paciucco of 28 Sandrock Avenue was present and stated that he was an adjoining property owner. Although he was not objecting to this application, he is concerned at the distance it will come to the unimproved portion of Russell Place. The Board reviewed Mr. DeGiorgio's plan and found that the plot plan and actual plan did not coincide. Mr. DeGiorgio stated that he was also unaware of that fact. The Board established that this home was built in April 1958, and, and that time, the zoning was two family. The present zoning now is one family. Mr. DeGiorgio stated, at present, he lives in this home with his brother in one apartment and his parents in the other apartment and it is not his intention to convert this home into a three family home. The Board stated that by placing stairs where they are located makes it very possible to convert this home into a three family. Mr. DeGiorgio restated his previous position that he does not want a three family home. • The Board requested Mr. DeGiorgio to have his plan redrawn and to have dimensions placed thereon. Further, Mr. DeGiorgio was requested to have Mr. Egner present at the next meeting, if possible. Village Attorney Murray stated that a decision has been given on the Berger Case, Article 78, and the Zoning Board must rehear the case. Further, he would supply the Board copies of said decision.
