The Chief Minister also rejected Geelani's demand to curtail the duration of the Amarnath Yatra to 30 days from the planned 59 days and said it will take place as scheduled. "Some people were involved in such activities. Action will be taken against those involved in such an act," Sayeed told journalists in Ahmedabad, recalling how separatist leader Masarat Alam Bhat, who had himself raised pro-Pakistan slogans and waved Pakistani flags at a rally attended by Geelani was put behind bars. "When Masarat Alam was released, he had already spent five years under PSA (Public Safety Act). Then, I myself saw him with Pakistani flag. We then took immediate action (against Alam, who was again arrested)," Sayeed, who is on a visit to Gujarat to promote tourism in his state, said, adding "law will take its course". At the April 15 rally Pakistani flags were waved by Geelani's supporters which led to filing of case against him, his close aide Masarat Alam Bhat and others on sedition and other charges. Bhat was arrested the next day and booked under the stringent Public Safety Act a week later. At yesterday's rally, the first by him at militancy-hit Tral in south Kashmir, Geelani's had demanded restricting the Amarnath Yatra to 30 days keeping in mind the safety of pilgrims and protection of environment. I have both the Provisional Confirmation Page for applicant Ms 'Kachir Gaw' as well as details of payment she made to BOPEE," Mattu wrote on his account. Mattu claimed that the records about the admit card had been taken off the BOPEE site at the behest of the state government. "However, after an informal heads-up was sent to the government, BOPEE was asked to take the record down from their website this morning. India seeks UN intervention on Lakhvi''s release United Nations, May 2 (PTI) India has sought UN's intervention in the release of Mumbai terror attack mastermind and LeT commander Zaki-ur Rehman Lakhvi, saying it was in violation of the norms of the global body and it should raise the matter with Pakistan. In a letter to the current Chair of the UN Sanctions Committee Jim McLay, India's Permanent Representative to the UN Asoke Mukherjee said Lakhvi's release by a Pakistani court was in violation of the 1267 UN resolution dealing with designated entities and individuals. The sanctions measures apply to designated individuals and entities associated with terror groups including al-Qaeda and LeT, wherever located. In the letter by the Indian envoy, it was also mentioned that even the bail amount provided was against the sanctions' committee rule which calls for freezing the funds and other financial assets or economic resources of designated individuals and entities. The sanctions' committee has five permanent and 10 non-permanent UN member-states in it. The release of Lakhvi had also raised concerns in the US, UK, Russia, France and Germany with Washington calling for him to be rearrested. Lakhvi and six others, Abdul Wajid, Mazhar Iqbal, Hamad Amin Sadiq, Shahid Jameel Riaz, Jamil Ahmed and Younis Anjum have been charged with planning and executing the Mumbai attack in November, 2008 that left 166 people dead. Lakhvi, 55, a close relative of LeT founder and Jamaat-Ud Dawa (JuD) chief Hafiz Saeed, was arrested in December 2008 and was indicted along with the six others on November 25, 2009 in connection with the 26/11 attack case. The trial has been underway since 2009. A Pakistani court had on April 9 set free Lakhvi, a development which India said "eroded" the value of assurances repeatedly conveyed to it by Pakistan on cross-border terrorism. Rahul attacks govt on real Nepal estate bill, calls it pro-builders quake toll New Delhi, May 2 (PTI) Firing yet another salvo at Narendra Modi government, Rahul Gandhi today claimed it had diluted provisions of Real Estate Regulatory Authority Bill making the legislation pro-builders from being pro-buyers. After meeting several NCR flat buyers today, the Congress Vice President, who has been attacking the Centre over land bill issue and the plight of farmers, said that he had learnt that it is not just farmers and tribals but also the middle class people that are "suppressed" on matters related to land. Assuring homebuyers that he would stand by them, Gandhi said that it was due to lack of transparency, the buyers were left in a quandary. "They are told that you will get the flat on a particular day but for years they don't get the flat. They are told the super duper area of the flat would be so much but what is delivered is different," he said. He said that someone was promised that the flat will have a good view, but a few months after the flat was delivered, another building came up and the view was blocked. He said the government was trying to destroy the Bill which Congress led UPA had brought to regulate the real estate sector. "Main dilution is that there was clear transparency. The carpet area that you sign is what would be given. They have diluted and from pro-buyer, made it pro-builder," he said. Attacking the government, he said, "What it is doing against farmers and tribals, it is also doing against the middle class". "I have assured them that the way I stand with farmers and tribals I stand with them also," he told reporters. Saloni Paroothi, one of the home buyers who had met Gandhi, said that she had booked a flat in Noida but the possession was now delayed by several years. Explaining her problem, Paroothi said that she not only had to ensure payment of EMI, but also the rent of the house where she was living. "The builder is neither paying any penalty, nor is he listening to us," she said. "The death toll has reached 6,624," said the home ministry's national disaster management division. A further 14,025 people were injured in the quake, it added. A fresh 4.5-magnitude aftershock this morning triggered panic among the people, who scrambled for open spaces. The 7.9-magnitude quake last week left a trail of devastation and suffering, with people spending the cold night in the open because of fears of fresh quake. Nepal's remote mountainous areas have suffered "almost total devastation" from the powerful quake, aid agencies have warned, even as relief slowly began to reach far-flung regions amid fresh aftershocks that kept people on edge. International humanitarian bodies have called for greater urgency in relief efforts. "Statements like these should not be taken seriously. These are given just to seek media attention," Singh told reporters, stressing that the yatra will he held as scheduled and all facilities including security will be provided to the pilgrims. He was asked about hardline Hurriyal leader Geelani's statement at a rally yesterday in Tral that the annual Amarnath yatra in south Kashmir Himalayas should be restricted to 30 days for "safety" of pilgrims and protection of environment. This year, the yatra to the holy cave shrine will be for 59 days from July 2. Hitting out at separatists, Singh said they have lost their ground in the Valley and were now trying to seek attention of the people with such statements. "The separatists are finding themselves to be irrele- vant that is why they are raising such issues. People do not follow them and there were only a few hundred people at the rally. "They have become irrelevant and they are doing this to seek the attention of general masses. They are trying to vitiate the atmosphere of J&K but they would not succeed in it," the BJP leader said. "They have been trying to vitiate the atmosphere since 1947. They are the people who have lost their ground. People of Jammu and Kashmir have rejected them as they have given power to PDP and BJP government. People want development-- they want rehabilitation of flood victims," he said. He held separatists responsible for "instigating" youths in the Valley in 2010 agitation which led to the death of more than 100 people. Asked whether government was considering action Geelani after Pakistani flags were waved at his rally yesterday, the Deputy Chief Minster said, "Law will take its own course". "Government is working and police is also working on it. Whosoever is the culprit and indulge in such activities, action would be taken against them," he said. He said that in the coming days nobody would dare to indulge in any anti-national activities in the state. "Everything will move forward as per our Common Minimum Programme (CMP). Singh said that the common people of Jammu and Kashmir especially Kashmir are anxiously waiting for the Yatra to commence. "Amarnath yatra is managed by the shrine board and it follows all the traditions under the Hindu mythology. Yatra will go as per schedule. All the facilities including security and safety will be provided to the pilgrims. Jammu and Kashmir government will give all cooperation to the shrine board," Singh said. After the Assembly election, he said, people of the state want to move ahead with a new thinking. "There are some elements who by making controversial statements seek media attention and also Pakistan which cannot control its own internal affairs and is poking its nose in our affairs. This would not have any effect here," he said. "Since this government has come to power, people from different faiths have come closer and these people are trying to create communal disharmony by making such statements," he said. He said that the government has been inviting people to visit Kashmir. "We are inviting people from Bollywood to come and make movies in Jammu, Ladakh and Kashmir. Such statements do not have any impact in Jammu and Kashmir. Jammu and Kashmir is peaceful and we want to tell this to rest of the country," he said. On the issue of granting amnesty to youths in Jammu who have were booked during Amarnath land row agitation, he said, "The agreement which was made has everything in it. There is no such instance in my knowledge. There are several cases against me as well. "I do not think that there are any serious charges against anybody relating to Amarnath agitation. If any such case comes o my knowledge, we would see what can be done," he said. Addressing a press conference at BJP headquarters alongwith State Spokesperson Balbir Ram Rattan, he said that the separatist leaders like Ali Shah Geelani, after having failed to get any public support in Kashmir valley, are now making attempts to disturb the peaceful atmosphere in the valley by interfering in the religious issues like Shri Amarnath Yatra to remain in limelight. Sunil Sethi said that the separatists are raising the issue of Shri Amarnath Yatra under a deep rooted conspiracy due to which they want to disturb the communal harmony in the state. But BJP will never allow to succeed such leaders in their game plan. He said the decision about the duration of Shri Amarnath Yatra is taken by the Shri Amarnath Yatra Shrine Board, which is an autonomous body and no one has any right to interfere in this religious issue, with which the sentiments of crores of people are connected directly. Sethi further added that the Annual ya- tra of Shri Amarnath is directly linked and also beneficial for the economy of the Kashmir valley, as the people in valley are entirely dependent upon the flow of pilgrims performing this holy yatra. While replying a query about holding the anti-India rally and waving of Pakistani flags in a rally at Tral in Kashmir valley, Sunil Sethi said that there is no difference between Masarat Alam and Sayeed Ali Shah Geelani, both are the separatist leaders and want to disturb the peaceful atmosphere in the valley by organizing such type of events. Stressing on the issue, Singh mentioned that students of Jammu University in particular are suffering lot because of poor network of BSNL .Even Amarnath Yatra: Tampering holy dates may lead to dangerous confrontation: Shri Ram Sena GOF Staff Reporter Jammu, May 2: Reacting strongly against the Hardline Hurriyat leader Syed Ali Shah Geelani’s remarks on the annual Amarnath Yatra, State President, Shri Ram Sena, Rajiv Mahajan threatened to launch a strong agitation to protest against the curtailment of Amarnath Yatra duration. In a statement issued today, Rajiv Mahajan said the Yatra shall commence from auspicious Jyeshth Purnima, a practice which has been going on for the last several years. Asking that Hurriyat leaders does not entitle to interfere with the affairs of the Amarnath Yatra or its conduct or its dates, Rajiv Mahajan said, "If Muslims can visit their religious places during any time of the year, if Christians can visit their religious places during any time of the year, why can't the Hindus be allowed to visit Amarnath Shrine as per their wish." He also warned that any tampering with holy dates of Amarnath Yatra could lead to a dangerous confrontation. It is pertinent to mention here that Geelani while addressing a public rally in Tral said that the Amaranth Yatra in south Kashmir Himalayas should be restricted to 30 days. The rally, which was the first in seven years by the separatist leader in the militancy-infested township, witnessed pro-Pakistan sloganeering and waving of Pakistani Reacting strongly flags. against the waving of Pakistani flag during rally, Rajiv Mahajan demanded immediate arrest of Syed Ali Shah Geelani. “At an April 15 rally too held by Geelani, Pakistani flags were waved by supporters which led to filing of case against him, his close aide Masarat Alam and others on sedition and other charges,” He said. “Bhat was arrested the next day and booked under the stringent Public Safety Act a week later then why not Geelani arrested,” Rajiv said. He said, “it’s a matter of serious concern that such anti-national activities took place in the State and it is totally against the interests of the Nation and people of the State”. He also criticized BJPPDP Coalition Government for allowing such rally in Srinagar in which Pakistani flags were openly waving and anti-India slogans had been raised. He raised question of government credibility that why police authorities did not take action against Geelani and his supporters participating in the rally. though there has been increase in the bill payments; there is no improvement in the services provided by BSNL, a government of India undertaking. Singh further mentioned that most of the rural areas are uncovered by BSNL network which creates problems among the people in general who need to communicate to their BSNL numbers. While strongly condemning the civilian killings in recent months he reminded the government of its promise of zero tolerance on human rights violations. “It seems government’s promise within and outside the Assembly of peace, freedom and zero tolerance is a hoax. Such incidents can derail peace in the state and it is the duty of the government to ensure that such incidents aren’t repeated,” he added. Hakim Yasin also urged the government to immediately review the new recruitment policy. “Based on the past experiences it has been observed that under the new policy political interference in making recruitments will erode the credibility of institutions. The group plans to provide essential commodities and medicines to the people in the quake hit country. "Our aim is to help the needy. He said that not only the yesterdays anti India rally but Syed Ali Shah Geelani had organized an identical rally in Hyderpora only a couple of days back where he indulged in India bashing, spewing venom against our nation besides other seditious activities but was allowed to go scot free. Questioning the BJP leaders over the tall slogans of ‘Zero Tolerance’ given by them against insurgency and Separatism, he said that nationalist forces of the country were seeking explanation from the ruling BJP and 56 inch chest man for the open defiance of the sovereignty and integrity of India by a handful of Separatists. He said that it was ironical that the Saffron party which always had been in the fore fronts of protests against separatists while in opposition had allowed them open space to indulge in anti India posturing, organize pro Pak rallies and to dictate the terms to the State govt. even in respect of Amarnath Ji Yatra and Separate townships for Kashmiri migrants. Not only that, Singh regretted that such anti India elements continue to enjoy State Government hospitality in the form of several perks, huge paraphernalia of security cover and govt. protection at the cost of Stat exchequer. Kotwal also attended the video conference. On the occasion, the Minister took stock of process of constitution of district, Tehsil and block level committees. The committees are being constituted to ascertain the exact number of additional families under AAY, BPL and APL categories as per hilly districts and also arrange private vehicle to carry the rations in case SRTC could not provide sufficient number of vehicles. For this purpose, he directed for constitution of a committee at the earliest. The Minister said at present the government is providing ration to 1.01 crore souls as per 2001 census. He said as per the 2011 census the requirement of ration is for 22.73 lakh families which comprise 1.25 crore souls. He further directed them that while formulating the plans, the basic requirements of the people should be kept in mind. C Wooing middle class mposing him firmly as voice of opposition in Parliament, Rahul Gandhi fired another salvo at the Narendra Modi government on Saturday for allegedly tweaking the real estate bill in favour of builders, as the Congress vice-president aggressively wooed the middle class after taking up the cause of farmers. Gandhi, who has been attacking the government over the land acquisition bill and the plight of farmers hit by untimely rains, met more than 100 homebuyers from the national capital region (NCR) at the Congress headquarters and heard their grievances about delays in possession of flats and fake promises allegedly made by builders. The meeting came in the wake of the government introducing a revamped Real Estate (Development and Regulation) Bill in the Rajya Sabha, which the opposition said is heavily tilted in favour of builders and leaves buyers facing the possibility of fraudulent practices by real estate developers. The original bill was introduced in 2013 by the Congress-led UPA government. Since returning from a 53-day leave of absence, Gandhi has been aggressively fighting for several issues, including the watered down land acquisition bill and net neutrality, seen as an issue for the middle class. Rahul was of the view that only farmers and tribal people are suffering due to land issues. But the same issue extends to the middle class as well, which is equally being exploited by removing a transparency clause from the real estate bill. Homebuyers are promised a certain super area...a specific time of completion of the project...beautiful view. But what they get (from the builder) in the end is totally different. Rahul will stand by them, as he assured, said that they were left in a quandary due to lack of transparency. Someone was promised that a flat will have a good view, but a few months after the flat was delivered, another building came up and the view was blocked. The government was trying to destroy the bill which the UPA had introduced to regulate the real estate sector. The main dilution is that there was clear transparency. The carpet area that you sign is what would be given. They have diluted and from probuyer, made it pro-builder. People are under tremendous pressure as they had invested their hard earned money in projects that were delayed for several years. Builders have got greater leeway as the cost of consumers in the revamped Real Estate (Development and Regulation) Bill. The opposition is demanding that the redrafted bill be sent to a select committee as major changes have been made from the original bill. The government, however, has defended the bill, saying it protects the interests of buyers without throttling the real estate sector. In turn, this has had an adverse impact on morale in the civilservice. In these circumstances, relief to a civil servant can come only from the court before whom he is arraigned. Union Finance Minister Arun Jaitley struck the right note recently while speaking at the 16th D.P. Kohli memorial lecture organised by the Central Bureau of Investigation (CBI) on April 27 in New Delhi. D.P. Kohli was the founder director of the CBI who held office from April 1, 1963 to May 31, 1968. The CBI traces its origin to the Special Police Establishment (SPE) which was set up in 1941 by the Government of India. It became the Delhi Special Police Establishement and acquired its popular current name, the Central Bureau of Investigation through a Home Ministry resolution dated April 4, 1963. Kohli is rightly remembered as being a determined crusader against corruption. One may not agree with all that Mr. Jaitley said at the lecture especially with regard to how an investigator somehow wants to make out a case against an accused, although the evidence marshalled by him did not justify it. He had said: “He [the investigator] follows the golden rule that if he gives a report that the accused is prima facie not guilty, then questions are going to be raised about him. Therefore, his golden rule is he must somehow make the case and it is the accused’s good luck that he gets a fair trial,” adding that this process has hindered the whole process of economic decision making. Mr. Jaitley further added that under such circumstances, decision-making becomes a game of passing the parcel. “Departments of purchase, defence and disinvestment have all suffered,” he said. Hurdle in administration However, his views on the need to revisit several provisions of the Prevention of Cor- I BY : BRINDA KARAT ven as countrywide protests against the land ordinance gain momentum, Adivasi communities living in mineral-rich areas are apprehensive of what awaits them as the Mines and Minerals (Development and Regulation) Amendment Bill 2015 (MMDRA) has received presidential assent and the government has drafted Rules for some clauses of the Act. The principal Act of 1957 is as draconian a law for Adivasis as was the Land Acquisition Act of 1894 for all farmers. But, shockingly, except for resistance by the Left parties and the Congress in the Rajya Sabha, this antitribal Bill got easy passage after regional parties such as the Trinamool Congress, the Bharatiya Janata Dal and even the Samajwadi Party came to a deal with the government. The main flaw in the Act is that it does not address the critical issue of the rights of those who own or occupy the surface land beneath which minerals lie. The Act has no provision for consent or even consultation with gram sabhas which would be affected by mining operations. Adivasis are described in the law as “occupiers of the surface of the land.” As “occupiers”, they have the right to compensation, but as enunciated in the Rules, if they do not E agree to the mining plan or to the amount of compensation, the “State Govt shall order the occupier to allow the licensee to enter upon the said land and carry out such operations as may be necessary.” Rights of Adivasis It is under this provision that lakhs of Adivasi families have been displaced, turned into migrants or, at best, into daily contract labourers in mines that have destroyed their forests, lands and water. Adivasi movements have been demanding amendments to ensure that before such leases are given, their informed consent is taken and they have a share in profits from mineral wealth. Governments have refused to heed this democratic demand. In India, the state has all rights over minerals, but over the years it has acted as a front to hand over mineral resources for private profit. There have been substantial amendments to the Act since 1957, but they have been to strengthen the rights of mining companies further, not to strengthen the rights of Adivasis. This despite the Supreme Court Samatha judgment of 1997, which upheld Adivasi rights to informed consent and to a share in mineral wealth. The judgement ruled that under the Fifth Schedule (administration and control of scheduled areas and PC Act was totally unsuited for such a situation facing a nation that was trying to march ahead on the economic front. He said, “… the Act pre-dated 1991, when the economic reform process began. It was perceived in a regulatory framework when we were still more regulated. That Act has today to evolve. And the basis of the evolution is that when economic activity is being enlarged in the country, in any economic activity and decision-making there would always be new areas to charter out and quick decisions to be taken.” Presumption of guilt Unfortunately, necessary changes to the law were not put in place and this failure to reform anti-corruption law had its impact on the pace of public administration and staff morale. Even now, the proposed amendments to the Act are excruciatingly slow in coming, although approved by the United Progressive Alliance (UPA) government more than a year ago. The information now is that the Union Cabinet has cleared the suggested changes and has improved upon the measures agreed upon by the UPA. Section 13(1)(d)(iii) of the Act is generally looked upon as being the villain of the piece. Under this provision of law, the investigating agency has to prove that a civil servant whose conduct was in question took a decision which “obtains for any person any valuable thing or pecuniary advantage without any public interest” in order to proceed against him under the Act. There is a suggestion here of a presumption of guilt that can be drawn against the official in question. This, prima facie, is a negation of the English jurisprudence which we inherited and adopted. The overall perception generated by the stern wording of this subsection was that it was not necessary at all for the investigator to prove mens rea or dishonest intention to proceed against the civil servant being probed, and that an adverse presumption could be drawn straightaway against him. Section 20 of the Act, which deals Why must poor sacrifice? BY : ASHWANI MAHAJAN here are two schools of thought about development. One school of thought believes in a philosophy of development, whereby the poor is kept in the centre of policy making. A model of development where the poor gets opportunities to grow; a production system which generates enough employment; and a distribution system where there are least inequalities in the distribution of income and wealth. If due to some reasons, the poor lag behind or lose their employment and livelihood; then we can think of adopting strategies to reduce inequalities in income, wealth and consumption; by way of government interventions, such as employment generation schemes like the MNREGA, subsidising essential products and services including food grain, education, health, fuel, housing, etc. Amartya Sen has also been advocating these schemes. Sometimes, policy makers, failing in improving the conditions of poor and deprived sections, make use of these schemes as populist measures to garner public support. Another philosophy of development is influenced purely by capitalist thinking. Proponents of this school of thought argue that the best way to help the poor is to increase investment, which can help increase output, employment and welfare of masses; and increase revenue, which can ultimately be used to fiinfrastructure for the nance development of the economy. If the government has resources, it can be used to subsidise goods and services required by masses. For those who believe in this model of development, the only measure of development is growth in real GDP. If GDP grows by 8 to 10 per cent, it is a matter of pride for them. They argue that if, in the process, the poor do not get their due share in growth, let them sacrifice today for better future. They argue that benefits of growth will automatically percolate to poor, what they call ‘percolation effect’. His description of the fear psychosis that grips the bureaucracy is no exaggeration. It is real, I have heard about this and had this conveyed to me strongly by many friends in the civil service. I agree that apprehension by civil servants of the consequences of taking a decision in a matter of public importance especially one that involves huge expense to the public exchequer has been a roadblock to proactive and positive administration. I highlight this especially at a time when the entire nation wants govts, both Central and State, to work fast and effectively. Ironically, fear is the hallmark of those more honest among civil servants than the ones who are venal and bereft of values. In this context, it should be remembered that there are instances where an honest civil servant makes a rank bad decision, not because of a lack of intelligence or inarticulation, but because of timidity and an inability to turn down unscrupulous, off-the-record directions from a political master. In cases like these, the official concerned has to be punished within govt and not in courts, that too for lack of courage rather than of integrity. Unfortunately the law, as it exists, does not make a distinction between the reasonably honest yet pusillanimous government official and the dishonest one. It places both on a par. This is the crux of the matter with regard to a lack of integrity in the civil services. The reforms era I was struck by the distinction Mr. Jaitley drew between the pre- and post-1991 situation in government and its impact on anti-corruption investigations. In the second time frame, the civil servant at the higher levels had to take momentous decisions to fast track liberalisation and quicken the processes of a failing economy. Conventional and routine thinking had to be shed and bold courses of actions adopted to meet the dire needs of the country. Mr. Jaitley was on target when he said that the scheduled tribes in these areas) and laws in different States, since Adivasi lands can neither be transferred nor leased to non-Adivasis, mining activities in tribal-dominated areas should involve the tribals themselves. Since 1997, other laws such as the Panchayat Extension to Scheduled Areas Act (1996), the Forest Rights Act (2006), and the Wildlife (Protection) Amendment Act (2006) have helped establish the rights of Adivasis and gram sabhas. The more recent Vedanta judgment by the Supreme Court struck down the agreement reached between the company and the State government because it did not have the consent of Scheduled Tribes whose “traditional rights” were affected. There is no dispute that a country’s mineral wealth should be mined and used for development. However the predominant understanding of ‘development’ by ruling governments at the Centre have privileged profit, in this case of mining companies, over the more sustainable and equitable use of minerals in partnership with local communities. This would also require a sane assessment of the amount of minerals required during a specific period of time with consideration being given to intergenerational equity instead of reckless loot in the name of development. In 2010, in partial recognition of the Adivasi demand for a stake in mineral wealth, the United Progressive Alliance govt had moved an amendment to the 1957 Land Acquisition Act. The Act stated, “any person or persons holding occupation or usufruct or traditional rights over the surface of the land will be allotted free shares equal to 26 per cent through company’s quota, or an annuity equal to 26 per cent of the profit (after tax paid)…”. It mandated “annual compensation as may be mutually agreed.” It also made other provisions towards the welfare of Adivasi communities. nomic policy and budgetary policies of the governments of various regimes have been that the burden of taxation on corporate has been gradually declining by way of concessions in corporate income tax, excise duty, custom duty etc. On the other hand, tax burden on the common man has been on the rise. Budget documents every year has a statement, namely, ‘Statement of Revenue Forgone’, which gives details of such concessions to business and corporate. If we leave out the tax concessions to personal income tax payers, revenue foregone to the benefit of business (mostly corporate) was nearly Rs. 5.5 lakh crore in 2014-15. It is notable that due to tax concessions to the businesses (mostly corporate), the government is not left with sufficient resources to be spent on the welfare of the poor, the deprived and other weaker sections of the society who need the support of the government the most. This is the reason for the government's inability to raise real allocation on welfare schemes and developmental programmes. Therefore, we can say that it is the poor who are sacrificing to boost growth, whereas businessmen and corporates are enjoying the fruits of growth. REMOVING CONTROLS However, those who support economic growth even at the cost of the poor, argue that once growth takes place, its benefits will start accruing to the poor too, sooner or later, as their income, employment and consumption will also get a boost. Basic philosophy behind the model of economic growth adopted in the name of the new economic policy is the same. This model, which is also called ‘Liberalisation Privatisation, Globalisation (LPG)’ model, works by way of liberalising industry of controls. Under the new scheme of things, fiscal incentives are given to businesses and companies and public sector enterprises are privatised. Imports are made free from tariff and non-tariff barriers and controls from foreign investments are lifted to facilitate free flow of foreign capital. Though it is correct that the nation has witnessed spectacular growth in GDP in the last two decades, the benefit of the same has failed to reach the poor. During the 10th and 11th Plans, GDP grew by nearly 8 per cent annually. However, during the same period, unemployment also increased simultaneously and this growth was termed jobless growth. According to the data published by National Sample Survey Office, during the last 10 years, employment seekers increased by nearly 12 crore, whereas we could provide employment to only 2 crore people (20 lakh annually) during this period. Between 2004-05 and 2009-10, in merely 5 years, 2.5 crore people went out of self-employment and 2.20 crore joined the army of casual labour, which hints at deterioration in quality of employment. Deprivation of the poor has further worsened. As per Census 2001, 45 per cent of farmers belonging to scheduled tribes reported that they were working on their own land, which declined to 35 per cent in Census 2011; percentage of farmers belonging to scheduled castes working on their own land declined from 20 to 15 per cent during this period, whereas in 2001, 37 per cent workers in rural areas reported themselves to be landless agricultural labourers. In 2011, this number increased to 44.4 per cent. It is notable that pace of poverty reduction has also declined significantly after the adoption of ‘LPG’ policies. One can conclude that due to the LPG policy, in the last 25 years, despite the fast rising GDP, the condition of the poor has been worsening; they are losing land and employment (and livelihood). The quality of employment is also going down gradually. Therefore, without denying the importance of GDP growth, the basic question is, why the poor should sacrifice for growth meant only for rich? Why not we make policies where the rich sacrifice for the benefit of poor? However, the UPA government soon succumbed to opposition from mining companies and replaced the amendment with a much more diluted version in the 2011 MMDRA Bill. Amending a diluted Bill Even these diluted provisions have been scrapped by the Narendra Modi government. The government has brought 22 substantial amendments, each one to strengthen the rights of private sector mining companies in the name of attracting investment. For instance, in the 2011 Bill, it was incumbent on State governments to obtain all necessary permissions from the owners and occupiers of land for major minerals, and consult with gram sabhas in Fifth and Sixth Schedule areas for minor minerals. The Bill also mandated that all environment and forest clearances under the Forest (Conservation) Act, Wildlife (Protection) Act or any other law in force be taken before a lease was given. It made tribal cooperatives eligible for the grant of leases for minor minerals in Fifth and Sixth Schedule areas. The 2015 Bill neither mentions tribal cooperatives nor contains provisions for consent, consultation or clearances. This is an attempt to bypass gram sabhas and environmental norms in the name of “speedy clearances” and “ease of doing business”. Further, the 2011 Bill proposed the setting up of a (DMF). The 2015 Amendment also includes this, but the scope of it and the funds required for it have been drastically reduced. Instead of a contribution of funds equivalent to the full amount of annual royalty paid to the State government, companies will now have to give only one third. Coal companies were mandated to give 26 per cent of profit to the DMF, but the Modi government has scrapped this provision altogether. The 2011 Amendment Bill was already inadequate, but what the Modi government has pushed through is nothing but a betrayal of Adivasi India. Leader of the Trinamool Congress in the Rajya Sabha, Derek O’Brien, who acted as the proxy spokesperson for the Modi government in support of the Bill, said, “See the glass as half full, not half empty… let’s not be negative. The government had accepted a suggestion to make local communities, including tribals, partners in the development of the mines neighbourhoods.” Mr. O’Brien should know that it is not a question of “making” tribals partners in development of “neighbourhoods”, but in recognising them legally as rights holders with stakes to a share in mineral wealth. with presumptions that can be drawn against an accused by the court, however refers only to clauses (a) and (b) of subsection (1) of Section 13 and not to clause (d)(iii) that punishes even an inadvertent act causing loss to government. Even so, as a rule of thumb, investigating agencies, both in the Centre and in the States, have, in the initial stages of an investigation and before obtaining legal opinion, tended to interpret the law in a very narrow perspective. In turn, this has had an adverse impact on civil servant morale. In these circumstances, relief to a civil servant can come only from the court before whom he/she is arraigned. For this, the civil servant should be lucky to get a knowledgeable judge and an objective public prosecutor both of whom are now a vanishing tribe. An amendment to the PC Act, which would delete this particular subsection (1)(d)(iii) of Section 13, has been on the anvil for quite some time. I am certain that there is political consensus that this harsh provision will have to go sooner than later. This move will greatly reduce misgivings in the civil service. Rise of corruption Naturally, Mr. Jaitley’s speech did not cover dishonest acts by government servants in routine decisions, such as assessment of income, granting exemptions from tax, purchase of material and award of contracts. The rise of corruption at the level of senior members of the bureaucracy, especially in revenue collection agencies, has been alarming. Many officers are guilty of blatant dishonesty, taking advantage of the enormous discretionary authority vested in them. The disease of corruption afflicts even those directly recruited through the All India competitive examination, and generally considered to be the cream of the civil services, and who have no justification to be even slightly dishonest. In a number of recent cases, a few who have not even completed five years of service, have been caught red handed for accepting bribes. Go bananas BY : FARRUKH DHONDY he vultures ate my grandmother. This was after she was dead. I was eight years old and some elders in the family must have decided that, being a boy, I was old enough to be told the facts of life — or at least of death and disposal. I walked, wearing my white, bowed rather than buttoned, muslin Parsi shirt, behind the funeral procession of men following the body — past Golibar Maidan, the Indian Army’s shooting ranges in Pune, to the Towers of Silence. The vultures gathered atop the stone tower and in the trees around. The ceremony, as I remember it, was fairly simple. The body-carriers detached themselves from the procession and were the only ones sanctioned to climb the spiralling steps to the tower’s entrance. My uncle explained the procedure to me. Granny’s body would be left on the metal grill at the top of the tower and would be exposed to the sky and air by tearing the cloth shroud so that the vultures could devour her flesh. My uncle imagined he was assisting me into mature realisations about customs, traditions and the human condition. The description became the fuel of future nightmares, but my elders thought it better to explain the details of “sky-burial” than to leave me with a mystery and questions as to where granny had gone. A philosophy was appended to its description. This was a way of not polluting the earth as buried bodies would and not polluting the air as the smoke and ashes of cremated bodies would. It was a way of passing into nature. The word “ecological” wasn’t in vogue at the time. But then a decade or more ago the vulture population of India began to dwindle. In the 1980s, it was estimated that there were 80 million vultures of several types in the subcontinent. Through the ’90s, their numbers dwindled significantly and the cause of this decline and near disappearance wasn’t discovered till 2003. The culprit was the anti-inflammatory drug Diclofenac which had been fed to cattle (and, of course, to Parsis with swelling complaints!). Vultures then absorbed it through eating dead cows and died because it affected their livers. It was only when the species became endangered in this way that the vulture-culture came to my attention through articles which argued that vultures, far from being demons of the sky, were indispensable to the environment. The governments of India, Nepal and Pakistan reacted by banning the administration of Diclofenac to cattle and finding an effective replacement drug. Even though I am a Parsi, I am not an automatic supporter of sky burial and can see that the continued use of Diclofenac by Parsis can continue to pose a threat to the vulture population. There are undoubtedly very many more cattle corpses than Parsi ones for vultures to feed on, but still one can appreciate the irony of one endangered species endangering another. I don’t intend to sound like an ardent balance-of-ecology advocate. Apart from a few viruses and bandicoots I, in a passive way, want all species to survive and prosper. But now in one case and on behalf of one “species”, this passivity has turned to active evangelism. This is the case of the threatened banana. Even with the myriad concerns that grace the news of our beleaguered and sad planet, I have been alarmed this last week by reports of the banana being under danger of extinction. I read an essay by a banana historian which enlightened me as to several facts. Did you know that bananas are botanically classified as berries? Or that there are over a thousand extant varieties of banana? Or that bananas have been mentioned in Buddhist documents dating back to 400 BC? Or that Alexander tasted his first banana when he defeated the Persian satrap Porus in India? All of these are no more than entertaining facts. What is a matter of concern is that one dominant species of banana, the main worldwide variety, was wiped out in the 1950s by a fungoid infection in its roots known as the Panama Disease. This fungus wiped out the entire crop of bananas in the Americas. It spared India. The fungus, which is resistant to fungicides is extremely virulent and can spread, according to the banana historian, at an alarming pace even through contact with the sole of a shoe transported on an unwitting foot from one continent to another. I have received many such complaints and during initial check we found 80 per cent cases were fake." Kejriwal announced that his government is coming up with a scheme to give a major rebate on pending electricity bills in another 10 days. All the pending cases will be closed, he said. "We are scanning the records of poor people which will be soon rationalized. Cases against them will be closed," he said. He further assured 24x7 power supply this summer saying his government was ready with a plan. In view of summer, the CM also pointed that water will be an area of focus. Wherever there is a problem tankers will be provided. A crackdown had been launched on ration shops where beneficiaries are being deprived their share of supplies, he said. This Labour Day, Delhi chief minister Arvind Kejriwal went all out to reward the vote bank which catapulted his party to a historic victory. The CM did not simply stop at measures to empower the labourers but chose to touch a familiar chord—power bills. After giving a power subsidy to consumers, the capital is now planning a rebate scheme on old bills. There is also respite promised from pending cases linked to power. The rebate scheme will, however, be only for the poor and the cases in question would be those in which it is felt that the consumer has been put through unnecessary harassment by discoms . The bus belongs to Orbit Aviation, a company owned by Punjab deputy chief minister Sukhbir Badal. The father alleged that he was being forced to reach a compromise and said he would not even allow an autopsy until his demand was met. "My daughter needs justice. She was a little girl. Is our legal system so weak that it can't even mention charges against the owner?" the angry father said. "I have taken my son to a safe location. I was being pressurised to enter into a compromise with some people," he alleged. The girl's body has been kept at a local private mortuary at village Singhewala, three kilometres from where the mother and daughter were thrown out of the bus. It has been more than two days since she was thrown out of the bus with her mother by the bus staff after they quarrelled over the fare. All the four men behind the grave crime have been arrested. The father also alleged that his wife and son were not convinced that the right men have been arrested. Punjab police chief DGP Sumedh Singh Saini did not answer calls or reply to text messages on the charges levelled by the family. The four accused were produced in the court of judicial magistrate first class (JMFC) Pratima Mahajan, who remanded them to police custody till May 4. Patanjali Yogapeeth spokesperson SK Tijarawala told Zee News that the institute will soon put a disclaimer on the product. “Patanjali will put a disclaimer on Putrajeevak medicine that its is for women and has no relation with sex determination,” said Tijarawala. Patanjali's statement comes two days after the Rajya Sabha witnessed uproar over much-publicised infertility medicine 'Divya Putrajeevak Seed'. They were protesting against the beating of a five-member team of their community yesterday by some youths in DelhiKandhla train, police said. The protesters gheraoed the police station and pelted stones besides setting some vehicles on fire, SP Vijay Bhushan said. To disperse the violent protesters, police used tear gas shells and cane charged them, Bhushan said. In the cane charging one person was injured. Security has been tightened and extra police force has been deployed in the town, he said. Five persons belonging to the Tablighi Jamaat community were beaten up last evening. The traffic on Saharanpur-Delhi highway was disrupted following the incident, they said. The senior police officers rushed to the spot and pacified the protesters assuring them of nabbing the absconding accused soon, they added. Neeraj Kumar also claimed to have spoken to Dawood Ibrahim three times in June 1994. "I spoke to a jittery Dawood three times in June 1994... He seemed to be toying with the idea of surrendering but had one worry - his rival gangs could finish him off if he returned to India. I told him his safety would be the responsibility of the CBI," Neeraj Kumar has told Hindustan Times. "Dawood was worried that his rivals may kill him if he would come back. I played along and told him that the CBI would take care of his safety if he were to return but before we could actually talk terms of surrender, my bosses in the CBI told me to back off," Neeraj Kumar says in the HT interview. In June 1994, Neeraj Kumar was with the CBI and he was leading the agency's probe into 1993 Mumbai blasts. Probe indicts Coast Guard DIG for Pakistani boat boast Agencies NEW DELHI May 2 : A board of inquiry (BoI) has indicted Coast Guard DIG BK Loshali, who had contradicted the government's version of the operation against an alleged Pakistani terror boat in January. Coast sources said Guard Loshali could now be court-martialed. Loshali had contradicted the government claim that when Coast Guard ships inched towards the Pakistani boat, occupants of the alleged terror boat blew themselves up. The DIG had claimed that he had ordered a Coast Guard ship in the vicinity to fire at the Pakistani boat. The BoI was instituted in February after Coast Guard was not satisfied with Loshali's response to the show-cause notice issued to him on his controversial remarks. The BoI report has been submitted to the Coast Guard director general, sources said. The video of his speech showed that Loshali did make the assertion that he had ordered the alleged terror boat to be blown up. He had later denied making such a claim. The government has been consistent in its claim that occupants of the boat had blown themselves up after being chased by Coast Guard ships on the night of December 31. He could speak only Tamil and had a culture shock on landing in Saudi Arabia. He had told his employers that he wanted to go back to India, and was advised to wait for a few days. On April 18, he left his house and has been missing since then. Indian diplomats are now checking all hospitals and prisons in Saudi Arabia. His family back home is worried about his whereabouts. Nagpur, Ahmedabad, Lucknow, Pune and Vijayawada are few cities which are under the consideration of the central government, he said. "The Metro services would cover a total length of 223km and cost Rs 83,000 crore," Naidu said. With such expansion of metro services, the demand for rolling stock is set to increase and keeping this in view, government is encouraging production of metro coaches in the country, Naidu said. Speaking at the inauguration of Reach-3B of Bangalore Metro Railway line between Nagasandra and Peenya Industrial Area, he said, "out of the 2,100 coaches that Delhi metro needs for its three phases, 1,850 are being indigenously manufactured." Stating that presently indigenous metro coach making facilities existed at three locations in the country with a total production capacity of 620 coaches per year, Naidu said these include BEML's unit at Bengaluru with a capacity of 150 coaches per year, Bombardier's unit in Gujarat with a capacity of 350 per year and Alstom's unit in Chennai that can produce 120 cars per year. "Alstom is setting up another metro car making unit at Sri City with an investment of Rs 630 crore," he added. Naidu said Bombardier has signed a contract with Australia for exporting 450 metro cars made in India and these exports will begin by the end of this year. Similarly, Alstom will supply 132 metro cars to Australia beginning in August, 2017. "This is what our Prime Minister is keen about. India shall emerge as the manufacturing hub for the world given our advantages. "Manufacturing of metro cars for domestic needs as well as for exports is an indication of the dream of 'Make in India' taking shape," he said. He said many challenges and difficult decisions lie ahead of the new government 234 Girls, Women Rescued From Boko Haram: Nigerian Military Agencies Lagos, May 2: Nigeria's military has rescued 234 more girls and women from a Boko Haram forest stronghold in the country's northeast, an announcement on social media said today. It brings the number of females declared rescued this week to more than 677. Another set of 234 women and children were rescued through the Kawuri and Konduga end of the Sambisa Forest on Thursday," said a message on the official Twitter account of the Nigerian Defence Headquarters posted early today. It comes as the army deployed ground troops following weeks of punishing air raids on the Sambisa Forest. President Goodluck Jonathan, whose term ends this month, said Thursday that the forest is the last holdout of the Islamic militants and he pledged to "hand over a Nigeria completely free of terrorist strongholds." There have been reports that some women fought the troops, with Boko Haram using them as an armed human shield for its main fighting force. It is not known how many girls, women, boys and men Boko Haram has kidnapped over its nearly 6-year-old rebellion. The military says it is screening the girls and women to find out what villages they came from. Some women the soldiers tried to rescue even shot at their rescuers, a military spokesman has said, indicating that some might now identify with Boko Haram after months of captivity and forced marriages. It also remains unclear if some of the women had willingly joined Boko Haram, or are family members of fighters. Jack Sen, whose grandfather was Indian and served as a doctor in the British Indian Army during the Raj era, was to contest the seat from West Lancashire. Sen, who describes himself on Twitter as “unapologetically politically incorrect proBritish”, directed abuse on the social networking site at Luciana Berger, the Labour party’s candidate who is Jewish. “You’re about authentic Labour as Ed Miliband. Protect child benefits? If you had it your way you’d send the £ to Poland/Israel,” he wrote in one message. In another, he said: “Britain’s youngest Jewish MP, Luciana Berger, is facing criticism over her record of…loyalties.” The reference to divided loyalties is a common anti-semitic slur meant to suggest that Jews are loyal to Israel, rather than to the country in which they live. Berger said it was “clearly an antiSemitic comment”. In a separate interview, Sen said minorities in South Africa were being ethnically cleansed and laid the blame for a “genocide” in western Europe at the door of Labour leader Ed Miliband and other prominent Jewish figures across the world. Speaking to the Guardian’ on Friday, Sen claimed that the messages had been tweeted by a party activist, not by him. But he failed to provide any further details on his remarks. A UKIP statement said, “Jack Sen, a UKIP candidate, has expressed views that in no way reflect the views of the party and any other of our hard-working dedicated candidates. “In the light of these and other comments, Sen has been suspended from UKIP with immediate effect.” UKIP leader Nigel Farage apologised for the comments attributed to Sen and those posted on his Twitter account. Joo admitted violating North Korean law, state media said. South Korea`s KCNA news agency reported that Joo was student at New York University (NYU). Dandong is home to many ethnic Korean Chinese traders who deal with both North and South Korean businessmen. "By the end of December this year, we will award road projects worth Rs 20,000 crore in the North-East. These will be spread across the region for improving the infrastructure, which will help the economy of the North-East," Union Road Transport, Highways and Shipping Minister Nitin Jairam Gadkari said at a press conference here. “The projects will have a long gestation period and will be implemented by public sector undertakings, besides private entities, in the public-private partnership mode,” he added. "Of these, around Rs 6,000-crore projects will be in Arunachal Pradesh while projects worth of Rs 8,000 crore will be developed in Assam. The remaining will be for other parts of the region," Gadkari said. Currently, Rs 31,025 crore worth of roads running into over 3,700 km are under development, which are being constructed by 10 players through 104 projects. Gadkari, in the same breath, called upon northeastern states to acquire land and secure necessary environmental clearances before the Ministry of Road Transport and the National Highways Authority of India (NHAI) can go ahead with these projects. He said the central government will encourage local contractors in the region by awarding smaller sizes of road projects, thus providing employment there. "These measures will ease the bottlenecks in establishing road projects," he added. On in- land waterways, Gadkari said the Centre will bring in a piece of legislation soon to declare 13 more national waterways on as many rivers in the NorthEast. These rivers are Barak, Lohit, Subansiri, Gangadhar, Aai, Beki, Puthimari, Kopili, Dihing, Dhansiri, Dikhow, Doyang and Tlawng. Construction of a ship repair facility at Pandu in Guwahati will start by October this year. We will have a dry dock there at a cost of Rs 50 crore," the Minister said. Gadkari further said his Ministry has booked 95 lakh tonnes of cement from manufacturers at a cheaper rate of Rs 120 per bag, excluding transportation and taxes. Finance Secretary Rajiv Mehrishi and other finance ministry officials have already reached Baku for the meeting of Board of Governors of the ADB. The four-day 48th annual meeting of the ADB began on Saturday. Jaitley, according to sources, is likely to return on May 5 and will be there in Parliament to pilot important economic legislations, including Goods and Services Tax and the black money bills. He will also have to get the Finance Bill, 2015 approved in the Rajya Sabha. The Bill was passed by the Lok Sabha on Thursday. This year's ADB meeting focus will be on "Fostering Partnership for Development" besides discussing the Millennium Development Goals on issues -- sustainable development, poverty alleviation and climate change. Traders said weakening global trend where gold fell to a six-week low on mounting speculation that the Federal Reserve is moving closer to raising US interest rates mainly kept pressure on gold prices. Gold in New York, which normally determines price trend on the domestic front, fell 0.7 per cent to settle at USD 1,174.50 an ounce after touching USD 1,168.40, the lowest since March 20 in yesterday's trade. Besides, fall in demand from jewellers and retailers at prevailing levels fuelled the downtrend in gold, they said. In the national capital, gold of 99.9 and 99.5 per cent purity fell further by Rs 160 each to Rs 27,030 and Rs 26,880 per ten gram respectively. It had plunged by Rs 285 yesterday. Sovereign, however, continued to be asked at last level of Rs 23,700 per piece of eight gram. Kolkata, May 2: State-run telecom operator BSNL on Saturday slashed roaming tariff by up to 40 percent for its prepaid and postpaid mobile connection with effect from May 1. The decision had been taken in the wake of telecom tariff order issued by TRAI, the company said in a statement. Roaming tariff for incoming calls has been cut by 40 percent, STD by 23 percent and 20 percent for local calls. Local and national SMS tariff has been reduced by 75 percent, the statement said. Saini sent a letter to the IOA stating that it has no confidence on Ramachandran and a Special GBM should be called at the earliest to vote on the issue. “As per Rule VIII (i) and (ii) of IOA Constitution, we Bowling Federation of India are moving a no confidence motion against Mr N. Ramachandran President IOA as we are totally in disagreement with his working and along with it we also feel he is working towards weakening and finishing of the IOA,” BFI said in the letter. “We request you to convene a Special General Meeting [SGM] of the IOA at the earliest to discus on the vote of no-confidence against Mr N. Ramachandran, President,” Sunaina and Saini wrote in the letter addressed to IOA president, secretary-general and treasurer. In such a directive, the rural road division of the Union Ministry of Rural Development has asked all states including Congress-ruled Kerala, Karnataka and AIADMK-ruled Tamil Nadu to "furnish success stories" of Pradhan Mantri Gram Sadak Yojana (PMGSY) in respect of their state, pertaining to 2014-15, in maximum of 600 words. "The success stories should be crisp and focus on the innovation in the should process/implementation/delivery as well as its impact on the local community/beneficiary habitations (with specific details of beneficiaries and habitations)," says a Ministry directive issued to state governments on April 30. Kumar planned to get himself injured in the fight in order to get bail on medical grounds. They had been sentenced to different jail terms under Child Marriage (Restraint) Act and IPC for kidnapping the boy and the girl. The defence lawyer, S Malik, argued that proof of age submitted by the girl was doubtful. He also said the Sessions Court had no jurisdiction to try a child marriage case, which should have been heard only by a Magistrate. The lawyer argued that it was only an engagement since the marriage was not performed as per Hindu rites. However, the HC observed that "even if the function was an engagement, the submissions were not convincing." "There was 'homam' (fire ritual) and all rituals were performed before a priest. Moreover, after the ceremony, the girl started living at the boy's house," the Judge observed. The court opined that the prosecution had proved beyond doubt that the girl, then aged 15 years and three months, had been taken away from her mother's custody. Arfan Sait, public prosecutor, argued that their evidence and witnesses were reliable and credible. The accused acted like a 'Khap Panchayat' (community council). As marriage is entirely a personal issue, they should not have thrust their decision on the boy, the girl and their parents. Sait submitted that the trial court's guilty verdict was legal and hence conviction should be upheld by the HC. "Our findings that there is a correlation with maternal but not paternal longevity are fully consistent with a previous stud- Gogoi Flays Centre Over Land Boundary Agreement Amendment Agencies Guwahati, May 2: Assam Chief Minister Tarun Gogoi today strongly criticised the Centre for keeping the state in dark while deciding to exclude it by bringing in an amendment to the Land Boundary Agreement (LBA). In a letter to Prime Minister Narendra Modi, Gogoi expressed surprise at the decision of the Union government not to include clauses relating to Assam in the protocol ratified by Parliament without any consultation with the state government. "We are completely in the dark about the reasons behind this turnaround and how the interest of the people of Assam are going to be protected by the exclusion of the clauses relating to Assam during the process of ratification by the Parliament," the chief minister said. An official release quoting Gogoi said the decision was also "against the principles of cooperative federalism which you (Modi) have been advocating." Gogoi requested Modi for inclusion of Assam in the protocol between the Centre and the Government of Bangladesh, signed on September 6, 2011. The chief minister pointed out that the provisions of the protocol were integral part of the 1974 agreement between India and Bangladesh. "As a result of the protocol, the Radcliff Line demarcating India-Bangladesh border in the Assam sector namely, LathitillaDumabari sector in Karimganj district, Kalabari (Boroibari) area in Dhubri district and the Pallathal area in Karimganj district of Assam will be re-drawn as agreed to in the protocol," he said. As a result of the re-demarcation, approximately 714 acres of land in Lathitilla area will formally become part of Assam in India and 193.85 acres of land in Kalabari (Boroibari) and 74.55 acres in Pallathal will formally go to Bangladesh. "268.40 acres of land are already under adverse possession of Bangladesh. Therefore, India (Assam) will formally get a net land area of 445.6 acres with reference to the Radcliff Line," Gogoi said. "In our agenda of alliance we have discussed about their livelihood because they have been living here for the past 67 years. It is the duty of the Jammu and Kashmir government so as to make arrangements for their bread and butter. We will find it out how it will be done taking in view the laws of the state," Deputy Chief Minister Nirmal Singh told reporters here. When asked whether the state government would grant permanent citizenship to the refugees from west Pakistan, a demand that was raised by his party prior to the formation of the coalition government in the state, he said "we do not have any mention of it in the agenda of alliance, but only their livelihood... we will do what is mentioned in the alliance agenda". He said the problem of the refugees was a long standing problem since 1947, maintaining that the previous governments have not been able to do anything for them. "A committee would soon be formed to address the grievances of the refugees. We want that a package must be given to them which has been denied since 1947," he said. He said that people from various places got displaced and came to Jammu. "In the agenda of alliance, we have mentioned that a package would be given to them. We have talked about their livelihood. In the Assembly, the chief minister had made a statement that a committee would be formed which would be headed by the deputy chief minister and some ministers should also be in the committee," he said. He said the committee would be opened as soon as office is open in Srinagar. "We have been listening to their problems and demands. It is a very complex issue. There are several type of refugees like of 1947, some are from PoK, some are from west Pakistan, some are from 1965, 1971, some are camp refugees and some are noncamp refugees. Some are registered while some are not registered so it's a very complex issue," he said. He said the refugees want a package which would compensate them of the property which they have left behind. "Some recommendations have been made by the Parliamentary Committee and the Wadhwa Committee. We will see everything and give a report to the government and to the Centre so that a package is given to them," he said. "Twenty Shiv Sena workers, who were protesting and shouting slogans outside Hotel Hyatt at Vastrapur area of the city, where J&K Chief Minister Mufti Mohammad Sayeed was scheduled to attend a programme, were detained," Vastrapur Police Inspector S M Sheikh said. They were shouting slogans against Pakistan, seeking immediate arrest of (Hurriyat leader) Syed Ali Shah Geelani, the police officer said adding, "The Sena workers had brought black flags and placards for the protest. However, we detained them before Sayeed's arrival at the hotel." The Sena men, who were taken into preventive custody for violating section 141 (unlawful assembly) of the Indian Penal Code, were let off after a few hours, he said. However, president of Shiv Sena Central Gujarat, Ashok Sharma, claimed that action was taken against the party workers for holding a protest against Jammu & Kashmir Chief Minister. "The agitation was against Mufti Mohammad Sayeed's visit to Gujarat as he has failed to arrest separatist leaders like Syed Ali Shah Geelani," Sharma said. Opposition National Conference today said they will not let Jammu and Kashmir government to set up separate colonies for Kashmiri Pandits but would strive for return of the minority community to their native places in the Valley. "We are against separate clusters for Kashmiri Pandits. We welcome them (to Kashmir), but we will not let the government to create separate colonies for them," NC general secretary Ali Mohammad Sagar told reporters during a protest rally against the new recruitment policy of the state government. Sagar said National Conference has always supported the return of Kashmiri Pandits to their native places in the Valley. "We have always said that we want them to return to the Valley and settle at their native places along with their Muslim brothers," he said. On the new recruitment policy, Sagar said it was an "injustice" with the youth of the state. "The new recruitment policy is antiyouth. It is an injustice with the youth of the state where unemployment is a big problem. We demand its immediate roll-back, otherwise we will intensify protests against it and take legal course as well," he said. On the issue of presence of Pakistani flags in a rally led by hardline Hurriyat chairman Syed Ali Shah Geelani at Tral in south Kashmir yesterday, Sagar said "there is no big deal in it". "Such flags have been hoisted before this as well. There are people who like Pakistan, there are people who want freedom and they do such things. There is no big deal in it," he said. Every individual should meet this crucial social responsibility: Chander Prakash JAMMU, May 2 Stressing the need for preservation and maintenance of traditional sources of water, the Minister for Industries and Commerce Chander Prakash today said that every individual has to come forward to meet this crucial social responsibility. The Minister was speaking at a seminar organised by the J&K Paryavaran Sanstha at IIIM Jammu to hold deliberations on preservation of the traditional water sources. He said that kandi ar- eas are facing acute shortage of water as the traditional sources like ponds and bowlies which were catering to the needs of the people are perishing due to negligence. “Most of the watershed projects have not been able to achieve the desired results due to lack of pragmatic approach” the Minister said adding that these projects should be based on sustainable futuristic needs of the people. The Minister said that the traditional sources of water were surrounded by catchment areas which kept these sources charged. “But while catering to our developmental needs we have neglected this vital aspect resulting in depletion of these water sources and disturbance of the ecological balances of the areas”. He maintained that everyone has to work for preserving the ecology and resources which are fast depleting due to over usage. The Minister said that these water resources should be used in judicious manner and asked the concerned departments to work in synergy to ensure that developmental goals are achieved while maintaining the ecological balance. He stressed that there should be optimal utilization of the funds and projects should be envisaged keeping in mind availability of water. The Minister said that efforts will be made to take up preservation and restoration of these traditional sources under the social corporate responsibility and involving various stakeholders in this noble cause . He said that the issues raised during the deliberation would be taken up with the concerned ministry and efforts would be made to take adequate steps. Division Bench of the J&K High Court comprising of Chief Justice Mr N Paul Vasanthakumar and Justice Dhiraj Singh Thakur today dismissed an appeal filed by Dr Vipan Banotra S/o Late Sh Niku Ram of Poonch against Abdul Shubam S/o Abdul Ghani R/o Poonch with costs of Rs 5000/-. The judgment was written by Justice Dhiraj Singh Thakur after hearing Adv Aditya Sharma for the appellant whereas Adv Assem Sawheny for the respondent and held that appeal as not maintainable so dismissed it with costs of Rs 5000. It may be mentioned that Dr Vipan Banotraappellant filed an appeal against the order dated 04.02.2015 passed by the Jammu and Kashmir State Consumer Disputes Redressal Commission, Jammu wherein the Commission had authorized one official of the Commission to file a complaint against the said appellant before the competent Magistrate for having committed perjury and fabrication of records. It was alleged that on account of the negligence of the Doctor-respondent herein, the complainant being the only bread winner of the family was forced to lead his life as a cripple and that his defendants had become destitute. With a view to bring the guilty to book, a direction was issued by the Commission to the Inspector General of Crimes and Railways (J&K) to register a case on the basis of the judgment of the Commission for the commission of offences regarding fabrication of records and forgery with a further direction to complete the investigation within a period of 4 months thereof. Said order came to be challenged by the appellant herein in CIMA No. 136/2009 titled Dr. Vipan Banotra vs. Abdul Shubam & ors, which came to be finally decided by a Division Bench of this Court vide its judgment and order dated 14.3.2013 wherein the Commission's direction to the IG Crime Branch were deleted and Commission was given liberty to lodge a complaint itself or by an authorized officer by the Division Bench in the previous Appeal. Aseem Sawhney Advocate submitted that pursuant to the order aforementioned, the Commission vide its order dated 4.2.2015 authorized one Predhiman Krishan Raina, an official of the Commission to lodge a complaint before the competent Magistrate and this order, which has been challenged again and also urged that the appeal itself was misconceived as the impugned order was not one, which could be said to be an appealable order in terms of Section 17 of the Jammu and Kashmir Consumer Protection Act, 1987. Division bench observed "In the present case, the order passed by the Commission, authorizing an official of the State Commission to lodge a complaint before a competent Magistrate cannot be deemed to be an order, deciding a consumer dispute within the meaning of the Consumer Protection Act. An appeal in terms of Section 17 envisages a decision on a consumer dispute providing for a forum of appeal to either the complainant in case his complaint is dismissed or to the respondent in case the same is allowed. In the present case, however, the order impugned is only an authorization granted to an official of the Commission to file a complaint before the competent Magistrate and cannot be said to be an order against which an appeal at all lies in terms of Section 17 of the Act. Not only this, by virtue of judgment and order dated 14.3.2013 passed, this court had granted liberty to the Commission to lodge a complaint either itself or by an authorized officer. The judgment and order dated 14.3.2013 not having been challenged by the appellant herein had attained finality. What was done by the Commission was, in fact, in furtherance of the liberty granted to the Commission to lodge a complaint and in doing so, the Commission cannot be said to have committed any illegality. For the reasons mentioned hereinabove, the appeal is held to be not maintainable and is accordingly dismissed with cost of Rs. 5,000/- to be deposited in the Advocates' Welfare Fund."
