As a precautionary measure, the residents of scores of hamlets including Padum moved to safer places as the water level in Phuktal river has been showing a rising trend. Pertinently, Zanskar Valley was under flood threat because one of the tributaries of the Zanskar River had been blocked by a massive 200 ft high landslide ‒ equal to height of a 20storey building). The landslide dam between Shaday Sumdo and MarShun had created a lake that is about 8 km long, whose size was increasing every day. Locals of Padum Zanskar that all the culverts and bridges located at different places including Ichar, Padum, Tipting, Chah and Pipcha were washed away due to flash floods. “The water level in the river has been increasing thick and fast and the gushing waters are passing through Zangla-Nimbo road that connects Zanskar with Leh. Due to flash floods, educational institutions remained closed on Thursday. “The only bridge that students used to reach Higher Secondary school has been washed away as a result no one turned up there,” said a local Muhammad Akbar. An official said there is no flood threat to the areas like Padum as the A water level has started decreasing. He confirmed that several bridges and culverts have been washed away due to speedy waters. Meanwhile, locals blamed National Disaster Response Force (NDRF) for the present mess. NDRF team that had arrived here received millions of rupees to clear the blockage, but the team did nothing. “The temporary measures taken by the NDRF team did not prove effective,” locals said. Deputy Commissioner Kargil said that the bursting of artificial lake on river Phuktal caused flash floods. He said that the flood caused damage to the infrastructure and some six bridges have been washed away. Meanwhile, hundreds of people on both sides of the Phuktal river downstream were shifted to safer places after an artificial lake formed in the water body during winter, breached inundating a village. Though authorities have claimed that flood threat due to formation of the artificial lake has receded after a dewatering tunnel was constructed in the lake, local MLA of Zanskar constituency Aga Syed Mohammad Baqir Rizvi had last month expressed his deep concern over the continued flood threat looming on the residents of Zanskar, due to the Phutkal glacial lake formation. Official sources said an artificial lake was formed in the river due to landslide, blocking the water flow in the river during winter. The NDRF and Army later claimed that the threat is over as big hole has been made in the frozen lake. But due to increase in the mercury, snow on the upper reaches and frozen water in the Lake started melting resulting in a sudden increase in the water level, they said, adding the outflow from the lake was very low this morning. Water had entered a nearby Ichar village and water was flowing downstream, they said, adding this will pose a serious threat to villages on both sides of the river. Sensing trouble, authorities have shifted some of the families living on both sides of the downstream to safer places. However, water could take time to reach Padam, the sub district headquarter of Zanaskar in Kargil district. Rizvi had last month warned of flood due to bursting of the artificial lake. He said the people of the area are concerned, as melting of snow has started, because of rise in temperatures. The temporary measures taken by the NDRF team so far, does not seem to have been very effective, as the discharge of the glacial lake has increased in the past few days, at an alarming rate, he said. He expressed concern that the impending disaster has the potential to cause extensive damage in the area, which may be beyond the coping capacity of the State as well as District Administration, despite their best efforts. He urged Chief Minister Mufti Mohammed Sayeed to urgently take up the issue once again with the Union Jammu, May 7: Government, so that with the help of satellite images the situation is reassessed and experts are sent again to the location to ease out the situation. He demanded that appropriate machinery is airlifted and deployed at the site and all possible measures are taken to ensure safety of each and every resident of the area, before the glacial lake causes any damage. Yesterday, the State Vigilance Commission (SVC) headby Chief Vigilance ed Commissioner Kuldeep Khoda, met in Srinagar, and called for the explanation from the SVO Director Sheikh Owais by May 18 for violation of State Vigilance Commission Act and Commission rules, the SVC Sources said. Earlier, on April 23, the SVO had been summoned in this regard and it submitted its report to the SVC which had listed the case for May 6. The SVO has violated the Commission Act and rules, the SVO said adding that this cannot be taken lightly and Commission will go ahead with the action in this regard. The Full Commission, headed by Chief Vigilance Commissioner Kuldeep Khoda, had summoned all the officials who dealt and investigated the complaint, for explanation on violation of legal procedure in filing the closure report before the High Court. Sources said that SVO had violated the law in protecting these former Speakers. "They have given a equivocate reply in their report on the closure of corruption complaint against two ex-speakers," the sources said. The SVO had filed closure report in the High Court last month on complaint of illegal and backdoor appointments made in the Assembly and MLAs Hostel by two former Speakers and the HC had expressed anguish over the closure. SVC took very serious note of the SVO surpassing the Commission to file closure complaint in the High Court. As per the SVC act, the State Vigilance Organisation had to inform and take consent of the Vigilance Commission before filing closure report of any complaint or case. However, in this particular case, the Vigilance Organisation had straightway filed the report before the High Court. Land Fraud Case: FIR registered against Tehsildar & others Jammu, May 7: Jammu and Kashmir State Vigilance Organisation (SVO) today registered a case in connection with the violation of rules in conferring ownership rights of government land to a displaced family in Jammu district. "The State Vigilance Organization has registered a case FIR No. 22/2015 against the then Tehsildar Settlement, Jammu and other officers and officials of Revenue Department, Jammu who in a conspired manner conferred ownership rights of government land to a displaced family in violation of rules", a senior officer said. The verification conducted into the matter revealed that the officials acted in vio- lation of Cabinet Order No. 578-C of 1994 dated May 7, 1954, whereby land prescribed for displaced families from Pakistan Occupied Kashmir in any case should not exceed 4 acre (32 kanals) of 'Aabi' (farm land) or 6 acre (48 kanals) of 'Khushki' land (dry land), he said. On February 25, 1995, the then Tehsildar Settlement and other officials conferred ownership rights of government land, measuring 36 kanals 16 marlas in Jammu's Deeli village upon one Krishana Wanti, wife of late Deputy Ram (displaced person of 1947) resident of Trikuta Nagar, Jammu. The protest march led by prominent citizens of Channi Himmat housing colony started under the leadership of Raj Kumar, famous social worker of the area, and culminated near Cremation ground. Senior residents including large number of women staged dharna against the alleged move by the corrupt officials of the J&K Housing board to extend undue advantage to their near and dear ones through back door allotment of commercial sites alongside Thanger nullah. During their NMC appeals CM to release 6% DA installment GOF Staff Reporter Jammu, May 7: Stressing on the need for immediate release of pending installment of 6% DA due since January, president of the National Mazdoor Conference (NMC), Subhash Shastri on Thursday appealed to chief minister Mufti Mohd. Sayeed to release the same installment of DA to employees of state Govt. and pensioners in the first cabinet meeting in the summer capital of Jammu and Kashmir State after Darbar Move, so that salaried class and pensioners get relief in view of increasing prices of essential commodities. Addressing a meeting of NMC activists here, Shastri stated that in view of the inbuilt provisions in the annual budget, there should not be any hitch for the state government as it is the routine financial matter more so when others states have already released the 6% DA installment since long adding that an early decision in this regard would be genuine measure to provide some relief to them. Recalling recommendations of the central 4th pay commission, which was implemented in January 1986 by the then government, Shastri said it also had recommendations that as soon as DA crosses more than 50%, the Centre is under an obligation to merge 50% DA into basic pay or pension, .now as the DA has already touched 113%, they request for early merger of 50% DA into basic pay/pension with retrospective effect so that confusion and uncertainty on this vital issue among the crores of employees/pensioners could come to end. Shastri also voiced serious concern over the nonpayment of5th installment of 6th Pay Commission arrears to the pensioners and employees .of the state Govt. has demanded immediate release of last installment of the 6th pay commission arrears. In a strong worded statement issued here today APMCC leaders Vinod Pandit, Chairman and King Bharati National Spokesperson APMCC have asked Dharmarth not to take Kashmiri Pandits lightly saying Dharmarth Trust could be sued for issuing open threat to Kashmiri Pandit community whom it has warned of dire consequences. Vinod Pandit has said that Dharmarth was resorting to open loot and sale of temples in Kashmir Valley and was trying to hide its own shortcomings by stooping so low as to issue open threats to the Kashmiri Pandit community. King Bharati while denouncing the open threat said that it was a very serious matter and Kashmiri Pandit community was feeling unsafe saying the Trust has tried to instigate local people against Kashmiri Pandits which equals to threats that resulted in mass exodus in Kashmir. He said it was an open threat to Pandit community and if anything untoward happens to any member Dharmarth Trust would be solely responsible for it. Anganwadi centre, Shekhan Peer, only four children were present in the said Anganwadi centre and the anganwadi worker was found unauthorized absent from the duty. The nutrition meant for the adolescent girls was also not provided as per the desired quantity. Anganwadi centre, Gole Pattan, there were only four children present in the Anganwadi centre.Whereas, the register revealed that there were thirty-four registered beneficiaries. Besides that, out of total eight registered P/Ladies and nursing mothers no nutrition was being provided to them. The anganwadi worker was found unauthorized absent from the duty. Anganwadi helpers are not doing their job properly. They have nothing to do with the presence or absence of children. The Supervisors supposed to be supervise the overall working of Anganwadi centres but they remain confined to their head quartes. The higher authorities of the concerned departments not bothered to maintain the discipline in the Anganwadi centre. The undersigned served the Show Cause Notice to the erring officials and enquiry has been started against the officers/officials. This was revealed by the Minister for Social Welfare, Bali Bhagat at a meeting of officers which was convened here to review the functioning of the Department. Minister of State for Social Welfare, Ms. Asiya Naqash was also present in the meeting. While reviewing the status of setting up of newly sanctioned Anganwari Centres, the Minister called upon the officers to speed up the process so that the benefits of this flagship programme percolate down to the designated beneficiaries. He stressed the need for following transparent procedure for establishing these Centres strictly as per the norms of the Government of India. The Minister received de- tailed resume of the functioning of the Department and stressed the need for evolving complete transparency, accountability in the functioning at all levels to achieve the tangible results. He called for streamlining the process of pensions, clearance of all pending cases under various welfare schemes after proper verification so that the deserving beneficiaries get the benefits. He said the Government has recently taken several reformative measures to facilitate the beneficiaries and these must be followed strictly. He issued specific instructions to promote the concept of e-governance and Direct Benefit Transfer Scheme (DBTS) in the Department to ensure cent percent transparency in the system of disbursement. Summer office timing in Udhampur from 10 am to 4 pm Udhampur, May 7: The District Development Commissioner, Udhampur, Mrs. Yasha Mudgal has notified the change of summer office timing in all the Government offices of the district from 10 am to 4 pm instead of 8 am to 2 pm with immediate effect. BRO celebrates 55th Raising Day GOF Staff Reporter Jammu, May 7: Border Road Organization (BRO) celebrated its 55th Raising Day on today in all over the state of J&K with great vigour and enthusiasm. The celebration on Thursday kicked off with special pooja at different units followed by Sainik Sammelan Barakhana (community feast) was organised for all ranks. Project Beacon in J&K was raised as Chief Engineer Roads (Ladakh) during the first week of May 1960 which was later redesignated as Chief Engineer Project Beacon. This is the oldest project of Border Roads Organisation initially looking after the entire J & K state. Later, projects Sampark and Himank were raised for Jammu and Ladakh regions respectively to ease out the workload of this project. Project Himank aptly known as Mountain Tamers, is located at the highest inhabited place in the world between great Himalayan and Karakoram mountain ranges. It is responsible to maintain line of communication through highest motorable road to highest battlefield in the world and from highest airfield to the highest lake. Currently this project is instrumental in development of road infrastructure in Eastern Ladakh and other strategically important roads in Ladakh Sector. Project Sampark the project was raised in January 1975 with its HQ at Jammu. It has an area of responsibility South of Pir Panjal covering all the border districts in Jammu region. The project has over 3000 Kms of roads (both under maintenance and construction/upgradation) and around 120 bridges. Project Vijayak is deployed in Kargil and is instrumental in maintenance of strategically important road link of 434Km long, Srinagar-Leh National Highway from Drass to Zero Point Gumri. BRO has been forefront in construction of Rohtang Tunnel out of a planned length of 8.80 Km of the tunnel of ManaliLeh road, 4,807 Km has been completed covering 2,245 Km from Manali side and 2,562 Km from Leh side. With regards to road projects of BROs, 73 roads in India has been identified as strategic Indo-China border roads (ICBR), out of which 61 roads have been entrusted to Border Roads Organisation (BRO) with a length of 3410 km. Out of 61 ICBRs with BRO, 19 roads of length 625 km have been completed and connectivity has been achieved on 24 roads. There are certain delays in execution of road projects mainly due to delay in Forest / Wildlife clearance, hard rock stretches, Limited working season, difficulties in availability of construction material, due to natural disaster such as flash flood of Leh in 2010, J&K flood in Sep 2014 and earthquake in Sikkim in 2011, resources are diverted, delay in land acquisition & non-availability of construction material in certain sectors/areas. The BRO in J&K is now working even closer to the Borders and under more challenging conditions, but the expectations and the confidence reposed by the people on the BRO is very high and they have always lived upto their motto “ Shramena Sarvam Sadhyam”. The BRO in J&K has contributed significantly during Op Megh Rahat in restoration of connecting of important links (Jammu-Srinagar, Srinagar Baramula and Srinagar-Zozila) BRO has ensured restoration of damaged bridges and road infrastructure of Akhnoor-Poonch-Rawalkote. inspection of the Anganwari Centres by the senior officers in order to ensure quality of nutrition supply, sanitation and maintaining attendance of children. He said the process of introducing on-line filling up of forms for availing benefits of various schemes, setting up of websites of various wings is in progress and shortly these services will be available in the Department. MLA Jammu west convenes meeting of PHE officials Jammu, May 7: To overcome the problem of water supply in the summer season in Jammu West area, a meeting of PHE officials was called upon by BJP MLA Jammu West Sat Sharma (CA). Executive Engineers, AEE’s, JE’s of Mechanical and Civil Division of PHE were present in the meeting. A detailed discussion was made by the MLA with the PHE officials showing his concern about problem of Water supply in Jammu West. In a press statement issued today, Sat Sharma (CA) said that during his interaction with PHE officials, he came to know that the 3000000 gallons per day of Water is still falling short to cover the requirements of the people of Jammu West. The MLA stated that in the coming days new Tube wells and Over Head Tanks are to be con- structed and redeveloped in Jammu West area in order to cope up with the supply of Water in the Constituency. He stated ERA (Economic also Reconstruction Agency) will take over the works of these Tube Wells and Over Head Tanks in the coming days. Giving details of the projects he said the tube well at Pandoka Colony will be redeveloped and Tube Well at Old Janipur Park will also be redeveloped. Construction of Over Head Tank at Rehari Colony, Augmentation of water supply at CPS Medical by way of constructing a new Tube Well, and at ITI Complex Talab Tillo for which land is to be acquired as a result of which water supply to Rajpura Mangotrian and Talab Tillo area shall improve. Recently made Tube Wells is to be made functional on war footing by ERA. New Tube Well drilled at Shamshan Ghat Kabir Nagar be commissioned to improve the Water supply of Kabir Nagar area. A new tube well to be constructed at Poonch House in the premises of institute of Music and Fine Arts to improve the drinking supply to Bharat Nagar area. Recently drilled Tube Well at Bakshni Nagar also to be commissioned on the War footing by ERA. Sharma also directed the PHE officials to look into the matter of leakage of pipes in various areas of the Constituency and told them to overcome the problem within days so that the public should not suffer. He instructed them that work for construction of roads is also going to start in various parts of the Constituency and the work for fixing leakage of pipes should be done before construction of those roads so that those could not be damaged again for repairing/fixing of pipes which will ultimately create loss for public. He also instructed the PHE officials that many areas in Jammu West face problems of water supply and it should be the duty of the department to serve the people at that time by providing Water Tankers to the areas where there is shortage of water supply. The PHE officials assured the MLA that all works will be taken on priority and each & every official of PHE department will work hard and honestly to overcome the problem of Water Supply in Jammu West. The pipeline project envisages an estimated cost of Rs 43 crore. This was stated by the Minister at a meeting convened here to discuss the status and other issues related to the project. The meeting also discussed issues pertaining to water scarcity and inadequate power supply in Chrar-e-Sharief constituency. The Minister directed the PHE authorities to prepare a comprehensive project report for construction of two water supply schemes including Darwon-Nowgam and Nilinag and submit the same to the concerned quarters so that funds could be arranged for the purpose. He also asked Tarigami condemns police action against employees Srinagar, May 7: MLA Tarigami has condemned the police action against government employees who tried to march towards the Civil Secretariat here to protest in support of their demand for regularisation of their services. In a press statement issued here today, Tarigami expressed concern over the way protesting employees are dealt with in Kashmir. “Use of batons, water cannons and tear smoke shells against the employees is most strongly condemnable. Dozens of employees who have been detained by police should be immediately released,” the CPI (M) leader demanded. He observed that by brow beating and use of excessive force the government is only complicating the grievances of its employees. “It is ironical that almost all problems in Kashmir are being tackled by the use of force. The PHE, PDD employees, daily wagers and casual labourers who are putting in their blood and sweat to make the government progarmmes a success are being humiliated to the hilt,” Tarigami remarked. Taking a strong exception to the government’s lackadaisical approach towards pending wages of casual labourers, salaries of employees working under SSA and RMSA Tarigami observed that it seems the present government like the previous dispensation believes in making deceptive commitments to buy time and avoid the crisis. He called for immediate regularization of all those daily wagers, casual labourers and other contractual employees, who have completed seven years of service in PHE, PDD and other engineering departments as per the norms in vogue. “It is appalling that the government is far from fulfilling its commitment with these daily wagers. He further revealed that Kashmir has been provided with four specialized facilities including Eye Bank at Srinagar, PET Scan Machine, Kidney Transplant Unit and Liver Transplant Unit whereas in Jammu there is no such facility. Pertinently, the patients who undergo Kidney transplant in Srinagar are been paid a sum of Rs one lakhs to patients as government aid. Surjit Choudhary added that Jammu Hospitals have only 25 Baby Warmers whereas in Kashmir, the number is 75. Similarly, there are just three Ventilators in Jammu whereas Kashmir has nine Ventilators, which speaks volume about the injustice and discrimination meted out to the people of Jammu as far as health care is concerned. Even the Psychiatry Hospital in Kashmir will soon get the status of Neurosciences Institute to boost the research and other activities whereas Jammu again is discriminated. “The figures itself suggest that people of Jammu are true in asserting that they have been discriminated in all spheres of life by the successive state governments led by the Kashmiri leaders,” he quipped. Surjit while taking a dig at Kashmiri leaders said that they had been hijacking everything and now they were eyeing AIIMS but the people of Jammu will not let this happen this time. He strongly flayed the BJP leaders for adopting silence over the whole issue and playing second fiddle to Kashmir leadership despite getting huge mandate from the people of Jammu region. Director SHD pays surprise visit to FACs GOF Staff Reporter Jammu, May 7: To take stock of the functioning of First Aid Camps (FACs) set up by Sheep Husbandry Department (SHD) Jammu for providing first aid to the migratory sheep and goats during the ongoing upward migration towards highland pastures, the Director SHD Jammu Dr. Sant Ram paid surprise visit to various FACs at Udhampur, Chenani, Pachound (Kud), Patnitop and Sanasar area. The Joint Director Extension Dr. Sanjeev Kumar besides other officers of the department also accompanied the Director. During the course of surprise inspection at Veterinary Assistant Surgeon HQ Chenani, the Director inspected the records wherein he checked the availability of the medicines and status of various sheep and goat units established under Tribal Sub Plan (TSP) and National Mission for Protein Supplement (NMPS). At First Aid Camp Sanasar the Director was apprised that till date 9409 sheep and goats have been provided first aid against various ailments. These flocks belonged to various breeders of Jammu division who have been migrating from their respective winter headquarters to highland pastures. The Director also inspected private flocks of Nazakat Ali of Dhema having flock strength of about 700 sheep and 800 goats and that of Mohd. Kyas Din having flock strength of about 400 sheep and 200 goats and held interaction with the breeders. He asked them to take benefit of the facilities being provided by the department for their livestock and advised to follow the precautionary measures during the migration for safety and well being of their livestock and wished them a safer journey to their respective destinations at Alpines. When introduced, GST will not only make the tax system simpler, but will also help in increased compliance, boost tax revenues, reduce the tax outflow in the hands of the consumers and make exports competitive. The GST or the Goods and Service Tax is a long pending indirect tax reform which India has been waiting for, and which is hoped to iron out the wrinkles in the existing tax system. This comprehensive tax policy is expected to be one of the most important reforms in contributing to the India growth story. To begin with, the GST is a value added tax to be levied on both goods and services (except for a list of exempted goods and services), at both the centre and state level (Central GST and State GST respectively). This is a single tax which will be levied on the product or service which is sold. In other words, multiple taxes like CENVAT, central sales tax, state sales tax, octroi, etc will not exist and will be replaced by GST. This comprehensive tax covers all stages from manufacture to sale. The tax will be levied only on the value added at each stage of the life cycle. A simple taxation regime can make the manufacturing sector more competitive and save both money and time. Experts opine that the implementation of GST would push up GDP by 1%-2%. Increased tax revenues: A simpler tax structure can bring about greater compliance, thus increasing the number of tax payers and in turn tax revenues for the Government. The current state of the Indian economy demands fiscal consolidation and reduction in fiscal deficit. A recent report by CRISIL states that GST is the country’s best bet to achieve fiscal consolidation. Competitive pricing: GST will eliminate all other forms of indirect taxing. This will effectively mean that the tax paid by the final consumer will come down in most cases. Television is a noisy medium but it can convey silence with great power and effectiveness, when it chooses to. In the past week, Indian television journalists covering the earthquake in Nepal have generated a great deal of sound and fury. Apart from the insensitivity and the boisterousness, it was the combination of jingoism and the relentless advertising of India’s aid efforts by television reporters embedded with the Indian forces that led to the intensely hostile reactions from Nepalese citizens on Twitter, the creation of the hash tag of protest: #IndianMediaGoHome. It is undeniably an age of advertised charity but the gloating does hurt the recipients of your generosity. Unlike the televised hysterics, the broken villages of Nepal and their residents were quiet, subdued, dignified. Whether it was mountainous expanses of Sindhupalchowk district, where more than 1,100 people were killed, or Sankhu outside Kathmandu, where several thousand houses in a dense urban cluster were wiped out, the dignity of the Nepalese men and women, quietly digging through the remains of their lost homes was the most striking aspect of reporting on the earthquake. STRIKING DIGNITY In their interviews, they were stoic, recounting the terrors of the day, the journeys of a lifetime in an unhurried way. It was easy to detect a tinge of frustrated resignation at the delayed relief measures, the inefficiency and weakness of their government in their voices. A woman who had been waiting for five days for help to get her daughter’s body retrieved from the rubble of a house was not hysterical. She stood quietly in the middle of A BY : SRIKANTH VISWANATHAN here is a crisis of governance brewing in our cities. In Bengaluru, for instance, the Karnataka government has decided to restructure the Bruhat Bengaluru Mahanagara Palike (BBMP), the city’s municipal corporation, and defer polls to the city council until the restructuring is effected. The Karnataka High Court had directed the State government to hold polls to the council before May 31, which the State government contested. Meanwhile, the State government has moved with uncharacteristic speed on two fronts. It dissolved the city council before the latter’s term ended, giving itself a window of possibility to push out polls to the BBMP. Simultaneously, it got the restructuring bill passed in the Legislative Assembly. Presently, the legislative council is discussing the bill, even as the three-member expert committee on BBMP’s restructuring, appointed by the State government, is working towards its deadline of June 30. A Public Interest Litigation was filed calling for elections be held irrespective of dissolution or proposed restructuring of the BBMP. The T Karnataka High Court in its judgement on April 22 has since set aside the single judge ruling and given the State Government a six-month period to conduct elections to the BBMP. The High Court order is likely to be challenged in the Supreme Court. These happenings are not isolated instances. Calls for reunification of the municipal corporations in Delhi and the scrapping of the Mumbai Development Plan 2034 are also manifestations of this crisis. More cities and towns in India will confront similar circumstances in coming years. Rising population, business activity and aspirations will severely strain the already creaky public infrastructure. The systems in our cities are presently not geared to meet these challenges. The good news is that the diagnosis of the problem has been carried out repeatedly over the last decade by several studies and committees. Broadly, the action areas fall under seven categories: land, spatial planning and urban design; municipal staffing and capacity building (covering adequacy of skilled staff and organisation design); municipal finance (including financial self-sufficiency and Service (IAS) officers who were at the Mt. Everest base camp when the earthquake struck and an avalanche destroyed the base camp, killing at least 17 climbers and sherpas. After three very difficult days, the four officers — one of them injured — were airlifted by a private helicopter and left at the Tenzing-Hillary airport in Lukla, the landing point closest to the Everest base camp. Several bodies of the dead climbers lay on the airstrip. On leaving the airstrip, Sohail Sharma, a Maharashtra-cadre IPS officer, was lugging two heavy bags and walking uphill to a hotel. A young man began walking beside him and struck up a conversation about his close call at the Everest camp. Sharma, a 27-year-old, was exhausted after three days of horror and almost no food. He panted as he spoke to the young man and climbed the hill. After a while, he called his mother, who lives in Amritsar, from the hotel. She had been crying. The young man following Sharma turned out to be a reporter with a Hindi television network. He had secretly recorded their conversation. Sharma’s mother in Amritsar had heard her son’s straining voice at home. KASHMIR PARALLEL What the television networks did in Nepal was a repetition of how they covered the Kashmir floods. In their gratitude to the Air Force officers who allowed them on the helicopters, their attempts at reporting briskly morphed into exercises in propaganda. In Kashmir, wherever the Indian helicopters dropped food packages, the embedded cameramen would zoom in at an angle that showed the desperate survivors in most inhumane light scrambling like insects on the ground. When they took over the rescue boats and thrust their mikes into faces of people stuck in submerged homes, the stupidity of the questions was legendary. One rather famous television journalist asked a man holding his child, “Is this your son?” Opposition is milking the agrarian crisis BY : SANDHYA JAIN he Prime Minister was ill-advised to issue a second ordinance on the land Bill; it made him seem rigid while professing to be open to discussion with the Opposition. The Bill should be taken up as a stand-alone issue The dramatic death (suicide /accident /conspiracy) of Gajendra Singh Kalyanwat, a farmer from Rajasthan, at the Aam Aadmi Party’s rally in Delhi on April 22, has important lessons for the ruling parties at the Centre and the State. The AAP ostensibly turned to populism to shift attention from the infighting that led to the expulsion of senior advocate Prashant Bhushan and psephologist Yogendra Yadav. Though the media has clubbed Mr Bhushan and Mr Yadav, the former differed with Mr Arvind Kejriwal’s unilateralism, while Mr Yadav wanted the Chief Minister to follow his political blueprint, including fighting elections in Haryana (where he had hoped to become Chief Minister). But Mr Kejriwal suffered by sacrificing his Government in 2013 to fight the Lok Sabha elections in the vain hope of checkmating the Modi juggernaut; on regaining the confidence of Delhi citizens (winning 67/70 seats in a State that gave the BJP 7/7 parliamentary seats in 2014), he wanted to focus on governance and disconnect with comrades who did not share his vision. The rally to draw attention to farmer suicides and the Centre’s land acquisition Bill, contradicts this resolve. The Delhi Government has not given any relief to farmers whose crops were damaged by the unseasonal rains and hailstorms, despite promising Rs20,000/acre. The rally suggests that Mr Kejriwal remains obliged to persons who catapulted him to national limelight (close confidants of the Congress president); his espousing farmer issues helped to galvanise opposition to the Modi Government’s land acquisition Bill. All was going well until a farmer, ostensibly depressed over the loss of his crops, threatened to commit suicide and, in a sequence of events that remains unclear, was soon hanging from a tree. At the hospital, he was declared dead on arrival. Throughout this shocking episode, Mr Kejriwal and his comrades continued their speeches, smug in the illusion of their teflon coating. Things unravelled fast after that. T The crisis of governance in our cities THE SYSTEMS IN CITIES ARE NOT GEARED TO MEET THE CHALLENGES OF INCREASING POPULATION, BUSINESS ACTIVITY AND RISING ASPIRATIONS. AND NO ROAD MAP TO A SOLUTION IS IN SIGHT. a street and requested people to help. A man who had helped dig out bodies of four family members and was working with Nepalese Army rescuers to retrieve the fifth body of someone from his family was prosaic about helping find the right place to dig through the rubble of what was a four-storied house. In the hospitals, the surgeons who were working the longest hours went about their work patiently, professionally. In the emergency ward of Bir Hospital, one of the biggest hospitals in Kathmandu, the people who were intrusive were the reporter and the cameraman of a television network, who chose to read out his dispatch by the bed of a boy, whose arms and legs were broken and whose head was being shaved as the doctors prepared him for a surgery for his head injury. There was also a Western photographer who jumped around the bed trying to find the right angle for a shot. Even the most dramatic rescue operations were conducted in grave silence. In the Maitrinagar neighbourhood of Kathmandu, which houses low-end hotels, mostly used by Nepal’s migrant workers leaving for or returning from their jobs in India, Korea, or the West Asian and Arab countries, scores of buildings had pancaked. A several-storied hotel, Pokhara Guest House, had collapsed on itself and a group of French rescue workers and Nepalese paramilitary force men had recovered several bodies. A few hundred people watched the rescue operations in silence as the rescuers used mikes connected to sensitive machines which could track faint sounds and signs of life. MEDIA INSENSITIVITY The noise throughout the aftermath of the earthquake came from television crews and their absurd questions, their indifference to the dignity of the survivors and the victims. The callousness wasn’t restricted to Nepalese citizens they interviewed, they wouldn’t even spare the team of Indian Police Service (IPS) and Indian Administrative fiscal responsibility); political leadership (covering both their powers and legitimacy); transparency; accountability (for service levels, expenditure and performance); and citizen participation. Interdependence between these categories shows the systemic nature of the challenge. For example, lack of adequate number of skilled staff in municipalities could lead to lower property tax collections and own revenues, but the ability to attract quality talent requires financial self-sufficiency. Similarly, land and spatial planning are crucial for financial self-sufficiency, but empowered political leadership is essential to harness those opportunities. The bad news, however, is that even the road map to a solution is not in sight. Local governments fall under the State List, but State governments have neither shown urgency nor are they equipped with the human and technical capacities required to solve this problem. Cities need to be a national priority and, therefore, at the core of the cooperative federalism agenda of the Union government. The current approach of managing urbanisation through smart cities and an urban development mission will not suffice. The Jawaharlal Nehru National Urban Renewal Mission (JNNURM) offers useful lessons on both the utility and limitations of packaging project funding linked to reforms. The government needs to ask itself whether these two missions answer the question “How can our cities guarantee acceptable standards of public service delivery and good governance to 400 million Indians today and 800 million Indians by 2050”. The first step to solving the problem Union Minister for Home Affairs Rajnath Singh stood by the Delhi Police which said it had not permitted the rally at Jantar Mantar and had suggested it be held in Ramlila Grounds, where the fire brigade would have space to stand by. It soon transpired that Gajendra Singh may have been goaded to climb the tree and stage a protest; he may have hanged himself by mistake. Some AAP leaders tweeted that Gajendra had become a martyr even before he was pronounced dead. Some reports suggested he had been in touch with Deputy Chief Minister Manish Sisodia. Worse, his ‘suicide note’ was fake; he was not poor; and was supposed to bring one lakh rupees home for a family wedding. Trapped between media and public ire, with Gajendra’s family alleging murder, the AAP scrambled for damaged control. Kumar Vishwas gave elaborate explanations on television; Ashutosh wept copiously when Gajendra’s daughter questioned him about the ‘suicide note’; and the Chief Minister admitted it was a mistake to continue with the rally. But for Congress vice president Rahul Gandhi, Gajendra’s death became an opportunity to charge the Modi Government of being antifarmer and of bringing the land Bill to favour corporates. Prime Minister Narendra Modi, having passed the Budget and several important Bills in one of the most productive Parliament sessions, should put the land acquisition Bill on hold till the Centre and States complete assessments of crop damage and disburse relief to the affected farmers. This could take several weeks, but would effectively de-link farmer debt and despair caused by inclement weather from the amended land acquisition Bill. Mr Modi was ill-advised to issue a second ordinance on the land Bill; it made him appear rigid while professing to be open to discussion with the Opposition and to accept legitimate changes. With below normal monsoons predicted for this year, farmers are already jittery. Industrialists have dropped the pretence that there is no link between agricultural and industrial growth. This is an ideal moment to rework the Green Revolution bias towards rice and wheat which depend on costly inputs but attract farmers due to high minimum support price. Farmers should be encouraged to grow other crops, especially native grains that are hardy and of successful urbanisation is to elevate the conversation to a holistic level. Liveable cities are critical today to India. Cities need to arguably become the fourth subgroup of the NITI Aayog. Cities bring together diverse, but important, priorities of economic growth and productivity, connectivity, jobs, skills and talent, foreign direct investment, ease of doing business, infrastructure and public services, housing for all and poverty alleviation. In many ways, cities are central to meeting many of these development priorities which are already part of the Union government’s agenda. The U.K.’s Work of the City Growth Commission could possibly be a good precedent. The second immediate priority would be to learn from the recent experiences in Delhi and Bengaluru. A serious discussion on how governance needs to be structured in a city is long more nutritious. A gradual reduction of chemical inputs in agriculture would improve soil health and crop yields over time (fertiliser overuse has reduced yields), with beneficial impact on public health. Ecologist Lester Brown (Full Planet, Empty Plates: The New Geopolitics of Food Scarcity) notes that world farmers tripled grain yields between 1950 and 1973 through fertilisers, irrigation and higher yielding varieties, the potential of which has now plateaued. He warns that genetic modification has little potential to increase yields because plant breeders using traditional approaches have already done everything possible to raise yields. Instead of hurting soil fertility by promoting GM crops, the government should improve irrigation facilities; rework cropping patterns, and fine tune its crop insurance scheme. The land acquisition Bill must be taken up only when it is a standalone issue. Mr Modi must himself explain to the people that while there was no ‘consent’ clause prior to 2013, the UPA made certain exemptions, to which he has added rural housing, irrigation, rural roads, sugar mill near sugarcane fields and wheat processing unit near wheat fields. This is to fulfill his election promises to bring agro-related industry closer to the farmer so that he can sell his produce faster, get better remuneration, and youth can find local employment to end the social turmoil associated with seasonal out-migration. Mr Modi must ensure that acquired land is put to intended use and not diverted to golf courses or holiday resorts. The realty mafia can be contained by encouraging citizens to set up cooperative housing societies; East Delhi grew in this manner, thanks to energetic support from late HKL Bhagat. Sadly, liberalisation led to nixing this highly successful model. The Prime Minister must ensure that squabbling over the land Bill does not get embroiled with the Bihar election; stable Government requires winning Uttar Pradesh as well. The BJP performed badly in the recent municipal polls in Bengal because of poor State leadership; this problem afflicts other States also and needs his urgent attention. The deep-seated resistance to his leadership within the old guard, largely dormant during the election campaign, surfaced within weeks of his triumph and is now an open secret. overdue and needs to move to contemporary realities and needs. Senior levels of the Union government and Chief Ministers of States must engage in a fruitful discussion. The outcome needs to be a broad set of principles on the architecture of a city government that address the seven action areas referred to earlier. If this does not happen, we risk wasting collective energies, resources and time in redrawing municipal boundaries with zero impact on quality of life or housing or connectivity or any of the other development priorities. What the Karnataka government does with Bengaluru in the next six months will be watched closely by the rest of India. We need to see if its actions serve as early warnings to other States or whether it will blaze a trail of transformational change that other States can emulate. Then there were the fake stories about the Army rescuing the separatist patriarch, Syed Ali Shah Geelani, who happened to live in a neighbourhood unaffected by the floods. A reminder that the humiliating coverage of the Kashmir floods has not been forgotten is in the popularity of a cartoon drawn by Mir Suhail, a young Kashmiri cartoonist for a Srinagar-based paper, which shows a television news reporter poking out of an Indian soldier’s uniform pocket with a camera. It has been one of the most used satirical images of the Nepal coverage. A SELF-PAT The self-congratulatory tone of the Indian relief efforts in Nepal was partly set by the Indian government itself. Prime Minister Narendra Modi told journalists in New Delhi that Nepal’s Prime Minister Sushil Koirala, who was visiting Thailand at the time of the earthquake, learnt about the quake from Mr. Modi’s tweet. Four days after the earthquake, a Minister of the Modi government spoke in Parliament about India’s emergence as a leading nation in disaster response. The feverishness to advertise the aid for Nepal was also found on the social media accounts of various government agencies. The anger in Nepal has grown to include criticism for the Indian Air Force (IAF) pilots for making it a priority to carry Indian journalists and allegedly ignoring the advice of local government officials. On Tuesday, Annapurna Post, a widely read Nepali language newspaper, ran a report from Gorkha, the district that is the epicentre of the earthquake, with the headline: “CDO tells PM, Indian Helicopters Humiliate Us.” Mr. Sushil Koirala was visiting Gorkha and had held meetings with local officials. It reported that Uddhav Timilsina, the Chief District Officer of Gorkha, complained to Mr. Koirala about the IAF pilots not coordinating with the local officials and creating problems with management of relief efforts. In the ‘land of pure’, no space for dissent BY : HIRANMAY KARLEKAR fter the murder of the fearless rights activist Sabeen Mahmud, India must know that nothing has changed in Pakistan. Peace with it will remain a chimera. The savage murder in Karachi on April 24 of Sabeen Mahmud, Pakistan's prominent human/women's rights activist, fearless champion of free speech, patron of arts and much else, bears the unmistakable imprimatur of the country's notorious dirty tricks organisation, the Inter-Services Intelligence Directorate. Some have dismissed the allegation. In an article in Pakistan's The Daily Mail of April 30, Ali Afzal Sahi refers to “pseudo intellectuals” who have once again “started bashing [the] intelligence agency and accused it of killing Sabeen”. Next, wondering how “such people can function logically in life”, he states, “To me the claim of ISI killing her is simply ridiculous and absurd for quite a few reasons.” Mr Sahi begins his first, and principal, line of reasoning by stating that “a fundamental rule underlying criminal law is that the primary suspect is that who benefits most from the murder”. He then asserts, “What can be clearly ascertained is that ISI has nothing to gain and everything to lose. Any sane person would have guessed that if she is hurt, ISI will be blamed. The real beneficiaries of this incident are those who wanted to highlight the Balochistan issue, while attempting to weaken and demoralise the security enforcement agencies. Reducing an intelligence agency that is otherwise ranked as number one in the entire world, and that too on the basis of flimsy evidence, leaves me utterly flabbergasted.” Mr Shahi's glowing description of the ISI and use of highly derogatory language regarding its critics, makes clear where he stands in Pakistan's blood-stained and murky political landscape. While he has every right to take whatever position he wants to, its validity is another matter. For this, it is important to recall the murder, after gruesome torture, of the highlyrespected Pakistani journalist, Syed Saleem Shahzad, in May 2011. Widely believed to be the ISI's work, it had, like Sabeen Mahmud's murder, led to widespread condemnation of the rogue intelligence agency. What happened? Nothing. The ISI continues untrammeled on its murderous, regressive and repressive course at home and with the promotion of terrorism and mass killings abroad. Pakistan's civilian Government either cannot, or does not want to, shackle it. Nor is the Government sensitive to criticism in the civil society, media and human rights abroad, which has not stopped the American Government from stanching aid to Islamabad. Witness the recent sanctioning of a billion dollars as military aid which, of course, will be used for buying arms against India. Despite the storm it triggered, Shahzad's death has been forgotten except for private remembrances. There is no reason to believe that it would be different in Sabeen Mahmud's case. Clearly, the ISI had no reason to fear the consequences of her death, as it had none in Shahzad's. Gains? Shahzad's murder followed the publication of an article by him linking the attack on the naval base, PNS Mehran, in May 2011, to ties between naval personnel and jihadist elements, and years of reporting on Al Qaeda's infiltration of Pakistani military. Sabeen Mahmud was killed after she had hosted at Second Floor (T2F), the café/bookshop/ performance space she founded in 2007, a meeting on the disappearance of people in Balochistan where the ISI and the Pakistani Army have launched a savage campaign of repression. Significantly, she had hosted it after the Lahore University's Department of Management Sciences, which had agreed to hold it earlier, had cried off under the Pakistani Government's pressure. Repression in Balochistan and Pakistani military's jihadi connections are beyond critical gaze in Pakistan. The message for media and social activists is: Anybody venturing into forbidden territory will perish. As for India, it needs to recognise that nothing has changed in Pakistan and peace with it will remain a chimera best not pursued. Union Home Ministry sources said Madhya Pradesh government has been asked to handover the case to NIA, which has been probing other terror cases related to alleged conspiracy to target political leadership of the country. The sources said once the case is transferred to the NIA, the agency would carry out overseas investigations in the case as the four -- Imran Khan, Waseem, Rizwan and Anwar Qureshi -- were allegedly being motivated by Yousuf-Al Hindi, who is the face of ISIS for India and Bangladesh. They said there was evidence that Yousuf, whose real name is believed to be Sultan Armar, had been killed in Afghanistan fighting the allied forces and his account was being handled by his brother Shafi Armar. Shafi, a master in computer technology, is not a new name for the central security agencies as he was allegedly instrumental in brainwashing youths from Rajasthan under the banner of Indian Mujahideen. Sources claimed that cyber evidence, gathered over a period of time by central security agencies and AntiTerrorist Squad of Madhya Pradesh Police, showed that the four were being persuaded by Yousuf for carrying out terror strikes. Forbes said that for the first time, China's four biggest banks own the top four spots and the South Asian giant is home to 232 of the world's largest companies, adding more spots than any other country in the world and surpassing Japan for the first time. New Delhi, May 7: Smart city guidelines are in an advanced stage of finalization after which cities where the project are to be implemented would be selected, Urban Development Minister M Venkaiah Naidu said on Thursday. Replying to supplementaries, he told the Rajya Sabha that there was "no agreement with regard to any financial committment between India and USA" regarding the Smart Cities Mission as the US role was limited to extending technical support and for capacity building. Regarding India-US Cooperation in making Visakhapatnam, Allahabad and Ajmer as Smart Cities, he said that the US will extend technical support for preparing Master Plans for these three cities besides assisting in capacity building and undertaking feasibility studies. The United States Trade Development Agency (USTDA) has signed MoUs with the states of Andhra Pradesh, Uttar Pradesh and Rajasthan in this regard. "The Smart Cities Guidelines are under formulation stage; which will contain the criteria... Guidelines are under advanced stage of finalization. Any time it can be finalized. "The selection of cities will be made after the guidelines are finalized. We are in the process of issuing guidelines," Naidu said. Smart City aspirants will be selected based on a 'City Challenge Competition'. Cities will be graded based on their revenues, expenditure, availability of infrastructure relating to transport, drinking water, solid waste management etc. Naidu said the Smart Cities Mission involved an 'area based approach' and it is meant to set examples that can be replicated both within and outside the Smart City. The BCCI on April 28 banned the West Indian from bowling “off-spinners” in the ongoing Indian Premier League (IPL). Narine requested an assessment of his remodelled action from BCCI’s Suspect Bowling Action Committee, following which he underwent a third biomechanical analysis of his action at the Sri Ramachandra Arthroscopy and Sports Sciences Centre in Chennai. “This analysis has reconfirmed the conclusion of the first official assessment by the committee, namely that the remodelled action for the off-spinner does not contravene Law 24.2 (as read with Law 24.3),” BCCI secretary Anurag Thakur said. “Accordingly, the committee has determined that Mr. Narine’s name be removed from the IPL Suspected Illegal Bowling Action Policy’s Warning List and that he may once more bowl all deliveries (the off-spinner, the knuckle ball and the quicker straight ball) in matches organised by the BCCI, including the IPL.” The BCCI added that Narine faces an outright ban from bowling further during the tournament if he “deviates” from his remodelled action. The International Monetary Fund (IMF) will soon send a team to India to get a grasp of the implementation of the government's new GDP methodology, which has been questioned in certain quarters, including RBI. IMF's Director for Asia and Pacific Department Changyong Rhee said the change in the methodology was a "welcome move by India" and this was in line with what the multilateral lending institution had suggested. However, a delegation will be sent to India "to discuss and understand the implementation of this methodology", Rhee told PTI here. Earlier this year, India changed the way it measures its GDP or economic output and revised its economic growth estimates accordingly. Besides change in the base year, the revised national accounts series incorporates numerous conceptual and methodological improvements to make it more consistent with international best practices. However, the revised data have been termed as "puzzling" by a number of experts and policymakers alike while the Reserve Bank of India (RBI) had also sought clarity from the government on the new methodology and the revised figures. Chief Economic Advisor Arvind Subramanian, who had also served previously at IMF, last month termed the revised GDP growth figures as a "puzzle" and said the numbers have been "bumped up" and it was a mystery how to interpret them. The upward revision to GDP figures has also been questioned by RBI Governor Raghuram Rajan, and most recently by a parliamentary panel. One of the athletes, a 15-year-old, died and three others, all undergoing training at the Water Sports Centre of the SAI in Alapuzha, were hospitalised. Everest may have shrunk due to quake: Satellite data analysis Agencies Kathmandu, May 7: The devastating earthquake that has rocked Nepal not only killed thousands but may have also shrunk the height of the world's tallest peak - Mount Everest - by about 2.5 cm, according to analysis of satellite data. The first good view of the aftermath of Nepal's deadly earthquake from a satellite showed that a broad swath of ground near Kathmandu lifted vertically, by about 1 metre, which could explain why damage in the city was so severe. The data also indicated the tallest mountain in the world, Mount Everest, got a wee bit shorter, Live Science reported. The new information comes from Europe's Sentinel1A radar satellite. Scientists are racing to interpret the Sentinel data, which were made available last week just hours after the satellite passed over Nepal. The devastating 7.9-magnitude earthquake that struck Nepal on April 25 has claimed over 7,500 lives and injured another 16,390 people. The Home Ministry said that a total of 2,79,234 houses have been completely damaged and 2,37,068 partially damaged due to the quake. The preliminary data can help guide relief efforts on the ground by identifying areas that were damaged or hit by landslides. Researchers detected the vertical shift in the ground by comparing before-and-after radar images from the satellite using a technique that produces an image called an interferogram. The resulting images have rainbow-coloured areas that represent the movement of the ground between the times each radar image was taken. Each colourful fringe on the European Space Agency's Nepal interferogramme reflects about 2.8 centimetres of vertical movement. The results will be refined in the coming weeks, with as scientists further analysis the images and additional data from satellites become available. According to the early analysis, a region 120 km long by 50 km) wide lifted upward by as much as 3 feet during the earthquake, said Tim Wright, a geophysicist at the University of Leeds in the United Kingdom. Lakhvi and six others, Abdul Wajid, Mazhar Iqbal, Hamad Amin Sadiq, Shahid Jameel Riaz, Jamil Ahmed and Younis Anjum, have been charged with planning and executing the Mumbai attacks in November, 2008 that left 166 people dead. Lakhvi, 55, a close relative of LeT founder and Jamaat-Ud Dawa chief Hafiz Saeed, was arrested in December 2008 and was indicted along with the six others on November 25, 2009 in connection with the 26/11 attacks case. The trial has been underway since 2009. A Pakistani court had on April 9 set free Lakhvi, a development which raised concerns among the international community also. SIDCO is developing 5324 kanals of land out of which 2420 kanals have been allotted to 432 unit-holders, including 19 in medium and large scale. While reviewing progress of work on the Circular Road around Pulwama Town, the Chief Minister directed Chief Engineer R&B, to speed up pace of work on the project so that a bypass access is provided to vehicular traffic towards Shopian and onwards to Mughal Road. He was informed that Rs. 13.72 crore have so far been utilized on the project costing Rs. 28.27 crore. The work on the 6.3 km stretch Circular Road has been completed up to BT level. It was given out in the meeting that Rs. 6.76 crore of additional funds are required to acquire 52 kanals of land to complete the project. Mufti Sayeed issued directions to prioritize release of funds for balance acquisition of land so that the project is completed within the shortest possible time. During his visit to Government District Hospital, the Chief Minister asked the DC to project the requirement of the hospital in terms of doctors and paramedics, space and medical equipment so that it functions to its optimum level. He was informed that laparoscopic, general and gynae-obstetrics’ surgeries are performed at the hospital. He was also informed about the need for installing a CT Scanner and posting of a radiologist to facilitate the patients. He also went around the general ward and talked to some of the patients. "Crime Branch Jammu today arrested Paramjeet Singh of Poonch for submitting fake and forged date of birth and qualification certificates while seeking the job of physical education teacher in district Reasi," the CB spokesman said. He said that the crime branch had started investigations after it received a complaint that the accused had secured the job after furnishing forged documents. "During the course of investigations it was found that the accused had altered his date of birth by one year and had also shown his matriculation marks as 446 instead of 279 which he had actually scored in the examination." However, the bullet missed the target following which the accused persons fled from there. Police said that a man died after his scooty was hit by a school bus of a known educational institute at Mishriwala area. The deceased was identified as Tarsem Lal a resident of Hiranagar. He was the PDD lineman. In another incident, a car rolled down from Jammu Srinagar highway at Nagrota leading to the death of Pawan Kumar of Rehari. At Canal road area, police said, they recovered body of a mobile Tower guard identified as Babu Ram of Bantalab. His body was found from the building of PNB. It was shifted to the hospital for post mortem and other legal formalities. Meanwhile, a woman namely Kamlesh Devi resident of Katriyal in Domana was found unconscious by the family members and they rushed her to the hospital learning that she has allegedly consumed poison. She was pronounced as brought dead by the doctors as they rushed her to the hospital. Investigation in all the cases is on. Swaraj had moved the Constitution (One Hundred and Nineteenth Amendment) Bill, 2013, for passage of the bill and said it had been passed unanimously by the Rajya Sabha on Wednesday. "There was no vote against it and there was no abstention (in the Rajya Sabha). It sent a message to Bangladesh that all political parties are one on the issue. I will request that it is passed with the same spirit in the Lok Sabha as it will send a good message," she said. The bill, which entails exchange of enclaves between the two countries, seeks to amend the First Schedule of the Constitution to give effect to an agreement entered into by India and Bangladesh on acquiring and transfer of territories between the two countries on May 16, 1974. Sushma Swaraj said that while the Bangladesh parliament had ratified the 1974 land boundary accord between two countries, the Indian parliament had not done so as demarcation had not been completed on the ground. She said then prime minister Manmohan Singh signed the protocol for transfer of territories during his visit to Bangladesh in 2011. The minister said the Constitution amendment bill was presented in the Rajya Sabha by the then United Progressive Alliance government in 2013 but the Bharatiya Janata Party, Trinamool Congress and Asom Gana Parishad had opposed it at the time. She said that while the AGP and the BJP felt that it overlooked interests of Assam, West Bengal was keen on a package for people who would come to the state as a result of implementation of the agreement. Sushma Swaraj said as foreign minister she chose Bangladesh as the country for her visit abroad, and Bangladesh Prime Minister Sheikh Hasina had urged her to move forward with the agreement. She said Prime Minister Narendra Modi told her to work towards removing hurdles in the implementation of the agreement. Sushma Swaraj said West Bengal Chief Minister Mamata Banerjee wanted a package from the central government and it had been agreed upon. The minister said she had moved the cabinet to keep Assam out of the implementation of agreement but the Congress was willing to support the bill only if the state was included. Sushma Swaraj said she again moved the cabinet and the bill with the inclusion of Assam was brought to parliament. The bill to operationalise the agreement with Bangladesh includes exchange of territories in Assam, West Bengal, Tripura and Meghalaya, and was cleared by the union cabinet at a meeting chaired by Prime Minister Modi on Tuesday. Petition seeking allotment of B.Ed seats: HC upholds JU’s decision Jammu, May 7: In a petition filed by Cosmic College of Education seeking quashment of decision of Board of Inspection on 30.05.2014 to the extent it declines the allotment of 153 seats for the year 2014-15 and also seeking direction to quash the decision taken by the respondents to the extent it declines to determine and allot 251 seats for the Session 2014-15 to the petitioner College as reflected in the list of Colleges Participating in Centralized B.Ed Counselling 2014-15, Justice Bansi Lal Bhat of J&K High Court Jammu Wing after hearing Sr. Adv KS Johal appearing for the petitioner college whereas Adv WS Nargal appearing for the Jammu University observed that 9. It appears that the University of Jammu, constituted as an Autonomous Body under the Kashmir and Jammu University Act, 1969 took a policy decision dispensing with the seat allotment formula based on the NAAC Accreditation and Affiliation Status and adopted the mechanism of surprise inspections and allotment of seats based on these inspections for allotment of seats to nongovernment colleges of education. This decision appears to have been taken in the University Council’s 75th Meeting held on 11.10.2013 in the backdrop of complaints about deficiencies in the functioning of privately run institutions. It further appears that the mechanism of allotment of seats devised by the College Development Council pursuant to the University Council’s decision dated 11th October, 2013 was applied in respect of petitionerCollege. According to respondents, the attendance monitoring Committee carried out surprise inspection of the petitionerCollege on 07.12.2013, 16.01.2014, 23.04.2014 and 21.05.2014 and on the basis of attendance of students reported by the said Committee, the average attendance of students was found to be 21.71%. This is disputed by the petitioner who claims such average attendance of students at 45% during the best two out of these inspections taken as proof of attendance. Respondents have specifically denied the allegation that in the inspection conducted on 23.04.2014, 229 students were present in the petitioner-College. It is pleaded that the list of students annexed with the petition appears to be fabricated as the inspection report dated 16.01.2014 clearly mentions that attendance was manipulated and fabricated. According to respondents, the higher number of students found present on the two selected dates of inspection were 82 students on 16.01.2014 and 63 students on 23.04.2014. The average of students during these two inspections conducted in Session 2013-14 is barely 21.71% and on the basis of formula devised by the College Development Council, petitioner-College has been found entitled to 75 seats for the Session 2014-15 which has been enhanced by 30% on the recommendation of Admission Committee thereby raising the number to 98 seats. Petitioner-College has accordingly been sanctioned 98 seats in addition to 8 management seats and 10 social infrastructure seats, the total intake capacity working up to 116 seats. The surprise inspection report dated 23.04.2014 of the Attendance Monitoring Committee re- veals that no student was found present in the petitioner-College at the time of Inspection. The enquiry revealed that the students had been deputed for teaching practice Course (TP). Out of 9 TPs, 8 were held at Pathankot in Punjab State. The Committee randomly enquired about the status of TPs held at School No.1, 2 and 4 and found that only 50% of the students allotted to these schools were attending the TP. The Committee appears to have been informed at the time of subsequent inspection on 21.05.2014 that three TPs were conducted in and around Kathua whereas others were conducted outside Jammu and Kashmir. The Attendance Monitoring Committee, thus, concluded that it was kept in dark in order to mislead. Viewed thus, the contention raised by petitioner in regard to attendance of students on 23.04.2014 constitutes a question of fact which cannot be decided while exercising writ jurisdiction. Petitioner has not raised any issue in regard to the University decision which adopted the mechanism of surprise inspections and allotment of seats based on these inspections. The dispute raised by petitioner is with regard to enforcement of University decision raising disputed questions of fact which cannot be gone into while exercising writ jurisdiction. It further appears that the representation of petitioner-College which had been kept on hold in view of pendency of OWP No.1275/2014 has been considered by respondents in compliance to the direction passed by this Court on 28.10.2014 and the same has been rejected. The consideration order dated 7th November, 2014 has not been assailed by the petitioner. In absence thereof, the instant petition would not be maintainable. It also transpires that the seats of petitioner-College determined by respondents on the basis of formula devised by College Development Council have been intimated to petitioner through Communication dated 28.07.2014 and the process of admission to B.Ed. Course for the Session 2014-15 has since culminated. The instant petition has, thus, been rendered infructuous. With these observations Court dismissed the petition. While returning the challan back, Railway Magistrate Jammu Mr. Sandeep Gandotra observed that investigation in this challan was unprofessional and suicide note was ignored. As per challan on 23-02-2015 ASI Mohd Rafiq had recorded the statement of Deepak Kumar at GMC Jammu in which Deepak Kumar had stated that he was married to Mst. Simran 9/10 years ago from whom he got divorced. Thereafter, he fell in love with Miss Sonika who was working as a nurse in Super Specialty Hospital Jammu and both of them agreed to marry. He had gone to meet Miss Sonika at Super Specialty Hospital but she raised an alarm due to which he was shocked. He had gone to his home and written a suicide note which he kept in his room. When he went to Tawi Bridge for committing suicide and jumped from the bridge. He has received serious injuries. On this statement, FIR No. 36/2015 for offence u/s 309 RPC was registered against accused Deepak Kumar. After considering the challan, Railway Magistrate Jammu Mr. Sandeep Gandotra observed that A perusal of the challan reveals that the investigation has been conducted by the investigating officer in most unprofessional manner and the SHO and SDPO City West have acted merely as rubber stamps and passed the challan without application of mind, ignoring the fact that a precious life has been lost. the IO seized the said suicide note of Deepak Kumar on 25-02-2015. Subsequently, on 01-03-2015 Deepak Kumar succumbed to his injuries and died. The most im- portant piece of evidence with the investigating officer in this case is the “suicide note” of the deceased Deepak Kumar. In the suicide note he has categorically written that Miss. Sonika has cheated him. She had promised to marry him and later on she had refused. That, she was in relationship with him since 02nd January 2014 and she got pregnant by him on more than two occasions. He has also mentioned in the suicide note that he had stayed with Sonika on many occasions in Meridian Hotel and they stayed there for the first time at night on 10th January 2014. For the reason best known to the investigating officer he has totally ignored this note and not made any investigation from the person mentioned in this suicide note which prompted the deceased to commit suicide. It is important to note here that the accused Deepak Kumar has categorically mentioned in his suicide note that the persons mentioned in the suicide note should not be left after his death. The investigating officer has neither enquired from the parents of the deceased nor from parents of Miss. Sonika, nor from employees of Super Specialty Hospital Jammu nor from employees of Hotel Meridian. He has merely kept three witnesses PW I, II & III as witnesses of seizure memo of vehicle; PW IV & V as witness of seizure memo of suicide note and other witnesses are witnesses of seizure memo and receipt of dead body of the deceased and medical expert who conducted the postmortem. Court further observed that It is very unfortunate reflection of the working of police in our State. The investigating officer has not conducted the investigation thoroughly and professionally and left many loopholes as discussed herein above. No investigation has been conducted as to what prompted the deceased to commit suicide. The challan is, as such, sent to Sr.S.P Jammu for further investigation to be conducted by any officer not below the rank of S.P. He shall submit the challan after proper investigation within one month. JNF Ahead of Prime Minister Narendra Modi's visit here next week, China has said it is "eager to cooperate" with India on deep seabed mining in the Indian Ocean where its deep diving vessel reported to have discovered large deposits of precious metals like gold and silver. "With quickening oceanic development and increasing mineral exploration in the Indian Ocean, China is eager to cooperate with India on deep seabed mining," the China Daily quoted China Ocean Resource R&D Mineral Association as saying. Terming India an ideal partner, deputy director of the association He Zongyu told the state-run daily that "China and India are both developing countries and contractors with the International Seabed Authority (ISA) so we have a lot in common and plenty of opportunities for further cooperation." The association is China's official organisation engaged in exploration and development of ocean floor and subsoil. Chen Lianzeng, deputy director of the State Oceanic Administration, visited India on April 20 and suggested the two sides enhance cooperation on oceanic research and development. "If we cooperate, we could share the costs, the risks and the benefits," He said. Proposing the cooperation, He said China and India are on about the same level in terms of the development of deep seabed mining, which makes India an ideal partner. Deep seabed mining is high-cost and high-risk work, with costs for a mining site topping USD 1.6 billion, He said. Beijing's proposal for India-China cooperation comes in the immediate backdrop of the completion of the 118day voyage of the China's deepsea manned submersible Jiaolong in the southwest Indian Ocean here it reported to have discovered large deposits of precious metals like gold and silver.
