Independent Electoral Commission Decision upon Erik Hadekær 02 Complainant : Melissa Lee, Rebecca Langmead, Nourhan Seifelnasr Respondent : Erik Hadekær Issues : Postering in Tim Hortons Decision : $7 fine payable to the SFSS Foodbank Reasons [1]

On March 16, Erik Hadekær had posters up in the Tim Hortons Cafeteria space (M01) and removed all of them except one. Over the following days, the IEC received several complaints about the lost poster. [2]

As per the Candidate Handbook Page 12,
Permissible Locations Campaign Materials may not be posted in Private Businesses. Campaign Materials may not be posted in Cafeterias. [3] As Erik had informed us via email that all of the offending posters had been removed from the Tim Hortons area, and IEC members had been in that space during the break in the Burnaby Debates without noticing it, it was concluded that it had accidentally been overlooked. [4] As the poster had been up for a full working week in the Tim Hortons Cafeteria Space, and the previous fine was 5$ for five posters. [5]

As Erik took down the remaining poster by his own accord on March 21st before being notified by the IEC. [6] A $7 payable to the SFU foodbank fine was deemed appropriate for the poster.
