Issues : Postering in SFSS Rotunda, Decision : 25$ reduction in campaign fund. Appeal outcome : Decision upheld. Reasons
[1] Between March 13th and 14th, The IEC received a series of complaints about campaign posters belonging to Kayode Fatoba being in the SFSS Rotunda Space. [2] As per the Candidate Handbook Page 12, Permissible Locations Campaign Materials may not be posted off campus, in SFSS spaces, or areas that not all candidates have access to. [3] An email circulated to all candidates on March 9th stated: Though not listed in the candidate handbook, the Rotunda is an SFSS space, and is off limits to campaigning.
[4] As Kayode Fatoba ran in the 2014 General Election where the Rotunda was specified as an off limits SFSS space.
[5] As Kayode Fatoba is currently VP Student Life, and should be able to identify SFSS spaces. [6] As Kayode attended an information session on March 4th at 1:30 in MBC 2234, where candidates were reminded by the CEO to communicate the elections rules to anyone assisting them with their campaign. [7] As Kayode has several other infractions, the IEC has decided that an immediate removal of the offending posters is required, and that a 25$ reduction to his campaign fund will be levied.
[8] On March 19, Kayode requested a hearing which was held on March 20 at 11:30 a.m. Kayode explained that the posters were put up by a volunteer on Saturday and that Kayode himself did a pass through campus and saw the posters, removing them promptly. He felt that a fine was not warranted since he had corrected the mistake and felt that very few people had seen them. He also objected to the lack of warning issued by the IEC about this infraction. [9] CEO Sanchez iterated that there were complaints accompanied by photographic proof from three separate individuals from Friday and Saturday. CEO Sanchez had also gone through on Saturday to verify the number and location of these posters within the Rotunda. Kayode suggested that CEO Sanchez should have multiple individuals take multiple photographs for evidence to verify in person as he does not have faith in one person verifying the complaint from the three initial complainants. Points 2 through 6 in this document were reiterated. [10] After the hearing, Commissioners Chu, Shepherd, and Turdeanu deliberated on the matter, while CEO Sanchez recorded minutes of the proceeding. The three commissioners recommended no change.
